SEPTEMBER 3, 2002

THE ACADIA PARISH POLICE JURY met on the above date at 6:30 p.m., in the Police Jury Meeting Room, Courthouse Building, Crowley, Louisiana, in regular session with the President, Claude Courville, presiding. At the request of the President, a moment of silence was offered and the Pledge to the Flag was recited in unison. The roll was called and final attendance was recorded as follows:

A motion was offered by Mrs. Catherine LaCombe, seconded by Mr. Alton Stevenson, to revise the agenda and include the following: Consider Change Order to Phase III Part A Contract 1, recognition of elected dignitaries, speed limits in District 7. Motion carried.

A motion was offered by Mr. Jimmie Pellerin, seconded by Mrs. Cecelia Broussard, to approve the Minutes of the August 20, 2002, Regular Police Jury Meeting. Motion carried.

                                     
RESOLUTION

WHEREAS, Mrs. Wadie Helen Bias and Mr. Joseph Pete are long standing and respective members of the Acadia Parish Community, and

WHEREAS, the Acadia Parish Police Jury acknowledges the dedicated service they have given their community and extends a unanimous vote of thanks and appreciation for the years of excellent and dedicated service they have provided to the Parish of Acadia, and

WHEREAS, Mrs. Wadie Helen Bias is recognized as the First Black Female Elected Official and Mr. Joseph Pete is recognized as the First Black Male Elected Official in the State.

THEREFORE, BE IT RESOLVED by the Acadia Parish Police Jury in regular session duly convened on this the 3rd day of September, 2002, does hereby extend to Mrs. Wadie Helen Bias and Mr. Joseph Pete its best wishes and many thanks for such profound and dedicated service.

BE IT FURTHER RESOLVED that this Resolution be formally presented and made a part of the permanent records in the Minutes of these proceedings.

     ENDORSEMENT RESOLUTION FOR A COMPANY TO PARTICIPATE
                        IN THE ENTERPRISE ZONE PROGRAM

RESOLUTION STATING THE ACADIA PARISH POLICE JURY'S ENDORSEMENT OF SOUTHERN KEY DEVELOPERS, LLC, TO PARTICIPATE IN THE BENEFITS OF THE LOUISIANA ENTERPRISE ZONE PROGRAM

WHEREAS, the Louisiana Enterprise Zone act of 1981, Act 901 was enacted by the Louisiana State Legislature, and Act 337 was enacted by the 1982 Legislature, Act 433 was enacted by the 1987 Legislature and Act 581 was enacted by the 1995 Legislature, and

WHEREAS, the Louisiana Enterprise Zone Program offers significant incentives for economic development to some of the most distressed areas in the Parish of Acadia, and

WHEREAS, the Louisiana Department of Economic Development designated Census Tract 9608, Block Group 007 or Economic Development Zone in Acadia Parish as an "Enterprise Zone or Economic Development Zone" eligible based on enabling legislation (R.S.51.21.1787-1791), and

WHEREAS, the Acadia Parish Police Jury states this endorsement is in agreement with the Overall Economic Development Plan for the Parish of Acadia, and

WHEREAS, the attached Enterprise Zone map has been marked to show the location of the business being endorsed, and

WHEREAS, in accordance with the Louisiana Enterprise Zone Program requirements the Acadia Parish Police Jury agrees:

1. To participate in the enterprise zone program.

2. To assist the Department in evaluating progress made in any enterprise
     zone within its jurisdiction.

BE IT RESOLVED by the Acadia Parish Police Jury in due, regular and legal session convened this 3rd day of September, 2002, that Southern Key Developers, and their project, new facility, State Application #20020417 is endorsed to participate in the Louisiana Enterprise Zone Program.

BE IT FURTHER RESOLVED that if any provision or item of this resolution or the application thereof is held invalid, such invalidity shall not affect other provisions, items or applications of this resolution which can be given effect without the invalid provisions, items or applications and to this end the provisions of this resolution are hereby declared severable.

BE IT FURTHER RESOLVED that all resolutions or parts thereof in conflict herewith are hereby repealed.

ELECTIONS

A suggestion was offered by local businessman Mr. L. J. Gielen to consider rededicating the Solid Waste Sales Tax for the purpose of mosquito control as an alternative to a new sales tax. Questions were asked by Juror Broussard related to the fund and the cost of the election. The 1/4 cents sales tax was defended by Vice President Humble indicating that it would be a small cost for a family of four.

