THE ACADIA PARISH POLICE JURY met on the above date at 6:30 p.m., in
the Police Jury Meeting Room, Courthouse Building, Crowley,
Louisiana, in regular session with the President, Claude Courville,
presiding. At the request of the President, a moment of silence was
offered and the Pledge to the Flag was recited in unison. The roll
was called and final attendance was recorded as follows:

A motion was offered by Mrs. Catherine LaCombe, seconded by Mr.
Alton Stevenson, to revise the agenda and add a request by Conoco to
repair an underground pipeline and a speed limit on Crown Road.
Motion carried.
A motion was offered by Mr. Jimmie Pellerin, seconded by Mr. John
Beard, to approve the Minutes of the April 16, 2002, Regular Police
Jury Meeting. Motion carried.
Tourist Commission Director Gwen Hanks presented the new Parish Flag
to the Acadia Parish Police Jury. The flag was designed by the
Acadia Parish Tourist Commission and will fly at the National
Association of County’s Convention in New Orleans in July.
RESOLUTION

WHEREAS, the Acadia Parish
Police Jury allows enrollment in a voluntary Deferred Compensation
Benefit Plan administered by Value Teachers and NationalWide
Retirement Solutions through payroll deduction, and
WHEREAS, the Police Jury
wishes to enhance the benefit package provided to its employees as a
means of recruiting and retention.
THEREFORE, BE IT RESOLVED by
the Acadia Parish Police Jury in regular session duly convened on
this the 7th day of May, 2002, does hereby empower, authorize and
direct the President to execute any and all contracts to implement
an employer 3% match of the employee’s gross salary to the voluntary
deferred compensation plan.
BE IT FURTHER RESOLVED that
the requirement to participate will include the following: (1) that
a person be employed at least six months, (2) a person participate
for a period of four years to be vested, (3) person must be a
full-time employee.

COMMUNITY/ECONOMIC DEVELOPMENT
A large group of residences were in attendance in protest to the
location of an adult retail outlet in the unincorporated area of the
Parish near the Community of Egan along Interstate 10.
Presenting strong verbal opposition and addressing the body were the
following people: Lisa Martin, a local resident, Joe Gall, Pastor of
the Haven Church in Egan, Roger Tarver, Lloyd Singley, Pastor of the
Northside Assembly of God Church, Barry Thompson, representing
Family Vision Christian Television & KAJN Radio, Mrs. Ezora Proctor,
former educator, Todd Hanks, Youth Pastor of the Acadiana Cathedral,
the Pastor of the Parkview Baptist Church and Bonnie Emerson.
Legal Counsel André Doguet stated that Title 14 of the Louisiana
Revised Statutes provides for uniform legislation related to crimes
of obscenity. He advised that action be taken to formally request
the District Attorney to investigate possible violations. He
indicated that the law centers around contemporary community
standards.

Jury for approval.

WHEREAS, the Board of
Commissioners of Acadia-Evangeline Fire Protection District of the
Parishes of Acadia and Evangeline, State of Louisiana (the
“Governing Authority”), acting as the governing authority of
Acadia-Evangeline Fire Protection District of the Parishes of Acadia
and Evangeline, State of Louisiana (the “District”), adopted a
resolution on April 23, 2002, calling a special election in the
District on Saturday, July 20, 2002, to authorize the levy of a
special tax therein; and
WHEREAS, the governing
authority of the District has requested that this Police Jury,
acting as the governing authority of the Parish of Evangeline, State
of Louisiana, give its consent and authority for the District to
hold the aforesaid election, and in the event that the election
carries to levy and collect the special tax provided for therein;
and
WHEREAS, as required by
Article VI, Section 15 of the Constitution of the State of Louisiana
of 1974, it is now the desire of this Police Jury to approve the
holding of said election and in the event that the election carries,
to levy and collect the special tax provided for therein.
NOW, THEREFORE, BE IT RESOLVED
by the Police Jury of the Parish of Acadia, State of Louisiana,
acting as the governing authority of said Parish, that:

RESOLUTION

BE IT RESOLVED: by the Acadia
Parish Police Jury in regular session duly convened this 7th day of
May, 2002, does hereby authorize an amendment to the staffing
agreement with the American Legion Hospital to provide necessary
employees to operate the Acadia Parish Community Clinics.
BE IT FURTHER RESOLVED that
the amendment provide for an increase in the amount paid for the
staffing of clinics by an estimated $3.00 per hour for full-time
employment.

