CROWLEY, LOUISIANA

APRIL 18, 2000

THE ACADIA PARISH POLICE JURY met on the above date at 6:30 p.m., in the Police Jury Meeting Room, Courthouse Building, Crowley, Louisiana, in regular session with the Claude J. Courville, presiding. At the request of the President, a moment of silence was offered and the Pledge to the Flag was recited in unison. The roll was called and final attendance was recorded as follows:

A motion was offered by Mr. John Humble, Sr., seconded by Mrs. Catherine LaCombe, to revise the agenda and consider maintenance repairs to asphalt roadways. Motion carried.

A motion was offered by Mr. Jimmie Pellerin, seconded by Mr. John Humble, Sr., to approve the Minutes of the April 4, 2000, Regular Police Jury Meeting. Motion carried.


COMMUNITY/ECONOMIC DEVELOPMENT

President Claude Courville announced the calling of a public hearing by the Department of Environmental Quality for May 22, 2000, Eunice Council Chambers for the purpose of receiving comments on the proposed CLECO-Calpine Power Generating Facility.

Mr. Kim Fontenot, Director of Regulatory Relations with CLECO, addressed the Jury with information on the proposed facility. He stated that the project would create 600 construction jobs and 30 permanent jobs with an annual payroll of $1,500,000 reminding the members that they met with area farmers and other concerned citizens to address issues surrounding the location of their facility.

Ms. Pamela Shultz Allen, resident of the area, voiced her concern over her unanswered questions associated with ground water, salt water intrusion and air quality.

Mr. Mike Thibodeaux also expressed many of the same concerns.


ELECTIONS

The following Resolution was offered by Mr. John Beard, seconded by Mrs. Cecelia Broussard:

                                      
RESOLUTION

          A Resolution approving the holding of an election in Fire
          Protection District No. 7 of the Parish of Acadia, State
          of Louisiana, on Saturday, July 15, 2000, to authorize
          the levy of a parcel fee therein.

WHEREAS, the Board of Commissioners of Fire Protection District No. 7 of the Parish of Acadia, State of Louisiana (the “Governing Authority”), acting as the governing authority of Fire Protection District No. 7 of the Parish of Acadia, State of Louisiana (the “District”), adopted a resolution on April 10, 2000, calling a special election in the District on Saturday, July 15, 2000, to authorize the levy of a parcel fee therein; and

WHEREAS, the governing authority of the District has requested that this Police Jury, acting as the governing authority of the Parish of Acadia, State of Louisiana, give its consent and authority for the District to hold the aforesaid election, and in the event that the election carries to levy and collect the parcel fee provided for therein; and

WHEREAS, as required by Article VI, Section 15 of the Constitution of the State of Louisiana of 1974, it is now the desire of this Police Jury to approve the holding of said election and in the event that the election carries, to levy and collect the parcel fee provided for therein; and

NOW, THEREFORE, BE IT RESOLVED by the Police Jury of the Parish of Acadia, State of Louisiana, acting as the governing authority of said Parish, that:

SECTION 1. In compliance with the provisions of Article VI, Section 15 of the constitution of the State of Louisiana of 1974, and in accordance with the request of the Board of Commissioners of Fire Protection District No. 7 of the Parish of Acadia, State of Louisiana, this Police Jury hereby approves the holding of an election in the District, on Saturday, July 15, 2000, at which election there will be submitted the following proposition to-wit:

                    
PROPOSITION (PARCEL FEE RENEWAL)

          SUMMARY: 10 YEAR, $25.00 PARCEL FEE RENEWAL FOR
          ACQUIRING FACILITIES AND EQUIPMENT, INCLUDING
          PAYING THE COST OF OBTAINING WATER FOR FIRE
          PROTECTION PURPOSES AND ALL PURPOSES INCIDENTAL
          THERETO, SUBJECT TO FUNDING INTO BONDS.

          Shall Fire Protection District No. 7 of the Parish of Acadia,
          State of Louisiana (the “District”), levy and collect
          annually for a period of ten (10) years, beginning with the
          year 2002, a fee of Twenty-Five ($25.00) on each lot,
          subdivided portion of ground or individual tract upon which
          is located, either in whole or in part, a residential or
          commercial structure, regardless of the structure’s being
          occupied or unoccupied, for the purpose of acquiring
          facilities and equipment, including paying the cost of
          obtaining water for fire protection purposes and all
          purposes incidental thereto, and shall the District be
          further authorized to fund the proceeds of said parcel fee
          into bonds to pay the costs of capital improvements, said
          bonds to be issued from time to time in the manner
          provided by law, including, but not limited to, Section
          1505 of Title 40 of the Louisiana Revised Statutes of 1950,
          as amended?

