PUBLIC HEARING

Parish President Claude Courville convened the public hearing as advertised at 6:00 p.m., in the Police Jury Meeting Room, to receive comments on the proposed reapportionment plans for the Acadia Parish Police Jury following the 2000 census.

Mr. Charles King submitted a plan for review. The plan called for the moving of whole precincts and was considered the citizen’s plan. The new proposed districts were within the 5% deviation.

Mr. Mike Hefner submitted “Plan I” for review. His plan required the divisions of two precincts into smaller precincts in order to balance the districts within the 5% deviation.

Mr. King felt that Mr. Hefner could not submit a plan that would concentrate minority strength in one district and weaken it in another.

Mr. Hefner pointed out that the issue was valid when taking a district and combining it with another. Sixty percent minority population is not an issue in this case.

THERE BEING NO FURTHER COMMENTS TO COME BEFORE THE JURY, THE PRESIDENT ADJOURNED THE PUBLIC HEARING.

THE ACADIA PARISH POLICE JURY met on the above date at 6:30 p.m., in the Police Jury Meeting Room, Courthouse Building, Crowley, Louisiana, in regular session with the President, Claude Courville, presiding. At the request of the President, a moment of silence was offered and the Pledge to the Flag was recited in unison. The roll was called and final attendance was recorded as follows:

A motion was offered by Mrs. Catherine LaCombe, seconded by Mr. Pat Daigle, to revise the agenda to consider authorization for contract to repair the landfill liner, approval of special permit conditions and adoption of a resolution regarding Louisiana Right To Know Act. Motion carried.

A motion was offered by Mr. Jimmie Pellerin, seconded by Mr. John Beard, to approve the Minutes of the November 7, 2001, Regular Police Jury Meeting. Motion carried.


ELECTIONS

The following Resolution was offered by Mr. John Humble, Sr., and seconded by Mrs. Catherine LaCombe:

                                      
RESOLUTION

          A resolution providing for canvassing the returns and
          declaring the results of the special election held in the
          Parish of Acadia, State of Louisiana, on Saturday,
          November 17, 2001, to authorize the levy of special
          taxes and the levy of a sales and use tax therein.

BE IT RESOLVED by the Police Jury of the Parish of Acadia, State of Louisiana (the “Governing Authority”), acting as the governing authority of the Parish of Acadia, State of Louisiana (the “Parish”), that:

SECTION 1. Canvass. This Governing Authority does now proceed in open and public session to examine the official tabulations of votes cast at the special election held in the Parish of Acadia, State of Louisiana, (the “Parish”), on SATURDAY, NOVEMBER 17, 2001, to authorize the levy of special taxes and to authorize the levy of a sales and use tax therein, and said Governing Authority does further proceed to examine and canvass the returns and declare the results of the special election.

SECTION 2. Procés Verbal. A Procés Verbal of the canvass of the returns of said election shall be made and a certified copy thereof shall be forwarded to the Secretary of State, Baton Rouge, Louisiana, who shall record the same in his office; another certified copy thereof shall be forwarded to the Clerk of Court and Ex-Officio Recorder of Mortgages in and for the Parish of Acadia, who shall record the same in the Mortgage Records of said Parish; and another copy thereof shall be retained in the archives of this Governing Authority.

SECTION 3. Promulgation of Election Results. The results of said election shall be promulgated by publication in the manner provided by law.

This resolution having been submitted to a vote, the vote thereon was as follows:

PROCÉS VERBAL AND PROCLAMATION OF THE CANVASS OF THE VOTES CAST AT THE SPECIAL ELECTION HELD IN THE PARISH OF ACADIA, STATE OF LOUISIANA, ON SATURDAY, NOVEMBER 17, 2001.

