MARCH 21, 2000

THE ACADIA PARISH POLICE JURY met on the above date at 6:30 p.m., in the Police Jury Meeting Room, Courthouse Building, Crowley, Louisiana, in regular session with the Claude J. Courville, presiding. At the request of the President, a moment of silence was offered and the Pledge to the Flag was recited in unison. The roll was called and final attendance was recorded as follows:

A motion was offered by Mrs. Cecelia Broussard, seconded by Mrs. Catherine LaCombe, to revise the agenda and consider the following: (1) omission of Item 13(d) from the agenda, (2) consider the request for a tax election for Branch Fire District #6, (3) speed limit on Springwood Road and (4) discussion on the purchase of property in Fire District #8. Motion carried.

A motion was offered by Mr. Jimmie Pellerin, seconded by Mr. John Humble, Sr., to approve the Minutes of the February 29, 2000, Regular Police Jury Meeting. Motion carried.

ELECTIONS

The following Resolution was offered by Mrs. Catherine LaCombe, seconded by Mr. John Beard:

          A RESOLUTION OF THE POLICE JURY OF THE PARISH OF
          ACADIA, STATE OF LOUISIANA, APPROVING A SPECIAL
          ELECTION TO BE HELD IN EGAN DRAINAGE DISTRICT
          NO. 1 OF THE PARISH OF ACADIA, STATE OF LOUISIANA,
          TO AUTHORIZE THE CONTINUATION OF THE LEVY OF A
          MILLAGE TAX OF SEVEN AND NINETY-SEVEN
          HUNDREDTHS (7.97) MILLS FOR A PERIOD OF TEN (10)
          YEARS.

WHEREAS, the Board of Commissioners of the Egan Drainage District No. 1 of the Parish of Acadia, State of Louisiana (the “District”), has requested that the Police Jury approve the holding of a special election in the District and in the event said election carries, that this Police Jury approve the levy of a millage tax therein; and

WHEREAS, as required by Article VI, Section 15 of the Constitution of the State of Louisiana of 1974, it is now the desire of this Police Jury to approve the holding of said election and the levy of a millage tax therein;

NOW, THEREFORE, BE IT RESOLVED BY THE POLICE JURY OF THE PARISH OF ACADIA, STATE OF LOUISIANA, acting as the governing authority of said Parish, in regular session duly convened:

SECTION 1. In compliance with the provisions of Article VI, Section 15 of the Constitution of the State of Louisiana of 1974, and in accordance with the request of the Board of Commissioners of the Egan Drainage District No. 1 of the Parish of Acadia, State of Louisiana, this Police Jury hereby approves the holding of an election in the District, on the 15th day of July, 2000, at which election there shall be submitted to all voters of the District, the following proposition, to-wit:

                     
PROPOSITION (TAX CONTINUATION)

         
SUMMARY: A ten (10) year ad valorem tax of seven
            and ninety-seven hundredths (7.97) mills on
            property subject to taxation situated in the District
            for the purpose of acquiring, constructing,
            maintaining and operating gravity drainage works
            within and for the said District.

          Shall the Egan Drainage District No. 1 of the Parish of
          Acadia, State of Louisiana, (the “District”), continue to
          levy and collect a tax of seven and ninety-seven
          hundredths (7.97) mills on all property subject to
          taxation, situated in said District, annually for a period
          of ten (10) years beginning with the year 2001 and
          ending with the year 2010, for the purpose of acquiring,
          constructing, maintaining and operating gravity drainage
          works within and for the said District?

SECTION 2. In the event the aforesaid proposition is carried at said election, this Police Jury does hereby approve the levy of an ad valorem tax therein in accordance with the proposition as set forth above.

This Resolution having been submitted to a vote, the vote thereon was as follows:

The following Resolution was offered by Mr. John Beard, seconded by Mrs. Cecelia Broussard:

                                      
RESOLUTION

          A Resolution approving the holding of an election in Fire
          Protection District No. 6 of the Parish of Acadia, State
          of Louisiana, on Saturday, July 15, 2000, to authorize
          the levy of a special tax therein.

WHEREAS, the Board of Commissioners of Fire Protection District No. 6 of the Parish of Acadia, State of Louisiana (the “Governing Authority”), acting as the governing authority of Fire Protection District No. 6 of the Parish of Acadia, State of Louisiana (the “District”), proposes to adopt a resolution calling a special election in the District on Saturday, July 15, 2000, to authorize the levy of a special tax therein; and

WHEREAS, the governing authority of the District has requested that this Police Jury, acting as the governing authority of the Parish of Acadia, State of Louisiana, give its consent and authority for the District to hold the aforesaid election, and in the event that the election carries to levy and collect the special tax provided for therein; and

WHEREAS, as required by Article VI, Section 15 of the Constitution of the State of Louisiana of 1974, it is now the desire of this Police Jury to approve the holding of said election and in the event that the election carries, to levy and collect the special tax provided for therein;