SECTION 2. In the event the election carries, this Police Jury does hereby further consent to and authorize the District to levy and collect the parcel fee provided for therein.

This Resolution having been submitted to a vote, the vote thereon was as follows:

YEAS: Alton Stevenson, Catherine LaCombe, John Humble, Sr., Cecelia
          Broussard, Jimmie Pellerin, John Beard, Pat Daigle and Claude
          Courville.

NAYS: None.

ABSENT: None.

And the Resolution was declared adopted on this, the 18th day of April, 2000.

FEDERAL/STATE FINANCIAL ASSISTANCE

                                  April 24 - 30, 2000

                 “NATIONAL COMMUNITY DEVELOPMENT WEEK”

WHEREAS, the Community Development Block Grant Program has operated since 1974 to provide local governments with the resources required to primarily meet the needs of low and moderate income persons; and

WHEREAS, the Community Development Block Grant Program is among the few remaining federal programs available to address the needs of low and moderate income persons and small cities; and

WHEREAS, the Community Development Block Grant Program has provided the Acadia Parish Police Jury with important and flexible assistance to meet the needs of low and moderate income residents by funding street and fire improvements projects; and

WHEREAS, the Congress and the Nation acknowledge the critical value of the Community Development Block Grant Program and the significant projects that rely on its funds for support; and

WHEREAS, the week of April 24 - 30, 2000, has been reserved for recognition and appreciation of the Community Development Block Grant Program.

NOW, THEREFORE, I, Claude J. Courville, of Acadia Parish Police Jury, proclaim April 24 - 30, 2000, ‘NATIONAL COMMUNITY DEVELOPMENT WEEK” within the Parish of Acadia, and call upon all citizens of this community to participate in activities and ceremonies celebrating the COMMUNITY DEVELOPMENT BLOCK GRANT PROGRAM.

FINANCE

                                      
RESOLUTION

         BY MESSRS: JOHN HUMBLE SR AND ALTON STEVENSON

WHEREAS, the Acadia Parish Police Jury has reviewed the Systems Survey and Compliance Questionnaire in its entirety, and

WHEREAS, the questionnaire is a required part of the financial and compliance audit of Louisiana governmental units and quasi-public corporations.

THEREFORE, BE IT RESOLVED by the Acadia Parish Police Jury in regular session duly convened this 18th day of April, 2000, does hereby adopt the Systems Survey and Compliance Questionnaire in connection with the audit of our Financial Statements for the period ending 12/31/99.

BE IT RESOLVED that all President and Secretary-Treasurer is hereby instructed and empowered to execute on behalf of the Acadia Parish Police Jury any and all instruments regarding the 1999 Financial Audit.

LEGISLATION

Mr. John Quebodeaux, Emergency Management Director, pointed out to the Jury concerns regarding the safety and welfare of residents who did not live in subdivisions defined by the Ordinances governing weeds and abandoned property. He also pointed out that throughout the Parish there were 125 subdivisions some of which are trailer parks and 106 that were not recognized by the definition in the Ordinance. He suggested the wording be changed in order to regulate conditions in those areas.

A motion was offered by Mrs. Cecelia Broussard, seconded by Mr. Pat Daigle, to authorize Legal Counsel to meet with the Emergency Management Director and draft amendments to both Ordinances #714 & #748 as they relate to health and welfare for citizens of the Parish. Motion carried.


PERSONNEL

A motion was offered by Mrs. Cecelia Broussard, seconded by Mrs. Catherine LaCombe, to approve leave with pay beginning Tuesday, April 11, 2000, for the Animal Control Officer until a final decision was made on the status of his employment. Motion carried.

A motion was offered by Mrs. Cecelia Broussard, seconded by Mrs. Catherine LaCombe, to accept the resignation submitted by Mr. Wayne Matlock, Animal Control Officer. The following roll call vote was cast: Yeas: Cecelia Broussard and Catherine LaCombe. Nays: Alton Stevenson, John Humble, Sr., Jimmie Pellerin, John Beard, Pat Daigle and Claude Courville. Motion failed.


PUBLIC FACILITIES/BUILDING & GROUNDS

Architect Ron Lawson presented the bid results for the expansion and renovation to the Rayne Health Unit Facility and outlined reasons for the bids exceeding the estimated cost. He pointed out that due to the size of the project the prices for material and services could not be discounted to fall within the realm of the budgeted amount.

WHEREAS, bids were received for the repairs for the expansion of the waiting room and the renovation to the Rayne Health Unit Facility, and

WHEREAS, bids received were as follows:

THEREFORE, BE IT RESOLVED by the Acadia Parish Police Jury in regular session duly convened on this the 18th day of April, 2000, does hereby concur with the recommendation of Ron Lawson, Architect, to accept the low base bid and alternative No. 1 bid of Clause Construction Co., in the amount of Eighty-five Thousand Eight Hundred Seventy-six and 00/100 ($85,876.00) Dollars.

