CROWLEY, LOUISIANA

FEBRUARY 29, 2000

THE ACADIA PARISH POLICE JURY met on the above date at 6:30 p.m., in the Police Jury Meeting Room, Courthouse Building, Crowley, Louisiana, in regular session with the Claude J. Courville, presiding. At the request of the President, a moment of silence was offered and the Pledge to the Flag was recited in unison. The roll was called and final attendance was recorded as follows:

A motion was offered by Mr. Claude Courville, seconded by Mr. John Beard, to approve the Minutes of the February 15, 2000, Regular Police Jury Meeting. Motion carried.

BE IT RESOLVED: by the Acadia Parish Police Jury in regular session duly convened this 29th day of February, 2000, does hereby re-appoint MR. LARRY REGAN, MS. JEAN GASPARD, MR. TERRY ROMERO, MR. JOHN QUEBODEAUX, MR. TOM CHISHOLM, MR. BYRON MARTIEN, MR. BILL WILLIAMS, MS. KATHY DUNCAN, MRS. KAY HABETZ, MR. ED DUTHILE, HONORABLE GIL PINAC and MR. ROY VARNADO and appoint MRS. DINA KUYKENDALL, MR. BRENDON BOUDREAUX and MR. GARY LACAZE to the Local Emergency Planning Committee and to accept the resignations of Ms. Renella Hebert, Mayor James Petitjean, Mr. Nick Treadway and Mr. John N. John III effective February, 2000.

COMMUNITY/ECONOMIC DEVELOPMENT

                            
RESOLUTION OF ACCEPTANCE

The following resolution was offered by Mr. John Humble, Sr., duly seconded by Mrs. Catherine LaCombe, and duly resolved and adopted on February 29, 2000.

A resolution authorizing and directing the President to execute for and on behalf of the Acadia Parish Police Jury, an Act of Acceptance for Forby Contracting, Inc., Contractor, pertaining to the completion of the contract, for joint sealing, apron sealant & airport markings at the Legros Memorial Airport, in accordance with the plans and specifications contained in the contract documents pertaining thereto.

WHEREAS, Forby Contracting, Inc., as Contractor, has completed the joint sealing, apron sealant & airport markings at the Airport in accordance with the plans and specifications contained in the contract documents pertaining thereto; and

WHEREAS, the Acadia Parish Police Jury desires to accept the completed work;

NOW, THEREFORE, BE IT RESOLVED by the Acadia Parish Police Jury that the President of said Acadia Parish Police Jury be, and is hereby empowered, authorized and directed to execute an Act of Acceptance for and on behalf of the Acadia Parish Police Jury accepting the work as being completed, and that he be authorized and directed to have a copy of said acceptance recorded in the Conveyance Records of the Parish of Acadia, State of Louisiana.

FEDERAL/STATE FINANCIAL ASSISTANCE

A motion was offered by Mr. John Humble, Sr., seconded by Mrs. Cecelia Broussard, to authorize the Parish Attorney and the Grant Consultant to negotiate the purchase of ˝ acre of property with LCDBG Funding for the construction of a Fire District Substation for Fire Protection District #8. Motion carried.


PERSONNEL

A motion was offered by Mrs. Cecelia Broussard, seconded by Mr. Alton Stevenson, to hire Mrs. Laura Thomas as Material Handler I and Mr. Anthony McClelland as Custodian beginning March 16, 2000, and Mr. Wayne Matlock as Animal Control Officer beginning March 1, 2000. Motion carried.

A motion was offered by Mrs. Cecelia Broussard, seconded by Mr. Pat Daigle, to amend the original motion to hire and include the following salaries Laura Thomas $6.00 per hour, Anthony McClelland $5.50 per hour and Wayne Matlock $8.44 per hour and to waive the hiring requirements for Mr. Matlock as he was currently employed by the Police Jury. Motion carried.


PUBLIC FACILITIES/BUILDING & GROUNDS

BE IT RESOLVED: by the Acadia Parish Police Jury in regular session duly convened this 29th day of February, 2000, does hereby authorize Mr. Ron Lawson, Architect, to advertise for repairs and expansion to the Rayne Health Unit Facility.

PUBLIC WORKS/ROAD & BRIDGE

Mr. John Quebodeaux, Parish Bridge Inspector, provided an up-to-date report on the Off-System Bridge inspections recently conducted. The report indicated the changes in the status of bridges over the past several months.

Mr. Lowray Chachere formally requested that the Jury consider acknowledging Foster Lane as a public servitude. This request was made following testimony that Foster Lane was maintained by the Police Jury many years ago.

Mr. Malcolm Brasseaux, Attorney for Mr. Chachere, indicated that Mr. Chachere bought property on one side of Foster Lane and intended to develop that property offering to widen the servitude an additional 25 ft.

Police Jury President Claude J. Courville suggested that the planning for the subdivision be complete prior to approval.

No formal action was taken with regard to the request, however, Attorney’s for both the Police Jury and Mr. Chachere were authorized to meet and discuss the matter further.

A motion was offered by Mrs. Cecelia Broussard, seconded by Mr. John Humble, Sr., to approve the request for special conditions to install an irrigation line by open cut method across Pamela Drive. Motion carried.

                                 
ORDINANCE #796

AN ORDINANCE MAKING IT UNLAWFUL FOR ANY PERSON TO OPERATE OR DRIVE A MOTOR VEHICLE UPON VICTOR ROAD (PARISH ROAD 2-101) IN ACADIA PARISH, LOUISIANA, AT A SPEED IN EXCESS OF
FIFTEEN MILES PER HOUR, AND, PROVIDING FOR THE PENALTIES FOR THE VIOLATION THEREOF.

SECTION 1. BE IT ORDAINED by the Police Jury of Acadia Parish, Louisiana, that it shall be unlawful for any person to operate or drive a motor vehicle in excess of fifteen miles per hour on the following described Parish Road:

                     
Victor Road (Parish Road 2-101)

SECTION 2. BE IT FURTHER ORDAINED that any person found guilty of operating or driving a motor vehicle in excess of fifteen miles per hour on the Parish road described above, shall be guilty of a misdemeanor, and upon conviction therefore, shall be fined not more than Fifty Dollars ($50) or be imprisoned not more than ten (10) days or both.

SECTION 3. BE IT FURTHER ORDAINED that any laws or parts of laws in conflict are hereby repealed.

The Ordinance was offered by Mr. Pat Daigle, and seconded by Mrs. Cecelia Broussard, and after being read and considered section by section, was adopted as a whole by the following vote:

YEAS: Alton Stevenson, Catherine LaCombe, John Humble, Sr., Cecelia
          Broussard, Jimmie Pellerin, John Beard, Pat Daigle and Claude
          Courville.

NAYS: None.

ABSENT: None.

The Sales Tax Reports were presented for the months of December, 1999 and January, 2000. The report indicated a gross receipt of $267,601.37, a decrease of $8,638.29 from December, 1998 and $546,982.63, an increase of $113,608.65 from January, 1999.


COMMENTS FROM THE PUBLIC

Mr. Lowray Chachere indicated how he would have hoped that the Police Jury would have taken formal action on his request to dedicate the road Foster Lane as public.

THERE BEING NO FURTHER BUSINESS TO COME BEFORE THE MEETING, THE MOTION WAS OFFERED DULY SECONDED, THAT THE MEETING ADJOURN UNTIL THE NEXT REGULARLY SCHEDULED MEETING OF MARCH 21, 2000, AT THE HOUR OF 6:30 P.M.
