THE ACADIA PARISH POLICE JURY met on the above date at 6:30 p.m., in
the Police Jury Meeting Room, Courthouse Building, Crowley,
Louisiana, in regular session with the President, Claude Courville,
presiding. At the request of the President, a moment of silence was
offered and the Pledge to the Flag was recited in unison. The roll
was called and final attendance was recorded as follows:

A motion was offered by Mr. John Humble, Sr., seconded by Mrs.
Cecelia Broussard, to amend the agenda to consider the following
subject matters: bridge replacement on Treasure Road, waiver of
permit fees on Roy LeBlanc Road and request from Mermentau Mayor
David Frugé. Motion carried.
A motion was offered by Mr. Jimmie Pellerin, seconded by Mr. Alton
Stevenson, to approve the Minutes of the August 21, 2001, Regular
Police Jury Meeting. Motion carried.
* * * PROCLAMATION * * *
WHEREAS, the week of October
7-13, 2001, has been designated in Louisiana and the nation as “Fire
Prevention Week”; and
WHEREAS, the loss of life and
property as the result of fire is extensive and often caused by
carelessness or lack of attention to fire prevention rules;
and
WHEREAS, our rural community
is privileged to have protection from the destruction of fire by a
large team of dedicated Volunteer Firefighter’s in the Mire
Volunteer Fire Department.
NOW, THEREFORE, we, the Acadia
Parish Police Jury, do hereby proclaim the week of October 7-13,
2001, as
“FIRE PREVENTION WEEK”
in Mire, Louisiana, and urge all citizens to take reasonable
precautions to avoid the risks of unknowingly creating or retaining
a fire hazard and instructing their children in the same prevention
methods and the importance of those concerns.

Mr. Stanley Guillory, representative of Entergy Corporation,

PRESIDENT
Mayor David Frugé, Village of Mermentau, expressed concern over the
continued operation of the recently constructed elderly housing
apartments in the Village. He pointed out that an estimated
$12,000.00 shortfall would mean a possible closure and shortage of
housing.
The matter was referred to Legal Counsel to determine the
possibility of the Police Jury providing temporary financial
support.
FINANCE
A motion was offered by Mr. Alton Stevenson, seconded by Mr. Pat
Daigle, to amend the General Fund Capital Outlay Budget to include
$285,000.00 for a total of $635,000.00 for the construction of an
expansion to the Parish Correctional Facility, from miscellaneous
fund balance, previous years. Motion carried.

