CROWLEY, LOUISIANA

JULY 2, 2002

THE ACADIA PARISH POLICE JURY met on the above date at 6:30 p.m., in the Police Jury Meeting Room, Courthouse Building, Crowley, Louisiana, in regular session with the President, Claude Courville, presiding. At the request of the President, a moment of silence was offered and the Pledge to the Flag was recited in unison. The roll was called and final attendance was recorded as follows:

A motion was offered by Mrs. Cecelia Broussard, seconded by Mr. Jimmie Pellerin, to amend the agenda and include discussion on the Acadia Parish Jail and omit Item 7(a). Motion carried.

A motion was offered by Mr. Jimmie Pellerin, seconded by Mrs. Cecelia Broussard, to approve the Minutes of the June 18, 2002, Regular Police Jury Meeting. Motion carried.

Mr. D.A. Delahoussaye requested assistance in preventing traffic over the bridge adjacent and south of the Kathy Apartments and also requested the Jury abandon the street approaching the bridge.

A suggestion was made to construct fencing to deter foot traffic. No formal action was taken.

A motion was offered by Mrs. Cecelia Broussard, seconded by Mr. Alton Stevenson, to authorize the Secretary-Treasurer to investigate alternative solutions to the overcrowding in the Parish Jail. Motion carried.


ELECTIONS

                                      
RESOLUTION

      BY: MRS CECELIA BROUSSARD AND MRS CATHERINE LACOMBE

WHEREAS, Ordinance #838 of the Acadia Parish Police Jury amending Ordinance #373 provided for the creation of Precinct 1-2c for the Acadia Parish School Board in accordance with the 2002 Census, and

WHEREAS, Precinct 1-2c was created to balance school board district populations as per the reapportionment plan adopted by the board pursuant to the 2000 decennial census, and

WHEREAS, the Acadia Parish School Board submitted an alternate plan reducing the number of members from 16 to 8 and being the same as the Acadia Parish Police Jury which was approved by the U.S. Department of Justice Civil Rights Division after which Precinct 1-2c therefore is of no purpose.

THEREFORE, BE IT RESOLVED by the Acadia Parish Police Jury in regular session duly convened on this the 2nd day of July, 2002, does hereby rescind Ordinance #838 abolishing the creation of Precinct 1-2c effective as of the date of this Resolution.

ORDINANCE #843

          AN ORDINANCE OF THE PARISH OF ACADIA AMENDING
          ORDINANCE #756 PROVIDING FOR THE CONSOLIDATION
          OF PRECINCTS AND THE REDEFINING OF BOUNDARIES

WHEREAS, Ordinance #834 of the Acadia Parish Police Jury amending Ordinance #756 provided for the division of two precincts into smaller voting precincts to satisfy the mandate of reapportionment following the release of 2000 Census data, and

WHEREAS, Ordinance #834 therefore established Precincts 6-2a and 3-3c for the purpose of redrawing Police Jury district boundaries pursuant to the 2000 Dicennial Census, and

WHEREAS, an opportunity to consolidate smaller precincts was provided by an act of the Louisiana Legislature, and

WHEREAS, the Acadia Parish Police Jury desires to redraw the common boundary between Precinct 5-1b and Precinct 5-3 to better accommodate distribution of voters.

NOW, THEREFORE, BE IT ORDAINED:

SECTION 1. All the “Whereas” clauses are incorporated herein and adopted as part of the Ordinance.

SECTION 2. The Acadia Parish Police Jury does consolidate two small precincts to make them part of larger adjourning precincts.

SECTION 3. Voting Precinct 6-2a now therefore is consolidated with and becomes part of Ward 6 Precinct 4.

SECTION 4. Voting Precinct 3-3c now therefore is consolidated with and becomes part of Ward 3 Precinct 1.

SECTION 5. Exhibit A recorded with the Acadia Parish Police Jury and Registrar of Voters Office of Acadia Parish and made a part of this Ordinance defines the boundaries of voting Precincts 6-2, 6-4, 3-1 and 3-3b.

