CROWLEY, LOUISIANA

NOVEMBER 18, 2003

THE ACADIA PARISH POLICE JURY met on the above date at 6:30 p.m., in the Police Jury Meeting Room, Courthouse Building, Crowley, Louisiana, in regular session with the Vice President, John Humble, Sr., presiding. At the request of the Vice President, a moment of silence was offered and the Pledge to the Flag was recited in unison. The roll was called and final attendance was recorded as follows:

A motion was offered by Mrs. Catherine LaCombe, seconded by Mrs. Cecelia Broussard, to amend the agenda and include appointments to the Acadia Parish Communications District. Motion carried.

A motion was offered by Mr. Jimmie Pellerin, seconded by Mr. John Beard, to approve the Minutes of the November 18, 2003, Regular Police Jury Meeting. Motion carried.

Mr. Sterling Hubbard addressed the members regarding the Jury’s annexation dispute with the Town of Duson. Mr. Hubbard indicated that he requested the Town of Duson annex a tract of land north of the Interstate Interchange for the purpose of constructing billboards on his property.

Legal Counsel André Doguet commented that the Police Jury would not object to small annexations for advertisement purposes but did have a problem with larger tracts that could possibly provide for enough space to construct a truck stop.

A representative of the advertising agency who is interested in constructing signage on the Hubbard Property suggested that a lawsuit may be filed if the matter was not resolved.

RESOLUTION

WHEREAS, the Acadia Parish Police Jury advertised for an oil, gas and mineral lease as provided by law for all of the oil rights in and to any highways, rights-of-way, streets, roads, lanes and alleys or other lands owned by and not presently under mineral lease from the Acadia Parish Police Jury, Acadia Parish, Louisiana in the following described property:

          All of the mineral rights, title and interest in any lands,
          highways, rights- of-way and roads owned by and not
          presently under mineral lease from the Acadia Parish
          Police Jury, situated in Acadia Parish, Louisiana, and
          being more fully described as follows: Beginning at a
          point having Coordinates of X = 1,726,310.00 and Y =
          628,750.00; thence East 2,740.00 feet to a point having
          Coordinates of X = 1,729,050.00 and Y = 628,750.00;
          thence South 5,290.00 feet to a point having Coordinates
          of X = 1,729,050.00 and Y = 623,460.00; thence West
          2,740.00 feet to a point having Coordinates of
          1,726,310.00 and Y = 623,460.00; thence North 5,290.00
          feet to the point of beginning, containing approximately
3
            acres, as shown outlined in red on a plat on file in the
          Office of Mineral Resources, Department of Natural
          Resources. All bearings, distances and coordinates are
          based on Louisiana Coordinate System of 1927 (South
          Zone).

WHEREAS, the following bid of Pride Oil & Gas Properties, Inc. was the sole bid received:

For a three (3) year lease.

BONUS: $750.00 (Seven Hundred Fifty and 00/100 Dollars).

DELAY RENTAL: $375.00 (Three Hundred Seventy-Five and 00/100
                      Dollars).

ROYALTY: 1/4 of all the oil, gas and all other minerals produced and
              saved. 1/4 of all gas produced and saved or utilized, but not
              less than 1/8th, and 1/4 of all other liquid or gaseous minerals
              in solution and produced with oil and gas and saved or utilized
              but not less than 1/8th.

PRIMARY TERMS: Three (3) years.

WHEREAS, after careful consideration it is the opinion of the Police Jury that the bid is satisfactory.

THEREFORE, BE IT RESOLVED by the Acadia Parish Police Jury in regular session duly convened this 18th day of November, 2003, that the bid of Pride Oil & Gas Properties, Inc., for said oil, gas and mineral lease is hereby accepted, and

BE IT FURTHER RESOLVED that the President is hereby authorized to sign the oil, gas and mineral lease as herein approved in behalf of the Acadia Parish Police Jury, and

BE IT FURTHER RESOLVED that a completed copy of said lease be sent to the Louisiana State Mineral Board for its approval.

          627,060.00; thence South 2,800.00 feet to a point
          having Coordinates of X = 1,723,660.00 and Y =
          624,260.00; thence West 7,250.00 feet to a point
          having Coordinates of X = 1,716,410.00 and Y =
          624,260.00; thence North 2,800.00 feet to the point
          of beginning, containing approximately
7 acres, as
          shown outlined in red on a plat on file in the Office of
          Mineral Resources, Department of Natural Resources.
          All bearings, distances and coordinates are based on
          Louisiana Coordinate System of 1927 (South Zone).

WHEREAS, the following bid of Pride Oil & Gas Properties, Inc. was the sole bid received:

For a three (3) year lease.

            Dollars).

A motion was offered by Mrs. Cecelia Broussard, seconded by Mrs. Catherine LaCombe, to grant a 2% across the board pay increase to all Parish employees and Coroner except for those subject to standard probationary pay increases effective January 1, 2004. Motion carried.

A motion was offered by Mrs. Cecelia Broussard, seconded by Mr. Pat Daigle, to deny the request in the 2004 Budget to purchase one new Animal Control Vehicle. Motion carried.

A motion was offered by Mrs. Cecelia Broussard, seconded by Mrs. Catherine LaCombe, to approve in the 2004 Budget the request to hire one full-time Animal Control Assistant at $7.00 per hour effective January 1, 2004. Motion carried.

A motion was offered by Mrs. Cecelia Broussard, seconded by Mrs. Catherine LaCombe, to approve in the 2004 Budget a $6.00 per day payment to the Sheriff’s Office for the feeding of Parish Inmates. Motion carried.

