CROWLEY, LOUISIANA

MARCH 6, 2001

THE ACADIA PARISH POLICE JURY met on the above date at 6:30 p.m., in the Police Jury Meeting Room, Courthouse Building, Crowley, Louisiana, in regular session with the President, Claude Courville, presiding. At the request of the President, a moment of silence was offered and the Pledge to the Flag was recited in unison. The roll was called and final attendance was recorded as follows:

A motion was offered by Mrs Cecelia Broussard, seconded by Mr. Jimmie Pellerin, to revise the agenda to consider a request for a waiver of pipeline permit conditions and discussion on the Crowley Health Unit Parking Lot. Motion carried.

A motion was offered by Mr. Jimmie Pellerin, seconded by Mr. John Beard, to approve the Minutes of the February 20, 2001, Regular Police Jury Meeting. Motion carried.


ELECTIONS

Mr. Stan McGee, representing the Acadiana Regional Development District, introduced Mr. Mike Hefner, subcontracted by the Agency, to provide Reapportionment Services for the Planning District.

Mr. McGee pointed out the U.S. Constitution and subsequent State and Federal Laws require the reapportionment of voting districts for all Parish-level governmental bodies and municipalities according to the 2000 Decennial Census population. Subsequent to redistricting, the plan must meet the requirements of the Federal Voting Rights Act of 1965 through a pre-clearance process established under Section 5 of the Act. He requested that the Jury consider contracting through the Regional Planning District for services provided by Mr. Hefner, Geographic Planning and Demographic Services, for the reapportionment of the Acadia Parish Police Jury Districts.

Registrar of Voters Billie Meyer stated that Mr. Hefner came highly recommended following contact with other Registrar of Voters in this area.

                                      
RESOLUTION

         BY MESSRS: JOHN HUMBLE SR AND ALTON STEVENSON

BE IT RESOLVED: by the Acadia Parish Police Jury in regular session duly convened this 6th day of March, 2001, does hereby empower, authorize and direct the President to execute a contract through the Acadiana Regional Development District for the purpose of the reapportionment of Police Jury Districts based on the 2000 Decennial Census.

BE IT FURTHER RESOLVED that the completed contractual services shall not exceed a total of $14,900.00.

RESOLUTION

      BY: MRS CECELIA BROUSSARD AND MRS CATHERINE LACOMBE

BE IT RESOLVED: by the Acadia Parish Police Jury that the President and Secretary advertise for bids for the leasing of the oil, gas and mineral rights in and under the following described property, to-wit:

          That portion of Acadia Parish Road No. 6-39, in Section 39,
          Township 10 South, Range 2 East, and possibly in Section
          38, Township 10 South, Range 1 East, Acadia Parish,
          Louisiana, lying and being situated within the geographical
          boundaries of the HET RA SUA, defined by State of Louisiana
          Office of Conservation Order No. 448-R, Perry Point Field,
          dated effective August 25, 1998, but outside the
          geographical boundaries of the BOL M RB SUA as defined by
          the State of Louisiana Office of Conservation Order No.
          448-P, Perry Point Field, dated effective July 14, 1992,
          estimated to contain 1.0 acre, more or less.

          It is the intention of the Lessor and Lessee herein to include
          all of the lands owned by Lessor lying within the HET RA SUA,
          but outside the BOL M RB SUA, whether properly described or
          not. Being a total of 1.0 acre, more or less, to be leased.

All bids to offer a cash bonus for a lease having a primary term which shall not exceed three (3) years. Minimum royalties shall be one-quarter (¼) of all oil, including condensate or other liquid minerals, produced and saved; one-quarter (¼) of the value of all gas, including casinghead gas, produced and saved or utilized by methods considered as ordinary production methods at the time of production; one-quarter (¼) of any and all other liquid or gaseous minerals in solution and produced with oil or gas and saved or utilized, which are not specifically mentioned herein.

Should lessee fail to begin operations for the drilling of a well on the leased premises within one (1) year from the date of the lease, the lease shall terminate as to both parties to the lease, unless on or before such anniversary date Lessee shall pay a delay rental (which shall in no event be less than one-half (½) of the bonus offered), which shall cover the privilege of deferring drilling operations for a period of one (1) year. Upon like payments annually, drilling operations may be further deferred for successive periods of one (1) year each during the primary term. The primary term of the lease shall be three (3) years.

Certified check, cashier's check or bank money order, payable to the Acadia Parish Police Jury for the full amount of the cash bonus shall accompany and be deposited with each bid, and no bid when deposited may be thereafter withdrawn or canceled and the cash bonus thus deposited shall be forfeited to the Acadia Parish Police Jury by the successful bidder in the event said bidder does not enter into a written contract within twenty (20) days after the written lease is submitted to him for execution. All bids to be submitted on Louisiana State Mineral Board bid form. Any lease awarded on the above lands shall be subject to the approval of the State Mineral Board.

The Acadia Parish Police Jury reserves the right to reject any and all bids and to grant a lease on any portion of the tracts advertised for a price not less than proportionate to the best bid offered for the lease of the entire tract.

PUBLIC FACILITIES/BUILDING & GROUNDS

Engineer Tim Mader provided an update on plans to find a suitable permanent site for the Parish Animal Shelter. The summary included the problems that existed with siting the facility at the LeGros Memorial Airport.

Questions were raised over the siting of the Shelter at the Parish Landfill. The primary concern being use of the proceeds of the dedicated tax for the purpose of animal control. The matter was referred to Legal Counsel.

A motion was offered by Mrs. Cecelia Broussard, seconded by Mr. Jimmie Pellerin, to approve the request to waive the permitting conditions for an irrigation pipeline installation by Mr. J. W. Zaunbrecher on Labas Road and allow the open cut method for that installation. Motion carried.

Mr. John Quebodeaux explained the existing problems with the heavy vehicular traffic crossing through the Parish Health Unit parking lot on Mill Street, Crowley. He was advised to meet with City Officials to resolve the issue.


LITIGATION

A motion was offered by Mrs. Cecelia Broussard, seconded by Mrs. Catherine LaCombe, to adjourn into executive session to discuss pending litigation related to Jail Overcrowding Docket #75,718-K. The following roll call vote was cast: Yeas: Alton Stevenson, Catherine LaCombe, John Humble, Sr., Cecelia Broussard, Jimmie Pellerin, John Beard, Pat Daigle and Claude Courville. Motion carried.

The Jury reconvened following executive session.

                                     
RESOLUTION

              BY MESSRS: JOHN HUMBLE SR AND PAT DAIGLE

WHEREAS, continued overcrowding at the Acadia Parish Jail Facility has created serious concern from both Sheriff’s Office Officials as well as the Office of Public Health, and

WHEREAS, continued deterioration of the existing Parish Jail Facility has compounded the serious nature of the overcrowding conditions, and

WHEREAS, formal litigation has been filed by the Acadia Parish Sheriff’s Office to alleviate the continued overcrowding problems citing the need to provide additional space for future arrests.

THEREFORE, BE IT RESOLVED by the Acadia Parish Police Jury in regular session duly convened on this the 6th day of March, 2001, does hereby unanimously declare the overcrowding conditions at the Acadia Parish Jail serious and emergency in nature.

BE IT FURTHER RESOLVED that the Acadia Parish Police Jury does hereby acknowledge their intention to take exception to the public bid law and construct through immediate negotiations a semi-permanent expansion sufficient enough to alleviate the current conditions that exist.

BE IT FURTHER RESOLVED that this public notice be published in the Official Journal for two consecutive weeks following the adoption of this Resolution.
