THE ACADIA PARISH POLICE JURY met on the above date at 6:30 p.m., in
the Police Jury Meeting Room, Courthouse Building, Crowley,
Louisiana, in regular session with the President, Cecelia Broussard,
presiding. At the request of the President, a moment of silence was
offered and the Pledge to the Flag was recited in unison. The roll

A motion was offered by Mr. John Humble, Sr., seconded by Mr. A. J.
Credeur, to revise the agenda to consider an insurance claim for
road damage, an address by J. Andrus Barousse relative to the first
oil well in Evangeline, DOTD request for assistance to repair LA
Hwy. 91, the purchase of culverts for Rabbit Road and the removal of
items relative to Litigation from the agenda. Motion carried.
A motion was offered by Mr. Jimmie Pellerin, seconded by Mr. A. J.
Credeur, to approve the Minutes of the April 5, 2005, Regular Police
Jury Meeting. Motion carried.
APPOINTMENTS
A motion was offered by Mr. Alton Stevenson, seconded by Mr. John
Humble, Sr., to approve the hiring of Mr. Lee Hebert as Director of
Emergency Preparedness and Homeland Security as a part-time employee
at $10.00 per hour effective April 20, 2005, provided all hiring
requirements are met. Motion carried.

WHEREAS, the strength of our
nation flows from the promise of individual equality and freedom of
choice;
and
WHEREAS, the 35th Anniversary
of the National Fair Housing Law, Title VIII of the Civil Rights Act
of 1968, during the month of April, is an occasion for all Americans
- individually and collectively - to rededicate themselves to the
principle of freedom from housing discrimination whenever it exists.
This law guarantees for each citizen that critical, personal element
of freedom of choice - selection of the home;
and
WHEREAS, a fair housing law
has been passed by the State of Louisiana; and implementation of
that law requires the positive commitment, involvement and support
of each of our citizens;
and
WHEREAS, the department and
agencies of the State of Louisiana are to provide leadership in the
effort to make fair housing not just an idea, but an ideal for all
our citizens;

WHEREAS, barriers that
diminish the rights and limit the options of any citizen will

Police Jury has reviewed the Systems Survey and Compliance
Questionnaire in its entirety,

a required part of the financial and compliance audit of Louisiana
governmental units and quasi-public corporations.

Stevenson, to authorize the Secretary to conduct the Medicare

AN ORDINANCE MAKING IT UNLAWFUL FOR ANY PERSON TO OPERATE OR DRIVE A
MOTOR VEHICLE UPON HALEY DRIVE IN ACADIA PARISH, LOUISIANA, AT A
SPEED IN EXCESS OF
FIFTEEN MILES PER HOUR, AND,
PROVIDING FOR THE PENALTIES FOR THE VIOLATION THEREOF.
SECTION 1. BE IT ORDAINED by
the Police Jury of Acadia Parish, Louisiana, that it shall be
unlawful for any person to operate or drive a motor vehicle in

Cost options to hard surface Suzie Drive was presented for review.
Juror A. J. Credeur recommended that the installation of soil cement
base be used in the design.
A motion was offered by Mr. A. J. Credeur, seconded by Mr. Cade
Benoit, to authorize the removal of trees on Jersey Road by W. M.
Contractors at an estimated cost of $5,000.00. Motion carried.
Mr. Ryan Fuselier, Engineer with C. H. Fenstermaker & Associates,
Inc., addressed the body on the development of a capital improvement
priority list for gravel roads. His presentation explained how
publicly interactive web based portals could be used along with a
geographic information system for comprehensive data analysis. Mr.
Fuselier proposed a ranking system that would take into
consideration important factors such as number of dwellings, traffic
volume and road conditions.

of criteria used in preparing past priority listing.

Moreau, to refer to the Road & Bridge Committee the subject of
priority listing of gravel roads. Motion carried.
RESOLUTION

WHEREAS, residents along
Higginbotham Highway located in the Second Ward Drainage District #1
requested assistance to construct drainage improvements on private
property along said highway,
and
WHEREAS, intergovernmental
agreements have been executed with drainage districts for mutual
assistance to correct such problems.
THEREFORE, BE IT RESOLVED by
the Acadia Parish Police Jury in regular session duly convened on
this the 19th day of April, 2005, does hereby support a Cooperative
Effort with the Second Ward Drainage District #1 to address drainage
problems behind residents located east of and paralleling the
Higginbotham Highway in the Second Ward Drainage District #1 of
Acadia Parish.

