CROWLEY, LOUISIANA

JANUARY 25, 2000

THE ACADIA PARISH POLICE JURY met on the above date at 6:30 p.m., in the Police Jury Meeting Room, Courthouse Building, Crowley, Louisiana, in regular session with the Claude J. Courville, presiding. At the request of the President, a moment of silence was offered and the Pledge to the Flag was recited in unison. The roll was called and final attendance was recorded as follows:

A motion was offered by Mrs. Cecelia Broussard, seconded by Mrs. Catherine LaCombe, to revise the agenda to consider the hiring of Material Handler for the Recycling Center and to consider approving special conditions for a pipeline permit. Motion carried.

A motion was offered by Mr. John Humble, Sr., seconded by Mr. Jimmie Pellerin, to approve the Minutes as amended for the January 11, 2000, Regular Police Jury Meeting. Motion carried.

WHEREAS, Bayou Plaquemine & Wikoff Gravity Drainage District has received a letter of resignation from Mr. Leroy Daugereau as a board member of Bayou Plaquemine & Wikoff Gravity Drainage District.

WHEREAS, Bayou Plaquemine & Wikoff Gravity Drainage District has placed in nomination the name of Mr. Anthony Bourgeois to fill said vacancy.

BE IT RESOLVED: by the Acadia Parish Police Jury in regular session duly convened this 25th day of January, 2000, does hereby appoint MR. ANTHONY BOURGEOIS to Bayou Plaquemine & Wikoff Gravity Drainage District to fill the unexpired term of Mr. Leroy Daugereau.

BE IT RESOLVED: by the Acadia Parish Police Jury in regular session duly convened this 25th day of January, 2000, does hereby remove the name of MR. MARVIN TODD MECHE and appoint MR. ADAM SOILEAUX, JR. to Acadia Fire Protection District #9 effective January, 2000.

ELECTIONS

The following Resolution was offered by Mrs. Catherine LaCombe, seconded by Mr. Alton Stevenson:

          A RESOLUTION OF THE POLICE JURY OF THE PARISH OF
          ACADIA, STATE OF LOUISIANA, APPROVING A SPECIAL
          ELECTION TO BE HELD IN FOURTH WARD DRAINAGE
          DISTRICT NO. 1 OF THE PARISH OF ACADIA, STATE OF
          LOUISIANA, TO AUTHORIZE THE RENEWAL OF THE LEVY
          OF A MILLAGE TAX OF FIVE (5) MILLS FOR A PERIOD OF
          TEN (10) YEARS.

WHEREAS, the Board of Commissioners of the Fourth Ward Drainage District No. 1 of the Parish of Acadia, State of Louisiana (the “District”), has requested that the Police Jury approve the holding of a special election in the District and in the event said election carries, that this Police Jury approve the levy of a millage tax therein; and

WHEREAS, as required by Article VI, Section 15 of the Constitution of the State of Louisiana of 1974, it is now the desire of this Police Jury to approve the holding of said election and the levy of a millage tax therein;

NOW, THEREFORE, BE IT RESOLVED BY THE POLICE JURY OF THE PARISH OF ACADIA, STATE OF LOUISIANA, acting as the governing authority of said Parish, in regular session duly convened:

SECTION 1. In compliance with the provisions of Article VI, Section 15 of the Constitution of the State of Louisiana of 1974, and in accordance with the request of the Board of Commissioners of the Fourth Ward Drainage District No. 1 of the Parish of Acadia, State of Louisiana, this Police Jury hereby approves the holding of an election in the District, on the 15th day of April, 2000, at which election there shall be submitted to all voters of the District, the following proposition, to-wit:

                        
PROPOSITION (TAX RENEWAL)

         
SUMMARY: A ten (10) year ad valorem tax of five (5)
            mills on property subject to taxation situated in the
            District for the purpose of acquiring, constructing,
            maintaining and operating gravity drainage works
            within and for the said District.

          Shall the Fourth Ward Drainage District No. 1 of the Parish
          of Acadia, State of Louisiana, (the “District”), levy and
          collect a tax of five (5) mills on all property subject to
          taxation, situated in said District, annually for a period of
          ten (10) years beginning with the year 2001 and ending
          with the year 2010, for the purpose of acquiring,
          constructing, maintaining and operating gravity drainage
          works within and for the said District?

SECTION 2. In the event the aforesaid proposition is carried at said election, this Police Jury does hereby approve the levy of an ad valorem tax therein in accordance with the proposition as set forth above.

This Resolution having been submitted to a vote, the vote thereon was as follows:

YEAS: Alton Stevenson, Catherine LaCombe, John Humble, Sr., Cecelia
          Broussard, Jimmie Pellerin, John Beard, Pat Daigle and Claude J.
          Courville.

NAYS: None.

ABSENT: None.

And the Resolution was declared adopted on this, the 25th day of January, 2000.

FINANCE

A motion was offered by Mrs. Cecelia Broussard, seconded by Mr. John Beard, to authorize the advertising for two (2) new ˝ ton pickup trucks. Motion carried.


LITIGATION

A motion was offered by Mrs. Cecelia Broussard, seconded by Mrs. Catherine LaCombe, to adjourn into executive session to consider the matter of Annette Clement Docket #72,005. The following roll call vote was cast: Yeas: Alton Stevenson, Catherine LaCombe, John Humble, Sr., Cecelia Broussard, Jimmie Pellerin, John Beard, Pat Daigle and Claude J. Courville. Motion carried.

