JANUARY 16, 2002

THE ACADIA PARISH POLICE JURY met on the above date at 6:30 p.m., in the Police Jury Meeting Room, Courthouse Building, Crowley, Louisiana, in regular session with the President, Claude Courville, presiding. At the request of the President, a moment of silence was offered and the Pledge to the Flag was recited in unison. The roll was called and final attendance was recorded as follows:

A motion was offered by Mr. Jimmie Pellerin, seconded by Mr. John Beard, to approve the Minutes of the December 19, 2001, Regular Police Jury Meeting. Motion carried.

A motion was offered by Mr. Alton Stevenson, seconded by Mrs. Catherine LaCombe, to elect the following officers for 2002 by acclamation Mr. Claude J. Courville, President and Mr. John Humble, Sr., Vice President. Motion carried.

APPOINTMENTS

A motion was offered by Mr. Alton Stevenson, seconded by Mrs. Catherine LaCombe, to re-appoint Mr. Katry Martin as Secretary-Treasurer for a two year period. Motion carried.

A motion was offered by Mr. Alton Stevenson, seconded by Mrs. Catherine LaCombe, to re-appoint Mr. André Doguet as Legal Counsel for the Police Jury. Motion carried.

ELECTIONS

The following Resolution was offered by Mrs. Cecelia Broussard, seconded by Mr. Jimmie Pellerin:

                                      
RESOLUTION

          A Resolution approving the holding of an election in Acadia
          St. Landry Hospital Service District of the Parishes of
          Acadia and St. Landry, State of Louisiana, on Saturday,
          April 6, 2002, to authorize the levy of a special tax therein.

WHEREAS, the Board of Commissioners of Acadia-St. Landry Hospital Service District of the Parishes of Acadia and St. Landry, State of Louisiana (the “Governing Authority”), acting as the governing authority of Acadia-St. Landry Hospital Service District of the Parishes of Acadia and St. Landry, State of Louisiana (the “District”), is scheduled to adopt a resolution on January 17, 2002, calling a special election in the District on Saturday, April 6, 2002, to authorize the levy of a special tax therein; and

WHEREAS, the governing authority of the District has requested that this Police Jury acting as the governing authority of the Parish of Acadia, State of Louisiana, give its consent and authority for the District to hold the aforesaid election, and in the event that the election carries to levy and collect the special tax provided for therein; and

WHEREAS, as required by Article VI, Section 15 of the Constitution of the State of Louisiana of 1974, it is now the desire of this Police Jury to approve the holding of said election and in the event that the election carries, to levy and collect the special tax provided for therein;

NOW, THEREFORE, BE IT RESOLVED by the Police Jury of the Parish of Acadia, State of Louisiana, acting as the governing authority of said Parish, that:

SECTION 1. In compliance with the provisions of Article VI, Section 15 of the constitution of the State of Louisiana of 1974, and in accordance with the request of the Board of Commissioners of Acadia-St. Landry Hospital Service District of the Parishes of Acadia and St. Landry, State of Louisiana, this Police Jury hereby approves the holding of an election in the District, on Saturday, April 6, 2002, at which election there will be submitted the following proposition, to-wit:

             ACADIA-ST. LANDRY HOSPITAL SERVICE DISTRICT
                          PROPOSITION (TAX RENEWAL)

          SUMMARY: 10 YEAR, 7.67 MILLS TAX RENEWAL FOR
          ACQUIRING, CONSTRUCTING, IMPROVING, MAINTAINING
          AND OPERATING THE HOSPITAL FACILITIES OF THE
          DISTRICT.

          Shall Acadia-St. Landry Hospital Service District of the
          Parishes of Acadia and St. Landry, State of Louisiana
          (the “District”), levy a tax of seven and sixty-seven
          hundredths (7.67) mills on all property subject to
          taxation within the District for a period of ten (10)
          years, beginning with the year 2003 and ending with
          the year 2012, for the purpose of acquiring, constructing,
          improving, maintaining and operating the hospital facilities
          of the District?

SECTION 2. In the event the election carries, this Police Jury does hereby further consent to and authorize the District to levy and collect the special tax provided for therein.

