CROWLEY, LOUISIANA

JUNE 19, 2001

THE ACADIA PARISH POLICE JURY met on the above date at 6:30 p.m., in the Police Jury Meeting Room, Courthouse Building, Crowley, Louisiana, in regular session with the President, Claude Courville, presiding. At the request of the President, a moment of silence was offered and the Pledge to the Flag was recited in unison. The roll was called and final attendance was recorded as follows:

A motion was offered by Mrs. Cecelia Broussard, seconded by Mr. Jimmie Pellerin, to amend the agenda and consider a request to waive permit conditions to install a water line and to remove Item “c” under Personnel from the agenda. Motion carried.

Juror John Humble, Sr., announced that Walton Farms, Inc., withdrew their request for an exemption to the environmental laws that would allow the application of sewer sludge on crop land in Acadia Parish.

A motion was offered by Mr. Jimmie Pellerin, seconded by Mr. Alton Stevenson, to approve the Minutes of the June 5, 2001, Regular Police Jury Meeting. Motion carried.


COMMUNITY/ECONOMIC DEVELOPMENT

A representative from Garan Manufacturing Inc., explained the proposed expansion and the addition of machinery to the Garan Manufacturing Plant located in Church Point.

               ENDORSEMENT RESOLUTION FOR A COMPANY TO
              PARTICIPATE IN THE ENTERPRISE ZONE PROGRAM

RESOLUTION STATING THE ACADIA PARISH POLICE JURY'S ENDORSEMENT OF GARAN MANUFACTURING, TO PARTICIPATE IN THE BENEFITS OF THE LOUISIANA ENTERPRISE ZONE PROGRAM

WHEREAS, the Louisiana Enterprise Zone act of 1981, Act 901 was enacted by the Louisiana State Legislature, and Act 337 was enacted by the 1982 Legislature, Act 433 was enacted by the 1987 Legislature and Act 581 was enacted by the 1995 Legislature, and

WHEREAS, the Louisiana Enterprise Zone Program offers significant incentives for economic development to some of the most distressed areas in the Parish of Acadia, and

WHEREAS, the Louisiana Department of Economic Development designated Census Tract 9601, Block Group 005 or Economic Development Zone in Acadia Parish as an "Enterprise Zone or Economic Development Zone" eligible based on enabling legislation (R.S.51.21.1787-1791), and

WHEREAS, the Acadia Parish Police Jury states this endorsement is in agreement with the Overall Economic Development Plan for the Parish of Acadia, and

WHEREAS, the attached Enterprise Zone map has been marked to show the location of the business being endorsed, and

WHEREAS, in accordance with the Louisiana Enterprise Zone Program requirements the Acadia Parish Police Jury agrees:

1. To participate in the enterprise zone program.

2. To assist the Department in evaluating progress made in any enterprise zone within its jurisdiction.

3. To REFUND all applicable * local sales taxes on the purchase of the material used in the construction of a building, or any addition or improvement thereon, for housing any legitimate business enterprise, and machinery and equipment used in that enterprise. This tax refund would be on materials, construction and equipment purchased for a project and used by a business permanently on that site.

BE IT RESOLVED by the Acadia Parish Police Jury in due, regular and legal session convened this 19th day of June, 2001, that Garan Manufacturing, and their project, expansion of the cut, sew & finish operations, State Application #20010168 is endorsed to participate in the Louisiana Enterprise Zone Program.

BE IT FURTHER RESOLVED that if any provision or item of this resolution or the application thereof is held invalid, such invalidity shall not affect other provisions, items or applications of this resolution which can be given effect without the invalid provisions, items or applications and to this end the provisions of this resolution are hereby declared severable.

BE IT FURTHER RESOLVED that all resolutions or parts thereof in conflict herewith are hereby repealed.

ELECTIONS

Mr. Mike Hefner with Geographic Planning & Demographic Services, LLC., submitted the Phase I Reapportionment Report to the members of the Jury. The report in summary indicated the need to make adjustments to two of the Police Jury Districts in order to comply with the reapportionment requirements.

Mr. Charles King questioned Mr. Hefner on the data used in determining the 1990 Census totals as well as on minority representations and the splitting of precincts.

A motion was offered by Mr. Alton Stevenson, seconded by Mr. John Humble, Sr., to authorize the introduction of an Ordinance declaring that a reapportionment of the election district boundaries must be conducted in order to re-balance the district population within the 5% variance and further authorize the calling of a public hearing prior to the adoption of that Ordinance. Motion carried.

