CROWLEY, LOUISIANA

APRIL 17, 2001

THE ACADIA PARISH POLICE JURY met on the above date at 6:30 p.m., in the Police Jury Meeting Room, Courthouse Building, Crowley, Louisiana, in regular session with the President, Claude Courville, presiding. At the request of the President, a moment of silence was offered and the Pledge to the Flag was recited in unison. The roll was called and final attendance was recorded as follows:

A motion was offered by Mrs. Cecelia Broussard, seconded by Mr. John Beard, to amend the agenda and consider a speed limit on Tornado Road. Motion carried unanimously.

A motion was offered by Mr. Jimmie Pellerin, seconded by Mr. John Beard, to approve the Minutes of the March 28, 2001, Special Police Jury Meeting and the April 3, 2001, Regular Police Jury Meeting. Motion carried.

                                     
RESOLUTION

      BY: MRS CECELIA BROUSSARD AND MRS CATHERINE LACOMBE

WHEREAS, the members of the Acadia Parish Police Jury with great sorrow and a deep sense of loss, take cognizance of the absence of our beloved friend and past Acadia Parish Police Juror, Mr. Aaron Cart, who has been taken by an untimely death, and

WHEREAS, he has rendered innumerable public services to his respective Parish and to the State of Louisiana and to the people thereof, and

WHEREAS, the absence of this outstanding citizen and friend to the public service is keenly felt as a personal loss to his family, friends and colleagues.

THEREFORE, BE IT RESOLVED by the Acadia Parish Police Jury in regular session duly convened on this the 17th day of April, 2001, does hereby pay tribute to the memory of

and does hereby express for members of this body and citizens of Acadia Parish their sense of gratitude for his achievements and contributions to the public good.

BE IT FURTHER RESOLVED that when this Jury adjourns, it does so out of respect and in memory of our departed friend “Aaron Cart”.

RESOLUTION

      BY: MRS CECELIA BROUSSARD AND MRS CATHERINE LACOMBE

WHEREAS, the Acadia Parish Police Jury desire to record the heavy sense of loss at the death of MR. BEN DAIGLE, and

WHEREAS, the Police Jury extends a formal expression of their sorrow at the death of Ben Daigle and does hereby note in the Minutes, the passing of a man who contributed years of faithful and dedicated service to the people of Acadia Parish.

THEREFORE, BE IT RESOLVED by the Acadia Parish Police Jury in special session duly convened on this the 17th day of April, 2001, does hereby extend to the family its deepest sympathy.

BE IT FURTHER RESOLVED that the original of this Resolution is to be tendered to his family as an expression of the Jury’s heartfelt sympathy.

WHEREAS, the COMMUNITY DEVELOPMENT BLOCK GRANT (CDBG) has operated since 1975 to provide local governments with the resources required to meet the needs of persons of low and moderate income, and CDBG funds are used by thousands of neighborhood based, non-profit organizations throughout the nation to address pressing neighborhood and human service needs; and

WHEREAS, the COMMUNITY DEVELOPMENT BLOCK GRANT PROGRAM has had a significant impact on our local economies through job creation and retention, physical redevelopment and improved local tax bases; and

WHEREAS, the Acadia Parish Police Jury and other local governments have clearly demonstrated the capacity to administer and customize the CDBG program to identify, prioritize and resolve pressing local problems, such as affordable housing, neighborhood and human service needs, job creation and retention and physical redevelopment.

THEREFORE, I, Claude J. Courville, President of the Acadia Parish Police Jury, proclaim April 16-22, 2001 as

             
COMMUNITY DEVELOPMENT BLOCK GRANT WEEK

within the Parish of Acadia, and urge all citizens to join us in recognizing the Community Development Block Grant Program and the important role it plays in our community.