A motion was offered by Mrs. Cecelia Broussard, seconded by Mr. Pat Daigle, to instruct the Secretary-Treasurer to discontinue contributions to the State Office of Public Health in order to resolve deficits in Health Unit spending. Motion carried.

                                     
RESOLUTION

BE IT RESOLVED: by the Acadia Parish Police Jury in regular session duly convened this 18th day of November, 2003, does hereby authorize the calling of a public hearing for December 2, 2003, at 6:00 P.M., Police Jury Meeting Room, to receive comments on the proposed 2004 Budget.

RESOLUTION

BE IT RESOLVED: by the Acadia Parish Police Jury in regular session duly convened this 18th day of November, 2003, does hereby empower, authorize and direct the President to execute a Statement of Recommendation made by the Homeland Security Council on the distribution of the 2003 funds.

A motion was offered by Mrs. Cecelia Broussard, seconded by Mr. Alton Stevenson, to approve the Acadiana Criminalistics Laboratory Budget with anticipated revenues of $851,600.00 and anticipated expenditures of $1,401,764.84 for fiscal year 2004 and authorize the payment of the Parish’s prorated share of the deficit in the amount of $17,930.00 with like amounts to be provided by the Acadia Parish Sheriff’s Office and the District Attorney. Motion carried.


PERSONNEL

A motion was offered by Mrs. Cecelia Broussard, seconded by Mrs. Catherine LaCombe, to approve the request to grant meritorious sick leave as provided for in the Police Jury Personnel Policy Manual to Mr. Wilbert Menard, Parish Road employee. Motion carried.

A motion was offered by Mrs. Cecelia Broussard, seconded by Mr. Pat Daigle, to offer recognition of a Parish employee as inductee into the Cajun French Music Hall of Fame. Motion carried.

WHEREAS, Mr. Cormier’s 34 years of musical talent and contribution is an important factor in the state’s cultural growth and the Jury recognizes the time and dedication given in performing and promoting our french musical heritage.

WHEREAS, Mr. Cormier has been inducted into the Cajun French Music Association Hall of Fame on November 16, 2003.

NOW, THEREFORE, BE IT RESOLVED by the Parish Government through its President Claude “Jimmy” Courville that Mr. Cormier be recognized, honored and commended for his long term dedication, achievements and success in the Cajun French Music industry.

PUBLIC FACILITIES/BUILDING & GROUNDS

A motion was offered by Mrs. Catherine LaCombe, seconded by Mr. Pat Daigle, to approve the recommendation to sell a 1.3 acre alternate tract of land in the Crowley/Rayne Industrial Park to Mr. Dennis Abshire at the originally agreed upon price of $8,500.00 per acre. All conditions previously set forth in the original agreement to be still in force. Motion carried.

Legal Counsel André Doguet informed the members of the ongoing litigation related to the workmanship repairs to the Acadia Rice Arena.

No action was required.

                                     
RESOLUTION

     BY: MRS CECELIA BROUSSARD AND MR ALTON STEVENSON

WHEREAS, it was advertised for bids for a Taxiway 25' x 1500' for Individual Tee Hangars at the LeGros Memorial Airport.

WHEREAS, bids received were as follows:

THEREFORE, BE IT RESOLVED by the Acadia Parish Police Jury in regular session duly convened on this the 18th day of November, 2003, does hereby accept the low bid submitted by Merrick Construction, Co., in the amount of One Hundred Sixty-six Thousand Nine Hundred Fifty-four and 00/100 ($166,954.00) Dollars.

BE IT FURTHER RESOLVED that the President of this Police Jury be and he is hereby empowered, authorized and directed to execute a contract with Merrick Construction, Co., on behalf of, in the name and under the seal of the Acadia Parish Police Jury relative to said project.

RESOLUTION OF ACCEPTANCE

The following resolution was offered by Mrs. Catherine LaCombe, duly seconded by Mr. Pat Daigle, and duly resolved and adopted on November 18, 2003.

A resolution authorizing and directing the President to execute for and on behalf of the Acadia Parish Police Jury, an Act of Acceptance for Coastal Timbers, Inc., Contractor, pertaining to the completion of the contract, Fournerat Road Bridge Repairs, in accordance with the plans and specifications contained in the contract documents pertaining thereto.

WHEREAS, Coastal Timbers Inc., as Contractor, has completed the Fournerat Road Bridge Repairs, in accordance with the plans and specifications contained in the contract documents pertaining thereto; and

WHEREAS, the Acadia Parish Police Jury desires to accept the completed work;

NOW, THEREFORE, BE IT RESOLVED by the Acadia Parish Police Jury that the President of said Acadia Parish Police Jury be, and is hereby empowered, authorized and directed to execute an Act of Acceptance for and on behalf of the Acadia Parish Police Jury accepting the work as being completed, and that he be authorized and directed to have a copy of said acceptance recorded in the Conveyance Records of the Parish of Acadia, State of Louisiana.

COMMENTS FROM THE PUBLIC

Residents of the Roberts Cove Community requested an update on the Indigo Bridge Project.

Parish Road Engineer Karl Aucoin indicated that the delineation was complete and they were processing permits through the Corps of Engineers.

Mr. Joseph LeBlue, Parish Employee from the Branch Road Maintenance Division, indicated there were problems with supervision pointing out that some of his personal belongings were discarded at the time that the Public Works Facility was cleaned.

Chairperson Cecelia Broussard stated that she would attempt to resolve the matter.

THERE BEING NO FURTHER BUSINESS TO COME BEFORE THE MEETING, THE MOTION WAS OFFERED DULY SECONDED, THAT THE MEETING ADJOURN UNTIL THE NEXT REGULARLY SCHEDULED MEETING OF DECEMBER 2, 2003, AT THE HOUR OF 6:30 P.M.
