Legal Counsel André Doguet reported on the application of
preferences for materials produced, manufactured or assembled within
the State of Louisiana advising that bids for metal pipe and

RESOLUTION
A Resolution approving the issuance, sale and delivery of Two
Hundred Thousand Dollars ($200,000) of Certificates of Indebtedness,
Series 2001, of Fire Protection District No. 6 of the Parish of
Acadia, State of Louisiana, and other matters relating thereto.
WHEREAS, the Board of
Commissioners of Fire Protection District No. 6 of the Parish of
Acadia, State of Louisiana, by resolution adopted on May 21, 2001,
has authorized the issuance of $200,000 of Certificates of
Indebtedness, Series 2001 (the “Certificates”), for the purposes of
(i) acquiring and equipping a new fire truck, (ii) acquiring other
equipment necessary to provide fire protection in the Issuer, and
(iii) paying the costs of issuance of the Certificates, under the
authority conferred by Section 742.2 of Title 39 of the Louisiana
Revised Statutes of 1950, as amended (R.S. 39:742.2) (the “Act”),
and other constitutional and statutory authority.
WHEREAS, it is now the desire
of the Police Jury of the Parish of Acadia, State of Louisiana, to
approve the issuance of the Certificates;
NOW, THEREFORE, BE IT RESOLVED
by the Police Jury of the Parish of Acadia, State of Louisiana (the
“Police Jury”), acting as the governing authority of the Parish of
Acadia, State of Louisiana:
SECTION 1. That, in compliance
with the provisions of Article VI, Section 15 of the Constitution of
the State of Louisiana of 1974, and in accordance with the request
of the Board of Commissioners of Fire Protection District No. 6, of
the Parish of Acadia, State of Louisiana, this Police Jury hereby
approves the issuance of Two Hundred Thousand Dollars ($200,000) of
Certificates of Indebtedness, Series 2001, of Fire Protection
District No. 6 of the Parish of Acadia, State of Louisiana, said
Certificates to be issued under the authority and for the purposes
stated in the preamble hereto.
SECTION 2. That neither the
Parish nor this Police Jury shall be liable in any manner for the

