THE ACADIA PARISH POLICE JURY met on the above date at 6:30 p.m., in
the Police Jury Meeting Room, Courthouse Building, Crowley,
Louisiana, in regular session with the President, Cecelia Broussard,
presiding. At the request of the President, a moment of silence was
offered and the Pledge to the Flag was recited in unison. The roll

A motion was offered by Mr. A. J. Credeur, seconded by Mr. Felton
Moreau, to authorize $1,250.00 of legal services to review LeGros
Airport Lease Contracts. Motion carried.
A motion was offered by Mr. Cade Benoit, seconded by Mr. John
Humble, Sr., to approve the payment of two months automobile
allowance to Mr. John Quebodeaux for the months of January and
February, 2005. Motion carried.
LEGISLATION
Chairman Broussard advised the members of Community interest in
alternate forms of Parish Government.
Juror John Humble, Sr., indicated that forms such as Home Rule
Charters are of many different types and expressed concern that a
system where a Parish President would be elected would open up an
opportunity for out of Parish waste. He also expressed concern for
the effect that it may have on local drainage and fire protection
districts.
Juror A. J. Credeur explained the situation in St. Landry Parish and
St. Mary Parish when those changes were made.
Juror Alton Stevenson indicated that working closely with
municipalities is of great importance.
A motion was offered by Mr. Cade Benoit, seconded by Mr. John
Humble, Sr., to authorize the Police Jury Legislative Committee to
appoint an independent study committee of individuals and report
their findings relative to the need for change in Acadia Parish.
Motion carried.
A motion was offered Mr. A. J. Credeur, seconded by Mr. Alton
Stevenson, to authorize Legal Counsel to prepare an Ordinance
providing for the permitting of individuals or groups soliciting
charitable contributions on or in public rights-of-ways. Motion
carried.
RESOLUTION
BY
MESSRS: A J CREDEUR AND ALTON STEVENSON
WHEREAS, House Bill No. 378
has been introduced in the 2005 Regular Session of the Louisiana
Legislature, and the intent of this Bill is to amend and reenact LSA–R.S.
11:231(D), 11:1902(1) and (14), and 11:1938(4)(a)(i) and (ii)
relative to the Parochial Employees’ Retirement System, and
WHEREAS, House Bill No. 378
provides for the final compensation of members of the Parochial
Employees’ Retirement System (PERS) to be calculated using a
sixty-month period instead of the current thirty-six-month period,
and
WHEREAS, in explanation for
the need for these changes, the Parochial Employees’ Retirement
System (PERS) presently uses an estimate of an 8% earnings rate on
investments in computing the following year’s employer contribution,
a rate that is presently used by several systems and in the past,
has seemed to be a reasonable investment rate assumption; and
WHEREAS, on the date of
adoption of this resolution, the Dow has an over 3% negative
year-to-date return, the NASDAQ has an over 9% negative year-to-date
return, and the Standard and Poor 500 has an over 2% negative
year-to-date return; and
WHEREAS, the fixed income
portion of the PERS portfolio is currently earning in the 5% to 6%
range which is well below the 8% earnings rate assumption used in
past years’ computation of employer contributions; and
WHEREAS, there has been a
shift by several in the investment professional arena that an 8%
earnings assumption is now on the high end and a more realistic and
conservative assumption would be in the 7% to 7 ½% range, however,
this would require the employer contribution rate to increase from
the present rate of 12-3/4% to approximately 17%; and
WHEREAS, the Executive Board
(the Board) of the PERS-whose duty is to ensure that the long-term
viability of the Retirement Plan (the Plan) is protected for all
Plan participants-held a meeting with several participating
employers in December of 2004 to inform them of the above
information and to request their opinions on their ability to fund
higher employer contribution levels, and the consensus was that any