This Resolution having been submitted to a vote, the vote thereon was as follows:

BE IT RESOLVED: by the Acadia Parish Police Jury that the President and Secretary advertise for bids for the leasing of the oil, gas and mineral rights in and under the following described property, to-wit:

          All of the rights, titles, and interest in any highways,
          right-of-ways, roads, or other lands owned by and not
          under mineral lease from Acadia Parish Police Jury,
          situated in Acadia Parish, Louisiana, within the following
          described boundaries:

          Beginning at a point having coordinates of X=
          1,709,780.00’ and Y=568,710.00’;

          Thence SOUTH 6,402.78 feet to a point having
          coordinates of X=1,709,780.00’ and Y=562,307.22’;

          Thence WEST 2,680.00 feet to a point having
          coordinates of X=1,707,100.00’ and Y=562,307.22’;

          Thence NORTH 6,402.78 feet to a point having
          coordinates of X=1,707,100.00’ and Y=568,710.00’;

          Thence EAST 2,680.00 feet to the point of beginning,
          containing approximately
5 acres, as shown outlined in
          red on the attached plat. All bearings, distances and
          coordinates are based on the Louisiana Coordinate
          System of 1927 (South Zone).

All bids to offer a cash bonus for a lease having a primary term which shall not exceed three (3) years. Minimum royalties shall be one-quarter (¼) of all oil, including condensate or other liquid minerals, produced and saved; one-quarter (¼) of the value of all gas, including casinghead gas, produced and saved or utilized by methods considered as ordinary production methods at the time of production; one-quarter (¼) of any and all other liquid or gaseous minerals in solution and produced with oil or gas and saved or utilized, which are not specifically mentioned herein.

Should lessee fail to begin operations for the drilling of a well on the leased premises within one (1) year from the date of the lease, the lease shall terminate as to both parties to the lease, unless on or before such anniversary date Lessee shall pay a delay rental (which shall in no event be less than one-half (½) of the bonus offered), which shall cover the privilege of deferring drilling operations for a period of one (1) year. Upon like payments annually, drilling operations may be further deferred for successive periods of one (1) year each during the primary term. The primary term of the lease shall be three (3) years.

Certified check, cashier's check or bank money order, payable to the Acadia Parish Police Jury for the full amount of the cash bonus shall accompany and be deposited with each bid, and no bid when deposited may be thereafter withdrawn or canceled and the cash bonus thus deposited shall be forfeited to the Acadia Parish Police Jury by the successful bidder in the event said bidder does not enter into a written contract within twenty (20) days after the written lease is submitted to him for execution. All bids to be submitted on Louisiana State Mineral Board bid form. Any lease awarded on the above lands shall be subject to the approval of the State Mineral Board.

The Acadia Parish Police Jury reserves the right to reject any and all bids and to grant a lease on any portion of the tracts advertised for a price not less than proportionate to the best bid offered for the lease of the entire tract.

PERSONNEL

A motion was offered by Mrs. Cecelia Broussard, seconded by Mr. John Humble, Sr., to approve a 5% pay increase for District Attorney Mike Harson effective January, 2002. Motion carried.

A motion was offered by Mrs. Cecelia Broussard, seconded by Mr. Alton Stevenson, to approve a 5% probationary pay increase for Mr. Larry Gotte which coincides with his first employee evaluation effective January 1, 2002. Motion carried.


PUBLIC FACILITIES/BUILDING & GROUNDS

                         
RESOLUTION OF ACCEPTANCE

The following resolution was offered by Mrs. Cecelia Broussard, duly seconded by Mr. Pat Daigle, and duly resolved and adopted on January 16, 2002.

A resolution authorizing and directing the President to execute for and on behalf of the Acadia Parish Police Jury, an Act of Acceptance for Stan Gall, Inc., Contractor, pertaining to the completion of the contract, weatherization to the Courthouse Building, Crowley, LA, in accordance with the plans and specifications contained in the contract documents pertaining thereto.

WHEREAS, Stan Gall, Inc., as Contractor, has completed the weatherization to the Courthouse Building, Crowley, LA, in accordance with the plans and specifications contained in the contract documents pertaining thereto; and

WHEREAS, the Acadia Parish Police Jury desires to accept the completed work;

NOW, THEREFORE, BE IT RESOLVED by the Acadia Parish Police Jury that the President of said Acadia Parish Police Jury be, and is hereby empowered, authorized and directed to execute an Act of Acceptance for and on behalf of the Acadia Parish Police Jury accepting the work as being completed, and that he be authorized and directed to have a copy of said acceptance recorded in the Conveyance Records of the Parish of Acadia, State of Louisiana.