BE IT KNOWN AND REMEMBERED that on Tuesday, November 20, 2001, at six-thirty o’clock (6:30) p.m., at its regular meeting place, the Police Jury Room of the Courthouse, Crowley, Louisiana, the Police Jury of the Parish of Acadia, State of Louisiana (the “Governing Authority”), acting as the governing authority of the Parish of Acadia, State of Louisiana (the “Parish”), and being the authority ordering the special election held therein on Saturday, November 17, 2001, with the following members present:

          PARISHWIDE MOSQUITO CONTROL PROGRAM, INCLUDING
          THE COST OF ACQUIRING LAND, BUILDINGS AND EQUIPMENT
          NECESSARY IN CONNECTION THEREWITH, WITH AUTHORITY
          TO FUND THE PROCEEDS OF THE TAX INTO BONDS TO PAY
          THE COST OF CAPITAL IMPROVEMENTS FOR SUCH
          PURPOSES.

          Shall the Parish of Acadia, State of Louisiana (the “Parish”),
          under the provisions of Article VI, Section 29 of the
          Constitution of the State of Louisiana of 1974, and other
          constitutional and statutory authority, be authorized to
          levy and collect a tax of one-fourth of one percent (1/4%)
          (the “Tax”) for a period of ten (10) years from the date of
          the first levy of the Tax upon the sale at retail, the use, the
          lease or rental, the consumption, and the storage for use or
          consumption, of tangible personal property and on sales of
          services within the Parish, all as defined in R.S. 47:301
          through 47:317, with the proceeds of the Tax (after paying
          the reasonable and necessary costs and expenses of
          collecting and administering the Tax) to be dedicated and
          used for the purpose of paying the cost of maintaining and
          operating a parishwide mosquito control program, including
          the cost of acquiring land, buildings and equipment
          necessary in connection therewith; and further, shall the
          Parish be authorized to fund the proceeds of the Tax into
          bonds to pay the cost of capital improvements for such
          purposes to the extent and in the manner permitted by the
          laws of Louisiana?

There was found by said count and canvass that the following votes had been cast at the said special election

The polling places above specified being the only polling places designated at which to hold the said election, it was therefore shown that

          (i) there was a total of 1,945 votes cast

AGAINST Proposition No. 1, as hereinabove set forth,
          and that there was a majority of 914 votes cast

            FAVOR OF Proposition No. 1 as hereinabove set forth;

          (ii) there was a total of 1,907 votes cast
IN FAVOR OF
          Proposition No. 2 and a total of 1,061 votes cast
         
AGAINST Proposition No. 2, as hereinabove set forth,
          and that there was a majority of 846 votes cast

          (iii) there was a total of 1,269 votes cast

Therefore, the Governing Authority did declare and proclaim and does hereby declare and proclaim in open and public session that Proposition No. 1 as hereinabove set forth was duly
CARRIED; that Proposition No. 2 as hereinabove set forth was duly CARRIED; and that Proposition No. 3 as hereinabove set forth was duly DEFEATED by a majority of the votes cast by the qualified electors voting at the said special election held in the Parish on Saturday, November 17, 2001.

PROCLAMATION

I, the undersigned President of the Police Jury of the Parish of Acadia, State of Louisiana, the governing authority of the Parish of Acadia, State of Louisiana (the “Parish”), do hereby declare, proclaim and announce that Proposition No. 1 and Proposition No. 2 submitted at the special election held in the Parish on Saturday, November 17, 2001 were
CARRIED by a majority of the votes cast at the said special election; and that Proposition No. 3 was DEFEATED by a majority of the votes cast at the said special election, all as described and set out in the above Procés Verbal.

President Courville and Vice President Humble offered comments relative to the defeat of the 1/4 cent sales tax proposition for mosquito control.

A motion was offered by Mrs. Catherine LaCombe, seconded by Mr. Pat Daigle, to approve the plan for reapportionment submitted by Mr. Mike Hefner for the reapportionment of voting districts for the Acadia Parish Police Jury. Motion carried.

A motion was offered by Mr. John Humble, Sr., seconded by Mr. Pat Daigle, to authorize the introduction of ordinances providing for the creation of two new voting precincts and defining the new eight voting district boundaries for the Police Jury. Motion carried.

