CROWLEY, LOUISIANA

NOVEMBER 21, 2000

THE ACADIA PARISH POLICE JURY met on the above date at 6:30 p.m., in the Police Jury Meeting Room, Courthouse Building, Crowley, Louisiana, in regular session with the President, Claude Courville, presiding. At the request of the President, a moment of silence was offered and the Pledge to the Flag was recited in unison. The roll was called and final attendance was recorded as follows:

A motion was offered by Mr. Jimmie Pellerin, seconded by Mrs. Cecelia Broussard, to approve the Minutes of the November 7, 2000, Regular Police Jury Meeting. Motion carried.

Mr. John Quebodeaux, Chairman of the First Annual Household Hazardous Waste Day recognized those who assisted with the event and presented a token of appreciation.

The members of the Jury also recognized those who served as Grand Marshalls for the International Rice Festival Parades.

BE IT RESOLVED: by the Acadia Parish Police Jury in regular session duly convened this 21st day of November, 2000, does hereby re-appoint MR. BRADLEY LEGER to the Acadiana Resource Conservation & Development for a two year term effective November 21, 2000.

COMMUNITY/ECONOMIC DEVELOPMENT

Mayor Stephen Broussard, Interim Executive Vice President with Acadia Economic Development Corporation, submitted the comprehensive report of activities of the organization for the twelve month period ending December, 2000. He highlighted all activities including grant applications, job creations and educational and youth activities. In concluding his report Mr. Broussard requested assistance in the amount of $80,000.00 from the Police Jury for the upcoming fiscal year. No formal action was taken.


ELECTIONS

The following Resolution was offered by Mr. Pat Daigle, seconded by Mrs. Catherine LaCombe:
RESOLUTION

          A Resolution approving the holding of an election in Fire
          Protection District No. 1 of the Parish of Acadia, State of
          Louisiana, on Saturday, January 20, 2001, to authorize
          the levy of a special tax therein.

WHEREAS, the Board of Commissioners of Fire Protection District No. 1 of the Parish of Acadia, State of Louisiana (the “Governing Authority”), acting as the governing authority of Fire Protection District No. 1 of the Parish of Acadia, State of Louisiana (the “District”), adopted a Resolution on October 17, 2000, calling a special election in the District on Saturday, January 20, 2001, to authorize the levy of a special tax therein; and

WHEREAS, the governing authority of the District has requested that this Police Jury, acting as the governing authority of the Parish of Acadia, State of Louisiana, give its consent and authority for the District to hold the aforesaid election, and in the event that the election carries to levy and collect the special tax provided for therein; and

WHEREAS, as required by Article VI, Section 15 of the Constitution of the State of Louisiana of 1974, it is now the desire of this Police Jury to approve the holding of said election and in the event that the election carries, to levy and collect the special tax provided for therein;

NOW, THEREFORE, BE IT RESOLVED by the Police Jury of the Parish of Acadia, State of Louisiana, acting as the governing authority of said Parish, that:

SECTION 1. In compliance with the provisions of Article VI, Section 15 of the constitution of the State of Louisiana of 1974, and in accordance with the request of the Board of Commissioners of Fire Protection District No. 1 of the Parish of Acadia, State of Louisiana, this Police Jury hereby approves the holding of an election in the District, on Saturday, January 20, 2001, at which election there will be submitted the following proposition, to-wit:

                         PROPOSITION (TAX CONTINUATION)

          SUMMARY: 10 YEAR, 4.83 MILLS PROPERTY TAX
          CONTINUATION FOR ACQUIRING, CONSTRUCTING,
          IMPROVING, MAINTAINING AND/OR OPERATING FIRE
          PROTECTION FACILITIES AND EQUIPMENT IN AND FOR
          THE DISTRICT, AND PAYING THE COST OF OBTAINING
          WATER FOR FIRE PROTECTION PURPOSES.

          Shall Fire Protection District No. 1 of the Parish of
          Acadia, State of Louisiana (the “District”), continue to
          levy a special tax of four and eighty-three hundredths
          (4.83) mills on all the property subject to taxation in
          the District for a period of ten (10) years, beginning
          with the year 2002 and ending with the year 2011, for
          the purpose of acquiring, constructing, improving,
          maintaining and/or operating fire protection facilities
          and equipment in and for the District, and paying the
          cost of obtaining water for fire protection purposes?

SECTION 2. In the event the election carries, this Police Jury does hereby further consent to and authorize the District to levy and collect the special tax provided for therein.

This Resolution having been submitted to a vote, the vote thereon was as follows:

YEAS: Catherine LaCombe, Cecelia Broussard, Jimmie Pellerin, John Beard,
          Pat Daigle and Claude Courville.

NAYS: None.

ABSENT: Alton Stevenson and John Humble, Sr.

And the Resolution was declared adopted on this, the 5th day of December, 2000.

FINANCE

                                      
RESOLUTION

          BY: MRS CECELIA BROUSSARD AND MR JIMMIE PELLERIN

BE IT RESOLVED: by the Acadia Parish Police Jury in regular session duly convened this 21st day of November, 2000, does hereby authorize the calling of a public hearing for December 5, 2000, at 6:00 P.M., Police Jury Meeting Room, to receive comments on the proposed 2001 Budget.

