MARCH 5, 2002

THE ACADIA PARISH POLICE JURY met on the above date at 6:30 p.m., in the Police Jury Meeting Room, Courthouse Building, Crowley, Louisiana, in regular session with the President, Claude Courville, presiding. At the request of the President, a moment of silence was offered and the Pledge to the Flag was recited in unison. The roll was called and final attendance was recorded as follows:

A motion was offered by Mrs. Catherine LaCombe, seconded by Mr. Pat Daigle, to amend the agenda to include: Teche Road Right-of-Way, authority to protest annexations by the Town of Duson, omit item 10(a), acceptance of the Multipurpose Facility repairs. Motion carried.

A motion was offered by Mr. Jimmie Pellerin, seconded by Mr. John Beard, to approve the Minutes of the February 19, 2002, Regular Police Jury Meeting. Motion carried.


FEDERAL/STATE FINANCIAL ASSISTANCE

                                      
RESOLUTION

           BY MESSRS: ALTON STEVENSON AND PAT DAIGLE

WHEREAS, the Acadia Parish Police Jury is in possession of a bridge located north of the City of Crowley at the junction of Morrow and Indigo Roads and Bayou Plaquemine currently in disrepair and out of service, and

WHEREAS, the Louisiana Department of Transportation and Development and City of Crowley propose to replace, in the near future, the State LA 13 Bridge at Bayou Plaquemine requiring detour routes entering and leaving the City, and

WHEREAS, North Highway 13 serves as a major hurricane evacuation route and thoroughfare for both emergency and non-emergency services immediately outside the corporate limits for schools and residential areas, and

WHEREAS, the use of Morrow and Indigo Roads would greatly enhance and perpetuate access to these areas for emergency services as well as convenience for local residents.

THEREFORE, BE IT RESOLVED by the Acadia Parish Police Jury in regular session duly convened on this the 5th day of March, 2002, does hereby request the Louisiana Department of Transportation and Development fund the repairs to the bridge at the junction of Morrow and Indigo Roads at Bayou Plaquemine as part of the North Highway 13 Crowley Bridge Project that would allow for an acceptable emergency detour route during construction as well as alleviate the serious congestion realized at the intersection of I-10, LA 100 and LA 13.

RESOLUTION

           BY: MRS CATHERINE LACOMBE AND MR PAT DAIGLE

WHEREAS, under the authorization of the Stewart B. McKinney Homeless Assistance Act funds are allocated to the State of Louisiana by the U. S. Department of Housing and Urban Development (HUD) for distribution to eligible recipients, and

WHEREAS, funds available under the ESG Program are dedicated for the rehabilitation, renovation or conversion of buildings for use as shelters for the homeless, and

WHEREAS, grantee local governments may make available all or part of grant amounts to private non-profit organizations such as the ASSIST Agency for use in eligible program activities, and

WHEREAS, careful attention has been paid to eligibility criteria requirements for matching funds and environmental clearance and required compliance with Federal and State regulations governing the use of these funds.

THEREFORE, BE IT RESOLVED by the Acadia Parish Police Jury in regular session duly convened on this the 5th day of March, 2002, does hereby authorize application for funds provided by the Homeless Emergency Shelter Grants Program.

BE IT FURTHER RESOLVED that the President be empowered, authorized and directed to execute Subgrant Agreement with the Assist Agency (Recipient) for the administration of program funds.

BE IT FURTHER RESOLVED that the President be authorized to execute final grant agreement with the Department of Social Services.

President Courville extended open thanks to NRG, Inc., and Legal Counsel for the funding of road improvements in the vicinity of the Peaking Power Plant currently under construction in Evangeline, LA.


FINANCE

A motion was offered by Mr. Alton Stevenson, seconded by Mrs. Catherine LaCombe, to authorize a purchasing limit of $2,000 per event for bridge materials including culverts without prior authorization from funds budgeted in the Sales Tax Road Fund 1996. Motion carried.

WHEREAS, the Acadia Parish Police Jury advertised for an oil, gas and mineral lease as provided by law for all of the oil rights in and to any highways, rights-of-way, streets, roads, lanes and alleys or other lands owned by and not presently under mineral lease from the Acadia Parish Police Jury, Acadia Parish, Louisiana in the following described property:

          All of the rights, titles, and interest in any highways,
          right-of-ways, roads, or other lands owned by and not
          under mineral lease from Acadia Parish Police Jury,
          situated in Acadia Parish, Louisiana, within the
          following described boundaries:

          Beginning at a point having coordinates of X=
          1,709,780.00’ and Y=568,710.00’;

          Thence SOUTH 6,402.78 feet to a point having
          coordinates of X=1,709,780.00’ and Y=562,307.22’;

          Thence WEST 2,680.00 feet to a point having
          coordinates of X=1,707,100.00’ and Y=562,307.22’;

          Thence NORTH 6,402.78 feet to a point having
          coordinates of X=1,707,100.00’ and Y=568,710.00’;

          Thence EAST 2,680.00 feet to the point of beginning,
          containing approximately 5 acres, as shown outlined in
          red on the attached plat. All bearings, distances and
          coordinates are based on the Louisiana Coordinate
          System of 1927 (South Zone).

