PUBLIC HEARING

It was announced by the President, that notice had been given that the Acadia Parish Police Jury would hold a public forum on December 5, 2001, at 6:00 P.M., Police Jury Meeting Room, Courthouse Building, Crowley, Louisiana, to receive all comments on the proposed 2002 Budget.

Mr. Robert Bergeaux, Parish Road Manager, requested that re-consideration we given to Parish Road employees for the $.25 per hour raise, emphasizing the importance of employee evaluations.

Juror Cecelia Broussard agreed with the Road Manager expressing the importance of evaluations.

Juror Alton Stevenson stated he was satisfied with the $.25 per hour across the board raises.

Juror Jimmie Pellerin suggested allowing what the Road Manager requested for his employees.

Juror Catherine LaCombe disagreed with percentage raises for the Secretary of the Road Department where other secretaries would get just $.25 per hour.

President Courville advised that if the road crew would get raises based on evaluations then it would not be fair to limit others to only $.25 per hour. These issues can be worked out earlier next year. The budget was not written in stone.

Juror Cecelia Broussard as Chairperson of the Personnel Committee “I receive too many mixed feelings from the Jury”.

Juror John Beard “I’m against percentage raises”.

No further comments were offered with regard to the Proposed 2002 Budget.

THE ACADIA PARISH POLICE JURY met on the above date at 6:30 p.m., in the Police Jury Meeting Room, Courthouse Building, Crowley, Louisiana, in regular session with the President, Claude Courville, presiding. A motion was offered by Mrs. Cecelia Broussard, seconded by Mrs. Catherine LaCombe, to change item 10(a) to an update on the correctional center expansion. Motion carried.

A motion was offered by Mr. John Beard, seconded by Mr. Jimmie Pellerin, to delete item 9(a) from the agenda relating to animal control. Motion carried.

A motion was offered by Mr. Jimmie Pellerin, seconded by Mr. John Beard, to approve the Minutes of the November 20, 2001, Regular Police Jury Meeting. Motion carried.

ORDINANCE #834

          AN ORDINANCE OF THE PARISH OF ACADIA AMENDING
          ORDINANCE #756 PROVIDING FOR THE DIVISION OF TWO
          VOTING PRECINCTS INTO SMALLER VOTING PRECINCTS
          TO SATISFY THE MANDATES OF REAPPORTIONMENT
          FOLLOWING THE RELEASE OF 2000 CENSUS DATA.

WHEREAS, it was determined that two of the eight Acadia Parish voting districts did not comply with the allowable 5% deviation from the average district population, and

WHEREAS, the Acadia Parish Police Jury contracted with the Acadiana Regional Development District to develop a plan for reapportionment that would comply with all state and federal guidelines, and

WHEREAS, the plans submitted and approved by the Acadia Parish Police Jury requires the division of two voting precincts in order to achieve balance and satisfy the deviation allowances.

NOW, THEREFORE, BE IT ORDAINED

SECTION 1. All the “Whereas” clauses are incorporated herein and adopted as part of the Ordinance.

SECTION 2. The Acadia Parish Police Jury does establish new voting precincts as a result of the division of existing precincts to comply with the current reapportionment requirements.

SECTION 3. Voting precinct 6-2 is therefore split into 6-2 and 6-2a and 6-2 shall include census block nos. 220019608001030, 1031, 1032, 1054, 1055, 1056, 1057, 1058, 1059, 1060, 1061, 1062, 1063, 3000, 3001, 3002, 3003, 3055, 3056, 3057, 3058, 3071, 3072, 3073, 3074, 3086, 3087, 3088, 4011, 4012, 4013, 4018, 4019, 4020, 4021, 4022, 4026, 4027, 4029, 4030, 4031, 4032, 4033, 4034, 4035, 4036, 4037, 4038, 4039, 4040, 4041, 4042, 4043, 4044, 4045, 4046 and shall be part of Police Jury District 2.

