CROWLEY, LOUISIANA

JUNE 21, 2005

THE ACADIA PARISH POLICE JURY met on the above date at 6:30 p.m., in the Police Jury Meeting Room, Courthouse Building, Crowley, Louisiana, in regular session with the President, Cecelia Broussard, presiding. At the request of the President, a moment of silence was offered and the Pledge to the Flag was recited in unison. The roll was called and final attendance was recorded as follows:

A motion was offered by Mr. John Humble, Sr., seconded by Mr. Alton Stevenson, to amend the agenda to consider: contract termination with Picard Steel Erectors and additional funding for the Rice Arena Project and health insurance assistance for a Parish employee. Motion carried.

A motion was offered by Mr. Jimmie Pellerin, seconded by Mr. John Humble, Sr., to approve the Minutes of the May 17, 2005, Regular Police Jury Meeting and the June 1, 2005, Special Meeting. Motion carried.

Mr. Blaine Koch, Chairman of the Acadia Parish Independent Citizen’s Study Committee, gave a preliminary report to the members of the Police Jury on the activities of the Committee. Mr. Koch indicated that the Committee was formed by the Jury and take the tasks and responsibilities very seriously noting that the duty was to investigate, spell out and truthfully reveal the merits and failings of various Parish governments. The Committee met within three days of being appointed and set a structure and time line of 60 days to complete its work.

The Committee organized on June 9th, subsequently meeting on the 14th, 16th and 21st. Guests at the Committee meeting included Iberia Parish President Will Langlinais, St. Martin Parish President Guy Cormier, District 4 Councilman Mike Huval and Calcasieu Parish Administrator S. Mark McMurray.

Mr. Koch gathered budget information from the Acadia Parish Police Jury, study material from the Louisiana Police Jury Association, a copy of the Police Jury Manual, study guides on the different forms of government, study guides on home rule charters, copies of the Iberia Parish and St. Martin Parish Home Rule Charters along with the informational guide book and structure of the Calcasieu Parish Police Jury.

The Committee plans to meet several additional times to finalize the recommendations to the Acadia Parish Police Jury.

BE IT FURTHER RESOLVED that the President is hereby authorized to execute on behalf of the Acadia Parish Police Jury a contract agreement with The Rayne Independent.

A motion was offered by Mr. John Humble, Sr., seconded by Mr. Jimmie Pellerin, to table action relative to the funding of economic development activities for 2005. Motion carried.

A motion was offered by Mr. John Humble, Sr., seconded by Mr. Jimmie Pellerin, to authorize a $500 addition to the public health budget to assist with the Acadia Parish Health Fair. Motion carried.


LEGISLATION

                                       
RESOLUTION

             BY MESSRS: CADE BENOIT AND JOHN HUMBLE SR

WHEREAS, Senate Bill 353 providing for the improving, relocation or the closing of railroad crossings at the request of the Department of Transportation and Development would provided a hardship for property owners along certain highways paralleling rail lines in Acadia Parish, and

WHEREAS, the choice to close certain railroad crossings would cause additional unsafe farm traffic on certain highways in Acadia Parish, and

THEREFORE, BE IT RESOLVED by the Acadia Parish Police Jury in regular session duly convened on this the 21st day of June, 2005, does hereby oppose Senate Bill 353 in all forms that provide for the possible relocation or closing of rails crossings in Acadia Parish.

BE IT FURTHER RESOLVED that a copy of this Resolution be forwarded to the Louisiana Police Jury Association and the Acadia Legislative Delegation.

A motion was offered by Mr. Cade Benoit, seconded by Mr. Alton Stevenson, to authorize that selection and appointments of the three recommended positions on the Louisiana Children and Youth Services Planning Board represent education, faith community and early childhood programs. Motion carried.

A motion was offered by Mr. A. J. Credeur, seconded by Mr. John Humble, Sr., to authorize the introduction of an ordinance titled Ground Water Protection Ordinance that will establish a zoning overlay district to be known as the Drinking Water Protection Critical Area to protect ground water from contamination and further authorize the Secretary to advertise for a public hearing to be held August 2nd at 6:00 P.M., in the Police Jury Meeting Room. Motion carried.

A motion was offered by Mr. Cade Benoit, seconded by Mr. Alton Stevenson, to refer to Legal Counsel suggested changes to Ordinance #809 providing for the trimming of weeds and grass in areas surrounded by recognized subdivisions. Motion carried.

A motion was offered by Mr. John Humble, Sr., seconded by Mr. Jimmie Pellerin, to authorize correspondence in support of the Parents Television Council’s Cable Choice campaign. Motion carried.