WHEREAS, the following bid of Jil Exploration, Inc. was the sole bid received:

For a three (3) year lease.

BONUS: $1,000.00 (One Thousand and 00/100 Dollars).

DELAY RENTAL: $500.00 (Five Hundred and 00/100 Dollars).

ROYALTY: 1/4 of all the oil, gas and all other minerals produced and
               saved. 1/4 of all gas produced and saved or utilized, but not
               less than 1/8th, and 1/4 of all other liquid or gaseous minerals
               in solution and produced with oil and gas and saved or utilized
               but not less than 1/8th.

PRIMARY TERMS: Three (3) years.

WHEREAS, after careful consideration it is the opinion of the Police Jury that the bid is satisfactory.

THEREFORE, BE IT RESOLVED by the Acadia Parish Police Jury in regular session duly convened this 5th day of March, 2002, that the bid of Jil Exploration, Inc., for said oil, gas and mineral lease is hereby accepted, and

BE IT FURTHER RESOLVED that the President is hereby authorized to sign the oil, gas and mineral lease as herein approved in behalf of the Acadia Parish Police Jury, and

BE IT FURTHER RESOLVED that a completed copy of said lease be sent to the Louisiana State Mineral Board for its approval.

A motion was offered by Mr. Pat Daigle, seconded Mr. Jimmie Pellerin, to approve the request by I-Acadia for funding in the amount of $10,000 to facilitate the organization’s move to the Enterprise Center of Acadia Parish. Motion carried.

A motion was offered by Mr. John Beard, seconded by Mrs. Catherine LaCombe, to increase the operation and maintenance budget for the Multipurpose Facility in the amount of $10,000 for additional repairs. Motion carried.


LEGISLATION

Comments were entered into the record by Mr. Charles King to Legal Counsel requesting a response as to the authority of the Police Jury to create precinct 1-2c and the available window of opportunity.

Counsel advised that these issues were presented to Demographer Mike Hefner for an official response.

Mr. Hefner advised that the Jury did have authority to adopt the Ordinance providing for the creation of precinct 1-2c as presented.

                               
ORDINANCE NO. #838
                                  CREATION OF PRECINCT 1-2C

          AN ORDINANCE AMENDING ORDINANCE NO. 373, CREATING
          VOTING PRECINCT 1-2C FOR THE ACADIA PARISH SCHOOL
          BOARD OF THE PARISH OF ACADIA, LOUISIANA, IN
          ACCORDANCE WITH THE 2000 CENSUS

WHEREAS, the Acadia Parish School Board desires to adopt Reapportionment Plan I and under that plan there is one additional precinct that must be divided in order to maintain minority representation levels as close to 1990 levels as possible and to stay in compliance with applicable State statutes; and

WHEREAS, since the School Board has a different membership than the Acadia Parish Police Jury, it may, under State statutes, split up to two precincts per district; and

WHEREAS, to maintain the proper minority representation levels in the Rayne area, it was necessary to split three precincts in School Board District 10; and

WHEREAS, each Acadia Parish School Board District cannot contain split precincts beyond the two allowed by State law and thereafter the remaining precincts must be whole precincts as approved by the Acadia Parish Police Jury; and

WHEREAS, the Acadia Parish School Board respectfully requests from the Acadia Parish Police Jury that Precinct 1-2B be split to form Precinct 1-2C so that it may submit its reapportionment Plan 1 to the U.S. Department of Justice for Section 5 Pre-Clearance;

BE IT ORDAINED by the Acadia Parish Police Jury, in regular session assembled, that Ordinance No. 373 be and the same is hereby amended to create Precinct 1-2C out of the Precinct 1-2B to wit:

          Commencing from the Point of Beginning at the intersection
          of the centerline of S. Arenas St. and the Southern Pacific
          Railroad tracks, thence southerly on S. Arenas St. to the
          intersection with the centerline of E. Butler St., thence
          easterly on E. Butler St. to the intersection with the
          centerline of S. Chevis St., thence southerly on S. Chevis
          St. to the intersection of the centerline of E. Branche St.,
          thence westerly on E. Branche St. to the intersection with
          the centerline of S. Parkerson St., thence northerly on S.
          Parkerson St. to the intersection with the Southern Pacific
          Railroad tracks, thence easterly on the Southern Pacific
          Railroad tracks to the Point of Beginning.

