PUBLIC HEARING

It was announced by the President, that notice had been given that the Acadia Parish Police Jury would hold a public forum on May 20, 2003, at 6:30 P.M., Police Jury Meeting Room, Courthouse Building, Crowley, Louisiana, to receive comments on the proposed abandonment of the bridge and access street adjacent to and south of the Kathy Apartments, Crowley, LA.

The President made three consecutive requests for comments. None being received.

THERE BEING NO FURTHER COMMENTS TO COME BEFORE THE JURY, THE PRESIDENT ADJOURNED THE PUBLIC HEARING.

THE ACADIA PARISH POLICE JURY met on the above date at 6:30 p.m., in the Police Jury Meeting Room, Courthouse Building, Crowley, Louisiana, in regular session with the President, Claude Courville, presiding. At the request of the President, a moment of silence was offered and the Pledge to the Flag was recited in unison. The roll was called and final attendance was recorded as follows:

A motion was offered by Mrs. Cecelia Broussard, seconded by Mrs. Catherine LaCombe, to move Item 10a and to consider authorizing the Solid Waste Engineer to prepare plans for the extension of the liner in Phase II East at the Acadia Parish Sanitary Landfill. Motion carried.

A motion was offered by Mr. Jimmie Pellerin, seconded by Mr. John Beard, to approve the Minutes of the May 6, 2003, Regular Police Jury Meeting and the May 12, 2003, Special Meeting. Motion carried.

                                      
RESOLUTION

       BY: MR JOHN HUMBLE SR AND MRS CATHERINE LACOMBE

WHEREAS, the Acadia Parish Police Jury published in the Official Journal of the Parish a notice of intention regarding the abandonment of the bridge and access street adjacent to and south of the Kathy Apartments, and

WHEREAS, a public hearing was held to discuss, answer questions and hear any objections to the proposed abandonment, and

WHEREAS, there was no one present who offered any objections.

THEREFORE, BE IT RESOLVED by the Acadia Parish Police Jury in regular session duly convened on this the 20th day of May, 2003, does hereby abandon the bridge and access street adjacent to and south of the Kathy Apartments.

BE IT FURTHER RESOLVED that the Acadia Parish Police Jury does hereby abandon any and all rights which they may have to any servitude of rights-of-way over said property with the exception of access to the bridge material at such time the Parish deems it necessary to remove and relocate it to their advantage.

COMMUNITY/ECONOMIC DEVELOPMENT

A motion was offered by Mr. Pat Daigle, seconded by Mrs. Cecelia Broussard, to refer to the Building & Grounds Committee the request to erect a Memorial near the Courthouse to honor radio personalities Bill Williams and Shel Kanter. Motion carried.

It was announced by the Parish President that negotiations with La Pac, the manufacturing facility in the Industrial Park, had not yet been successful.

A motion was offered by Mr. John Humble, Sr., seconded by Mr. Pat Daigle, to refer the request to purchase property owned by the Parish in the Community of Midland to Legal Counsel for review. Motion carried.

A motion was offered by Mr. Pat Daigle, seconded by Mr. John Beard, to approve the request by the Church Point Chamber of Commerce to provide funding in the amount of $15,000.00 to assist with Chamber activities requiring that they provide semi-annual updates on same. Motion carried with two Jurors voting in opposition to the motion, Mr. Alton Stevenson and Mrs. Cecelia Broussard.

A motion was offered by Mr. Alton Stevenson, seconded by Mr. Jimmie Pellerin, to approve payment in the amount of $25,000.00 to Acadia Economic Development Corporation to provide economic development services for the remainder of 2003. Motion carried.


ELECTIONS

The following Resolution was offered by Mr. Pat Daigle and seconded by Mr. John Humble, Sr. :

                                     
RESOLUTION

          A resolution approving the holding of an election in Fire
          Protection District No. 1 of the Parish of Acadia, State of
          Louisiana, on Saturday, July 19, 2003, to authorize the
          levy of a special tax therein.

