PUBLIC HEARING

It was announced by the President, that notice had been give that the Acadia Parish Police Jury would hold a public forum on September 18, 2001, at 6:30 P.M., Police Jury Meeting Room, Courthouse Building, Crowley, Louisiana, to receive views and comments to determine the needs of the Community for the 2002-2003 LCDBG Funding period.

Police Jury President Claude J. Courville called the public hearing to order at 6:30 p.m., and explained the purpose of the hearing to those in attendance. He then opened the floor for comments.

Mrs. Paula Fuselier, Grant Coordinator, explained the $37,000,000 funding cycle wherein each Parish is allowed two applications per cycle.

Mr. Larry Comeaux, Linda Stelly and Steve Daigle leaders of the Mire Fire Department described the need for improving fire protection in their community. They expressed the need to relocate the main station due to right-of-way problems at the original location. Parking and room to operate is a major factor.

Mr. Greg Richard, member of the Fire Protection Group in Fire District #5 also expressed the need for enhanced fire protection in the fifth ward. The Fire Department is in need of fire fighting equipment especially trucks, tankers and pumpers.

NO FURTHER COMMENTS WERE OFFERED AND THE PRESIDENT CLOSED THE HEARING.

THE ACADIA PARISH POLICE JURY met on the above date at 6:30 p.m., in the Police Jury Meeting Room, Courthouse Building, Crowley, Louisiana, in regular session with the President, Claude Courville, presiding. At the request of the President, a moment of silence was offered and the Pledge to the Flag was recited in unison. The roll was called and final attendance was recorded as follows:

A motion was offered by Mr. Jimmie Pellerin, seconded by Mr. John Beard, to approve the Minutes of the September 4, 2001, Regular Police Jury Meeting. Motion carried.

President Courville reported on the upcoming Region 7 Meeting hosted by the Parish on September 22, 2001, in Rayne. He stated that all arrangements have been completed.

ELECTIONS

County Agent Ron Levy answered questions related to the safety and effectiveness of pesticides used on mosquitos.

The following resolution was offered by Mr. John Humble, Sr., and seconded by Mrs. Catherine LaCombe:

                                      
RESOLUTION

          A resolution ordering and calling a special election to be
          held in the Parish of Acadia, State of Louisiana, to
          authorize the levy of special taxes therein and to
          authorize the levy and collection of a sales and use tax
          therein; making application to the State Bond
          Commission in connection therewith; and providing for
          other matters in connection therewith.

BE IT RESOLVED by the Police Jury of the Parish of Acadia, State of Louisiana (the “Governing Authority”), acting as the governing authority of the Parish of Acadia, State of Louisiana (the “Parish”), that:

SECTION 1. Election Call. Subject to the approval of the State Bond Commission, and under the authority conferred by Article VI, Sections 29, 30 and 32 of the Constitution of the State of Louisiana of 1974, the applicable provisions of Chapter 5, Chapter 6-A and Chapter 6-B of the Louisiana Election Code, and other constitutional and statutory authority, a special election is hereby called and ordered to be held in the Parish on SATURDAY, NOVEMBER 17, 2001, between the hours of six o’clock (6:00) a.m., and eight o’clock (8:00) p.m., in accordance with the provisions of La. R.S. 18:541, and at the said election there shall be submitted to all registered voters qualified and entitled to vote at the said election under the Constitution and laws of this State and the Constitution of the United States, the following propositions, to-wit:

          BUILDINGS AND EQUIPMENT NECESSARY IN CONNECTION
          THEREWITH, WITH AUTHORITY TO FUND THE PROCEEDS
          OF THE TAX INTO BONDS TO PAY THE COST OF CAPITAL
          IMPROVEMENTS FOR SUCH PURPOSES.

          Shall the Parish of Acadia, State of Louisiana (the
          “Parish”), under the provisions of Article VI, Section 29 of
          the Constitution of the State of Louisiana of 1974, and
          other constitutional and statutory authority, be authorized
          to levy and collect a tax of one-fourth of one percent
          (1/4%) (the “Tax”) for a period of ten (10) years from the
          date of the first levy of the Tax upon the sale at retail,
          the use, the lease or rental, the consumption, and the
          storage for use or consumption, of tangible personal
          property and on sales of services within the Parish, all as
          defined in R.S. 47:301 through 47:317, with the proceeds
          of the Tax (after paying the reasonable and necessary
          costs and expenses of collecting and administering the Tax)
          to be dedicated and used for the purpose of paying the
          cost of maintaining and operating a parishwide mosquito
          control program, including the cost of acquiring land,
          buildings and equipment necessary in connection therewith;
          and further, shall the Parish be authorized to fund the
          proceeds of the Tax into bonds to pay the cost of capital
          improvements for such purposes to the extent and in the
          manner permitted by the laws of Louisiana?