THEREFORE, BE IT RESOLVED by the Acadia Parish Police Jury in special session duly convened this 16th day of January 16, 2002, does hereby concur with the recommendation of Aucoin & Associates to accept the bid submitted by M B Industries, LLC, in the amount of Seven Hundred Nineteen Thousand Seven Hundred Forty-three and 00/100 ($719,743.00) Dollars.

BE IT FURTHER RESOLVED that the President of this Police Jury be and he is hereby empowered, authorized and directed to execute a contract with M B Industries, LLC, on behalf of, in the name and under the seal of the Acadia Parish Police Jury relative to said project.

BE IT FURTHER RESOLVED that the President be empowered, authorized and directed to execute, on behalf of the Parish, a lease of Real Estate Agreement with the Acadia Parish Law Enforcement District for the location of said Parish Jail Expansion.

PUBLIC WORKS/ROAD & BRIDGE

A motion was offered by Mr. John Humble, Sr., seconded by Mr. Pat Daigle, to approve the expenditure of $125.00 for legal fees to review right-of-way documents for the Federal Off-System Bridge Replacement Program. Motion carried.

Parish Engineer Karl Aucoin reviewed the plans and possible dates for the upcoming asphalt patching project. Work should begin within 90 days.

A motion was offered by Mrs. Cecelia Broussard, seconded by Mr. John Beard, to approve the Emergency Work Report for the month of December, 2001. Said expenditures to be in the amount of $161.55. Motion carried.

A motion was offered by Mr. John Humble, Sr., seconded by Mr. Pat Daigle, to approve special conditions and allow the open cut method for the installation of an irrigation pipeline across Benton Road. Motion carried.

A motion was offered by Mrs. Catherine LaCombe, seconded by Mrs. Cecelia Broussard, to approve special conditions and allow the open cut method for the installation of an irrigation pipeline across Fox Trot Road. Motion carried.

The subject of signage for permitted activities was referred to Road & Bridge Committee for detailed discussion.

A motion was offered by Mr. John Humble, Sr., seconded by Mr. Pat Daigle, to authorize an expenditure from Equipment Reserve Fund for the purchase of front-end backhoe attachments estimated to cost $1,000.00. Motion carried.

BE IT RESOLVED: by the Acadia Parish Police Jury in regular session duly convened this 16th day of January, 2002, does hereby empower, authorize & direct the President to execute Change Order No. 1 to the UV Protection Project at the Acadia Parish Landfill and decrease the amount by One Thousand Six Hundred Thirty-two and 00/100 ($1,632.00) Dollars with Red Fern, Inc., for an adjusted contract price of Forty-four Thousand Nine Hundred Seventy-six and 20/100 ($44,976.20) Dollars.

RESOLUTION OF ACCEPTANCE

The following resolution was offered by Mrs. Catherine LaCombe, duly seconded by Mr. Pat Daigle, and duly resolved and adopted on January 16, 2002.

A resolution authorizing and directing the President to execute for and on behalf of the Acadia Parish Police Jury, an Act of Acceptance for Red Fern, Inc., Contractor, pertaining to the completion of the contract, installation of UV Protection on South Slope of Phase II (East) Acadia Parish Sanitary Landfill, Egan, LA, in accordance with the plans and specifications contained in the contract documents pertaining thereto.

WHEREAS, Red Fern, Inc., as Contractor, has completed the installation of UV Protection on South Slope of Phase II (East) Acadia Parish Sanitary Landfill, Egan, LA, in accordance with the plans and specifications contained in the contract documents pertaining thereto; and

WHEREAS, the Acadia Parish Police Jury desires to accept the completed work;

NOW, THEREFORE, BE IT RESOLVED by the Acadia Parish Police Jury that the President of said Acadia Parish Police Jury be, and is hereby empowered, authorized and directed to execute an Act of Acceptance for and on behalf of the Acadia Parish Police Jury accepting the work as being completed, and that he be authorized and directed to have a copy of said acceptance recorded in the Conveyance Records of the Parish of Acadia, State of Louisiana.

The Sales Tax Report was presented for the month of December, 2001. The report indicated a gross receipt of $405,624.80, an increase of $133,120.11 from December, 2000.

THERE BEING NO FURTHER BUSINESS TO COME BEFORE THE MEETING, THE MOTION WAS OFFERED DULY SECONDED, THAT THE MEETING ADJOURN UNTIL THE NEXT REGULARLY SCHEDULED MEETING OF FEBRUARY 5, 2002, AT THE HOUR OF 6:30 P.M.