NOW, THEREFORE, BE IT RESOLVED by the Police Jury of the Parish of Acadia, State of Louisiana, acting as the governing authority of said Parish, that:

SECTION 1. In compliance with the provisions of Article VI, Section 15 of the constitution of the State of Louisiana of 1974, and in accordance with the request of the Board of Commissioners of Fire Protection District No. 6 of the Parish of Acadia, State of Louisiana, this Police Jury hereby approves the holding of an election in the District, on Saturday, July 15, 2000, at which election there will be submitted the following proposition, to-wit:

          Shall Fire Protection District No. 6 of the Parish of Acadia,
          State of Louisiana (the “District”), continue to levy a
          seven and eighty-eight hundredths (7.88) mills tax on all
          the property subject to taxation within the District for a
          period of ten (10) years beginning with the year 2000 and

          constructing, acquiring, improving, maintaining and
          operating fire protection facilities and equipment in the
          District and paying the cost of obtaining water for fire

FEDERAL/STATE FINANCIAL ASSISTANCE

                                      
RESOLUTION

     BY: MRS CECELIA BROUSSARD AND MRS CATHERINE LACOMBE

WHEREAS, under the authorization of the Stewart B. McKinney Homeless Assistance Act funds are allocated to the State of Louisiana by the U. S. Department of Housing and Urban Development (HUD) for distribution to eligible recipients, and

WHEREAS, funds available under the ESG Program are dedicated for the rehabilitation, renovation or conversion of buildings for use as shelters for the homeless, and

WHEREAS, grantee local governments may make available all or part of grant amounts to private non-profit organizations such as the ASSIST Agency for use in eligible program activities, and

WHEREAS, careful attention has been paid to eligibility criteria requirements for matching funds and environmental clearance and required compliance with Federal and State regulations governing the use of these funds.

THEREFORE, BE IT RESOLVED by the Acadia Parish Police Jury in regular session duly convened on this the 21st day of March, 2000, does hereby authorize application for funds provided by the Homeless Emergency Shelter Grants Program.

BE IT FURTHER RESOLVED that the President be empowered, authorized and directed to execute Subgrant Agreement with the Assist Agency (Recipient) for the administration of program funds.

BE IT FURTHER RESOLVED that the President be authorized to execute final grant agreement with the Department of Social Services.

                                  * * * PROCLAMATION * * *

WHEREAS, the strength of our nation flows from the promise of individual equality and freedom of choice; and

WHEREAS, the 32nd Anniversary of the National Fair Housing Law, Title VIII of the Civil Rights Act of 1968, during the month of April, is an occasion for all Americans - individually and collectively - to rededicate themselves to the principle of freedom from housing discrimination whenever it exists. This law guarantees for each citizen that critical, personal element of freedom of choice - selection of the home; and

WHEREAS, a fair housing law has been passed by the State of Louisiana; and implementation of that law requires the positive commitment, involvement and support of each of our citizens; and

WHEREAS, the department and agencies of the State of Louisiana are to provide leadership in the effort to make fair housing not just an idea, but an ideal for all our citizens; and

WHEREAS, barriers that diminish the rights and limit the options of any citizen will ultimately diminish the rights and limit the options of all;

THEREFORE, I, Claude J. Courville, President of the Acadia Parish Police Jury, do hereby proclaim the month of April, 2000 as

                               
FAIR HOUSING MONTH

in the Parish of Acadia and do hereby encourage all citizens to abide by the letter and spirit of the Fair Housing Law, and ask the citizens of this Parish to join in reaffirming the obligation and commitment to fair housing opportunities for all.

Grant Consultant Paula Fuselier informed the Jury that estimated cost for the purchase of property to locate the new substation in Fire Protection District #8 exceeded the limits allowed in the Block Grant Application. She indicated the Jury could amend the line item and use funds set aside for contingencies.

A motion was offered by Mrs. Cecelia Broussard, seconded by Mr. John Humble, Sr., to approve the use of contingencies for the purchase of the property to locate the substation for Fire Protection District #8 through the LCDBG Program. Motion carried.


FINANCE

WHEREAS, the Acadia Parish Police Jury advertised for bids in the Official Journal for two (2) new ˝ ton pickup trucks.

WHEREAS, bids received were as follows:

THEREFORE, BE IT RESOLVED by the Acadia Parish Police Jury in regular session duly convened on this the 21st day of March, 2000, does hereby ratify the low bid submitted by Lamarque Ford, in the amount of Twenty-eight Thousand Nine Hundred Twelve and 00/100 ($28,912.00) Dollars.

BE IT FURTHER RESOLVED that the President of this Police Jury be and he is hereby empowered, authorized and directed to execute a contract with Lamarque Ford, on behalf of, in the name and under the seal of the Acadia Parish Police Jury relative to the purchase of said equipment.