rate above the current 12-3/4% rate, which has risen from 7-3/4% in
2003, would be a budgetary strain, but anything above 15% could be
devastating to their individual Parish budgets; and
WHEREAS, the Board then
requested its actuary to look at several different alternatives that
could be used to address this issue, and the actuary felt that the
change which would have the least detrimental effect on the Plan
participants-but would have a substantial financial benefit to the
Plan itself-would be the change outlined in House Bill No. 378;
and
WHEREAS, it is estimated that
the enactment of the proposed changes as contained in House Bill No.
378 would result in Plan A employer rates to be lower than they
would otherwise be (if no changes are made to the current system) by
2.2% of payroll, and in Plan B by 1.172% of payroll; and
WHEREAS, in most cases, a
member can work approximately four to twelve months to fully offset
the impact of the proposed change contained in House Bill No. 378,
for example, if a member is receiving 2½% annual salary increases in
the affected years, that member could work an additional four months
and produce a retirement benefit equal to that produced by the
current formula, and a member earning 4% annual salary increases
would need to work approximately six additional months to produce a
benefit equal to that of the current formula; and
WHEREAS, this proposed changes
does not impact current retirees of the Plan; and
WHEREAS, the legislative
actuary has prepared a note which is attached to House Bill No. 378
which estimates savings in excess of $50 million systemwide over the
first five years if this change is implemented; and
WHEREAS, some employers have
suggested that this change be applied to new hires only, however,
such an approach would diminish the impact on savings such that ten
years or more would elapse before a 1% of payroll deduction in
contribution rates would be achieved due to the fact that if the
change is applied only to new hires, it is estimated that the
savings would be $4.8 million over five years instead of $50 million
if the change is implemented systemwide, and such a delay in impact
may come too late for the Plan’s financial health; and
WHEREAS, any change will have
some negative effects but doing nothing could have negative effects
that are not only substantially more distasteful but possibly
financially devastating to the viability of the retirement system
and to all Plan participants; and
WHEREAS, the Police Jury
Association of Louisiana, at its annual convention in February of
2005, urged the PERS Board to consider all available means, and
study all other methods, of ensuring the financial solvency of PERS
so as to minimize the adverse financial impact on Parish governments
throughout the State; and
WHEREAS, finding an approach
to the difficulties faced by Parochial and other public retirement
funds in Louisiana is not an easy matter, and finding one solution
that satisfies everyone is even harder, therefore, all suggestions
for alternative approaches to maintaining affordability of the Plan
would be welcomed by the PERS Board.
THEREFORE, BE IT RESOLVED by
the Acadia Parish Police Jury in regular session duly convened on
this the 17th day of May, 2005, does hereby support House Bill No.
378 filed by the Honorable Brett Geymann in the 2005 Regular Session
of the Louisiana Legislature which will provide for the final
compensation of members of the Parochial Employees’ Retirement
System (PERS) to be calculated using a sixty-month period instead of
the current thirty-six month period, and further, will require that
a person working after completing participation in the Deferred
Retirement Option Plan (DROP) to work for five years in order to
have the additional benefit calculated based on his compensation
during the period of post-DROP employment.
BE IT FURTHER RESOLVED that a
certified copy of this resolution be forwarded to all members of the
Acadia Legislative Delegation respectfully requesting their support
and assistance in this matter.

