FEBRUARY 19, 2002

THE ACADIA PARISH POLICE JURY met on the above date at 6:30 p.m., in the Police Jury Meeting Room, Courthouse Building, Crowley, Louisiana, in regular session with the President, Claude Courville, presiding. At the request of the President, a moment of silence was offered and the Pledge to the Flag was recited in unison. The roll was called and final attendance was recorded as follows:

A motion was offered by Mr. John Humble, Sr., seconded by Mr. Pat Daigle, to amend the agenda and include the following items: Tourist Commission By Law Changes; Approval of the 2002 Solid Waste House Count; Speed Limit on Pellisier Lane and Bridge repairs on Henry Bieber Road. Motion carried.

A motion was offered by Mr. Jimmie Pellerin, seconded by Mr. John Beard, to approve the Minutes of the February 5, 2002, Regular Police Jury Meeting. Motion carried.

BE IT RESOLVED: by the Acadia Parish Police Jury in regular session duly convened this 19th day of February, 2002, does hereby appoint MR. ROLAND POUSSON to fill the unexpired term of Mr. Harry LaCasse to the Iota-Long Point Drainage District effective February, 2002.

LEGISLATION

A motion was offered by Mrs. Catherine LaCombe, seconded by Mrs. Cecelia Broussard, to introduce the following proposed ordinance:

                                 
ORDINANCE NO.         
                                  CREATION OF PRECINCT 1-2C

          AN ORDINANCE AMENDING ORDINANCE NO. 373, CREATING
          VOTING PRECINCT 1-2C FOR THE ACADIA PARISH SCHOOL
          BOARD OF THE PARISH OF ACADIA, LOUISIANA, IN
          ACCORDANCE WITH THE 2000 CENSUS

WHEREAS, the Acadia Parish School Board desires to adopt Reapportionment Plan I and under that plan there is one additional precinct that must be divided in order to maintain minority representation levels as close to 1990 levels as possible and to stay in compliance with applicable State statutes; and

WHEREAS, since the School Board has a different membership than the Acadia Parish Police Jury, it may, under State statutes, split up to two precincts per district; and

WHEREAS, to maintain the proper minority representation levels in the Rayne area, it was necessary to split three precincts in School Board District 10; and

WHEREAS, each Acadia Parish School Board District cannot contain split precincts beyond the two allowed by State law and thereafter the remaining precincts must be whole precincts as approved by the Acadia Parish Police Jury; and

WHEREAS, the Acadia Parish School Board respectfully requests from the Acadia Parish Police Jury that Precinct 1-2B be split to form Precinct 1-2C so that it may submit its reapportionment Plan 1 to the U.S. Department of Justice for Section 5 Pre-Clearance;

BE IT ORDAINED by the Acadia Parish Police Jury, in regular session assembled, that Ordinance No. 373 be and the same is hereby amended to create Precinct 1-2C out of the Precinct 1-2B to wit:

Commencing from the Point of Beginning at the intersection of the centerline of S. Arenas St. and the Southern Pacific Railroad tracks, thence southerly on S. Arenas St. to the intersection with the centerline of E. Butler St., thence easterly on E. Butler St. to the intersection with the centerline of S. Chevis St., thence southerly on S. Chevis St. to the intersection of the centerline of E. Branche St., thence westerly on E. Branche St. to the intersection with the centerline of S. Parkerson St., thence northerly on S. Parkerson St. to the intersection with the Southern Pacific Railroad tracks, thence easterly on the Southern Pacific Railroad tracks to the Point of Beginning.

Said precinct having the following Census 2000 demographics:

Population: 269                         Minority Population: 12
Voting Age Population: 191          Minority Voting Age Population: 7

The remainder of the provisions of Ordinance No. 373 shall remain in full force and effect. All Ordinance or Resolutions or parts thereof in conflict herewith are hereby repealed. This amended Ordinance is to become effective upon the receipt of Pre-Clearance from the U.S. Department of Justice of these precinct amendments.