WHEREAS, the Board of Commissioners of Fire Protection District No.1 of the Parish of Acadia, State of Louisiana (the “Governing Authority”), acting as the governing authority of Fire Protection District No. 1 of the Parish of Acadia, State of Louisiana (the “District”), adopted a resolution on May 15, 2003, calling a special election in the District on Saturday, July 19, 2003, to authorize the levy of a special tax therein; and

WHEREAS, the governing authority of the District has requested that this Police Jury, acting as the governing authority of the Parish of Acadia, State of Louisiana, give its consent and authority for the District to hold the aforesaid election, and in the event that the election carries to levy and collect the special tax provided for therein; and

WHEREAS, as required by Article VI, Section 15 of the Constitution of the State of Louisiana of 1974, it is now the desire of this Police Jury to approve the holding of said election and in the event that the election carries, to levy and collect the special tax provided for therein;

NOW, THEREFORE, BE IT RESOLVED by the Police Jury of the Parish of Acadia, State of Louisiana, acting as the governing authority of said Parish, that:

SECTION 1. In compliance with the provisions of Article VI, Section 15 of the constitution of the State of Louisiana of 1974, and in accordance with the request of the Board of Commissioners of Fire Protection District No. 1 of the Parish of Acadia, State of Louisiana, this Police Jury hereby approves the holding of an election in the District, on Saturday, July 19, 2003, at which election there will be submitted the following proposition, to-wit:

                                     
PROPOSITION

          SUMMARY: 10 YEAR, 3 MILLS PROPERTY TAX
          CONTINUATION (HERETOFORE LEVIED FOR THE PURPOSE
          OF PAYING DEBT SERVICE ON THE GENERAL OBLIGATION
          BONDS, SERIES 1988, OF THE DISTRICT) FOR ACQUIRING,
          CONSTRUCTING, IMPROVING MAINTAINING AND/OR
          OPERATING FIRE PROTECTION FACILITIES AND EQUIPMENT
          IN AND FOR THE DISTRICT, AND PAYING THE COST OF
          OBTAINING WATER FOR FIRE PROTECTION PURPOSES,
          SAID TAX TO BE IN ADDITION TO ANY OTHER TAXES NOW

          Shall Fire Protection District No. 1 of the Parish of Acadia,
          State of Louisiana (the “District”), be authorized to
          continue to levy a three (3) mills tax (heretofore levied
          for the purpose of paying debt service on the General
          Obligation Bonds, Series 1988, of the District) on all the
          property subject to taxation in the District for a period of
          ten (10) years, beginning with the year 2003 and ending
          with the year 2012, for the purpose of acquiring,
          constructing, improving, maintaining and/or operating fire
          protection purposes, said tax to be in addition to any other
          taxes now being levied by the District for such purposes?

SECTION 2. In the event the election carries, this Police Jury does hereby further consent to and authorize the District to levy and collect the special tax provided for therein.

This resolution having been submitted to a vote, the vote thereon was as follows:

The following Ordinance was offered by Mr. John Humble, Sr. and seconded by Mrs. Catherine LaCombe:

                                 
ORDINANCE #854

          An ordinance creating Mosquito Control Sales Tax District
          No. 3 of the Parish of Acadia, State of Louisiana, and
          providing for other matters in connection therewith.