SECTION 4. Voting precinct 6-2 is therefore split into 6-2 and 6-2a and 6-2a shall include census block nos. 220019608004007, 4010 and shall be part of Police Jury District 1.

SECTION 5. Voting precinct 3-3b is therefore split into 3-3b and 3-3c and 3-3b shall include census block nos. 220019601004002, 4003, 4004, 4005, 4006, 4007, 4008, 4009, 4010, 4011, 4012, 4013, 4014, 4015, 4016, 4017, 4018, 4019, 4020, 4021, 4022, 4023, 4024, 4029, 4030, 4031, 4032, 4033, 4034 and shall be part of Police Jury District 6.

SECTION 6. Voting precinct 3-3b is therefore split into 3-3b and 3-3c and 3-3c shall include census block nos. 220019601003016, 3017, 3027 and 3028 and shall be part of Police Jury District 7.

SECTION 7. The new voting precinct boundaries are as reflected in Exhibit “A” which is a map of all precincts indicating boundaries and numbered designations which map is on file in the Office of the Secretary of the Parish; as is reflected in Exhibit “B” which is a written description of each new precinct boundary, which is a written description on file in the Office of the Secretary of the Parish.

SECTION 8. This Ordinance once adopted shall be submitted for pre-clearance by the United States Department of Justice under the voting rights Act of 1965 as amended.

SECTION 9. All Ordinances or Resolutions or parts thereof, including, but not limited to all Ordinances or Resolutions or parts thereof of the Parish of Acadia, if any, in conflict herein are hereby repealed.

ORDINANCE #835

          AN ORDINANCE AMENDING ORDINANCE #583,
          REAPPORTIONING SINGLE MEMBER VOTING DISTRICTS
          FOR THE ACADIA PARISH POLICE JURY, ACADIA PARISH,
          LOUISIANA, IN ACCORDANCE WITH THE 2000 CENSUS.

WHEREAS, there are presently eight single member voting districts for the Parish of Acadia designated as Districts 1, 2, 3, 4, 5, 6, 7 and 8; and

WHEREAS, according to the 2000 Census of the U.S. Census Bureau, the Acadia Parish Police Jury commissioned a reapportionment study which determined that unequal apportionment of the Parish population exists and, therefore the boundaries of the eight single member voting districts should be changed to reflect as nearly as possible and equal apportionment of said population, as required by law, particularly La R.S. 33:382 and La. R.S. 33:1371.

BE IT ORDAINED by the Acadia Parish Police Jury in regular session assembled, that Ordinance No. 835 be and the same is hereby adopted as follows: to-wit:

SECTION I. (Definition of District 1)

District 1 of the Parish of Acadia shall be defined by the description contained in the attached Exhibit labeled “District 1", and including the boundaries and dimensions as shown of the plat attached hereto.

SECTION II. (Definition of District 2)

District 2 of the Parish of Acadia shall be defined by the description contained in the attached Exhibit labeled “District 2", and including the boundaries and dimensions as shown of the plat attached hereto.

SECTION III. (Definition of District 3)

District 3 of the Parish of the Parish of Acadia shall be defined by the description contained in the attached Exhibit labeled “District 3", and including the boundaries and dimensions as shown of the plat attached hereto.

SECTION IV. (Definition of District 4)

District 4 of the Parish of Acadia shall be defined by the description contained in the attached Exhibit labeled “District 4", and including the boundaries and dimensions as shown of the plat attached hereto.

SECTION V. (Definition of District 5)

District 5 of the Parish of Acadia shall be defined by the description contained in the attached Exhibit labeled “District 5", and including the boundaries and dimensions as shown of the plat attached hereto.

DEFINITION VI. (Definition of District 6)

District 6 of the Parish of Acadia shall be defined by the description contained in the attached Exhibit labeled “District 6", and including the boundaries and dimensions as shown of the plat attached hereto.