ORDINANCE #828
AN ORDINANCE AMENDING ORIGINAL ORDINANCE NO. 345, TO MODIFY THE
PROVISIONS GOVERNING THE REGULATION OF VEHICULAR TRAFFIC AT THE
LEGROS MEMORIAL AIRPORT AND TO PROVIDE FOR SPECIAL OPERATIONS
PROCEDURES DURING THE CROP GROWING SEASON.
BE IT ORDAINED by the Police
Jury of Acadia Parish, Louisiana in regular session on this 5th day
of June, 2001, an Ordinance amending Ordinance No. 345, to modify
the provisions governing the regulation of vehicular traffic at the
LeGros Memorial Airport and to provide for special operations
procedures during the crop growing season, as follows:
REGULATIONS
GOVERNING VEHICULAR TRAFFIC
1. No person shall operate any motor vehicle on the Airport
otherwise than in strict accordance with the applicable provisions
of these regulations and applicable Federal, State and Municipal
laws, codes and other similar regulatory measures, now in existence
or as may hereafter be modified or amended.
2. NORMAL OPERATIONS: All private and commercial vehicles must
remain clear of and are not to be operated on/near active runways
and taxiways. Except for Special Operations discussed below, only
FAA, State, and other official vehicles approved by the Airport
Owner–for the explicit purpose of performing official aviation
functions–may be allowed on airport runways and taxiways.
Additionally, all vehicles in excess of 15,000 pounds except those
vehicles servicing Fixed Based Operations, will remain clear of
Nighthawk Road and may access the airport only by other roads
designated for commercial/heavy vehicle operations once construction
of the commercial access road(s) are complete(d).
(3)(A) SPECIAL OPERATIONS: The Airport Authority’s designated
representative may approve a brief period (approximately one week)
for Special Operations for Commercial Owners/Operators in which the
Owners/Operators may use pre-designated alternate areas of the
airport for loading and application of seed rice, fertilizer and/or
herbicide if both of the following circumstances exist:
1. Following a period of extensive rainfall during the crop-growing
season when there exists a very narrow window of opportunity to
successfully sow rice seed during the germination period and/or
apply fertilizer and/or herbicide.
2. The designated operating areas for commercial users will be
unable to accommodate all the aircraft that need to load and fly for
the purpose set forth above.
(3)(B) Under the aforementioned circumstances, the Airport
Authority’s Designee may implement Special Operations in designated
alternate areas of the airport (including aprons and taxiways–but
not runways) where Commercial Owners/Operators may temporarily
operate heavy vehicles. Additionally, four (4) hours prior to
implementing each specified period for special operations, the
Airport Authority’s Designee will notify the DeRidder Flight Service
to publish a Notice to Airmen (NOTAM) pertaining to the
implementation of Special Operations, including the closure of
specific taxiways and aprons and the specific period of closure.
Once implemented, the Airport Authority’s Designee will also notify
the DOTD/Aviation Division in writing that Special Operations have
been initiated and will specify the period for which these
procedures will be in effect.
4. It shall be unlawful for the operator of any vehicle to fail to
give proper signals or to ignore or disobey the instructions of any
official traffic sign placed in accordance with these regulations
unless otherwise directed by a traffic officer.
5. Pedestrians and aircraft shall at all times have right-of-way
over vehicular traffic. All vehicles shall pass to the rear of
taxiing aircraft.
6. Before crossing runways or taxiways of authorized vehicles,
drivers will insure by personal observation that no aircraft is
approaching his position.
7. When parking adjacent to a runway, all vehicles must park
parallel to the runway and at least 50 feet laterally outside of the
runway lights.
8. Heavy trucks in excess of 20,000 lbs. single axle load will not
be permitted on runways or taxiways. A fine of fifty ($50) dollars
and the cost of repairing any damage caused by such truck will be
levied against the owner/operator of said truck for the first
violation. Subsequent violations may result in the additional
penalty of prohibition of use of the airport by said owner/operator
as provided in Paragraph 21 below.
9. No person shall operator a motor vehicle of any kind on the
Airport in a reckless or negligent manner nor in such a manner that
it is not under safe and proper control at all times, weather and
traffic conditions considered.
10. No person shall operate any vehicle other than authorized
emergency and maintenance vehicles on the Airport at a speed in
excess of 25 miles per hour, unless otherwise posted.
11. No person under the influence of liquor or narcotic drugs shall
operate a motor vehicle or aircraft on the Airport.
12. No person shall ride on the running board, stand up in the body
of moving vehicles, ride on the outside of the body of a vehicle, or
with arms or legs protruding from the body of motor vehicles, other
than crash, fire and rescue vehicles designed for standing
personnel.
13. No person shall operate a motor vehicle which is so constructed,
equipped or loaded or in such physical or mechanical condition as to
endanger persons or property, or which had attached thereto any
object or equipment which is being towed, or drags, or swings, or
projects so as to be hazardous to persons or property upon the
Airport.
14. No person shall operate a motor scooter, truck or other motor
vehicle in any hangar or the Airport without exhausts protected by
screens or baffles to prevent the escape of sparks or the
propagation of flame.
15. No person shall clean or make any repairs to vehicles anywhere
within the Airport boundary other than in shop or other areas
designated for such purposes, except minor repairs necessary to
remove such vehicles from the Airport, nor shall any person move,
interfere or tamper with any vehicle or put in motion the engine or
take or use any vehicle part, instrument or tool thereof without
permission of the owner or satisfactory evidence of the right to do
so presented to the Airport Manager.
16. Emergency conditions existing at any time on the Airport air
operations area will not mitigate or cancel these regulations.
During such conditions, the driver of any vehicle, civilian or
military, will make certain that he does not move his vehicle in any
direction unless specifically cleared to do so. The Airport
Authority shall determine when normal operations may be resumed.
17. Vehicles shall be registered, in accordance with the laws of the
State of Louisiana unless said vehicle is specifically authorized by
the Airport Authority to be operated in such areas.
18. Vehicles shall have an overhead yellow or red flashing light
displayed or display a checkered flag, not less than one and
one-half (1 ½’) feet square, of international orange and white in
accordance with FAA AC 150/5210-5.
19. In the interest of safety, the Airport Authority is authorized
to open or close areas as necessary.
20. Auto access lanes may be designated by the Police Jury or
Airport Authority as necessary.
21. Any person found to be in violation of vehicular traffic or
parking regulations as specified herein may be denied permission by
the Airport Manager to operate a vehicle upon the Airport premises.