                                     
ORDINANCE #

          AN ORDINANCE OF THE PARISH OF ACADIA AMENDING
          ORDINANCE #756 PROVIDING FOR THE DIVISION OF
          TWO VOTING PRECINCTS INTO SMALLER VOTING
          PRECINCTS TO SATISFY THE MANDATES OF
          REAPPORTIONMENT FOLLOWING THE RELEASE OF
          2000 CENSUS DATA.

WHEREAS, it was determined that two of the eight Acadia Parish voting districts did not comply with the allowable 5% deviation from the average district population, and

WHEREAS, the Acadia Parish Police Jury contracted with the Acadiana Regional Development District to develop a plan for reapportionment that would comply with all state and federal guidelines, and

WHEREAS, the plans submitted and approved by the Acadia Parish Police Jury requires the division of two voting precincts in order to achieve balance and satisfy the deviation allowances.

NOW, THEREFORE, BE IT ORDAINED

SECTION 1. All the “Whereas” clauses are incorporated herein and adopted as part of the Ordinance.

SECTION 2. The Acadia Parish Police Jury does establish new voting precincts as a result of the division of existing precincts to comply with the current reapportionment requirements.

SECTION 3. Voting precinct 6-2 is therefore split into 6-2 and 6-2a and 6-2 shall include census block nos. 220019608001030, 1031, 1032, 1054, 1055, 1056, 1057, 1058, 1059, 1060, 1061, 1062, 1063, 3000, 3001, 3002, 3003, 3055, 3056, 3057, 3058, 3071, 3072, 3073, 3074, 3086, 3087, 3088, 4011, 4012, 4013, 4018, 4019, 4020, 4021, 4022, 4026, 4027, 4029, 4030, 4031, 4032, 4033, 4034, 4035, 4036, 4037, 4038, 4039, 4040, 4041, 4042, 4043, 4044, 4045, 4046 and shall be part of Police Jury District 2.

SECTION 4. Voting precinct 6-2 is therefore split into 6-2 and 6-2a and 6-2a shall include census block nos. 220019608004007, 4010 and shall be part of Police Jury District 1.

SECTION 5. Voting precinct 3-3b is therefore split into 3-3b and 3-3c and 3-3b shall include census block nos. 220019601004002, 4003, 4004, 4005, 4006, 4007, 4008, 4009, 4010, 4011, 4012, 4013, 4014, 4015, 4016, 4017, 4018, 4019, 4020, 4021, 4022, 4023, 4024, 4029, 4030, 4031, 4032, 4033, 4034 and shall be part of Police Jury District 6.

SECTION 6. Voting precinct 3-3b is therefore split into 3-3b and 3-3c and 3-3c shall include census block nos. 220019601003016, 3017, 3027 and 3028 and shall be part of Police Jury District 7.

SECTION 7. The new voting precinct boundaries are as reflected in Exhibit “A” which is a map of all precincts indicating boundaries and numbered designations which map is on file in the Office of the Secretary of the Parish; as is reflected in Exhibit “B” which is a written description of each new precinct boundary, which is a written description on file in the Office of the Secretary of the Parish.

SECTION 8. This Ordinance once adopted shall be submitted for pre-clearance by the United States Department of Justice under the voting rights Act of 1965 as amended.

SECTION 9. All Ordinances or Resolutions or parts thereof, including, but not limited to all Ordinances or Resolutions or parts thereof of the Parish of Acadia, if any, in conflict herein are hereby repealed.

ORDINANCE #

          AN ORDINANCE AMENDING ORDINANCE #583,
          REAPPORTIONING SINGLE MEMBER VOTING DISTRICTS
          FOR THE ACADIA PARISH POLICE JURY, ACADIA
          PARISH, LOUISIANA, IN ACCORDANCE WITH THE 2000
          CENSUS.