BE IT FURTHER RESOLVED that the President of this Police Jury be and he is hereby empowered, authorized and directed to execute a contract with Clause Construction Co., on behalf of, in the name and under the seal of the Parish of Acadia.

BE IT FURTHER RESOLVED that the Health Unit Budget be amended in the amount of $26,000.00 to include the additional cost associated with the repairs to the Facility and that the revenues be derived from miscellaneous fund balance from previous years.

PUBLIC SAFETY

Mr. Tom Regan, Counsel for R M Enterprises, Inc., who had been served by the Parish Ordinance for abandoned property, responded to the notice that demanded cleanup of their property in the community of Midland. He indicated that R M Enterprises wished to donate the property to the Police Jury in exchange for the cost of the cleanup activity and noted that his client did not want to litigate the issue.

Juror John Humble, Sr., suggested that the Parish afford itself an opportunity to research the offer and instructed the Enforcement Officer to obtain cost estimates to cleanup the property before any formal action would be recommended.


PUBLIC WORKS/ROADS & BRIDGES

A motion was offered by Mrs. Cecelia Broussard, seconded by Mr. John Beard, to approve the following Committee recommendations: approve the request made by the Acadia Parish Planning Commission to amend Ordinance #761 regulating subdivision development to allow property owners to retain royalties in all cases under dedicated roadways, to approve the Emergency Work Report for March, to authorize Parish Engineer and Secretary-Treasurer to determine requirements and estimated costs to provide walkways for pedestrians along a portion of West Northern Avenue and to accept the offer by Calpine to hardsurface a portion of Buckhorn Road and authorize Legal Counsel and Parish Engineer to proceed with necessary contract and preliminary plans for said project. Motion carried.

BE IT RESOLVED: by the Acadia Parish Police Jury in regular session duly convened this 18th day of April, 2000, does hereby empower, authorize and direct the President to execute Change Order #3 for bridge repairs.

BE IT FURTHER RESOLVED that said change order in the amount of Three Thousand Six Hundred Thirty-six and 00/100 ($3,636.00) Dollars be added for a total contract price of One Hundred Ninety-seven Thousand Six Hundred Fifteen and 95/100 ($197,615.95) Dollars.

Mr. John Quebodeaux, Parish Bridge Inspector, presented an up-to-date report on current bridge inspections specifying bridges that could be replaced with alternate drainage structures such as pipe or culvert.

The Jury requested DOTD assist in the cleanup of storm damages along state rights-of-ways. Representative Greg Fruge was in attendance and stated that he would relay that request. No formal action was taken.

BE IT RESOLVED: by the Acadia Parish Police Jury in regular session duly convened this 18th day of April, 2000, does hereby award the bid for Henry Bieber Road Bridge to E. B. Feucht & Sons, Inc. in the amount of Thirty-two Thousand Nine Hundred Eighty-seven and 50/100 ($32,987.50) Dollars with an Additive Alternate No. 1 Bid of Fifteen Thousand and 00/100 ($15,000.00) Dollars for a total of Forty-seven Thousand Nine Hundred Eighty-seven and 50/100 ($47,987.50) Dollars.

ORDINANCE #802

AN ORDINANCE MAKING IT UNLAWFUL FOR ANY PERSON TO OPERATE OR DRIVE A MOTOR VEHICLE UPON DAVID NEIL ROAD (PARISH ROAD 1-44) IN ACADIA PARISH, LOUISIANA, WITH A GROSS WEIGHT IN EXCESS OF
TWELVE (12) TONS, AND PROVIDING FOR THE PENALTIES FOR THE VIOLATION THEREOF.

SECTION 1. BE IT ORDAINED by the Police Jury of Acadia Parish, Louisiana, that it shall be unlawful for any person to operate a motor vehicle with a gross weight in excess of Twelve (12) Tons on the following described parish road:

                      
DAVID NEIL ROAD (PARISH ROAD 1-44)

SECTION 2. BE IT FURTHER ORDAINED that any person found guilty of operating or driving a motor vehicle with a gross weight exceeding Twelve (12) Tons on the parish roads described above, shall be guilty of a misdemeanor, and upon conviction therefore, shall be fined nor more than Fifty Dollars ($50) or be imprisoned not more than ten (10) days or both.

SECTION 3. BE IT FURTHER ORDAINED that any laws or parts of laws in conflict are hereby repealed.

The Ordinance was offered by Mrs. Cecelia Broussard, seconded by Mr. John Beard, and after being read and considered section by section, was adopted as a whole by the following vote:

The Sales Tax Report was presented for the month of March, 2000. The report indicated a gross receipt of $437,331.54, an increase of $107,405.85 from March, 1999.
