CROWLEY, LOUISIANA

MAY 2, 2000

THE ACADIA PARISH POLICE JURY met on the above date at 6:30 p.m., in the Police Jury Meeting Room, Courthouse Building, Crowley, Louisiana, in regular session with the Claude J. Courville, presiding. At the request of the President, a moment of silence was offered and the Pledge to the Flag was recited in unison. The roll was called and final attendance was recorded as follows:

A motion was offered by Mr. John Humble, Sr., seconded by Mrs. Cecelia Broussard, to revise the agenda and consider an address from Mr. Buster Hardy, Candidate for Region 7 Director for the Police Jury Association, Change Order #5 for the Tourist Welcome Center, Speed limits on Canadian, Everest & St. Romans Roads and request from TRIAD for temporary employment. Motion carried.

A motion was offered by Mr. Jimmie Pellerin, seconded by Mr. John Beard, to approve the Minutes of the April 18, 2000, Regular Police Jury Meeting. Motion carried.

Mr. Buster Hardy, Police Juror from Vermilion Parish, asked the Jury to support his appointment as Executive Director from Region 7 to the State Executive Board for the Police Jury Association. Mr. Hardy expressed his gratitude for an opportunity to speak and gave a brief history of his tenure in public service.

Mrs. Peggy Breaux, Director of TRIAD, submitted a written request for temporary help to complete necessary work for the upcoming conference.

A motion was offered by Mrs. Cecelia Broussard, seconded by Mr. Alton Stevenson, to provide $3,300 of temporary help for the TRIAD Program. Motion carried.

RESOLUTION

WHEREAS, Bayou Mallet Gravity Drainage District has received a letter of resignation from Mr. Lee Augustine as a board member of Bayou Mallet Gravity Drainage District.

WHEREAS, Bayou Mallet Gravity Drainage District has placed in nomination the name of Mr. Bobby Dupré to fill said vacancy.

THEREFORE, BE IT RESOLVED by the Acadia Parish Police Jury in regular session duly convened this 2nd day of May, 2000, does hereby appoint MR. BOBBY DUPRÉ to the Bayou Mallet Gravity Drainage District to fill the unexpired term of Mr. Lee Augustine.

ELECTIONS

The following Resolution was offered by Mr. John Humble, Sr. and seconded by Mrs. Catherine LaCombe:

                                      
RESOLUTION

          A resolution ordering and calling a special election to be
          held in the Parish of Acadia, State of Louisiana, to
          authorize the rededication and extension of a special
          tax now authorized to be levied by the Parish; making
          application to the State Bond Commission in connection
          therewith; and providing for other matters in connection
          therewith.

BE IT RESOLVED by the Police Jury of the Parish of Acadia, State of Louisiana (the “Governing Authority”), acting as the governing authority of the Parish of Acadia, State of Louisiana (the “Parish”), that:

SECTION 1. Election Call. Subject to the approval of the State Bond Commission, and under the authority conferred by Article VI, Sections 30 and 32 of the Constitution of the State of Louisiana of 1974, the applicable provisions of Chapter 5, Chapter 6-A and Chapter 6-B of Title 18 of the Louisiana Revised Statutes of 1950, as amended, and other constitutional and statutory authority, a special election is hereby called and ordered to be held in the Parish on SATURDAY, JULY 15, 2000, between the hours of six o’clock (6:00) a.m., and eight o’clock (8:00) p.m., in accordance with the provisions of La. R.S. 18:541, and at the said election there shall be submitted to all registered voters qualified and entitled to vote at the said election under the Constitution and laws of this State and the Constitution of the United States, the following proposition, to-wit:

          BUILDING PURPOSES.

          Shall the Parish of Acadia, State of Louisiana (the “Parish”),
          be authorized to rededicate the proceeds heretofore or
          hereafter received by the Parish from the levy and
          collection of a two and twelve hundredths (2.12) mills tax
          (the “Tax”), authorized to be levied in the year 2000
          through 2003, inclusive, pursuant to an election held in the
          Parish on January 15, 1994, so that such proceeds may be
          used not only (i) for the purpose of constructing, improving,
          maintaining and operating the Parish’s Cooperative
          Extension Service Building and acquiring equipment and
          furnishings therefore, but also (ii) for the purpose of
          constructing improvements to and maintaining and
          operating the Parish’s Multi-Purpose Building and Arena,
          provided, however, that at least 40% of the annual Tax
          proceeds shall be budgeted for each of said purposes and
          further; shall the Parish be authorized to continue to levy
          the Tax on all property subject to taxation within the Parish
          for an additional six (6) years beginning with the year 2004
          and ending with the year 2009 and use the proceeds thereof
          for the aforesaid public building purposes?

SECTION 2. Publication of Notice of Election. A Notice of Special Election shall be published in the “Rayne Acadian Tribune,” a weekly (published on Thursday) newspaper of general circulation within the Parish, published in Rayne, Louisiana, and being the official journal of the Parish, once a week for four consecutive weeks, with the first publication to be made not less than forty-five (45) days nor more than ninety (90) days prior to the date of the election, which Notice shall be substantially in the form attached hereto as “Exhibit A” and incorporated herein by reference the same as if it were set forth herein in full.

SECTION 3. Canvass. This Governing Authority shall meet at its regular meeting place, the Police Jury Room of the Courthouse, Crowley, Louisiana, on TUESDAY, JULY 18, 2000, at SIX-THIRTY O’CLOCK (6:30) P.M., and shall then and there in open and public session proceed to examine and canvass the returns and declare the result of the said special election.