WHEREAS, the strength of our nation flows from the promise of individual equality and freedom of choice; and

WHEREAS, the 33rd Anniversary of the National Fair Housing Law, Title VIII of the Civil Rights Act of 1968, during the month of April, is an occasion for all Americans - individually and collectively - to rededicate themselves to the principle of freedom from housing discrimination whenever it exists. This law guarantees for each citizen that critical, personal element of freedom of choice - selection of the home; and

WHEREAS, a fair housing law has been passed by the State of Louisiana; and implementation of that law requires the positive commitment, involvement and support of each of our citizens; and

WHEREAS, the department and agencies of the State of Louisiana are to provide leadership in the effort to make fair housing not just an idea, but an ideal for all our citizens; and

WHEREAS, barriers that diminish the rights and limit the options of any citizen will ultimately diminish the rights and limit the options of all;

THEREFORE, I, Claude J. Courville, President of the Acadia Parish Police Jury, do hereby proclaim the month of April, 2001 as

                                
FAIR HOUSING MONTH

in the Parish of Acadia and do hereby encourage all citizens to abide by the letter and spirit of the Fair Housing Law, and ask the citizens of this Parish to join in reaffirming the obligation and commitment to fair housing opportunities for all.

COMMUNITY/ECONOMIC DEVELOPMENT

Mr. Stephen Broussard, Executive Vice President of Acadia Economic Development Corporation, presented the first quarter report to the Jury on activities of the organization which included job placement, marketing, job fair activities, grant writing, business incubation, housing and base mentoring.

BE IT RESOLVED: by the Acadia Parish Police Jury in regular session duly convened this 17th day of April, 2001, does hereby appoint to the Northeast Acadia Development Corporation MR. CARL DAIGLE effective to April, 2001.

Mr. Todd Richard, President of the Northeast Acadia Development Corporation, requested that the Jury consider creating a new economic development corporation for the Parish which would be comprised of an eight member board, one from each Police Jury District, and would be required to meet certain qualifications to serve. He suggested that this board receive the only funding provided by the Parish for economic development. Should the Jury not choose to take this path that they acknowledge I-Acadia as the Parishes Economic Development Corporation.

No action was taken regarding Mr. Richard’s request.


ELECTIONS

The following Resolution was offered by Mr. Jimmie Pellerin, seconded by Mrs. Cecelia Broussard:

                                    
RESOLUTION

A Resolution approving the holding of an election in the First Ward Drainage District of the Parish of Acadia, State of Louisiana, on Saturday, July 21, 2001, to authorize the levy of a special tax therein.

WHEREAS, the Board of Commissioners of First Ward Drainage District of the Parish of Acadia, State of Louisiana (the “Governing Authority”), acting as the governing authority of the First Ward Drainage District of the Parish of Acadia, State of Louisiana (the “District”), adopted a resolution on April 9, 2001, calling a special election in the District on Saturday, July 21, 2001, to authorize the levy of a special tax therein; and

WHEREAS, the governing authority of the District has requested that this Police Jury, acting as the governing authority of the Parish of Acadia, State of Louisiana, give its consent and authority for the District to hold the aforesaid election, and in the event that the election carries to levy and collect the special tax provided for therein; and

WHEREAS, as required by Article VI, Section 15 of the Constitution of the State of Louisiana of 1974, it is now the desire of this Police Jury to approve the holding of said election and in the event that the election carries, to levy and collect the special tax provided for therein;

NOW, THEREFORE, BE IT RESOLVED by the Police Jury of the Parish of Acadia, State of Louisiana, acting as the governing authority of said Parish, that:

SECTION 1. In compliance with the provisions of Article VI, Section 15 of the constitution of the State of Louisiana of 1974, and in accordance with the request of the Board of Commissioners of First Ward Drainage District of the Parish of Acadia, State of Louisiana, this Police Jury hereby approves the holding of an election in the District, on Saturday, July 21, 2001, at which election there will be submitted the following proposition, to-wit:

                                    
PROPOSITION

          SUMMARY: 10 YEAR, 8 MILLS PROPERTY TAX FOR
          MAINTENANCE, CONSTRUCTION AND IMPROVEMENT OF
          DRAINAGE WORKS WITHIN AND FOR THE DISTRICT,
          INCLUDING THE ACQUISITION OF EQUIPMENT THEREFORE,
          SAID TAX TO BE IN LIEU OF AND REPLACE A SIMILAR TAX
          OF 5.18 MILLS PRESENTLY AUTHORIZED TO BE LEVIED
          THROUGH THE YEAR 2001.