The following Resolution was offered by Mr. John Humble, Sr., and seconded by Mr. Pat Daigle:

                                     
RESOLUTION

          A Resolution ordering and calling a special emergency
          election to be held in the Parish of Acadia, State of
          Louisiana, to authorize the levy of a sales and use tax
          therein; making application to the State Bond
          Commission in connection therewith; and providing for
          other matters in connection therewith.

WHEREAS, the Parish of Acadia, State of Louisiana (the “Parish”), proposed sales tax was defeated at a special election held on July 20, 2002; and

WHEREAS, as a result of the defeat of said proposed sales tax, a real emergency presently exists as this Parish does not have the funds necessary to properly operate and maintain its mosquito control program; and

BE IT RESOLVED by the Police Jury of the Parish of Acadia, State of Louisiana (the “Governing Authority”), acting as the governing authority of the Parish of Acadia, State of Louisiana (the “Parish”), that:

SECTION 1. Election Call. Subject to the approval of the State Bond Commission, and under the authority conferred by Article VI, Section 29 of the Constitution of the State of Louisiana of 1974, the applicable provisions of Chapter 5, Chapter 6-A and Chapter 6-B of the Louisiana Election Code, and other constitutional and statutory authority, a special emergency election is hereby called and ordered to be held in the Parish on TUESDAY, NOVEMBER 5, 2002, between the hours of six o’clock (6:00) a.m., and eight o’clock (8:00) p.m., in accordance with the provisions of La. R.S. 18:541, and at the said election there shall be submitted to all registered voters qualified and entitled to vote at the said election under the Constitution and laws of this State and the Constitution of the United States, the following proposition, to-wit:

                          PROPOSITION (1/4% SALES TAX)

          SUMMARY: 1/4% SALES AND USE TAX FOR A PERIOD
          OF 10 YEARS TO BE DEDICATED AND USED FOR THE
          PURPOSE OF PAYING THE COST OF MAINTAINING AND
          OPERATING A PARISHWIDE MOSQUITO CONTROL
          PROGRAM, INCLUDING THE COST OF ACQUIRING LAND,
          BUILDINGS AND EQUIPMENT NECESSARY IN
          CONNECTION THEREWITH, WITH AUTHORITY TO FUND
          THE PROCEEDS OF THE TAX INTO BONDS TO PAY THE
          COST OF CAPITAL IMPROVEMENTS FOR SUCH
          PURPOSES.

          Shall the Parish of Acadia, State of Louisiana (the
          “Parish”), under the provisions of Article VI, Section
          29 of the Constitution of the State of Louisiana of
          1974, and other constitutional and statutory authority,
          be authorized to levy and collect a tax of one-fourth
          of one percent (1/4%) (the “Tax”) for a period of ten
          (10) years from the date of the first levy of the Tax
          upon the sale at retail, the use, the lease or rental,
          the consumption, and the storage for use or
          consumption, of tangible personal property and on
          sales of services within the Parish, all as defined in
          R.S. 47:301 through 47:317, with the proceeds of the
          Tax (after paying the reasonable and necessary costs
          and expenses of collecting and administering the Tax)
          to be dedicated and used for the purpose of paying the
          cost of maintaining and operating a parishwide
          mosquito control program, including the cost of acquiring
          land, buildings and equipment necessary in connection
          therewith; and further, shall the Parish be authorized to
          fund the proceeds of the Tax into bonds to pay the cost
          of capital improvements for such purposes to the extent
          and in the manner permitted by the laws of Louisiana?

SECTION 2. Publication of Notice of Election. A Notice of Special Election shall be published in the Rayne Acadian Tribune, a weekly (published on Thursday) newspaper of general circulation within the Parish, published in Rayne, Louisiana, and being the official journal of the Parish, once a week for four consecutive weeks, with the first publication to be made not less than forty-five (45) days not more than ninety (90) days prior to the date of the election, which Notice shall be substantially in the form attached hereto as “Exhibit A” and incorporated herein by reference the same as if it were set forth herein in full.

SECTION 3. Canvass. This Governing Authority shall meet at its regular meeting place, the Police Jury Room of the Courthouse, Crowley, Louisiana, on TUESDAY, NOVEMBER 18, 2002, at SIX-THIRTY O’CLOCK (6:30) P.M., and shall then and there in open and public session proceed to examine and canvass the returns and declare the result of the said special election.