A motion was offered by Mr. John Humble, Sr., seconded by Mrs. Catherine LaCombe, to authorize Legal Counsel to settle all claims against the Parish Road Maintenance Crew as it relates to litigation involving Annette Clement, Docket #72,005. Motion carried.


PERSONNEL

A motion was offered by Mrs. Cecelia Broussard, seconded by Mr. Jimmie Pellerin, to authorize advertising for the position of Custodian at the Acadia Parish Courthouse. Motion carried.

A motion was offered by Mr. Alton Stevenson, seconded by Mrs. Catherine LaCombe, to authorize advertising for the position of Material Handler at the Recycling Center and to promote Mrs. Selena Broussard to the position of Recycling Coordinator at a pay of $7.12 per hour effective February 1, 2000. Motion carried.


PUBLIC WORKS/ROAD & BRIDGE

                                
ORDINANCE #789

AN ORDINANCE MAKING IT UNLAWFUL FOR ANY PERSON TO OPERATE OR DRIVE A MOTOR VEHICLE UPON RABBIT ROAD (PARISH ROAD 5-03) IN ACADIA PARISH, LOUISIANA, AT A SPEED IN EXCESS OF
TWENTY MILES PER HOUR, AND, PROVIDING FOR THE PENALTIES FOR THE VIOLATION THEREOF.

SECTION 1. BE IT ORDAINED by the Police Jury of Acadia Parish, Louisiana, that it shall be unlawful for any person to operate or drive a motor vehicle in excess of twenty miles per hour on the following described Parish road:

                        
Rabbit Road (Parish Road 5-03)

SECTION 2. BE IT FURTHER ORDAINED that any person found guilty of operating or driving a motor vehicle in excess of twenty miles per hour on the Parish road described above, shall be guilty of a misdemeanor, and upon conviction therefore, shall be fined not more than Fifty Dollars ($50) or be imprisoned not more than ten (10) days or both.

SECTION 3. BE IT FURTHER ORDAINED that any laws or parts of laws in conflict are hereby repealed.

The Ordinance was offered by Mr. John Humble, Sr., and seconded by Mr. John Beard, and after being read and considered section by section, was adopted as a whole by the following vote:

AN ORDINANCE MAKING IT UNLAWFUL FOR ANY PERSON TO OPERATE OR DRIVE A MOTOR VEHICLE UPON GOLF COURSE ROAD (PARISH ROAD 2-11) IN ACADIA PARISH, LOUISIANA, AT A SPEED IN EXCESS OF
THIRTY MILES PER HOUR, AND, PROVIDING FOR THE PENALTIES FOR THE VIOLATION THEREOF.

SECTION 1. BE IT ORDAINED by the Police Jury of Acadia Parish, Louisiana, that it shall be unlawful for any person to operate or drive a motor vehicle in excess of thirty miles per hour on the following described Parish roads:

                  
Golf Course Road (Parish Road 2-11)
                                Hard Surface portion only

SECTION 2. BE IT FURTHER ORDAINED that any person found guilty of operating or driving a motor vehicle in excess of thirty miles per hour on the Parish road described above, shall be guilty of a misdemeanor, and upon conviction therefore, shall be fined not more than Fifty Dollars ($50) or be imprisoned not more than ten (10) days or both.

SECTION 3. BE IT FURTHER ORDAINED that any laws or parts of laws in conflict are hereby repealed.

The Ordinance was offered by Mr. John Beard, and seconded by Mr. John Humble, Sr., and after being read and considered section by section, was adopted as a whole by the following vote:

A motion was offered by Mrs. Cecelia Broussard, seconded by Mr. Alton Stevenson, to approve the special conditions and use the open cut method to install an irrigation pipeline on Fournerat Road by Mr. J. W. Zaunbrecher. Motion carried.


SOLID WASTE/ENVIRONMENTAL

                                      
RESOLUTION

       BY: MR JOHN HUMBLE SR AND MRS CATHERINE LACOMBE

WHEREAS, pursuant to Section III-D, Article 9-C of the Contract for Collection and Disposal of Solid Waste between Browning-Ferris Industries and the Acadia Parish Police Jury, the result of a joint house count submitted by BFI indicates an increase of 203 homes bringing the total number of the residential house count to 21,223.

THEREFORE, BE IT RESOLVED by the Acadia Parish Police Jury in regular session duly convened this 25th day of January, 2000, does hereby concur with the results of the joint house count verifying the number of service units.

BE IT FURTHER RESOLVED that the effective date of the revised count submitted be in accordance with the Solid Waste Collection and Disposal Contract by and between Browning-Ferris Industries and the Acadia Parish Police Jury.

A motion was offered by Mrs. Cecelia Broussard, seconded by Mrs. Catherine LaCombe, to set the meeting dates on the first & third Tuesday of each month beginning February 15, 2000, at 6:30 P.M. Motion carried.


COMMENTS FROM THE PUBLIC

Mr. Junior LeJeune, resident of the Church Point area, requested information regarding the hiring of temporary services.

Animal Control Officer Mr. Lorne Quebodeaux verbally submitted his resignation effective March 10, 2000.

It was announced that the Personnel Committee would meet on Monday, January 31, 2000, to consider the resignation of the Animal Control Officer.

President Claude J. Courville announced that a reception was planned in Iota to recognize the State Champion Football Team for Wednesday, January 26, 2000, at 1:30 P.M.

Solid Waste Engineer Tim Mader announced the plans to host a landfill tour at the Acadia Parish Sanitary Landfill on February 11, 2000.
