PUBLIC HEARING

It was announced by the President that notice had been given that the Acadia Parish Police Jury would hold a public forum on Tuesday, August 2, 2005, at 6:00 P.M., Police Jury Meeting Room, Courthouse Building, Crowley, Louisiana, to receive comments on a proposed Groundwater Protection Ordinance.

Secretary-Treasurer Katry Martin commented on the portion of the Ordinance providing for the administration of the permitting process.

Legal Counsel Doug Wimberly suggested prior to taking formal action that administrative details be completed.

Mr. Howard Fielding, with the Department of Environmental Quality, advised that the Police Jury in other parishes take on the responsibility of administrative procedures. He indicated that both Avoyelles and Vermilion Parishes had adopted the same Ordinance.

THERE BEING NO COMMENTS TO COME BEFORE THE JURY, THE PRESIDENT ADJOURNED THE PUBLIC HEARING.

THE ACADIA PARISH POLICE JURY met on the above date at 6:30 p.m., in the Police Jury Meeting Room, Courthouse Building, Crowley, Louisiana, in regular session with the President, Cecelia Broussard, presiding. ELECTIONS

The following Resolution was offered by Mr. Felton Moreau, seconded by Mr. A. J. Credeur:

                                     
RESOLUTION

          A Resolution approving the holding of an election in Iota
          Fire Protection District of the Parish of Acadia, State of
          Louisiana, on Saturday, October 15, 2005, to authorize
          the levy of special taxes therein.

WHEREAS, the Board of Commissioners of Iota Fire Protection District of the Parish of Acadia, State of Louisiana (the “Governing Authority”), acting as the governing authority of Iota Fire Protection District of the Parish of Acadia, State of Louisiana (the “District”), adopted a resolution on July 11, 2005, calling a special election in the District on Saturday, October 15, 2005, to authorize the levy of special taxes therein; and

WHEREAS, the governing authority of the District has requested that this Police Jury, acting as the governing authority of the Parish of Acadia, State of Louisiana, give its consent and authority for the District to hold the aforesaid election, and in the event that the election carries to levy and collect special taxes provided for therein; and

WHEREAS, as required by Article VI, Section 15 of the Constitution of the State of Louisiana of 1974, it is now the desire of this Police Jury to approve the holding of said election and in the event that the election carries, to levy and collect special taxes provided for therein;

NOW, THEREFORE, BE IT RESOLVED by the Police Jury of the Parish of Acadia, State of Louisiana, acting as the governing authority of said Parish, that:

SECTION 1. In compliance with the provisions of Article VI, Section 15 of the constitution of the State of Louisiana of 1974, and in accordance with the request of the Board of Commissioners of Iota Fire Protection District of the Parish of Acadia, State of Louisiana, this Police Jury hereby approves the holding of an election in the District, on Saturday, October 15, 2005, at which election there will be submitted the following propositions, to-wit:

          SUMMARY: 10 YEAR, 10.60 MILLS PROPERTY TAX

          Shall Iota Fire Protection District of the Parish of Acadia,
          State of Louisiana, (the “District”), be authorized to
          continue to levy a tax of ten and sixty hundredths (10.60)
          mills on all the property subject to taxation in the District,
          for a period of ten (10) years beginning with the year 2006
          and ending with the year 2015, for the purpose of
          maintaining and operating fire protection facilities,
          purchasing fire trucks and other fire fighting equipment and
          paying the cost of obtaining water for fire protection

          CONSTRUCTING, IMPROVING, MAINTAINING AND/OR
          OPERATING FIRE PROTECTION FACILITIES AND
          EQUIPMENT FOR THE DISTRICT, AND PAYING THE COST
          OF OBTAINING WATER FOR FIRE PROTECTION PURPOSES,
          SAID TAX TO BE IN ADDITION TO ANY OTHER TAXES
          NOW BEING LEVIED BY THE DISTRICT FOR SUCH
          PURPOSES.

          Shall Iota Fire Protection District of the Parish of Acadia,
          State of Louisiana (the “District”), be authorized to
          continue to levy a tax of eleven and forty-nine
          hundredths (11.49) mills tax (heretofore levied for the
          purpose of paying debt service on the General Obligation
          Bonds, Series 1996, of the District) on all the property
          subject to taxation in the District for a period of ten (10)
          years, beginning with the year 2006 and ending with the
          year 2015, for the purpose of acquiring, constructing,
          improving, maintaining and/or operating fire protection
          facilities and equipment for the District, and paying the
          cost of obtaining water for fire protection purposes, said
          tax to be in addition to any other taxes now being levied
          by the District for such purposes?

SECTION 2. In the event the election carries, this Police Jury does hereby further consent to and authorize the District to levy and collect the special taxes provided for therein.

This Resolution having been submitted to a vote, the vote thereon was as follows:

WHEREAS, bids received were as follows:

THEREFORE, BE IT RESOLVED by the Acadia Parish Police Jury in regular session duly convened on this the 2nd day of August, 2005, does hereby accept the low bids submitted by Townsend Chemical and Helena Chemical in the amounts presented herein.

BE IT FURTHER RESOLVED that the President of this Police Jury be and she is hereby empowered, authorized and directed to execute a contract with Townsend Chemical and Helena Chemical, respectively, on behalf of, in the name and under the seal of the Acadia Parish Police Jury relative to the purchase of said chemicals for the period August 3, 2005 through June 30, 2006.