RESOLUTION

WHEREAS, the name Police Jury
Association of Louisiana has been in existence for over 80 years,
with all 64 parishes belonging to said Association, and
WHEREAS, the Police Jury
Association enjoys a favorable reputation in the Halls of the
Louisiana Legislature, in the Halls of Congress, with members of the
National Association of Counties and with Police Jurors-Parish
Councilmen/Commissioners throughout the country and the State of
Louisiana, and
WHEREAS, significant
achievements have been in upgrading governmental services to the
citizens of the State of Louisiana, through the united efforts of
members of the Police Jury Association of Louisiana, and
WHEREAS, the proposal was
defeated in 1998 to change the name of the Police Jury Association
to the Louisiana Parish Government Association, and
WHEREAS, the name change has
caused major concern and diverseness among members of the Police
Jury Association of Louisiana and ultimately will impair the ability
of the Police Jury Association to further improve governmental
services to its members and constituents; and
THEREFORE, BE IT RESOLVED by
the Acadia Parish Police Jury in regular session duly convened on
this the 17th day of May, 2005, does hereby go on record as being in
support of keeping the name of the Police Jury Association of
Louisiana.

RESOLUTION
TO REMOVE SUGAR FROM THE
CENTRAL AMERICAN FREE
TRADE AGREEMENT (CAFTA)
LEGISLATION, AS SOON AS
POSSIBLE.
WHEREAS, agriculture is the
leading industry and a large employer in Acadia and surrounding
parishes, and
WHEREAS, farmers in Lafourche
Parish and the State of Louisiana have suffered severe economic
disasters during the last several years, including Hurricane Lili in
2002 and other conditions due to weather extremes, including
drought, hurricanes and torrential rainfalls, which situation was
compounded by historically low commodity prices, and
WHEREAS, many farmers and
businesses, including sugar cane farmers and related industries,
will be unable to survive these trying economic times, and
WHEREAS, two local sugar mills
located in Lafourche Parish have recently closed permanently,
affecting many employees jobs and adversely the local economy, while
several other local sugar cane mills in the area struggle to remain
open, and
WHEREAS, any proposed
legislation which would allow for additional sugar imports from
other countries, including Mexico, would be detrimental to the sugar
producing areas of Louisiana and of the United States.
THEREFORE, BE IT RESOLVED by
the Acadia Parish Police Jury in regular session duly convened on
this the 17th day of May, 2005, does hereby respectfully request
that the United States President and the Louisiana Congressional
Delegation make every effort to remove sugar from the Central
American Free Agreement (CAFTA) legislation, as soon as possible.
BE IT FURTHER RESOLVED that
the Louisiana Police Jury Association and the National Association
of Counties Organization are hereby requested to consider similar
Resolutions in support of an effort to remove sugar from the CAFTA
legislation.
BE IT FURTHER RESOLVED that

OPPOSING A ONE CENT TAX
ON FUEL DEDICATED TO THE
COMPLETION OF INTERSTATE
49 IN THE STATE OF
LOUISIANA, AND DOES URGE
AND REQUEST THE SUPPORT
OF THE LEGISLATIVE
DELEGATION AND OF PARISHES
THROUGHOUT THE STATE.
WHEREAS, the completion of
Interstate 49 in the State of Louisiana is of vital importance to
the economic future of the State and Lafourche Parish, and
WHEREAS, Interstate 49 will
serve as a major thoroughfare for commerce and industry and will
create many opportunities for citizens and businesses throughout the
State, and
WHEREAS, funds are needed to
continue construction of Interstate 49 in both North and South
Louisiana; and
WHEREAS, State Representative
Billy Montgomery has proposed a one cent fuel tax to be dedicated
solely to the construction of Interstate 49, to be removed from the
tax rolls upon completion of the project, and
WHEREAS, even though Acadia
Parish recognizes the importance of Interstate 49, it does hereby
suggest that the project be funded by better management of taxpayers
money than funded by a one cent fuel tax.
THEREFORE, BE IT RESOLVED by
the Acadia Parish Police Jury in regular session duly convened on
this the 17th day of May, 2005, does hereby oppose a one cent tax on
fuel dedicated to the completion of Interstate 49 in the State of
Louisiana, and does urge and request the support of its Legislative
Delegation.

Louisiana may obtain Hospital Insurance-Medicare only coverage
(“Medicare”), and
WHEREAS, the Acadia Parish
Police Jury desires to offer Medicare coverage to its eligible
employees.
THEREFORE, BE IT RESOLVED by
the Acadia Parish Police Jury in regular session duly convened on
this the 17th day of May, 2005, does hereby adopt the following
Resolution:
SECTION 1. It is hereby
declared to be the policy and purpose of the Acadia Parish Police
Jury to extend the provisions of Section 1, Act 204, 1952 Regular
Session, as amended by LA Act 280 of 2004, providing Medicare
coverage to eligible officers and employees of the Acadia Parish
Police Jury.
SECTION 2. In pursuance of
said policy, the Acadia Parish Police Jury requests the State
Treasurer’s Office to conduct a divided vote referendum, under
Section 218(d)(6) of the Social Security Act, for employees hired
before April 1, 1986, who are members of the Parochial Employees
Retirement System (LASERS). The divided vote referendum will be
conducted pursuant to applicable State and Federal laws and
regulations for the purpose of allowing eligible employees the
option of paying the Medicare-only tax.
SECTION 3. The Acadia Parish
Police Jury is hereby authorized and directed to execute an
agreement with the State of Louisiana to secure Medicare coverage of
eligible officers and employees as provided in Section 1 hereof.
SECTION 4. The coverage of
eligible officers and employees shall be effective as of October 1,
2003, for the employees who voted “Yes” in the divided vote Medicare
referendum.
SECTION 5. Withholdings from
salaries or wages of officers and employees for the purposes
provided in Section 1 hereof of this resolution are hereby
authorized to be made in the amounts and at such times as may be
required by applicable State and Federal laws and regulations, and
shall be paid to the Internal Revenue Service, in such amounts and
at such times as are designated in IRS Code 3121(b)(7)(E) and 3126.
SECTION 6. Employer
contributions shall be paid from amounts appropriated for such
purposes to the Internal Revenue Service in accordance with
applicable Federal laws.
SECTION 7. The Acadia Parish
Police Jury shall maintain such records and submit such reports as
may be required by applicable State and Federal laws or regulations.
SECTION 8. This resolution
shall take effect and be in full force from and after its passage.

the Secretary be authorized to make arrangements to relocate said
building on newly leased property.