A motion was offered by Mrs. Cecelia Broussard, seconded by Mrs. Catherine LaCombe, to amend the 2000 Budget to include Public Health costs of inmate care as part of the Public Health Fund subject to approval of Parish Auditors. Motion carried.


PERSONNEL

A motion was offered by Mrs. Cecelia Broussard, seconded by Mrs. Catherine LaCombe, to approve the request made by the Acadia Parish Communications District to allow District Employees to participate in Police Jury’s Health Insurance Program, wherein all cost of the premium would be borne by either the employee and/or the Communications District. Motion carried.

A motion was offered by Mrs. Cecelia Broussard, seconded by Mr. Pat Daigle, to authorize the Secretary to advertise for two Road Maintenance Employees. Motion carried.


PUBLIC WORKS/ROAD & BRIDGE

                               
ORDINANCE #818

AN ORDINANCE MAKING IT UNLAWFUL FOR ANY PERSON TO OPERATE OR DRIVE A MOTOR VEHICLE UPON LAVERGNE ROAD (PARISH ROAD 1-05) IN ACADIA PARISH, LOUISIANA, AT A SPEED IN EXCESS OF
TWENTY-FIVE MILES PER HOUR, AND, PROVIDING FOR THE PENALTIES FOR THE VIOLATION THEREOF.

SECTION 1. BE IT ORDAINED by the Police Jury of Acadia Parish, Louisiana, that it shall be unlawful for any person to operate or drive a motor vehicle in excess of twenty-five miles per hour on the following described Parish Road:

                         Lavergne Road (Parish Road 1-05)

SECTION 2. BE IT FURTHER ORDAINED that any person found guilty of operating or driving a motor vehicle in excess of twenty-five miles per hour on the Parish road described above, shall be guilty of a misdemeanor, and upon conviction therefore, shall be fined not more than Fifty Dollars ($50) or be imprisoned not more than ten (10) days or both.

SECTION 3. BE IT FURTHER ORDAINED that any laws or parts of laws in conflict are hereby repealed.

The Ordinance was offered by Mr. John Beard, and seconded by Mrs. Cecelia Broussard, after being read and considered section by section, was adopted as a whole by the following vote:

YEAS: Catherine LaCombe, Cecelia Broussard, Jimmie Pellerin, John Beard,
          Pat Daigle and Claude Courville.

NAYS: None.

RESOLUTION

BE IT RESOLVED: by the Acadia Parish Police Jury in regular session duly convened this 21st day of November, 2000, does hereby empower, authorize & direct the President to execute an Act of Acceptance on behalf of the Acadia Parish Police Jury to receive the extension of Beckett Drive into the Parish Road Maintenance System.

RESOLUTION

BE IT RESOLVED: by the Acadia Parish Police Jury in regular session duly convened this 21st day of November, 2000, does hereby empower, authorize and direct the President to execute Change Order #1 for patching and leveling of blacktop roads.

BE IT FURTHER RESOLVED that said change order in the amount of Twenty-six Thousand Seven Hundred Thirty-seven and 60/100 ($26,737.60) Dollars be added for a total contract price of Sixty-nine Thousand Four Hundred Fifty-three and 60/100 ($69,453.60) Dollars.

RESOLUTION OF ACCEPTANCE

The following resolution was offered by Mrs. Cecelia Broussard, duly seconded by Mr. Pat Daigle, and duly resolved and adopted on November 21, 2000.

A resolution authorizing and directing the President to execute for and on behalf of the Acadia Parish Police Jury, an Act of Acceptance for J. B. Talley & Co., Inc., Contractor, pertaining to the substantial completion of the contract, patching and crack sealing of blacktop roads, in accordance with the plans and specifications contained in the contract documents pertaining thereto.

WHEREAS, J. B. Talley & Co., Inc., as Contractor, has substantially completed the patching and crack sealing of blacktop roads in accordance with the plans and specifications contained in the contract documents pertaining thereto; and

WHEREAS, the Acadia Parish Police Jury desires to accept the completed work;

NOW, THEREFORE, BE IT RESOLVED by the Acadia Parish Police Jury that the President of said Acadia Parish Police Jury be, and is hereby empowered, authorized and directed to execute an Act of Acceptance for and on behalf of the Acadia Parish Police Jury accepting the work as being substantially completed, and that he be authorized and directed to have a copy of said acceptance recorded in the Conveyance Records of the Parish of Acadia, State of Louisiana.

The Sales Tax Report was presented for the month of October, 2000. The report indicated a gross receipt of $413,791.60, an increase of $47,815.44 from October, 1999.


COMMENTS FROM THE PUBLIC

Animal Control Officer Wayne Matlock submitted a report of recent activities. Reports included an act of vandalism and response to loose livestock.

THERE BEING NO FURTHER BUSINESS TO COME BEFORE THE MEETING, THE MOTION WAS OFFERED DULY SECONDED, THAT THE MEETING ADJOURN UNTIL THE NEXT REGULARLY SCHEDULED MEETING OF DECEMBER 5, 2000, AT THE HOUR OF 6:30 P.M.