SECTION 4. Polling Places. The polling places set forth in the aforesaid Notice of Special Election are hereby designated as the polling places at which to hold the said election, and the Commissioners-in-Charge and Commissioners, respectively, will be the same persons as those designated in accordance with law.

SECTION 5. Election Commissioners; Voting Machines. The officers designated to serve as Commissioners-in-Charge and Commissioners pursuant to Section 4 hereof, or such substitutes therefor as may be selected and designated in accordance with La. R.S. 18:1287, shall hold the special election as herein provided, and shall make due returns of said election for the meeting of the Governing Authority to be held on Tuesday, November 18, 2002, as provided in Section 3 hereof. All registered voters in the Parish will be entitled to vote at the special election, and voting machines shall be used.

SECTION 6. Authorization of Officers. The Secretary of the Governing Authority is hereby empowered, authorized and directed to arrange for and to furnish to said election officers in ample time for the holding of said election, the necessary equipment, forms and other paraphernalia essential to the proper holding of said election and the President and/or Secretary of the Governing Authority are further authorized, empowered and directed to take any and all further action required by State and/or Federal law to arrange for the election, including but not limited to, appropriate submission to the Federal Department of Justice under Section 5 of the Federal Voting Rights Act of 1965, as amended.

SECTION 7. Furnishing Election Call to Election Officials. Certified copies of this resolution shall be forwarded to the Secretary of State, the Commissioner of Elections, the Clerk of Court and Ex-Officio Parish Custodian of Voting Machines of Acadia Parish and the Registrar of Voters of Acadia Parish, as notification of the special election, in order that each may prepare for said election and perform their respective functions as required by law.

SECTION 8. Application to State Bond Commission. Application is made to the State Bond Commission for consent and authority to hold the special election as herein provided, and in the event said election carries for further consent and authority to levy and collect the sales and use tax provided for therein. A certified copy of this resolution shall be forwarded to the State Bond Commission on behalf of this Governing Authority, together with a letter requesting the prompt consideration and approval of this application.

This resolution having been submitted to a vote, the vote thereon was as follows:

NOTICE OF SPECIAL ELECTION

Pursuant to the provisions of a resolution adopted by the Police Jury of the Parish of Acadia, State of Louisiana (the “Governing Authority”), acting as the governing authority of the Parish of Acadia, State of Louisiana (the “Parish”), on September 3, 2002, NOTICE IS HEREBY GIVEN that a special election will be held within the Parish on
TUESDAY, NOVEMBER 5, 2002, and that at the said election there will be submitted to all registered voters in the Parish qualified and entitled to vote at the said election under the Constitution and Laws of the State of Louisiana and the Constitution of the United States, the following proposition, to-wit:

FEDERAL/STATE FINANCIAL ASSISTANCE

                                      
RESOLUTION

WHEREAS, uncontrolled overcrowding in the Acadia Parish Jail has required the Acadia Parish Police Jury to consider expansion to the existing jail facility, and

WHEREAS, there is a large number of warrants out for the arrest of other serious violators with no place to house them, and

WHEREAS, Senators Gerald Theunissen and Fred Hoyt, Representative Gil Pinac, Greg Frugé and Dan Morrish requested that the Acadia Parish Police Jury submit a Capital Outlay Budget Request for funding to expand the Acadia Parish Jail and alleviate serious overcrowding.

THEREFORE, BE IT RESOLVED by the Acadia Parish Police Jury in regular session duly convened on this the 3rd day of September, 2002, does hereby agree to prepare and submit a Capital Outlay Budget Request for this purpose.

BE IT FURTHER RESOLVED that Mark Lalande, Architect, be designated as the Project Architect providing services to develop conceptual plans, preliminary cost estimates and Capital Outlay Budget Requests.

HEALTH

Mr. John Quebodeaux, Director of Emergency Management, advised of the ongoing mosquito abatement activities including ground and aerial spraying along with surveillance work. He further advised that in order to complete the necessary aerial work which would cover the remaining parts of the Parish that it would cost an additional $100,000.00.

A motion was offered by Mr. John Humble, seconded by Mr. Pat Daigle, to authorize an additional $100,000.00 expenditure from the Public Health Unit Fund for a total of $300,000.00 for the purpose of abating mosquitos. Motion carried.


PROPERTY ASSESSMENT

                                     
RESOLUTION

WHEREAS, the list of assessments for the Parish of Acadia in the dollar amount of $181,222,230.00 have been exposed for public review, and

WHEREAS, the Acadia Parish Police Jury did sit as a Board of Review as required by law and no protests were received.