Said precinct having the following Census 2000 demographics:

Population: 269                     Minority Population: 12
Voting Age Population: 191      Minority Voting Age Population: 7

The remainder of the provisions of Ordinance No. 373 shall remain in full force and effect. All Ordinance or Resolutions or parts thereof in conflict herewith are hereby repealed. This amended Ordinance is to become effective upon the receipt of Pre-Clearance from the U.S. Department of Justice of these precinct amendments.

After being considered section by section and being put to a vote on the whole, the vote thereon was as follows:

YEAS: Alton Stevenson, Catherine LaCombe, Jimmie Pellerin, John Beard,
          Pat Daigle and Claude Courville.

NAYS: None.

ABSENT: John Humble, Sr. and Cecelia Broussard

And the said Ordinance was therefore declared adopted on this 5th day of March, 2002.

PERSONNEL

The Parish Secretary in association with Animal Control offered a plan to expand the Rabies Program into the small municipalities at the same time developing a method to provide additional support for the Parish.

A motion was offered by Mr. Alton Stevenson, seconded by Mrs. Catherine LaCombe, to authorize contact with local mayors and for Legal Counsel to prepare an intergovernmental agreement to facilitate a pilot program to provide aid in the form of Rabies and Animal Control to small municipalities. Motion carried.


PUBLIC WORKS/ROAD & BRIDGE

Residents from the Community of Midland requested assistance to obtain passage onto private property by way of an undeveloped dedicated servitude located at the junction of Tech Street, Crocker Street, and Huntington. It was noted that a house was situated very near the extension of Teche and on the portion of right-of-way known as Huntington.

A motion was offered by Mr. John Beard, seconded by Mr. Pat Daigle, to authorize Legal Counsel to prepare written notice to the individuals living on the undeveloped right-of-way known as Huntington Street in Midland, Acadia Parish, to authorize Mader-Miers Engineering to survey the assumed right-of-way and assign the Parish Road Manager to prepare a basic cost estimate to improve the proposed easement.

Motion was amended by Mr. John Beard, seconded by Mr. Pat Daigle, not to authorize the proposed survey. The motion as amended was adopted.

                                 
ORDINANCE #839

AN ORDINANCE MAKING IT UNLAWFUL FOR ANY PERSON TO OPERATE OR DRIVE A MOTOR VEHICLE UPON AUBRY ROAD IN ACADIA PARISH, LOUISIANA, AT A SPEED IN EXCESS OF
FIFTEEN MILES PER HOUR, AND, PROVIDING FOR THE PENALTIES FOR THE VIOLATION THEREOF.

SECTION 1. BE IT ORDAINED by the Police Jury of Acadia Parish, Louisiana, that it shall be unlawful for any person to operate or drive a motor vehicle in excess of fifteen miles per hour on the following described Parish Road:

                                                 Aubry Road

SECTION 2. BE IT FURTHER ORDAINED that any person found guilty of operating or driving a motor vehicle in excess of fifteen miles per hour on the Parish road described above, shall be guilty of a misdemeanor, and upon conviction therefore, shall be fined not more than Fifty Dollars ($50) or be imprisoned not more than ten (10) days or both.

SECTION 3. BE IT FURTHER ORDAINED that any laws or parts of laws in conflict are hereby repealed.

The Ordinance was offered by Mr. Alton Stevenson, and seconded by Mr. Pat Daigle, after being read and considered section by section, was adopted as a whole by the following vote:

The Sales Tax Report was presented for the month of February, 2002. The report indicated a gross receipt of $531,210.71, a decrease of $272,605.75 from February, 2001.


LITIGATION

A motion was offered by Mrs. Catherine LaCombe, seconded by Mr. Pat Daigle, to adjourn into executive session to discuss pending litigation Acadia Parish Police Jury and Acadia Parish Sheriff’s Office vs. Town of Duson Docket #75,890E. The following roll call vote was cast: Yeas: Alton Stevenson, Catherine LaCombe, Jimmie Pellerin, John Beard, Pat Daigle and Claude Courville. Nays: None. Absent: John Humble, Sr. and Cecelia Broussard. Motion carried.

The President reconvened the meeting following executive session.

A motion was offered by Mrs. Catherine LaCombe, seconded by Mr. Pat Daigle, to authorize Legal Counsel and the Parish President to file suit in opposition to current and future annexations by the Town of Duson into Acadia Parish until such time that the pending litigation is settled. Motion carried.


COMMENTS FROM THE PUBLIC

Juror LaCombe introduced a request made by a local volunteer fire department for financial assistance to obtain medical equipment known as an AED (defibulator). She suggested other Jurors contact their local firefighters to determine similar needs.