LEGISLATION
A motion was offered by Mr. John Humble, Sr., seconded by Mrs.
Catherine LaCombe, to approve the request to prepare a draft
Ordinance regulating certain domestic and vicious animals. Motion
carried.
PERSONNEL
A motion was offered by Mr. John Humble, Sr., seconded by Mrs.
Catherine LaCombe, to approve a probationary pay increase for Mr.
David Duhon in the amount of 5% effective May 16, 2002. Motion
carried.
PUBLIC FACILITIES/BUILDING & GROUNDS
No action was taken relative to the request to execute an
“Acknowledgment and Consent” form pertaining to the lease with Cajun
Bag.
A motion was offered by Mr. Jimmie Pellerin, seconded by Mr. John
Beard, to approve the use of funds set aside for contractual labor
as overtime pay for the purpose of maintaining the Rayne Public
Health Facility. Motion carried.
A motion was offered by Mr. John Humble, Sr., seconded by Mrs.
Catherine LaCombe, to authorize Architect Ron Lawson to prepare a
cost estimate to repair and improve the court room facilities in the
Acadia Parish Courthouse as per the request made by the Acadia
Parish Bar Association. Motion carried.
A motion was offered by Mr. Alton Stevenson, seconded by Mrs.
Catherine LaCombe, to approve the request made by Animal Control to
purchase a euthanizing chamber and make improvements to the Animal
Shelter. Motion carried.
PUBLIC WORKS/ROAD & BRIDGE
RESOLUTION

remobilization, repreparation of base course, removal of damaged
surface treatment and lost production due to flooding of roadway
from agricultural practices in the amount of Thirty-four Thousand
Six Hundred Twenty-one and 00/100 ($34,621.00) Dollars with W.R.
Core, LLC.

Engineer Tim Mader reported on the progress being made to negotiate
for the additional work provided in Change Order No. 1 to Phase III
Part A Contract 2 of Parishwide Road Improvements. He noted that the
contractor was not prepared to commit to the additional work.
A motion was offered by Mr. John Humble, Sr., seconded by Mr. John
Beard, to approve the Emergency Work Report for the month of April,
2002. Said expenditures to be in the amount of $254.61. Motion
carried.
RESOLUTION

WHEREAS, bids were received
and duly opened on April 23, 2002, for the Parishwide Base Failure
Repair and Asphalt Surface Leveling Project, and
WHEREAS, one bid was received
in the amount of $219,925.00 (base bid) $60,600.00 (Additive
Alternate No. 1) and $87,024.00 (Additive Alternate No. 2) from
Prairie Construction Company, Inc., and
WHEREAS, the Police Jury saw
fit to appropriate $100,000.00 for fiscal year 2001 and $100,000.00
for fiscal year 2002 and the estimate to construct the improvements
did not exceed the appropriated funding.
WHEREAS, the base bid
submitted by Prairie Construction Company was in excess of the
estimated cost as well as the funding appropriations.
THEREFORE, BE IT RESOLVED by
the Acadia Parish Police Jury in regular session duly convened on
this the 7th day of May, 2002, does hereby reject the bid submitted
by Prairie Construction as it exceeded the estimated cost and the
money appropriated to construct the project.
BE IT FURTHER RESOLVED that
the firm of Aucoin & Associates be authorized to amend the plans and
solicit bids for the Parishwide Base Failure and Leveling Project.

the Police Jury of Acadia Parish, Louisiana, that it shall be
unlawful for any person to operate or drive a motor vehicle in
excess of thirty-five miles per hour
on the following described Parish Road:
Goodrich Road
SECTION 2. BE IT FURTHER ORDAINED
that any person found guilty of operating or driving a motor vehicle
in excess of thirty-five miles per hour
on the Parish road described above, shall be guilty of a
misdemeanor, and upon conviction therefore, shall be fined not more
than Fifty Dollars ($50) or be imprisoned not more than ten (10)
days or both.
SECTION 3. BE IT FURTHER ORDAINED
that any laws or parts of laws in conflict are hereby repealed.