PERSONNEL

A motion was offered by Mr. Cade Benoit, seconded by Mr. John Humble, Sr., to authorize the hiring of Ms. Melissa Baudin as Community Clinic Clerk effective July 5, 2005, at a starting pay of $7.50 per hour provided all hiring requirements are met. Motion carried.

A motion was offered by Mr. Cade Benoit, seconded by Mr. Jimmie Pellerin, to authorize the hiring of Dane Duhon as Landfill Heavy Equipment Operator at a starting pay of $7.61 per hour provided all hiring requirements are met. Motion carried.

A motion was offered by Mr. Cade Benoit, seconded by Mr. A. J. Credeur, to authorize the lateral transfer of Ms. Susan Lewis from Road Maintenance to Animal Control as an assistant and award a $.75 increase in hourly pay to Ms. Debbie Papillion, Animal Control Director in lieu of a 5% probationary increase and further provide that the Road Manager take the necessary steps to fill the vacancy effective July 1, 2005. Motion carried.

A motion was offered by Mr. Cade Benoit, seconded by Mr. A. J. Credeur, to authorize the hiring of Mr. Walin Thibodeaux as Maintenance Technician Level D at a starting pay of $7.00 per hour provided all hiring requirements are met. Motion carried.

A motion was offered by Mr. Cade Benoit, seconded by Mr. A. J. Credeur, to authorize additional hourly pay for the Part-time Homeland Security Director to cover time spent at workshops, conferences or during emergency response situations. Motion carried.

A motion was offered by Mr. Cade Benoit, seconded by Mr. John Humble, Sr., to authorize extended meritorious sick leave for Mr. Kenneth Carried until August 31, 2005. Motion carried.

A motion was offered by Mr. Cade Benoit, seconded by Mr. Jimmie Pellerin, to authorize the hiring of Ms. Brandi Darbonne at $17.00 per hour as a RN at the Community Clinic effective June 22, 2005, provided all hiring requirements are met. Motion carried.

A motion was offered by Mr. Cade Benoit, seconded by Mr. John Humble, Sr., to authorize an additional $2,800 in salary in the Community Clinic Budget to provide for training during the transition of new employees. Motion carried.

A motion was offered by Mr. Jimmie Pellerin, seconded by Mr. A. J. Credeur, to assist in the employee portion of health insurance premium for Mr. Herman Robinson during his period of recovery not to exceed two months. Motion carried.

R. Core, Inc., for an adjusted contract price of Nine Hundred Eighty-four Thousand Seventy-eight and 00/100 ($984,078.00) Dollars.

RESOLUTION OF ACCEPTANCE

The following resolution was offered by Mr. A. J. Credeur, duly seconded by Mr. Felton Moreau, and duly resolved and adopted on June 21, 2005.

A resolution authorizing and directing the President to execute for and on behalf of the Acadia Parish Police Jury, an Act of Acceptance from F. Miller & Sons, LLC, Contractor, pertaining to the completion of the contract subject to a punch list attached hereto and made a part of this Resolution, for “Bridge Replacement over Bayou Plaquemine Brule and Roadway Improvements on Indigo Road” in accordance with the plans and specifications contained in the contract documents pertaining thereto.

WHEREAS, F. Miller & Sons, LLC, as Contractor, has substantially completed the “Bridge Replacement over Bayou Plaquemine Brule and Roadway Improvements on Indigo Road” in accordance with the specifications contained in the contract documents pertaining thereto; and

WHEREAS, the Acadia Parish Police Jury desires to accept the completed work;

NOW, THEREFORE, BE IT RESOLVED by the Acadia Parish Police Jury that the President of said Acadia Parish Police Jury be, and is hereby empowered, authorized and directed to execute an Act of Acceptance for and on behalf of the Acadia Parish Police Jury accepting the work as being substantially completed, and that she be authorized and directed to have a copy of said Notice recorded in the Conveyance Records of the Parish of Acadia, State of Louisiana.

BE IT FURTHER RESOLVED that the President of this Police Jury be and she is hereby empowered, authorized and directed to execute a contract with E. B. Feucht & Sons, Inc., on behalf of, in the name and under the seal of the Acadia Parish Police Jury relative to said project.

AN ORDINANCE MAKING IT UNLAWFUL FOR ANY PERSON TO OPERATE OR DRIVE A MOTOR VEHICLE UPON ST. DAMIAN ROAD IN ACADIA PARISH, LOUISIANA, AT A SPEED IN EXCESS OF
TWENTY-FIVE MILES PER HOUR, AND, PROVIDING FOR THE PENALTIES FOR THE VIOLATION THEREOF.