SECTION 6. Voting Precincts 5-3 and 5-1b are hereby re-defined in Exhibit B and recorded with the Acadia Parish Police Jury and Registrar of Voters Office of Acadia Parish and made a part of this Ordinance.

SECTION 7. This Ordinance once adopted shall be submitted for pre-clearance by the United States Department of Justice under the voting rights Act of 1965, as amended.

SECTION 8. This Ordinance becomes effective as provided for by law and all Ordinance or Resolutions or parts thereof, including but not limited to all Ordinance or Resolutions or parts thereof of the Parish of Acadia, if any, in conflict herein are hereby repealed.

This Ordinance was offered by Mrs. Catherine LaCombe, seconded by Mr. Pat Daigle, after being read and considered section by section, was adopted as a whole by the following vote:

YEAS: Alton Stevenson, Catherine LaCombe, John Humble, Sr., Cecelia
          Broussard, Jimmie Pellerin, Pat Daigle and Claude Courville.

NAYS: None.

ABSENT: John Beard.

LEGISLATION

A motion was offered by Mrs. Catherine LaCombe, seconded by Mr. Pat Daigle, to authorize Legal Counsel to research additional legislation to regulate obscenity. Motion carried.


PUBLIC WORKS/ROAD & BRIDGE

                                    
RESOLUTION

         BY: MRS CECELIA BROUSSARD AND MR PAT DAIGLE

WHEREAS, the Acadia Parish Police Jury requested the Louisiana Department of Transportation and Development to erect lighting at the Interstate 10 Interchange at LA. 13 north of the City of Crowley, and

WHEREAS, an agreement between the Department of Transportation and Development the Acadia Parish Police Jury provides that the Parish operate and maintain the lighting system, and

WHEREAS, the City of Crowley recently proposed the annexation of the Interstate Interchange and property north along the LA. 13 corridor thus causing the Interstate Lighting System to be within the corporate limits of the city.

THEREFORE, BE IT RESOLVED by the Acadia Parish Police Jury in regular session duly convened on this the 2nd day of July, 2002, does hereby authorize the President to execute any and all agreements or contracts to facilitate the transfer of the operation and maintenance of the Interstate 10 Lighting at the LA. 13 Interchange to the City of Crowley whereby the City of Crowley would purchase and erect missing poles and fixtures and the Police Jury would restore power to all lights.

BE IT RESOLVED: by the Acadia Parish Police Jury in regular session duly convened this 2nd day of July, 2002, does hereby authorize the Parish Road Manager to prepare specifications and advertise for one new hydraulic excavator with dozer blade and one new utility trailer.

Recommendation to refer to Legal Counsel requested changes in the Waste Disposal Ordinance was postponed.


SOLID WASTE/ENVIRONMENTAL

A motion was offered by Mrs. Catherine LaCombe, seconded by Mr. Pat Daigle, to authorize the purchase of one used state surplus vehicle for use at the Acadia Parish Sanitary Landfill at a cost not to exceed $5,000.00. Motion carried.


COMMENTS FROM THE PUBLIC

President Courville reminded members of the public hearing scheduled for July 16, 2002.

Mrs. Mary Brasseaux urged the Jury to consider requesting DEQ include in their site cleanup the building located at Major Mud.

Juror Catherine LaCombe announced absentee voting begins Monday for the upcoming July 20th election.

Mr. Lynn Richard, Church Point area resident, voiced his objection to the delays to the Phase III road work.

The Secretary-Treasurer announced the changes to the Community Clinic schedules affecting Iota and Rayne.

THERE BEING NO FURTHER BUSINESS TO COME BEFORE THE MEETING, THE MOTION WAS OFFERED DULY SECONDED, THAT THE MEETING ADJOURN UNTIL THE NEXT REGULARLY SCHEDULED MEETING OF JULY 16, 2002, AT THE HOUR OF 6:30 P.M.