WHEREAS, Section 2721.6 of Title 33 of the Louisiana Revised Statutes of 1950, as amended, authorizes the Police Jury of the Parish of Acadia, State of Louisiana (the “Police Jury”), to create a Sales Tax District within the Parish of Acadia, State of Louisiana which Sales Tax District shall comprise and embrace all of that territory contained within the corporate boundaries of the Parish, less and except that area of the Parish contained within the corporate limits of the municipalities of Crowley and Rayne, as the corporate limits of said municipalities are presently constituted; and

WHEREAS, it is now the desire of the Police Jury to create a Sales Tax District in the Parish containing all of the aforementioned territory, all for the purpose of submitting to the electorate of said Sales Tax District the question of the imposition of a sales and use tax in said district in the manner provided by the aforesaid statutory provision and Article VI, Section 29 of the Constitution of the State of Louisiana of 1974;

NOW, THEREFORE, BE IT ORDAINED by the Police Jury of the Parish of Acadia, State of Louisiana, acting as the governing authority of said Parish:

SECTION 1. That, in accordance with the provisions of Section 2721.6 of Title 33 of the Louisiana Revised Statutes of 1950, as amended, and other constitutional and statutory authority supplemental thereto, there be and there is hereby created a Sales Tax District in the Parish of Acadia, State of Louisiana (the “Parish”), which Sales Tax District shall comprise and embrace all of that territory contained within the corporate boundaries of the Parish, less and except that area of the Parish contained within the corporate limits of the municipalities of Crowley and Rayne, as the corporate limits of said municipalities are presently constituted.

SECTION 2. That said Sales Tax District shall be and the same is hereby known and designated as “Mosquito Control Sales Tax District No. 3 of the Parish of Acadia, State of Louisiana” (the “District”); and the seal of the Parish of Acadia, State of Louisiana, be and the same is hereby adopted as the seal of the District. The governing authority of the District shall be the Police Jury of the Parish of Acadia, State of Louisiana (the “Police Jury”), the domicile shall be the regular meeting place of the Police Jury and the officers of the Police Jury shall be the officers of the District.

SECTION 3. That the District shall have all powers granted to it under Louisiana Law, including the power to levy a Sales and Use Tax in accordance with Section 2721.6 of Title 33 of the Louisiana Revised Statutes, as amended, and Article VI, Section 29 of the Constitution of the State of Louisiana of 1974, and to fund the proceeds thereof into Bonds for the purposes for which the Sales Tax is authorized to be used.

SECTION 4. In case any one or more of the provisions of this Ordinance shall for any reason be held to be illegal or invalid, such illegality or invalidity shall not affect any other provisions of said Ordinance, but the same shall be construed and enforced as if such illegal or invalid provisions had not been contained herein. Any constitutional or statutory provisions enacted after the date of this ordinance which validate or make legal any provisions thereof shall be deemed to apply hereto.

SECTION 5. This ordinance shall be published in full in the official journal of this Police Jury after adoption.

This ordinance having been submitted to a vote, the vote thereon was as follows:

RESOLUTION

          A resolution ordering and calling a special election to be
          held in Mosquito Control Sales Tax District No. 3 of the
          Parish of Acadia, State of Louisiana, to authorize the levy
          of a sales and use tax therein; making application to the
          State Bond Commission in connection therewith; and
          providing for other matters in connection therewith.

BE IT RESOLVED by the Police Jury of the Parish of Acadia, State of Louisiana (the “Governing Authority”), acting as the governing authority of Mosquito Control Sales Tax District No. 3 of the Parish of Acadia, State of Louisiana (the “District”), that:

SECTION 1. Election Call. Subject to the approval of the State Bond Commission, and under the authority conferred by Article VI, Section 29 of the Constitution of the State of Louisiana of 1974, the applicable provisions of Chapter 5, Chapter 6-A and Chapter 6-B of the Louisiana Election Code, and other constitutional and statutory authority, a special election is hereby called and ordered to be held in the district on SATURDAY, JULY 19, 2003, between the hours of six o’clock (6:00) a.m., and eight o’clock (8:00) p.m., in accordance with the provisions of La. R.S. 18:541, and at the said election there shall be submitted to all registered voters qualified and entitled to vote at the said election under the Constitution and laws of this State and the Constitution of the United States, the following proposition, to-wit:

          PROPOSITION [ONE-FOURTH OF ONE PERCENT (1/4%)
          SALES TAX] (EXCLUDING THE MUNICIPALITIES OF
          CROWLEY AND RAYNE)

          SUMMARY: ONE-FOURTH OF ONE PERCENT (1/4%)
          SALES AND USE TAX FOR A PERIOD OF 10 YEARS TO BE
          DEDICATED AND USED FOR THE PURPOSE OF PAYING

          Shall Mosquito Control Sales Tax District No. 3 of the
          Parish of Acadia, State of Louisiana (excluding the
          municipalities of Crowley and Rayne) (the “District”),
          under the provisions of Article VI, Section 29 of the
          Constitution of the State of Louisiana of 1974, and other
          constitutional and statutory authority, be authorized to
          levy and collect a tax of one-fourth of one percent
          (1/4%) (the “Tax”) for a period of ten (10) years from
          the date of the first levy of the Tax upon the sale at
          retail, the use, the lease or rental, the consumption, and
          the storage for use or consumption, of tangible personal
          property and on sales of services within the District, all
          as defined in R.S. 47:301 through 47:317, with the
          proceeds of the Tax (after paying the reasonable and
          necessary costs and expenses of collecting and
          administering the Tax) to be dedicated and used for the
          purpose of paying the cost of maintaining and operating a
          mosquito control program within the District, including the
          cost of acquiring land, buildings and equipment necessary
          in connection therewith; and further, shall the District be
          authorized to fund the proceeds of the Tax into bonds to
          pay the cost of capital improvements for such purposes
          to the extent and in the manner permitted by the laws of
          Louisiana?

SECTION 2. Publication of Notice of Election. A Notice of Special Election shall be published in the Rayne Acadian Tribune, a weekly (published on Thursday) newspaper of general circulation within the District, published in Rayne, Louisiana, and being the official journal of the District, once a week for four consecutive weeks, with the first publication to be made not less than forty-five (45) days nor more then ninety (90) days prior to the date of the election, which Notice shall be substantially in the form attached hereto as “Exhibit A” and incorporated herein by reference the same as if it were set forth herein in full.

SECTION 3. Canvass. This Governing Authority shall meet at its regular meeting place, the Police Jury Room of the Courthouse, Crowley, Louisiana, on TUESDAY, AUGUST 5, 2003, at SIX-THIRTY O’CLOCK (6:30) P.M., and shall then and there in open and public session proceed to examine and canvass the returns and declare the result of the said special election.

SECTION 4. Polling Places. The polling places set forth in the aforesaid Notice of Special Election are hereby designated as the polling places at which to hold the said election, and the Commissioners-in-Charge and Commissioners, respectively, will be the same persons as those designated in accordance with law.

SECTION 5. Election Commissioners; Voting Machines. The officers designated to serve as Commissioners-in-Charge and Commissioners pursuant to Section 4 hereof, or such substitutes therefor as may be selected and designated in accordance with La. R.S. 18:1287, shall hold the said special election as herein provided, and shall make due returns of said election for the meeting of the Governing Authority to be held on Tuesday, August 5, 2003, as provided in Section 3 hereof. All registered voters in the District will be entitled to vote at the special election, and voting machines shall be used.

SECTION 6. Authorization of Officers. The Secretary of the Governing Authority is hereby empowered, authorized and directed to arrange for and to furnish to said election officers in ample time for the holding of said election, the necessary equipment, forms and other paraphernalia essential to the proper holding of said election and the President and/or Secretary of the Governing Authority are further authorized, empowered and directed to take any and all further action required by State and/or Federal law to arrange for the election, including but not limited to, appropriate submission to the Federal Department of Justice under Section 5 of the Federal Voting Rights Act of 1965, as amended.

SECTION 7. Furnishing Election Call to Election Officials. Certified copies of this resolution shall be forwarded to the Secretary of State, the Commissioner of Elections, the Clerk of Court and Ex-Officio Parish Custodian of Voting Machines of Acadia Parish and the Registrar of Voters of Acadia Parish, as notification of the special election, in order that each may prepare for said election and perform their respective functions as required by law.