THEREFORE, BE IT RESOLVED by the Acadia Parish Police Jury in regular session duly convened on this the 3rd day of September, 2002, that valuation for the 2002 Taxes, Parish of Acadia, as set by the Acadia Parish Tax Assessor, be and the same is hereby accepted by the Police Jury of Acadia Parish.

BE IT RESOLVED: by the Acadia Parish Police Jury in regular session duly convened this 3rd day of September, 2002, does hereby empower, authorize and direct the President to execute an Intergovernmental Agreement with the City of Crowley to extend sewer service to the Correctional Center expansion on Capitol Avenue at an estimated cost of $15,000.00.

BE IT RESOLVED: by the Acadia Parish Police Jury in regular session duly convened this 3rd day of September, 2002, does hereby empower, authorize and direct the President to execute a long term lease with Southwest Acadia Water Corporation to locate a water treatment facility at the LeGros Memorial Airport contingent upon FAA approval.

PUBLIC WORKS/ROAD & BRIDGE

A motion was offered by Mr. Alton Stevenson, seconded by Mrs. Catherine LaCombe, to approve the request to open cut Ellis Road to install an irrigation pipe line. Motion carried.

                                 
ORDINANCE #848

AN ORDINANCE MAKING IT UNLAWFUL FOR ANY PERSON TO OPERATE OR DRIVE A MOTOR VEHICLE UPON GOODRICH ROAD IN ACADIA PARISH, LOUISIANA, AT A SPEED IN EXCESS OF
TWENTY-FIVE MILES PER HOUR, AND, PROVIDING FOR THE PENALTIES FOR THE VIOLATION THEREOF.

SECTION 1. BE IT ORDAINED by the Police Jury of Acadia Parish, Louisiana, that it shall be unlawful for any person to operate or drive a motor vehicle in excess of twenty-five miles per hour on the following described Parish Road:

SECTION 2. BE IT FURTHER ORDAINED that any person found guilty of operating or driving a motor vehicle in excess of twenty-five miles per hour on the Parish road described above, shall be guilty of a misdemeanor, and upon conviction therefore, shall be fined not more than Fifty Dollars ($50) or be imprisoned not more than ten (10) days or both.

SECTION 3. BE IT FURTHER ORDAINED that any laws or parts of laws in conflict are hereby repealed.

The Ordinance was offered by Mr. Pat Daigle, and seconded by Mr. John Humble, Sr., after being read and considered section by section, was adopted as a whole by the following vote:

YEAS: Alton Stevenson, Catherine LaCombe, John Humble, Sr., Jimmie
          Pellerin, Cecelia Broussard, John Beard, Pat Daigle and Claude
          Courville.

NAYS: None.

ABSENT: None.

RESOLUTION

      BY: MRS CATHERINE LACOMBE AND MR ALTON STEVENSON

BE IT RESOLVED: by the Acadia Parish Police Jury in regular session duly convened this 3rd day of September, 2002, does hereby authorize the firm of Aucoin & Associates to prepare a Change Order to Phase III Part A Contract 1 for the purpose of including Clement Road, Clover Road and Janice Road improvements at an estimated cost of $50,000.00.

Discussion on speed limits in District 7 were postponed until the next meeting.


SOLID WASTE/ENVIRONMENTAL

A motion was offered by Mrs. Catherine LaCombe, seconded by Mr. Alton Stevenson, to provide roll-off containers to the Cities of Crowley, Rayne and Church Point on a six month trial basis for the purpose of collecting and transporting extraordinary out of compliance municipal solid waste. Motion carried.


COMMENTS FROM THE PUBLIC

Mr. Karl Johnson, resident of District 7, inquired about the blacktopping of Donaut Guillory Road. He also pointed out that the signs along the road were laying in the ditch. Mr. Johnson’s request was reinforced by Mr. Joseph Guidry.

The Secretary announced the upcoming Parish Administrative Officials Conference and the Region Meeting for Saturday, September 7th.

Jurors Alton Stevenson requested information related to the hiring practices for the Registrar of Voters Office.

THERE BEING NO FURTHER BUSINESS TO COME BEFORE THE MEETING, THE MOTION WAS OFFERED DULY SECONDED, THAT THE MEETING ADJOURN UNTIL THE NEXT REGULARLY SCHEDULED MEETING OF SEPTEMBER 17, 2002, AT THE HOUR OF 6:30 P.M.