          Shall the First Ward Drainage District of the Parish of
          Acadia, State of Louisiana (the “District”), levy a special
          tax of eight (8) mills on all the property subject to
          taxation within the District, for a period of ten (10) years
          beginning with the year 2001 and ending with the year
          2010, for the purpose of the maintenance, construction
          and improvement of drainage works within and for the
          District, including the acquisition of equipment therefore,
          said tax to be in lieu of and replace a similar tax of 5.18
          mills presently authorized to be levied through the year
          2001?

SECTION 2. In the event the election carries, this Police Jury does hereby further consent to and authorize the District to levy and collect the special tax provided for therein.

This Resolution having been submitted to a vote, the vote thereon was as follows:

YEAS: Alton Stevenson, Catherine LaCombe, John Humble, Sr., Cecelia
          Broussard, Jimmie Pellerin, John Beard, Pat Daigle and Claude
          Courville.

NAYS: None.

ABSENT: None.

And the Resolution was declared adopted on this, the 17th day of April, 2001.

LEGISLATION

                                      
RESOLUTION

       BY: MRS CECELIA BROUSSARD AND MR ALTON STEVENSON

WHEREAS, State Representative Gallot has introduced HB 515 relative to adjusting Severance Tax Allocation to Parishes, and

WHEREAS, said HB 515 authorizes a Constitutional Amendment to be submitted to the electors of the State of Louisiana on November 2, 2002, and

WHEREAS, if said Constitutional Amendment is approved by the electors of the State of Louisiana, would increase the distribution of Severance Taxes to the parishes where production occurs not to exceed a maximum of one million dollars ($1,000,000) effective on July 1, 2005, and

WHEREAS, the Maximum amount which shall be remitted to the Parish in which severance or production occurs shall be increased July first every five years beginning on July 1, 2010 and said increase shall be determined by the Revenue Estimating Conference and shall be based upon the aggregate of the increase in the Consumer Price Index, or its successor, for the most recent five year period for which such index is available.

NOW, THEREFORE, BE IT RESOLVED that the Acadia Parish Police Jury does hereby support the said HB 515 and urges that the other State Legislators representing Acadia Parish support the said HB 515, and

BE IT FURTHER RESOLVED that each Parish Governing Authority ask their State Legislators to support the said Resolution.

PERSONNEL

A motion was offered by Mrs. Cecelia Broussard, seconded by Mrs. Catherine LaCombe, to approve a probationary pay increase of 5% for Mr. Barry Cormier and Mr. George Pousson effective April 15, 2001. Motion carried.


PUBLIC WORKS/ROAD & BRIDGE

Mr. John Beard requested, on behalf of the Mire Volunteer Fire Department, assistance in constructing a road at the site at which the Fire District plans to relocate the station.

No objection was raised with regard to the request.

                                  
ORDINANCE #823

AN ORDINANCE MAKING IT UNLAWFUL FOR ANY PERSON TO OPERATE OR DRIVE A MOTOR VEHICLE UPON EUGENNE LANE (PARISH ROAD 7-39) IN ACADIA PARISH, LOUISIANA, AT A SPEED IN EXCESS OF
TWENTY-FIVE MILES PER HOUR, AND, PROVIDING FOR THE PENALTIES FOR THE VIOLATION THEREOF.