After being considered section by section and being put to a vote on the whole, the vote thereon was as follows:

                                                RESOLUTION

         BY: MRS CECELIA BROUSSARD AND MRS CATHERINE LACOMBE

BE IT RESOLVED: by the Acadia Parish Police Jury in regular session duly convened this 19th day of February, 2002, does hereby approve the proposed changes to Article III entitled “Commission Directors” and Article IX entitled “Bonding of the Bylaws” governing the Acadia Parish Convention and Visitor’s Commission.

BE IT FURTHER RESOLVED that Article III shall now change the term limits of the two at large commissioners from three to one year and generalizes the representation.

BE IT FURTHER RESOLVED that Article IX shall be written omitting Paragraph D related to Bonding.

PUBLIC WORKS/ROAD & BRIDGE

The request to abandon Castle Cove Road was postponed on advice of Counsel till such time all property owners with interest along said road petition such action.

WHEREAS, Aucoin & Associates, Inc., advertised for bids for the LCDBG FY 2000-2001 Phase IIIA Road Improvements in District 2, 4 & 5 and the following bids were received:

McDonald & Son, Inc., for a total cost of Four Hundred Eleven Thousand Eighty Hundred Forty-two and 00/100 ($411,842.00) Dollars.

BE IT FURTHER RESOLVED that the President of this Police Jury be and he is hereby empowered, authorized and directed to execute a contract with W. E. McDonald & Son, LLC., on behalf of, in the name and under the seal of the Acadia Parish Police Jury relative to said project.

A motion was offered by Mr. Pat Daigle, seconded by Mrs. Cecelia Broussard, to accept legal opinion on the request to abandon the private portion of Lois Lane. Motion carried.

                               
ORDINANCE #837

AN ORDINANCE MAKING IT UNLAWFUL FOR ANY PERSON TO OPERATE OR DRIVE A MOTOR VEHICLE UPON PELLISSIER LANE IN ACADIA PARISH, LOUISIANA, AT A SPEED IN EXCESS OF
FIFTEEN MILES PER HOUR, AND, PROVIDING FOR THE PENALTIES FOR THE VIOLATION THEREOF.

SECTION 1. BE IT ORDAINED by the Police Jury of Acadia Parish, Louisiana, that it shall be unlawful for any person to operate or drive a motor vehicle in excess of fifteen miles per hour on the following described Parish Road:

                                           Pellissier Lane

SECTION 2. BE IT FURTHER ORDAINED that any person found guilty of operating or driving a motor vehicle in excess of fifteen miles per hour on the Parish road described above, shall be guilty of a misdemeanor, and upon conviction therefore, shall be fined not more than Fifty Dollars ($50) or be imprisoned not more than ten (10) days or both.

SECTION 3. BE IT FURTHER ORDAINED that any laws or parts of laws in conflict are hereby repealed.

The Ordinance was offered by Mrs. Cecelia Broussard, and seconded by Mrs. Catherine LaCombe, after being read and considered section by section, was adopted as a whole by the following vote:

A motion was offered by Mr. John Humble, Sr., seconded by Mr. Pat Daigle, to authorize the purchase of one 36 inch arched pipe to replace the bridge on Henry Bieber Road at an estimated cost of $817.00. Motion carried.


SOLID WASTE/ENVIRONMENTAL

                                     
RESOLUTION

     BY: MRS CATHERINE LACOMBE AND MRS CECELIA BROUSSARD

WHEREAS, pursuant to Section III-D, Article 9-C of the Contract for Collection and Disposal of Solid Waste between Browning-Ferris Industries and the Acadia Parish Police Jury, the result of a joint house count submitted by BFI indicates an increase of 292 homes bringing the total number of the residential house count to 21,928.

THEREFORE, BE IT RESOLVED by the Acadia Parish Police Jury in regular session duly convened this 19th day of February, 2002, does hereby concur with the results of the joint house count verifying the number of service units.

BE IT FURTHER RESOLVED that the effective date of the revised count submitted be in accordance with the Solid Waste Collection and Disposal Contract by and between Browning-Ferris Industries and the Acadia Parish Police Jury.

COMMENTS FROM THE PUBLIC

Mr. John Quebodeaux, Emergency Management Director announced the award of a $7,500 Grant to the Parish to enhance the Parish Emergency Mapping System.

Mr. Albert Leger introduced himself as the new Veteran’s Service Officer in Acadia Parish.