WHEREAS, there are presently eight single member voting districts for the Parish of Acadia designated as Districts 1, 2, 3, 4, 5, 6, 7 and 8; and

WHEREAS, according to the 2000 Census of the U.S. Census Bureau, the Acadia Parish Police Jury commissioned a reapportionment study which determined that unequal apportionment of the Parish population exists and, therefore the boundaries of the eight single member voting districts should be changed to reflect as nearly as possible and equal apportionment of said population, as required by law, particularly La R.S. 33:382 and La. R.S. 33:1371.

BE IT ORDAINED by the Acadia Parish Police Jury in regular session assembled, that Ordinance No.             be and the same is hereby adopted as follows: to-wit:

SECTION I. (Definition of District 1)

District 1 of the Parish of Acadia shall be defined by the description contained in the attached Exhibit labeled “District 1", and including the boundaries and dimensions as shown of the plat attached hereto.

SECTION II. (Definition of District 2)

District 2 of the Parish of Acadia shall be defined by the description contained in the attached Exhibit labeled “District 2", and including the boundaries and dimensions as shown of the plat attached hereto.

SECTION III. (Definition of District 3)

District 3 of the Parish of the Parish of Acadia shall be defined by the description contained in the attached Exhibit labeled “District 3", and including the boundaries and dimensions as shown of the plat attached hereto.

SECTION IV. (Definition of District 4)

District 4 of the Parish of Acadia shall be defined by the description contained in the attached Exhibit labeled “District 4", and including the boundaries and dimensions as shown of the plat attached hereto.

SECTION V. (Definition of District 5)

District 5 of the Parish of Acadia shall be defined by the description contained in the attached Exhibit labeled “District 5", and including the boundaries and dimensions as shown of the plat attached hereto.

DEFINITION VI. (Definition of District 6)

District 6 of the Parish of Acadia shall be defined by the description contained in the attached Exhibit labeled “District 6", and including the boundaries and dimensions as shown of the plat attached hereto.

DEFINITION VII. (Definition of District 7)

District 7 of the Parish of Acadia shall be defined by the description contained in the attached Exhibit labeled “District 7", and including the boundaries and dimensions as shown of the plat attached hereto.

The remainder of the provisions of Ordinance No. 583 shall remain in full force and effect. All ordinances or resolutions or parts thereof in conflict herewith are hereby repealed. This ordinance is to become effective at the end of the terms of office of the current members of the Acadia Parish Police Jury on December 31, 2004, as provided by La. R.S. 33:1371 (B).

This ordinance having been submitted to a vote in regular session of the Acadia Parish Police Jury, the vote thereon being as follows:

FINANCE

A motion was offered by Mr. John Humble, Sr., seconded by Mr. Pat Daigle, to approve an increase in pay beginning January, 2002, for the Registrar of Voters, Registrar of Voters Office Staff, Criminal Court Staff and District Attorney Staff in the amount of 5% and $0.25 per hour. Motion carried with Mr. John Beard casting a descending vote.

A motion was offered by Mr. John Beard, seconded by Mrs. Catherine LaCombe, to approve an increase of $117.00 per month for contractual services with C. J. Leger at the Crowley/Rayne Industrial Park. Motion carried.

A motion was offered by Mr. Pat Daigle, seconded by Mr. Jimmie Pellerin, to approve a grant in the amount of $50,000 for I-Acadia to conduct economic development activities on behalf of the Police Jury. Motion carried.

A motion was offered by Mrs. Catherine LaCombe, seconded by Mr. John Humble, Sr., to approve an increase of $200 per year in salary per associate County Agents and County Agents in Acadia Parish. Motion carried.

PUBLIC HEALTH

Mr. John Quebodeaux, on behalf of Juror Cecelia Broussard, announced that matters relating to the domestic animal complaint presented by Mrs. Kibodeaux at the previous meeting was handled in an appropriate manner.

Mr. Quebodeaux, Emergency Management Director, described the cleanup process subsequent to a recent fire at a storage facility outside the city limits of Crowley.