DEFINITION VII. (Definition of District 7)

District 7 of the Parish of Acadia shall be defined by the description contained in the attached Exhibit labeled “District 7", and including the boundaries and dimensions as shown of the plat attached hereto.

DEFINITION VIII. (Definition of District 8)

District 8 of the Parish of Acadia shall be defined by the description contained in the attached Exhibit labeled “District 8", and including the boundaries and dimensions as shown of the plat attached hereto.

The remainder of the provisions of Ordinance No. 583 shall remain in full force and effect. All ordinances or resolutions or parts thereof in conflict herewith are hereby repealed. This ordinance is to become effective at the end of the terms of office of the current members of the Acadia Parish Police Jury on December 31, 2004, as provided by La. R.S. 33:1371 (B).

This ordinance having been submitted to a vote in regular session of the Acadia Parish Police Jury, the vote thereon being as follows:

FINANCE

A motion was offered by Mrs. Cecelia Broussard, seconded by Mr. Jimmie Pellerin, to approve the Acadiana Criminalistic Laboratory Budget with anticipated revenues of $982,101.04 and anticipated expenditures of $982,101.04 for fiscal year 2001. Motion carried.

                                      
RESOLUTION

BE IT RESOLVED: by the Acadia Parish Police Jury in regular session duly convened this 5th day of December, 2001, does hereby adopt the 2002 annual budget with anticipated revenues in the amount of $23,804,714 and expenditures in the amount of $23,185,495 with an estimated surplus of $619,219 with the majority of the surplus funds considered dedicated monies subject to legal dedication and shall be used only for the stated purpose(s).

BE IT FURTHER RESOLVED that the Acadia Parish Police Jury has adopted the fiscal year 2002 budget by department totals and will not incur any liability for any expenditures and/or contracts for and/or beyond fiscal year 2002 which will exceed the amounts appropriated to officials, department heads, commissions or other operating agencies unless authorized by the Jury through budget amendments.

RE: 2002 Budget Overview

Dear Mr. Courville:

The Administration submits to you, the Governing Authority and to the Parish of Acadia, the Proposed 2002 Budget prepared in compliance with the Louisiana Local Government Budget Act (LRS 39:1301-1314). Many thanks to those who assisted in the completion of this document in such a timely manner.

The 2002 Balanced Budget totaling $23,185,495 provides $619,219 of revenue over expenditures, the majority of which will be compounded in the Solid Waste Closure Fund, Equipment Reserve funds and Sales Tax Fund all of which have dedicated restrictions.

The Proposed 2002 Budget contains an increase of $5,963,717 over FY 2001. This growth was primarily due to the sale of $5,000,000 of new road construction bonds secured by the collection of Rededicated Solid Waste Sales Taxes. Road Construction was also enhanced by a $500,000 Block Grant award for street repairs and a $250,000 appropriation for bridge repairs.

A net increase in spending in the General Fund of $335,000 is a direct result of the proposed $700,000 Correctional Facility Expansion Approximately $180,000 of the cost will be paid from the Parish Economic Development Fund as part of the revenue generated through lease of real estate in the Crowley/Rayne Industrial Park and approximately one half million dollars will be required from General Fund Surplus.

Other Capital Outlay expenditures would include improvements to the center ditch embankment in Crowley and the completion of the Multipurpose Facility Roof Repairs.

The Parish’s debt service remains unchanged, however, approximately $500,000 annual debt installments shifted from Solid Waste to road improvements with the same source of sales tax as security.

The Library Budget will provide approximately $164,000 less in Capital Outlay spending and the Health Unit Fund plans a total decrease of $40,000 in expenditures after providing for the three new outreach clinics.

The FY 2002 Budget has compensated for lower interest earnings and higher health care costs. In addition, the following salary increases will go into affect in January of 2002: a 5% + $.25/hour increase for the Registrar of Voters, Criminal Court and District Attorney Staff personnel, $.25/hour for the remainder of Parish employees with the exception of those who changed employee responsibilities.