SECTION 1. BE IT ORDAINED by the Police Jury of Acadia Parish, Louisiana, that it shall be unlawful for any person to operate or drive a motor vehicle in excess of twenty-five miles per hour on the following described Parish Road:

                         Eugenne Lane (Parish Road 7-39)

SECTION 2. BE IT FURTHER ORDAINED that any person found guilty of operating or driving a motor vehicle in excess of twenty-five miles per hour on the Parish road described above, shall be guilty of a misdemeanor, and upon conviction therefore, shall be fined not more than Fifty Dollars ($50) or be imprisoned not more than ten (10) days or both.

SECTION 3. BE IT FURTHER ORDAINED that any laws or parts of laws in conflict are hereby repealed.

The Ordinance was offered by Mr. Pat Daigle, and seconded by Mr. John Humble, Sr., after being read and considered section by section, was adopted as a whole by the following vote:

A motion was offered by Mr. John Humble, Sr., seconded by Mr. Pat Daigle, to approve the Emergency Work Report for the month of March, 2001. Said expenditures to be in the amount of $485.40.

A motion was offered by Mr. John Humble, Sr., seconded by Mr. Pat Daigle, to authorize the expenditure of $500.00 to install a cross drain under St. Jules Road by the Bayou Des Cannes Nezpique Drainage District. Motion carried.

                                      
RESOLUTION

      BY: MRS CATHERINE LACOMBE AND MRS CECELIA BROUSSARD

WHEREAS, continued traffic congestion at the Intersection of LA 13, LA 100 and Frontage Road north of I-10, Crowley, has created serious problems for motorist who both patronize and reside northeast of the City of Crowley, and

WHEREAS, said location has historically been an area of high concern for safety, and

WHEREAS, attempts have been made to alleviate congestion and improve safety conditions by both local and state officials.

THEREFORE, BE IT RESOLVED by the Acadia Parish Police Jury in regular session duly convened on this the 17th day of April, 2001, does hereby request the Louisiana Department of Transportation and Development conduct the necessary traffic studies in order to determine adequate solutions to the ongoing traffic flow problem at the said intersection.

BE IT FURTHER RESOLVED that the Louisiana Department of Transportation and Development give this request their utmost and prompt attention.

SOLID WASTE/ENVIRONMENTAL

                                     
RESOLUTION

     BY: MRS CATHERINE LACOMBE AND MRS CECELIA BROUSSARD

WHEREAS, pursuant to Section III-D, Article 9-B (page 34) of the Contract for Collection and Disposal of Solid Waste between BFI and Acadia Parish Police Jury a comparative statement reflecting an increase in Base Residential Rate effective March 1, 2001 (Rate Modification Date) was presented, and

WHEREAS, calculation as provided and inspected by Mr. Stephen Lambousy with Broussard, Poché, Lewis & Breaux as outlined in Article 9-B Consumer Price Index for Urban Wage Earners and Clerical Workers for “all items” and “gasoline”.

THEREFORE, BE IT RESOLVED by the Acadia Parish Police Jury in regular session duly convened on this the 17th day of April, 2001, does hereby approve the new Residential Rate effective March 1, 2001, to be increased to $4.97 per service unit per month as provided.

BE IT FURTHER RESOLVED that the increase also be applied to the matrix of commercial fees and other special rates.

The Sales Tax Report was presented for the month of March, 2001. The report indicated a gross receipt of $1,037,700.67, an increase of $600,369.13 from March, 2000.


COMMENTS FROM THE PUBLIC

Mr. Charles King, resident of Crowley, pointed out that a roll call vote was required to amend the agenda in order to determine the actual number of votes cast. He also clarified issues related to Library Board Appointments.

THERE BEING NO FURTHER BUSINESS TO COME BEFORE THE MEETING, THE MOTION WAS OFFERED DULY SECONDED, THAT THE MEETING ADJOURN UNTIL THE NEXT REGULARLY SCHEDULED MEETING OF MAY 1, 2001, AT THE HOUR OF 6:30 P.M.