                                      
RESOLUTION

        BY: MRS CATHERINE LACOMBE AND MR JOHN HUMBLE SR

WHEREAS, there was an incident in Acadia Parish on November 9, 2001, involving a fire at a Medical Waste Storage Site, and

WHEREAS, the Crowley Fire Department responded to this fire without prior knowledge of the contents of the site and three firemen received minor open cuts which were exposed to run off from the medical waste.

THEREFORE, BE IT RESOLVED by the Acadia Parish Police Jury in regular session duly convened this 20th day of November, 2001, does hereby request that the Acadia Parish Legislative Delegation consider introducing legislation adding Medical Waste Storage Sites to the Louisiana Right to Know Law.

BE IT FURTHER RESOLVED that a copy of this Resolution be sent to all Parish Councils and Police Juries, the Louisiana Police Jury Association and the Chairman of the Louisiana Emergency Response Council.

Said amount is to be deducted from the contract price and the adjusted contract price to date is Two Hundred Thirty-nine Thousand Three Hundred Fifty-four and 29/100 ($239,354.29) Dollars.

RESOLUTION OF TERMINATION

The following resolution was offered by Mr. John Humble, Sr., duly seconded by Mrs. Catherine LaCombe, and duly resolved and adopted on November 20, 2001.

A resolution authorizing and directing the President to execute for and on behalf of the Acadia Parish Police Jury, a Notice of Termination from Environmental Specialties International, Inc., Contractor, pertaining to the completion of the contract for “Extension of the Composite Geosynthetic Clay Liner on the Interface Between Phase II (West) and Phase II (East) at the Acadia Parish Sanitary Landfill” in accordance with the plans and specifications contained in the contract documents pertaining thereto.

WHEREAS, a final inspection on the above referenced project was performed on November 6, 2001; and

WHEREAS, Environmental Specialities International, Inc., as Contractor, has substantially completed the “Extension of the Composite Geosynthetic Clay Liner on the Interface Between Phase II (West) and Phase II (East) at the Acadia Parish Sanitary Landfill” in accordance with the plans and specifications contained in the contract documents pertaining thereto; and

WHEREAS, the Acadia Parish Police Jury desires to accept the completed work;

NOW, THEREFORE, BE IT RESOLVED by the Acadia Parish Police Jury that the President of said Acadia Parish Police Jury be, and is hereby empowered, authorized and directed to execute a Notice of Termination for and on behalf of the Acadia Parish Police Jury accepting the work as being substantially completed, and that he be authorized and directed to have a copy of said acceptance recorded in the Conveyance Records of the Parish of Acadia, State of Louisiana.

WHEREAS, the Acadia Parish Police Jury, by Resolution, may authorize the observance of holidays as it may deem in keeping with efficient administration.

THEREFORE, BE IT RESOLVED by the Acadia Parish Police Jury in regular session duly convened on this the 20th day of November, 2001, does hereby authorize the observance of Monday, December 24, 2001, and Monday, December 31, 2001, as legal holidays.

BE IT FURTHER RESOLVED that the Acadia Parish Police Jury authorizes the closing of the Acadia Parish Courthouse and/or various offices, presently under its direct supervision to observe this holiday.

The Sales Tax Report was presented for the month of October, 2001. The report indicated a gross receipt of $685,050.85, an increase of $271,259.25 from October, 2000.


COMMENTS FROM THE PUBLIC

Mr. Allen Castille, Stamm Raymond Addition, complained about the unsafe conditions where a commercial waste container was placed on Parish Right-of-Way. He also expressed a concern for the sanitary conditions in the area.

Mr. Charles King made a statement regarding the reapportionment plan approved by the Jury as it related to minority distribution.

Marsha Pellerin requested the Jury reconsider the resignation accepted from the Animal Control Officer and that she was disappointed in the way things were handled.

THERE BEING NO FURTHER BUSINESS TO COME BEFORE THE MEETING, THE MOTION WAS OFFERED DULY SECONDED, THAT THE MEETING ADJOURN UNTIL THE NEXT REGULARLY SCHEDULED MEETING OF DECEMBER 5, 2001, AT THE HOUR OF 6:30 P.M.