SECTION 1. BE IT ORDAINED by the Police Jury of Acadia Parish, Louisiana, that it shall be unlawful for any person to operate or drive a motor vehicle in excess of twenty-five miles per hour on the following described Parish Road:

                                   
St. Damian Road

SECTION 2. BE IT FURTHER ORDAINED that any person found guilty of operating or driving a motor vehicle in excess of twenty-five miles per hour on the Parish road described above, shall be guilty of a misdemeanor, and upon conviction therefore, shall be fined not more than Fifty Dollars ($50) or be imprisoned not more than ten (10) days or both.

SECTION 3. BE IT FURTHER ORDAINED that any laws or parts of laws in conflict are hereby repealed.

The Ordinance was offered by Mr. A J. Credeur, and seconded by Mr. Jimmie Pellerin, after being read and considered section by section, was adopted as a whole by the following vote:

THIRTY-FIVE MILES PER HOUR, AND, PROVIDING FOR THE PENALTIES FOR THE VIOLATION THEREOF.

SECTION 1. BE IT ORDAINED by the Police Jury of Acadia Parish, Louisiana, that it shall be unlawful for any person to operate or drive a motor vehicle in excess of thirty-five miles per hour on the following described Parish Road:

                                         Tepetate Road

SECTION 2. BE IT FURTHER ORDAINED that any person found guilty of operating or driving a motor vehicle in excess of thirty-five miles per hour on the Parish road described above, shall be guilty of a misdemeanor, and upon conviction therefore, shall be fined not more than Fifty Dollars ($50) or be imprisoned not more than ten (10) days or both.

SECTION 3. BE IT FURTHER ORDAINED that any laws or parts of laws in conflict are hereby repealed.

A motion was offered by Mr. A. J. Credeur, seconded by Mr. Alton Stevenson, to remove the requested tree on the Crowley Center Ditch at a cost of $450.00 and further request that the Sixth Ward & Crowley Drainage District aide in its removal. Motion carried.

A motion was offered by Mr. A. J. Credeur, seconded by Mr. Felton Moreau, to authorize the purchase of culverts to replace bridges on Morris Miller, Nickel and Emar Roads at an estimated cost of $16,200.00. Motion carried.

Karl Aucoin, President of Aucoin & Associates, presented a comprehensive proposal to prepare a Parishwide Priority Capital Outlay Program which consisted of the hard surfacing of aggregate roads. Mr. Aucoin pointed out the criteria he and his firm would use in developing the priority. Mr. Aucoin noted that there would be no charges for the work as his firm currently possessed the majority of data.


SOLID WASTE/ENVIRONMENTAL

A motion was offered by Mr. John Humble, Sr., seconded by Mr. Felton Moreau, to authorize the Parish Attorney to advise Picket Industries that no action would be taken relative to the request for additional payments pursuant to the contract for Landfill liner extension at the Acadia Parish Sanitary Landfill. Motion carried.


LITIGATION

                      
RESOLUTION OF TERMINATION

The following resolution was offered by Mr. John Humble, Sr., duly seconded by Mr. Felton Moreau, and duly resolved and adopted on June 21, 2005.

A resolution authorizing and directing the President to execute for and on behalf of the Acadia Parish Police Jury, a Notice of Termination from Picard Steel Erectors, Inc., Contractor, pertaining to the completion of the contract for “Remedial Work at the Acadia Parish Rice Arena” in accordance with the plans and specifications contained in the contract documents pertaining thereto.

WHEREAS, Picard Steel Erectors, Inc., as Contractor, has substantially completed the “Remedial Work at the Acadia Parish Rice Arena” in accordance with the specifications contained in the contract documents pertaining thereto; and

WHEREAS, the Acadia Parish Police Jury desires to accept the completed work;

NOW, THEREFORE, BE IT RESOLVED by the Acadia Parish Police Jury that the President of said Acadia Parish Police Jury be, and is hereby empowered, authorized and directed to execute a Notice of Termination for and on behalf of the Acadia Parish Police Jury accepting the work as being substantially completed, and that she be authorized and directed to have a copy of said Notice recorded in the Conveyance Records of the Parish of Acadia, State of Louisiana.

A motion was offered by Mr. A. J. Credeur, seconded by Mr. John Humble, Sr., to authorize payment of 1/3 of the consulting fees associated with the remediation work with Picard Steel Erectors at the Rice Arena and further authorize a budget amendment in the amount of $20,000.00 to cover said costs. Motion carried.

The Sales Tax Report was presented for the month of May, 2005. The report indicated a gross receipt of $458,871.89 a decrease of $69,982.05 from May, 2004.


COMMENTS FROM THE PUBLIC

The Secretary announced a demonstration was scheduled for Friday at 2:00 P.M. at the LeGros Airport where remote control target air craft would be flown. He also noted the tentative schedule to formally open the bridge on Morrow Road named Zaunbrecher Bridge was scheduled for Wednesday at 10:00 A.M.