                         
PROPOSED ORDINANCE #

WHEREAS, the Census 2000 count has been completed and the PL 94-171 reapportionment data was delivered to the State of Louisiana on the 13th of March, 2001, and

WHEREAS, the Acadia Parish Police Jury, under Louisiana Revised Statutes must make a determination whether reapportionment is necessary with the Census 2000 population count no later than the 13th of September, 2001, and

WHEREAS, the Jury commissioned a study to calculate the new Census 2000 population in each of the existing elections districts, and

WHEREAS, the current districts have the following Census 2000 population numbers:

WHEREAS, Districts 1 and 6 are outside the allowable +/-5% deviation from the ideal district population of 7,358.

THEREFORE, BE IT ORDAINED that the Acadia Parish Police Jury hereby declares that a reapportionment of the election district boundaries must commence in order to re-balance the district populations to within +/-5% of the ideal district population of 7,358 and that such plan, as adopted by the Jury, be submitted to the U.S. Department of Justice for Section 5 Pre-Clearance no later than March 1, 2003.

PERSONNEL

A motion was offered by Mrs. Catherine LaCombe, seconded by Mr. John Humble, Sr., to adopt the proposed Drug & Alcohol Policy as presented and revised by Legal Counsel André Doguet and made a part of the Personnel Policy & Procedures pertaining to use, possession, distribution or sale of unauthorized and/or illegal drugs while on Police Jury premises. Motion carried.

A motion was offered by Mrs. Cecelia Broussard, seconded by Mr. John Beard, to authorize the hiring of Mr. Larry Gotte at $6.25 per hour as Mower Operator for the Iota Division and Mr. Shelton Leleux at $6.25 per hour as Mower Operator for the Crowley Division effective July 1, 2001, providing all hiring requirements are met. Motion carried.


PUBLIC FACILITIES/BUILDING & GROUNDS

Architect Ron Lawson advised the Jury that no adequate bids had been submitted for Courthouse Weatherization and requested that he be allowed an extended period of time in order to obtain sufficient response to the bidding request.

No formal action was taken.


PUBLIC SAFETY

A motion was offered by Mr. John Humble, Sr., seconded by Mr. John Beard, to authorize final contract negotiations and the preparation of an Intergovernmental Agreement between the Police Jury and the Acadia Parish Sheriff’s Office for the construction and/or operation of the Correctional Center expansion. Motion carried.


PUBLIC WORKS/ROAD & BRIDGE

                                      
RESOLUTION

         BY MESSRS: JOHN HUMBLE SR AND ALTON STEVENSON

BE IT RESOLVED: by the Acadia Parish Police Jury in regular session duly convened this 19th day of June, 2001, does hereby empower, authorize & direct the President to execute an Intergovernmental Agreement with the City of Crowley and the Sixth Ward & Crowley Drainage District to construct improvements to the embankment on the Crowley Center Ditch.

BE IT FURTHER RESOLVED that the Jury agrees to pay half the materials and engineering not to exceed a total of $25,000.00 for said improvements and that the revenues be derived from General Fund Reserve Fund Balances.

A motion was offered by Mr. John Humble, Sr., seconded by Mr. Pat Daigle, to approve the request by Mr. Clarence Richard to waive the permit requirements and allow the open cut method to install a potable water service line across Clarence Lane and in addition waive the permit fees associated with that installation. Motion carried.


SOLID WASTE/ENVIRONMENTAL

                                      
RESOLUTION

WHEREAS, it was advertised according to law in the Official Journal of the Parish for the Installation of Subtitle D Liner at the Acadia Parish Sanitary Landfill.

WHEREAS, bids received were as follows:

THEREFORE, BE IT RESOLVED by the Acadia Parish Police Jury in special session duly convened this 19th day of June, 2001, does hereby concur with the recommendation of Mader-Miers Engineering to accept the low bid submitted by Environmental Specialties International in the amount of Two Hundred Ninety-nine Thousand Six Hundred Seventy-eight and 00/100 ($299,678.00) Dollars.

BE IT FURTHER RESOLVED that the President of this Police Jury be and he is hereby empowered, authorized and directed to execute a contract with Environmental Specialities International, on behalf of, in the name and under the seal of the Acadia Parish Police Jury relative to the purchase of said liners.

LITIGATION

No action was taken regarding the settlement request in the case of John Guidry vs. Acadia Parish Police Jury Docket #68,257.

The Sales Tax Report was presented for the month of May, 2001. The report indicated a gross receipt of $414,005.82 an increase of $75,917.41 from May, 2000.


COMMENTS FROM THE PUBLIC

President Courville announced the date of the Region 7 Meeting to be held in Acadia Parish on September 22, 2001. All members of the Jury volunteered to serve as a Committee to prepare for that meeting.

July 2, 2001, was tentatively set as an informal meeting to discuss local tax renewals.

Juror Alton Stevenson inquired about the status of the Interstate Light Repair Project. He suggested that an update be offered at each subsequent meeting.