RESOLUTION

            BY MESSRS: A J CREDEUR AND JOHN HUMBLE SR

WHEREAS, the Acadia Parish Police Jury advertised in the Official Journal for proposals to manage or lease a 15.6 acre tract of farm land along Capitol Avenue in Acadia Parish.

WHEREAS, a proposal to lease said land was received from Mr. Matt Lambousy.

THEREFORE, BE IT RESOLVED by the Acadia Parish Police Jury in regular session duly convened this 2nd day of August, 2005, does hereby accept the lease proposal from Mr. Matt Lambousy for the 15.6 acres (more or less) of crop land located on Capitol Avenue in the amount of $40 per acre per year.

BE IT FURTHER RESOLVED that Legal Counsel be authorized to prepare a crop lease agreement with Matt Lambousy to include certain considerations for farm maintenance and care.

LEGISLATION

Juror A. J. Credeur suggested that there may be problems with amending the Grass & Weed Ordinance to include property surrounded by existing rural subdivisions and may present a burden to certain land owners.

Legal Counsel Doug Wimberly offered changes which would allow for enforcement of the weed ordinance on land surrounded on three sides by recognized subdivisions.

A motion was offered by Mr. Cade Benoit, seconded by Mr. Jimmie Pellerin, to authorize the calling of a public hearing September 6, 2005, at 6:30 P.M., to receive comments on proposed changes to Ordinance #809 providing for the trimming of weeds and grass in recognized subdivisions. Motion carried.

A motion was offered by Mr. Alton Stevenson, seconded by Mr. Felton Moreau, to refer to the Solid Waste/Environmental Committee the Groundwater Protection Ordinance. Motion carried.


PERSONNEL

A motion was offered by Mr. Cade Benoit, seconded by Mr. Felton Moreau, to authorize the hiring of Mr. Ferral Reed as a Maintenance Tech Level D (Iota Division) at $7.00 per hour effective August 16, 2005, provided all hiring requirements are met. Motion carried.

A motion was offered by Mr. Cade Benoit, seconded by Mr. Jimmie Pellerin, to authorize the hiring of Mr. Brandon Brasket as a Maintenance Tech Level D Truck Driver (Branch Division) at a starting pay of $7.50 per hour effective August 16, 2005, provided all hiring requirements are met. Motion carried.

A motion was offered by Mr. Cade Benoit, seconded by Mr. John Humble, Sr., to approve the light duty transitional job description for Mr. David Duhon which includes activities under the Mosquito, Recycling and Animal Control Programs. Motion carried.

A motion was offered by Mr. Cade Benoit, seconded by Mr. Alton Stevenson, to terminate the probationary employment of Mr. Dane Duhon effective August 2, 2005. Motion carried.

A motion was offered by Mr. Cade Benoit, seconded by Mr. Alton Stevenson, to terminate the probationary employment for Ms. Susan Lewis effective August 2, 2005. The following roll call vote was cast: Yeas: Alton Stevenson, John Humble, Sr., Cecelia Broussard, A. J. Credeur, Cade Benoit and Felton Moreau. Nays: A. J. Broussard and Jimmie Pellerin. Motion carried.

Mr. A. J. Broussard voiced his objection to the debate that was conducted relative to the matter of Susan Lewis.

The Secretary advised that Animal Control Officer, Debbie Papillion, was available if the Committee needed to contact her to ask questions.

A motion was offered Mr. Cade Benoit, seconded by Mr. Alton Stevenson, to authorize advertising for two Landfill Equipment Operators. Motion carried.

Dr. Gibson Miller raised the question of the dual office holding relative to the Acadia Parish Librarian. Mr. Miller indicated that the current Librarian also held an elected position with the Acadia Parish School Board. Mr. Miller requested the Police Jury obtain an Attorney General’s opinion on the matter.

BE IT RESOLVED: by the Acadia Parish Police Jury in regular session duly convened this 2nd day of August, 2005, does hereby empower, authorize and direct the President to execute an extension to the Vegetative and C & D Debris Removal Contract with D & J Enterprises for a period of one year under the same terms and conditions as provided for in Section 6 of the Agreement effective August 3, 2005.

Mr. Clinton Bouillion, a ten year resident of Meche Road in Acadia Parish, explained conditions involving the placing of solid waste along the roadside for collection by BFI. He described how Speech Road was too long and narrow for a truck to collect garbage from residents. He noted that for many years trash had been placed near the intersection of Speech and Meche Roads for collection and complaints had been filed with the Acadia Parish Sheriff’s Office.

A motion was offered by Mr. A. J. Credeur, seconded by Mr. Felton Moreau, to refer the Solid Waste Collection complaint at the intersection of Meche and Speech Roads to Legal Counsel for review. Motion carried.

The Sales Tax Report was presented for the month of July, 2005. The report indicated a gross receipt of $414,344.41 a decrease of $25,150.89 from July, 2004.


COMMENTS FROM THE PUBLIC

Ms. Kim Henry advised of an incident that occurred on August 1st on LeGros Road where she ran against a pile of gravel that wasn’t properly deposited causing damage to her vehicle.

The Parish Attorney referred her to her insurance provider while the matter was under investigation.

The Secretary-Treasurer advised of the upcoming Region Meeting scheduled for August 13, 2005.