RESOLUTION

WHEREAS, pursuant to Section
III-D, Article 9-B (page 34) of the Contract for Collection and
Disposal of Solid Waste between BFI and Acadia Parish Police Jury a
comparative statement reflecting an increase in Base Residential
Rate effective March 1, 2005 (Rate Modification Date) was presented,
and
WHEREAS, calculation was
provided to and inspected by Mr. L. Charles Abshire with Broussard,
Poché, Lewis & Breaux as outlined in Article 9-B Consumer Price
Index for Urban Wage Earners and Clerical Workers for “all items”
and “gasoline”.
THEREFORE, BE IT RESOLVED by
the Acadia Parish Police Jury in regular session duly convened on
this the 19th day of April, 2005, does hereby approve the new
Residential Rate effective March 1, 2005, to be increased to $4.85
per service unit per month as provided.

Humble, Sr., to award a $5,000.00 annual increase in pay for the
Solid Waste Supervisor effective May 1, 2005. Motion carried.
A motion was offered by Mr. Cade Benoit, seconded by Mr. John
Humble, Sr., to rescind action relative to an increase in pay for
the Solid Waste Supervisor to be made effective May 1, 2005. Motion
carried.
A motion was offered by Mr. Alton Stevenson, seconded by Mr. Felton
Moreau, to set the level of pay for the Solid Waste Supervisor equal
to that of the Parish Road Manager effective May 1, 2005. Motion
carried.
A claim for damages submitted to American Interstate Insurance
Company on behalf of Southwest Timber Company of Louisiana that
occurred on Indigo Road in the vicinity of Bayou Plaquemine Brule
Bridge was referred to Legal Counsel for settlement.
RESOLUTION

WHEREAS, it is evident that
the Community of Evangeline in Acadia Parish was a true berth place
of crude oil in the State of Louisiana and should be given the
recognition so rightly deserved,
and
WHEREAS, W. Scott Haywood was
the owner of Jennings Abell Oil in the early 1900's who drilled the
first well in Louisiana and the third in the United States,
and
WHEREAS, the Acadia Parish
Police Jury wishes to give recognition by erecting a monument at the
historic site in the Community of Evangeline in Acadia Parish.
THEREFORE, BE IT RESOLVED by
the Acadia Parish Police Jury in regular session duly convened on
this the 19th day of April, 2005, does hereby acknowledge that the
first crude oil well in the State of Louisiana was drilled in the
Community of Evangeline in Acadia Parish.
BE IT FURTHER RESOLVED that
this Police Jury is in full support and encourages the erection of a
monument designating the location of the historic site in Acadia
Parish.
BE IT FURTHER RESOLVED that a
copy of this Resolution be presented in the form of a request to
State Law Makers and State Tourist Officials to not only proclaim
this historic event but also to provide assistance in funding for
the monumental improvements as well as tourist promotional
activities.

RESOLUTION

WHEREAS, LA Highway 91 in
Acadia Parish located between Highway 98 and Highway 100 is a major
route for school buses transporting students from surrounding
communities in and out of the Town of Iota,
and
WHEREAS, said route is heavily
traveled by student participating in extracurricular activities both
during school and summer sessions,
and
WHEREAS, said highway provides
a primary route for waste transporters to the Parish Sanitary
Landfill and for farmers moving commodities to market,
and
WHEREAS, LA Highway 91
continues to deteriorate and is dangerous to travelers particularly
at night and in rainy conditions,
and
WHEREAS, there is evidence
that no major reconstruction has been done since it was built in
1953 and is currently in dire need of repairs for the safety of
children as well as parents and other constituents of the Parish.
THEREFORE, BE IT RESOLVED by
the Acadia Parish Police Jury in regular session duly convened on
this the 19th day of April, 2005, does hereby request the Louisiana
Department of Transportation and Development consider major
reconstruction of the portion of Highway 91 from LA 98 to LA 100 in
Acadia Parish.
BE IT FURTHER RESOLVED that
this Resolution be presented to the Acadia Parish Legislative
Delegation in support of this effort.