As a practical matter Mr. President, the Budget remains generally unchanged. We have not made provisions for any windfall in sales taxes as a result of ongoing economic development activities and will not do so until more certainties present themselves. What is now here proposed passes the budget balance test and I remain of the opinion that if the Parish stays on the current path, you will witness continued prosperity.

PERSONNEL

A motion was offered by Mrs. Cecelia Broussard, seconded by Mrs. Catherine LaCombe, to approve the hiring of Rodney Lee Roy as the Animal Control Officer at $8.86 per hour provided all hiring requirements are met. Motion carried.


PUBLIC FACILITIES/BUILDING & GROUNDS

Legal Counsel André Doguet advised of the progress to complete a Cooperative Endeavor Agreement with the Acadia Parish Sheriff’s Office for the lease of property to construct the correctional center expansion.

BE IT RESOLVED: by the Acadia Parish Police Jury in regular session duly convened this 5th day of December, 2001, does hereby empower, authorize & direct the President to execute Change Order No. 2 to the Courthouse Weatherization Project to add in the Clock Tower, Elevator Tower and the change out of roof-exterior doors at an estimated cost of Twenty-five Thousand Seven Hundred Sixty and 00/100 ($25,760.00) Dollars, including ten additional contract days.

BE IT FURTHER RESOLVED that Ron Lawson, Architect, be instructed to obtain competitive quotes prior to awarding work on the door change out.

PUBLIC WORKS/ROAD & BRIDGE

A motion was offered by Mr. John Humble, Sr., seconded by Mr. Alton Stevenson, to authorize the purchase of culverts in the amount of $869.00 to cross Meridian Road and amend the budget in Fund 304 accordingly. Motion carried.

A motion was offered by Mrs. Cecelia Broussard, seconded by Mr. John Humble, Sr., to authorize the purchase of culverts to repair washouts on Faulk Road at the Lyons Point Gully at an estimated cost of $1,316.00 and amend the budget in Fund 304 accordingly. ORDINANCE #836

AN ORDINANCE MAKING IT UNLAWFUL FOR ANY PERSON TO OPERATE OR DRIVE A MOTOR VEHICLE UPON ALL STREETS IN CLEARVIEW PLACE SUBDIVISION IN ACADIA PARISH, LOUISIANA, AT A SPEED IN EXCESS OF
FIFTEEN MILES PER HOUR, AND, PROVIDING FOR THE PENALTIES FOR THE VIOLATION THEREOF.

SECTION 1. BE IT ORDAINED by the Police Jury of Acadia Parish, Louisiana, that it shall be unlawful for any person to operate or drive a motor vehicle in excess of fifteen miles per hour on the following described Parish Roads:

                
All Street in Clearview Place Subdivision

SECTION 2. BE IT FURTHER ORDAINED that any person found guilty of operating or driving a motor vehicle in excess of fifteen miles per hour on the Parish roads described above, shall be guilty of a misdemeanor, and upon conviction therefore, shall be fined not more than Fifty Dollars ($50) or be imprisoned not more than ten (10) days or both.

SECTION 3. BE IT FURTHER ORDAINED that any laws or parts of laws in conflict are hereby repealed.

The Ordinance was offered by Mrs. Cecelia Broussard, and seconded by Mr. John Humble, Sr., after being read and considered section by section, was adopted as a whole by the following vote:

COMMENTS FROM THE PUBLIC

Ms. Dana Comeaux asked Committee members why she was not chosen for the Animal Control position.

Mr. Joseph LeBleu, Equipment Operator with the Parish Road Crew, requested that the organization look into employee substitutions in Branch.

A motion was offered by Mr. Alton Stevenson, seconded by Mr. Pat Daigle, to revise the agenda and consider temporary help in Branch. Motion carried.

A motion was offered by Mr. Alton Stevenson, seconded by Mr. Pat Daigle, authorize temporary help as needed in the Branch Unit. Motion carried.