LEGISLATION

Action on the request from Concordia Parish relating to Nursing Home Funding was postponed pending further information.


LITIGATION

A motion was offered by Mrs. Cecelia Broussard, seconded by Mr. Jimmie Pellerin, to adjourn into executive session to consider the matter relating to the one vehicle accident on Clement Road. The following roll call vote was cast: Yeas: Catherine LaCombe, John Humble, Sr., Cecelia Broussard, Jimmie Pellerin, John Beard, Pat Daigle and Claude Courville. Motion carried.

The President reconvened the meeting following the executive session. No action was recommended.


PERSONNEL

A motion was offered by Mrs. Cecelia Broussard, seconded by Mr. John Humble, Sr., to recommend the hiring of the following upon successful completion of all screening requirements: Mr. Clifford Senegal and Mr. Lance Thibodeaux at $6.25 per hour and Mr. Joseph Gibson, Mr. Roy Hebert and Mr. Monty Istre at $7.25 per hour. Motion carried.


PUBLIC WORKS/ROAD & BRIDGE

A motion was offered by Mr. Pat Daigle, seconded by Mrs. Cecelia Broussard, to defer action on the request to rescind abandonment on Saint Dorothy Road until it was brought to acceptable condition. Motion carried.

A motion was offered by Mr. Pat Daigle, seconded by Mrs. Catherine LaCombe, to authorize the Parish Road Engineer and Road Manager to inspect and make recommendations on the possible acceptance of Fire Station Lane. Motion carried.

A motion was offered by Mrs. Cecelia Broussard, to approve the partnership with the City of Crowley to participate in the expense to provide lighting at the Interstate/Hwy. 13 Interchange as per the terms of the amended agreement. Motion failed for lack of a second.

A motion was offered by Mr. John Humble, Sr., seconded by Mr. Pat Daigle, to approve the Emergency Work Report for the month of February, 2000. Said expenditures to be $198.12. Motion carried.

                                   
ORDINANCE #797

AN ORDINANCE MAKING IT UNLAWFUL FOR ANY PERSON TO OPERATE OR DRIVE A MOTOR VEHICLE UPON SPRINGWOOD ROAD (PARISH ROAD 4-128) IN ACADIA PARISH, LOUISIANA, AT A SPEED IN EXCESS OF
TWENTY-FIVE MILES PER HOUR, AND, PROVIDING FOR THE PENALTIES FOR THE VIOLATION THEREOF.

SECTION 1. BE IT ORDAINED by the Police Jury of Acadia Parish, Louisiana, that it shall be unlawful for any person to operate or drive a motor vehicle in excess of twenty-five miles per hour on the following described Parish Road:

                   
Springwood Road (Parish Road 4-128)

SECTION 2. BE IT FURTHER ORDAINED that any person found guilty of operating or driving a motor vehicle in excess of twenty-five miles per hour on the Parish road described above, shall be guilty of a misdemeanor, and upon conviction therefore, shall be fined not more than Fifty Dollars ($50) or be imprisoned not more than ten (10) days or both.

SECTION 3. BE IT FURTHER ORDAINED that any laws or parts of laws in conflict are hereby repealed.

The Ordinance was offered by Mrs. Catherine LaCombe, and seconded by Mrs. Cecelia Broussard, and after being read and considered section by section, was adopted as a whole by the following vote:

          Pellerin, John Beard, Pat Daigle and Claude Courville.

NAYS: None.

SOLID WASTE/ENVIRONMENTAL

                                      
RESOLUTION

            BY: MRS CATHERINE LACOMBE AND MR JOHN BEARD

BE IT RESOLVED: by the Acadia Parish Police Jury in regular session duly convened this 21st day of March, 2000, does hereby authorize the President and Secretary to advertise in the Official Journal of the Parish for the purchase of One (1) New Non-Reconditioned Landfill Compactor and the trade-in of One (1) used Landfill Compactor Model #826G, Serial #7LN00165.

BE IT FURTHER RESOLVED that sealed bids will be received by the Administrative Office of the Acadia Parish Police Jury until 10:00 A.M., on Monday, May 1, 2000.

BE IT FURTHER RESOLVED that the Police Jury reserves the right to reject any and all bids or to accept any bid(s) which in the opinion of the Jury will be to the best interest of the Parish of Acadia.

A motion was offered by Mrs. Catherine LaCombe, seconded by Mr. John Humble, Sr., to authorize the use of road maintenance equipment to construct a one foot earthing buffer over construction and demolition disposal area at the Acadia Parish Sanitary Landfill. Motion carried with one descending vote Mrs. Cecelia Broussard.

A presentation on alternative daily cover for Landfill applications was presented by Mr. Don Breaux, representative of Louisiana Vegetation Management, Inc.

The Sales Tax Report was presented for the month of February, 2000. The report indicated a gross receipt of $260,231.48, a decrease of $37,062.41 from February, 1999.