The proposed Drug & Alcohol Policy presented to the Personnel
Committee for review was reviewed by Legal Counsel André Doguet.
Counsel will provide a completed document for adoption at the next
regular meeting.
A motion was offered by Mrs. Catherine LaCombe, seconded by Mr. John
Humble, Sr., to ratify the decision made by the Parish Road Manager
to advertise for the positions of Mower Operators for Crowley and
Iota. Motion carried.
PUBLIC SAFETY
Representatives from the Mire Volunteer Fire Department requested
that the Jury consider the needs of the fire district and support an
application for a Community Development Block Grant to assist with
the construction of a new fire station. It was noted, that the grant
application period would likely be in December and that public
comments would be received prior to that date.
No action was taken.
RESOLUTION OF ACCEPTANCE
The following resolution was offered by Mrs. Cecelia Broussard, duly
seconded by Mr. John Humble, Sr., and duly resolved and adopted on
June 5, 2001.
A resolution authorizing and directing the President to execute for
and on behalf of the Acadia Parish Police Jury, an Act of Acceptance
for Fruge Lumber Company, Inc., Contractor, pertaining to the
substantial completion of the contract subject to a punch list, for
Fire Station Addition - District No. 8 in Lyons Point, in accordance
with the plans and specifications contained in the contract
documents pertaining thereto.
WHEREAS, Fruge Lumber Company,
Inc, as Contractor, has substantially completed the Fire Station
Addition - District No. 8 in Lyons Point, in accordance with the
plans and specifications contained in the contract documents
pertaining thereto; and
WHEREAS, the Acadia Parish
Police Jury desires to accept the completed work;
NOW, THEREFORE, BE IT RESOLVED
by the Acadia Parish Police Jury that the President of said Acadia
Parish Police Jury be, and is hereby empowered, authorized and
directed to execute an Act of Acceptance for and on behalf of the
Acadia Parish Police Jury accepting the work as being substantially
completed, and that he be authorized and directed to have a copy of
said acceptance recorded in the Conveyance Records of the Parish of

Engineer Tim Mader provided a comprehensive report on the cost to
stabilize the embankment on parts of the Crowley Center Ditch. He
estimated that two of the three part plan would cost approximately
$50,000 and would include all engineering, contingencies and would
provide for the purchase of materials. The work would be provided as
inkind by the local drainage district.
The Jury suggested that Juror Alton Stevenson attend the next Public
Works Committee Meeting of the Crowley City Council to encourage
participation by the City.
No formal action was taken.
A motion was offered by Mrs. Cecelia Broussard, seconded by Mrs.
Catherine LaCombe, to authorize the Parish Engineer to present the
project information to the City of Crowley for review. Motion
carried.
A motion was offered by Mr. Alton Stevenson, seconded by Mr. Pat
Daigle, to approve the request made by St. Thomas Moore Church to
assist with the construction of an access road to the church
cemetery. Motion carried.
ORDINANCE #829
AN ORDINANCE MAKING IT UNLAWFUL FOR ANY PERSON TO OPERATE OR DRIVE A
MOTOR VEHICLE UPON TEPETATE ROAD (PRIMARY ROAD 11) IN ACADIA PARISH,
LOUISIANA, WITH A GROSS WEIGHT IN EXCESS OF TWENTY (20) TONS, AND
PROVIDING FOR THE PENALTIES FOR THE VIOLATION THEREOF.
SECTION 1. BE IT ORDAINED by
the Police Jury of Acadia Parish, Louisiana, that it shall be
unlawful for any person except local farmers during harvest and
garbage truck drivers to operate a motor vehicle with a gross weight
in excess of Twenty (20) Tons on the following described Parish
road:

from 368 to 3068
SECTION 2. BE IT FURTHER ORDAINED
that any person found guilty of operating or driving a motor vehicle
with a gross weight exceeding Twenty (20) Tons on the Parish road
described above, shall be guilty of a misdemeanor, and upon
conviction therefore, shall be fined nor more than Fifty Dollars
($50) or be imprisoned not more than ten (10) days or both.
SECTION 3. BE IT FURTHER ORDAINED
that any laws or parts of laws in
conflict are hereby repealed.
The Ordinance was offered by Mr. John Humble, Sr., seconded by Mr.
Pat Daigle, and after being read and considered section by section,
was adopted as a whole by the following vote:

A motion was offered by Mrs. Cecelia Broussard, seconded by Mr.
Alton Stevenson, to approve the request to purchase small tools for
the Parish inmate program out of the Solid Waste and Health Unit
Funds in the amount of $2,000.00 from each fund. Motion carried.
SOLID WASTE/ENVIRONMENTAL
Juror John Humble, Sr., expressed concern over a request for an
exemption to State Environmental Laws that would allow the
disposition of solid waste sludge over crop land in Acadia Parish.
RESOLUTION
WHEREAS, public notice was
given that Walton Farms, Inc., 2469 South LeBlanc Road, Morse,
Louisiana, 70559 does intend to submit to the Department of
Environmental Quality, Office of Environmental Services, Permits
Division, a request for an exemption of LAC Title 33, VII 1103A to
operate a Beneficial Use Solid Waste Facility for the land
application of sewage sludge in Acadia Parish and,
WHEREAS, said application is
intended for agricultural land in the Fifth Ward of Acadia Parish
and there is much skepticism and a lack of knowledge regarding the
proposal.
WHEREAS, local residents of
the targeted areas, Agricultural Marketing Specialists, health
interests and local politicians voiced strong objections to granting
exemptions from such environmental laws.
THEREFORE, BE IT RESOLVED by
the Acadia Parish Police Jury in regular session duly convened this
5th day of June, 2001, does hereby object to the Louisiana
Department of Environmental Quality granting an exemption of LAC
Title 33 VII 1103A to Walton Farms, Inc., 2469 South LeBlanc Road,
Morse, Louisiana, for the application of sewage sludge on land in
Acadia Parish.
BE IT FURTHER RESOLVED that an
opportunity for open public hearings be granted in these local areas
and that any and all similar requests made subject to involving
systems of land in Acadia Parish be denied.
BE IT FURTHER RESOLVED that a
copy of this resolution be sent to the Secretary of the Department
of Environmental Quality and the Acadia Parish Legislative
Delegation.

LITIGATION
A motion was offered by Mrs. Catherine LaCombe, seconded by Mrs.
Cecelia Broussard, to adjourn into executive session to consider the
matter related to the Town of Duson with regard to Video Poker
Revenue Docket #75,890E. The following roll call vote was cast:

Broussard, Jimmie Pellerin, John Beard, Pat Daigle and Claude
Courville. Motion carried.
Following the executive session the President reconvened the
meeting.
A motion was offered by Mr. John Humble, Sr., seconded by Mr. Pat
Daigle, to approve the hiring of Professor Lee Hargrave as a
professional witness to aide in the litigation as an expert witness
at the rate of $150.00 per hour contingent upon the Sheriff’s
agreeing to pay half the cost. Motion carried.
The Sales Tax Report was presented for the month of April, 2001. The
report indicated a gross receipt of $553,442.25, an increase of
$143,955.12 from April, 2000.