SECTION 8. Application to State Bond Commission. Application is made to the State Bond Commission for consent and authority to hold the special election as herein provided, and in the event said election carries for further consent and authority to levy and collect the sales and use tax provided for therein. A certified copy of this resolution shall be forwarded to the State Bond Commission on behalf of this Governing Authority, together with a letter requesting the prompt consideration and approval of this application.

This resolution having been submitted to a vote, the vote thereon was as follows:

WHEREAS, the Office of Public Health in cooperation with the Louisiana State University Agricultural Center has developed a comprehensive planning tool for parishes that do not have an organized mosquito abatement district, and

WHEREAS, the Office of Public Health has made available funding through their Arboviral Grant Initiative to aid those parishes wishing to start new mosquito control programs, and

WHEREAS, the Acadia Parish Police Jury made a commitment to establish an abatement program which would include all aspects of a comprehensive plan.

THEREFORE, BE IT RESOLVED by the Acadia Parish Police Jury in regular session duly convened on this the 20th day of May, 2003, does hereby authorize the Parish Secretary to negotiate a contract with the Office of Public Health through their Arboviral Grant Initiative Program for the sole purpose of applying for grant funding in the amount of $100,000 and to prepare and submit any and all necessary documents to accomplish same.

WHEREAS, the Louisiana Code of Ethics for elected officials tends to work a hardship in many instances, and

WHEREAS, the Police Jury Association of Louisiana, at its state convention in February, 2002, believing that the Code should be amended to correct such problems, adopted a resolution of support, and

WHEREAS, the Beauregard Parish Police Jury at its May, 2003, regular session, believing that the code should be amended to correct such problems, adopted a resolution of support.

THEREFORE, BE IT RESOLVED by the Acadia Parish Police Jury in regular session duly convened on this the 20th day of May, 2003, does hereby request the Louisiana Legislature to consider changes in the Louisiana Code of Ethics which prohibits elective and appointive members of political subdivisions from seeking purely routine legislative changes such as the re-subdivision of property without being in violation of the Code.

BE IT FURTHER RESOLVED that certified copies of this resolution shall be forwarded to all Legislators and to each Parish governing authority in the State of Louisiana requesting their support on SB 1032 during this 2003 Regular Legislative Session.

RESOLUTION OF TERMINATION

The following resolution was offered by Mrs. Cecelia Broussard, duly seconded by Mr. Jimmie Pellerin, and duly resolved and adopted on May 20, 2003.

A resolution authorizing and directing the President to execute for and on behalf of the Acadia Parish Police Jury, a Notice of Termination for W. E. McDonald & Sons, L.L.C., Contractor, pertaining to the completion of the contract for “Acadia Parish Phase III-A Contract 2 Road Improvements Program” in accordance with the plans and specifications contained in the contract documents pertaining thereto.

WHEREAS, a final inspection on the above referenced project was performed on May 15, 2003 and a punchlist of miscellaneous work items to be completed is attached and made a part of this resolution; and

WHEREAS, W. E. McDonald & Sons, L.L.C., as Contractor, has substantially completed the “Acadia Parish Phase III-A Contract 2 Road Improvements Program” in accordance with the plans and specifications contained in the contract documents pertaining thereto; and

WHEREAS, the Acadia Parish Police Jury desires to accept the completed work;

NOW, THEREFORE, BE IT RESOLVED by the Acadia Parish Police Jury that the President of said Acadia Parish Police Jury be, and is hereby empowered, authorized and directed to execute a Notice of Termination for and on behalf of the Acadia Parish Police Jury accepting the work as being substantially completed, and that he be authorized and directed to have a copy of said acceptance recorded in the Conveyance Records of the Parish of Acadia, State of Louisiana.