SECTION 4. Polling Places. The polling places set forth in the aforesaid Notice of Special Election are hereby designated as the polling places at which to hold the said election, and the Commissioners-in-Charge and Commissioners, respectively, will be the same persons as those designated in accordance with law.

SECTION 5. Election Commissioners; Voting Machines. The officers designated to serve as Commissioners-in-Charge and Commissioners pursuant to Section 4 hereof, or such substitutes therefor as may be selected and designated in accordance with La. R.S. 18:1287, shall hold the said special election as herein provided, and shall make due returns of said election for the meeting of the Governing Authority to be held on Tuesday, July 18, 2000, as provided in Section 3 hereof. All registered voters in the Parish will be entitled to vote at the special election, and voting machines shall be used.

SECTION 6. Authorization of Officers. The Secretary of the Governing Authority is hereby empowered, authorized and directed to arrange for and to furnish to said election officers in ample time for the holding of said election, the necessary equipment, forms and other paraphernalia essential to the proper holding of said election and the President and/or Secretary of the Governing Authority are further authorized, empowered and directed to take any and all further action required by State and/or Federal law to arrange for the election, including but not limited to, appropriate submission to the Federal Department of Justice under Section 5 of the Federal Voting Rights Act of 1965, as amended.

SECTION 7. Furnishing Election Call to Election Officials. Certified copies of this resolution shall be forwarded to the Secretary of State, the Commissioner of Elections, the Clerk of Court and Ex-Officio Parish Custodian of Voting Machines of Acadia Parish and the Registrar of Voters of Acadia Parish, as notification of the special election, in order that each may prepare for said election and perform their respective functions as required by law.

SECTION 8. Application to State Bond Commission. Application is made to the State Bond Commission for consent and authority to hold the special election as herein provided, and in the event said election carries for further consent and authority to levy and collect the special tax provided for therein. A certified copy of this resolution shall be forwarded to the State Bond Commission on behalf of this Governing Authority, together with a letter requesting the prompt consideration and approval of this application.

This resolution having been submitted to a vote, the vote thereon was as follows:

Pursuant to the provisions of a resolution adopted by the Police Jury of the Parish of Acadia, State of Louisiana (the “Governing Authority”), acting as the governing authority of the Parish of Acadia, State of Louisiana (the “Parish”), on May 2, 2000, NOTICE IS HEREBY GIVEN that a special election will be held within the Parish on

INSURANCE

The President appointed an Insurance Committee consisting of the following: John Beard, John Humble, Sr., Pat Daigle, Claude Courville, Robert Bergeaux, Wayne Matlock and Katry Martin to study the Police Jury health insurance program. AN ORDINANCE MAKING IT UNLAWFUL FOR ANY PERSON TO OPERATE OR DRIVE A MOTOR VEHICLE UPON CANADIAN LANE (PARISH ROAD 2-19) IN ACADIA PARISH, LOUISIANA, AT A SPEED IN EXCESS OF
FORTY-FIVE MILES PER HOUR, AND, PROVIDING FOR THE PENALTIES FOR THE VIOLATION THEREOF.

SECTION 1. BE IT ORDAINED by the Police Jury of Acadia Parish, Louisiana, that it shall be unlawful for any person to operate or drive a motor vehicle in excess of forty-five miles per hour on the following described Parish Road:

SECTION 2. BE IT FURTHER ORDAINED that any person found guilty of operating or driving a motor vehicle in excess of forty-five miles per hour on the Parish road described above, shall be guilty of a misdemeanor, and upon conviction therefore, shall be fined not more than Fifty Dollars ($50) or be imprisoned not more than ten (10) days or both.

SECTION 3. BE IT FURTHER ORDAINED that any laws or parts of laws in conflict are hereby repealed.

BE IT RESOLVED: by the Acadia Parish Police Jury in regular session duly convened this 2nd day of May, 2000, does hereby empower, authorize and direct the President to execute Change Order #5 for the new Acadia Parish Tourist Commission Welcome Center.

BE IT FURTHER RESOLVED that said change order in the amount of Four Thousand Three Hundred Seventy and 00/100 ($4,370.00) Dollars be added for a total contract price of Two Hundred Forty-five Thousand Eight Hundred Eighty-five and 74/100 ($245,885.74) Dollars.

Bid tabulations were presented for the purchase of one new-non reconditioned Landfill Compactor.

Representatives of Louisiana Machinery and Scott Construction were in attendance at the meeting and requested the Jury take under advisement the bids for the compactor because the low bidder had no local dealer support.

A Representative from Norwel Equipment Co., pledged they would provide warranty work and service on the machinery.

A motion was offered by Mr. John Humble, Sr., seconded by Mr. Pat Daigle, to defer action until the next regular Police Jury Meeting on the decision to purchase one new non-reconditioned landfill compactor. Motion carried.


COMMENTS FROM THE PUBLIC

The Jury reviewed the Solid Waste Pickup Compliance with no objection.

Juror Catherine LaCombe indicated she attended meetings on a hazardous waste pickup day for the Parish and the proposed business incubator. She also stated that the clean sweep project was held in the Egan area recently.

THERE BEING NO FURTHER BUSINESS TO COME BEFORE THE MEETING, THE MOTION WAS OFFERED DULY SECONDED, THAT THE MEETING ADJOURN UNTIL THE NEXT REGULARLY SCHEDULED MEETING OF MAY 16, 2000, AT THE HOUR OF 6:30 P.M.