SECTION 2. Publication of Notice of Election. A Notice of Special Election shall be published in the Rayne Acadian Tribune, a weekly (published on Thursday) newspaper of general circulation within the Parish, published in Rayne, Louisiana, and being the official journal of the Parish, once a week for four consecutive weeks, with the first publication to be made not less than forty-five (45) days nor more then ninety (90) days prior to the date of the election, which Notice shall be substantially in the form attached hereto as “Exhibit A” and incorporated herein by reference the same as if it were set forth herein in full.

SECTION 3. Canvass. This Governing Authority shall meet at its regular meeting place, the Police Jury Room, of the Courthouse, Crowley, Louisiana, on TUESDAY, NOVEMBER 20, 2001, at SIX-THIRTY O’CLOCK (6:30) P.M., and shall then and there in open and public session proceed to examine and canvass the returns and declare the results of the said special election.

SECTION 4. Polling Places. The polling places set forth in the aforesaid Notice of Special Election are hereby designated as the polling places at which to hold the said election, and the Commissioners-in-Charge and Commissioners, respectively, will be the same persons as those designated in accordance with law.

SECTION 5. Election Commissioners; Voting Machines. The officers designated to serve as Commissioners-in-Charge and Commissioners pursuant to Section 4 hereof, or such substitutes therefor as may be selected and designated in accordance with La. R.S. 18:1287, shall hold the said special election as herein provided, and shall make due returns of said election for the meeting of the Governing Authority to be held on Tuesday, November 20, 2001, as provided in Section 3 hereof. All registered voters in the Parish will be entitled to vote at the special election, and voting machines shall be used.

SECTION 6. Authorization of Officers. The Secretary of the Governing Authority is hereby empowered, authorized and directed to arrange for and to furnish to said election officers in ample time for the holding of said election the necessary equipment, forms and other paraphernalia essential to the proper holding of said election and the President and/or Secretary of the Governing Authority are further authorized, empowered and directed to take any and all further action required by State and/or Federal law to arrange for the election, including but not limited to, appropriate submission to the Federal Department of Justice under Section 5 of the Federal Voting Rights Act of 1965, as amended.

SECTION 7. Furnishing Election Call to Election Officials. Certified copies of this resolution shall be forwarded to the Secretary of State, the Commissioners of Elections, the Clerk of Court and Ex-Officio Parish Custodian of Voting Machines of Acadia Parish and the Registrar of Voters of Acadia Parish, as notification of the special election, in order that each may prepare for said election and perform their respective functions as required by law.

SECTION 8. Application to State Bond Commission. Application is made to the State Bond Commission for consent and authority to hold the special election as herein provided, and in the event said election carries for further consent and authority to levy and collect the special taxes provided for therein. A certified copy of this resolution shall be forwarded to the State Bond Commission on behalf of this Governing Authority, together with a letter requesting the prompt consideration and approval of this application.

This resolution having been submitted to a vote, the vote thereon was as follows:

FEDERAL/STATE FINANCIAL ASSISTANCE

WHEREAS, the Acadia Parish Police Jury wishes to authorize participation in the construction of improvements at the LeGros Memorial Airport, Estherwood, Louisiana, and

WHEREAS, Cooperative Funding is available through the FAA and LA DOTD for such improvements.

THEREFORE, BE IT RESOLVED by the Acadia Parish Police Jury in regular session duly convened on this the 18th day of September, 2001, does hereby authorize the President to apply for funding with the FAA for Airport improvements.

BE IT FURTHER RESOLVED that the President be empowered, authorized and directed to execute any and all contracts associated with FAA funding for improvements at the LeGros Airport.

          DISTRICTS #5 & #7 IN ACADIA PARISH.

WHEREAS, the Acadia Parish Police Jury is allowed to submit a maximum of two single purpose applications for funding for public facilities under the Fiscal Year 2002-2003 Louisiana Community Development Block Grant Program, and

WHEREAS, the Acadia Parish Police Jury has conducted a public hearing in order to encourage citizen participation with respect to the selection of viable public facilities projects for their Fiscal Year 2002-2003 Louisiana Community Development Block Grant Program, and

WHEREAS, the Acadia Parish Police Jury deems it necessary and proper that both public facilities applications for funding submitted are for fire protection improvements for Fire Protection Districts #5 & #7 in Acadia Parish.

THEREFORE, BE IT RESOLVED by the Acadia Parish Police Jury in regular session duly convened on this the 18th day of September, 2001, does hereby empower, authorize and direct the President to submit an application for funding under the FY ‘02-03 Louisiana Community Development Block Grant Program for fire protection improvements for Fire Protection Districts #5 & #7 in Acadia Parish.