AN ORDINANCE AMENDING
ORDINANCE #761 TO PROVIDE
FOR CONDITIONS OF PRIVATE
STREET AND PRIVATE
ALLEYS IN PARISH
SUBDIVISION DEVELOPMENTS,
WHEREIN A PRIVATE STREET
IS DEFINED AS A RIGHT-OF-
PASSAGE INTENDED FOR USE
BY THE GENERAL PUBLIC
THAT IS DESIGNATED AS A
PRIVATE STREET ON THE
PRELIMINARY AND FINAL
SUBDIVISION PLAT.
SECTION 1. PRIVATE STREETS
AND PRIVATE ALLEYS
(a) General Arrangement and Layout of Private Streets
The pattern or layout of the private street system in any project
must provide for the following basic design concepts:
(a) Provide adequate vehicle access to buildings and facilities
within the plat boundaries.
(b) Provide adequate interior traffic circulation and access to
buildings by fire fighting personnel and equipment.
(c) Provide adequate access to the existing public street system
adjacent to the boundaries of the plat.
(d) Be so designed to allow for the orderly flow of vehicular
traffic, which would not induce a hazard to vehicular traffic and
the occupants of the development as determined by the Parish
Engineer.
(e) Private streets may be utilized only in those areas where there
is no possibility of future extension of public streets into the
area; and in areas where due to the boundaries of the subdivision
there will be no future need to extend the private streets beyond
the boundaries.
(f) The designation of a private street as a private street, is the
responsibility of the Planning Commission.
(b) Right-of-Way Widths and Pavement Requirements of Private
Streets
Right-of-Way widths shall be the same as required for public
streets. The private street shall be paved to the same pavement
requirements that pertain to public streets. The assurance of
pavement construction requirements will be under the jurisdiction of
the Parish’s review of construction standards.
(c) Each lot shall have a direct frontage on a public or private
street. Where a townhouse, condominium, apartment complex, or mobile
home subdivision is planned, a certified copy of restrictions,
agreements or contracts providing adequate public access and safety
to each unit must be submitted to the Parish Planning Commission.
(d) General Arrangement and Layout of Private Alleys
Private alleys may be provided within any subdivision to provide
secondary vehicular access to buildings which otherwise have their
primary access from an adjacent public street or private street.
Private alleys cannot be used or designed to provide the principle
access to property outside the subdivision plat boundaries in which
the private alleys are located.
(e) Right-of-Way Widths and Pavement of Private Alleys
Private Alleys shall conform to minimum requirements for public
alleys.
(f) Dead-Ends, Cul-de-Sacs and T-Type Turnarounds for Private
Streets
& Private Alleys
Dead-end private streets and private alleys over one hundred-fifty
feet (150') long, measured from the nearest right-of-way line at the
intersection, must be terminated by a circular cul-de-sac having a
right-of-passage radius of not less than fifty feet (50'). It is
permissible for a private alley to be terminated by a T-type
turnaround designated in conformance with the standards of the
Parish.
(g) Allowable Lengths of Private Streets and Private Alley Cul-de-Sacs
Allowable lengths of private streets and private alley cul-de-sacs
conform to minimum requirements for public streets and alleys.
(h) Intersections of Private Streets and Private Alleys
Private streets must not be direct projections of any public street.
When a private street or private alley intersects with a public
street there must be a minimum offset distance of one hundred and
twenty-five feet (125') from the center line of the private street
or private alley to the center line of any adjacent street or alley
intersecting the public street. Intersections of all private streets
and private alleys with the public streets must be at right angles
with variations not to exceed ten degrees (10̊) and have twenty-five
feet (25') radii at all corners.
(i) Multiple Access Points to Public Streets
All property containing private streets must have a private street
system so designed to provide adequate emergency vehicular access.
The private street system must be designed to provide more than one
point of access to the project or development from the public street
adjacent to the boundaries of the project or development, if at all
possible.
(j) Designation of Private Streets and Private Alleys
The right-of-way of all private streets will be clearly marked and
designated as private streets or private alleys on the Preliminary
and Final plats.
(k) Maintenance of Private Streets, Private Alleys and Drainage
Facilities
Within Development
The developer will cause to be created (or furnish a certified
correct copy if already in existence) a financial and management
legal entity or entities that will guarantee and assure the
maintenance of all private streets and private alleys constructed.
The developer will provide a certification to the Parish Planning
Commission, prior to obtaining final subdivision approval, from an
attorney licensed to practice law in the State of Louisiana, that
the documentation, attached to such certification, provides for the
creation of an entity that is responsible for the maintenance of the
private streets, private roads, private alleys and drainage
facilities in the subdivision; which certification shall contain the
name of the entity responsible for maintenance and its registered
office.
(l) Drainage of Private Streets and Private Alleys
Private streets and private alleys must be provided with adequate
drainage and shall conform to minimum requirements for public
streets and alleys.
SECTION 2. All other Sections
of Ordinance No. 761 shall remain in full force and effect. This
Ordinance shall have full force & effect from and after the date of
this adoption.
SECTION 3. All Ordinance or
parts of Ordinances contrary to or in conflict herewith are hereby
repealed.

the Acadia Parish Police Jury in regular session duly convened on

SECTION 1. BE IT ORDAINED by
the Police Jury of Acadia Parish, Louisiana, that it shall be
unlawful for any person to operate or drive a motor vehicle in
excess of fifteen miles per hour
on the following described Parish Road:

SECTION 2. BE IT FURTHER ORDAINED
that any person found guilty of operating or driving a motor vehicle
in excess of fifteen miles per hour
on the Parish road described above, shall be guilty of a
misdemeanor, and upon conviction therefore, shall be fined not more
than Fifty Dollars ($50) or be imprisoned not more than ten (10)
days or both.
SECTION 3. BE IT FURTHER ORDAINED
that any laws or parts of laws in conflict are hereby repealed.

A motion was offered by Mrs. Catherine LaCombe, seconded by Mrs.
Cecelia Broussard, to approve the request to open cut Roy LeBlanc
Road to replace a damaged water line and waive the permit fees for
the construction with exception of as-built drawings. Motion
carried.
COMMENTS FROM THE PUBLIC
Mr. Charles King encouraged the Jury to consider a policy of laying
over new laws such as speed limits prior to adoption.
Jury President Claude Courville encouraged that such requests be
submitted to Legal Counsel.
THERE BEING NO FURTHER BUSINESS TO COME BEFORE THE MEETING,
THE MOTION WAS OFFERED DULY SECONDED, THAT THE MEETING ADJOURN UNTIL