BE IT FURTHER RESOLVED that the President of this Police Jury be and he is hereby empowered, authorized and directed to execute a contract with K.A.S. Construction, LLC, on behalf of, in the name and under the seal of the Acadia Parish Police Jury relative to said project.

A motion was offered by Mr. John Humble, Sr., seconded by Mr. Pat Daigle, to amend the 2001 Budget and increase Capitol Outlay, Multipurpose Facility Construction Fund by $132,000.00 supplemented by Cooperative Extension Fund balance from previous years. Motion carried.

RESOLUTION

           BY: MRS CECELIA BROUSSARD AND MR JOHN BEARD

WHEREAS, on September 11, 2001, was suddenly and brutally attacked by foreign terrorists, and

WHEREAS, these terrorists hijacked and destroyed four civilian aircraft, crashing two of them into the towers of the World Trade Center in New York City, and a third into the Pentagon outside Washington, DC, and

WHEREAS, thousands of innocent Americans were killed and injured as a result of these attacks, including the passengers and crew of the four aircraft, workers in the World Trade Center and in the Pentagon, rescue workers, and bystanders, and

WHEREAS, these cowardly acts were by far the deadliest terrorist attacks ever launched against the United States, and, by targeting symbols of American strength and success, clearly were intended to intimidate our nation and weaken its resolve, and

WHEREAS, these horrific events have affected all Americans. It is important that we carry on with the regular activities of our lives. Terrorism cannot be allowed to break the spirit of the American people, and the best way to show these cowards that they have truly failed is for the people of the United States and their counties to stand tall and proud.

THEREFORE, BE IT RESOLVED that the governing board of Acadia Parish condemns the cowardly and deadly actions of these terrorists.

BE IT FURTHER RESOLVED that the governing board of Acadia Parish supports the President of the United States, as he works with his national security team to defend against additional attacks, and find the perpetrators to bring them to justice.

BE IT FURTHER RESOLVED that the governing board of Acadia Parish recommends to its citizens to support relief efforts by giving blood at the nearest available blood donation center.

Mr. John Quebodeaux, Emergency Management Director, on behalf of Mr. Wayne Matlock, Animal Control Officer, explained a mutual aid agreement proposed by Animal Control for Acadia Parish which would provide for the sharing of services. The subject will be discussed further at the next meeting.


PUBLIC WORKS/ROAD & BRIDGE

Mr. Ken Camden requested assistance to correct drainage problems on Lisa Drive generally caused by backed up water.

A motion was offered by Mrs. Catherine LaCombe, seconded by Mr. John Humble, Sr., to authorize Aucoin & Associates to determine the problems with drainage on Lisa and Teddy Drive providing practical solutions. Motion carried.

A motion was offered by Mrs. Cecelia Broussard, seconded by Mrs. Catherine LaCombe, to authorize Aucoin Trucking to use open cut method to install an irrigation pipeline on Connie Road. Motion carried.

WHEREAS, Aucoin & Associates, Inc., advertised for bids for Phase IIIa Street Improvements and the following bids were received:

W.E. McDonald & Son           $2,897,647.75

THEREFORE, BE IT RESOLVED by the Acadia Parish Police Jury in regular session duly convened on this the 18th day of September, 2001, does hereby award the low bid submitted by W.R. Core, LLC for the total cost of Two Million Eight Hundred Forty-seven Thousand Seven Hundred Nineteen and 75/100 ($2,847,719.75) Dollars.

BE IT FURTHER RESOLVED that the President of this Police Jury be and he is hereby empowered, authorized and directed to execute a contract with W.R. Core, LLC, on behalf of, in the name and under the seal of the Acadia Parish Police Jury relative to said project.

A motion was offered by Mrs. Cecelia Broussard, seconded by Mr. John Beard, to waive permit fees requested by South Rayne Water Corporation, a non-profit corporation, for a rural water expansion in the South East portion of Acadia Parish. Motion carried.

A motion was offered by Mr. John Beard, seconded by Mr. Pat Daigle, to allow open cut method and waive permit fees for the installation of underground piping on Boone Road by Mr. Mark Link provided as-built drawings are submitted. Motion carried.

A motion was offered by Mrs. Catherine LaCombe, seconded by Mr. Pat Daigle, to authorize an additional $10,000.00 for overtime for Road Maintenance activities. Motion carried.


COMMENTS FROM THE PUBLIC

Mr. John Quebodeaux, Bridge Inspector, clarified a bridge report handout distributed for Off-System Bridge Replacement Program.