A motion was offered by Mr. Alton Stevenson, seconded by Mr. Jimmie
Pellerin, to authorize repairs to the Fourth Floor Courthouse Air
Conditioning at an estimated cost of $4,600.00 and further authorize
a budget amendment for the necessary funding. Motion carried.
A motion was offered by Mr. Alton Stevenson, seconded by Mr. Jimmie
Pellerin, to authorize the lease of vacant health unit property in
Iota for the purpose of road maintenance activities at a monthly
rate of $750.00. Motion carried.
PUBLIC WORKS/ROAD & BRIDGE
A motion was offered by Mr. John Humble, Sr., seconded by Mr. A. J.
Broussard, to abandon a portion of Stanford Road in Midland north of
Teche Street to the drain ditch. The following roll call vote was
cast: Yeas: A. J. Broussard, John Humble, Sr., Cecelia Broussard.
Nays: Jimmie Pellerin, A. J. Credeur, Cade Benoit and Felton Moreau.
Abstained: Alton Stevenson. Motion failed.
A motion was offered by Mr. A. J. Credeur, seconded by Mr. Felton
Moreau, to authorize C. H. Fenstermaker & Associates, Inc., Ryan
Fuselier, P.E., to prepare plans and specifications and solicit bids
to repair the bridge located on Istre Road using the bridge plank
replacement method at an estimated cost of $175,095.00 and further
authorize a budget amendment in the Sales Tax Road Fund to provide
the necessary funding. Motion carried.
It was noted that a bridge recently replaced on North Crocker
Street, Midland, was not in line with the apparent Parish’s
right-of-way.
Residents in the area indicated that property markers were moved at
the time the bridge was installed.
Mr. Charles Benoit indicated that the road & bridge crossing at the
end of North Crocker went to a dump site north of the drain ditch.
A motion was offered by Mr. Cade Benoit, seconded by Mr. A. J.
Credeur, to authorize Legal Counsel to conduct a close investigation
as to the accurate ownership of the bridge located on the end of
North Crocker and further authorize Legal Counsel to establish
property markers once ownership has been determined. Motion carried.
A motion was offered by Mr. A. J. Credeur, seconded by Mr. Felton
Moreau, to authorize the removal of trees located at the Crowley
Maintenance Facility at an estimated cost of $1,800.00. Motion
carried.
A motion was offered by Mr. A. J. Credeur, seconded by Mr. Felton
Moreau, to authorize the reallocation of $25,000 to construct
drainage improvements subject to Jury approval. Motion carried.
A motion was offered by Mr. A. J. Credeur, seconded by Mr. Felton
Moreau, to authorize the Secretary to request U.S. Army Corps of
Engineers assist with ditch bank erosion along Standard Mill Road.
Motion carried.
A motion was offered by Mr. A. J. Credeur, seconded by Mr. Cade
Benoit, to authorize a cooperative road maintenance assistance to
repair and maintain shoulders along Standard Mill Road at the
Crowley City limits. Motion carried.
A motion was offered by Mr. A. J. Credeur, seconded by Mr. Cade
Benoit, to approve the Emergency Work Report for April, 2005. Said
expenditures to be in the amount of $21.63. Motion carried.

Moreau, to amend the agenda to consider recognizing a local drainage
district for their hard work and dedication. Motion carried.

WHEREAS, the Bayou Des Cannes
Nezpique Drainage Board Members have dedicated their time and energy
to improving drainage in their community, and
WHEREAS, a successful and
cooperative effort has been made to identify critical areas to plan
and construct improvements that have benefitted both the Parish and
residents of the Bayou Des Cannes Nezpique Drainage area.

A motion was offered by Mr. A. J. Credeur, seconded by Mr. Cade
Benoit, to authorize the Parish Road Manager to prepare
specifications and options for the purpose of acquiring one new
hydraulic excavator and present said information to the Road &
Bridge Committee for review. Motion carried.
A motion was offered by Mr. A. J. Credeur, seconded by Mr. Felton
Moreau, to declare a 1998 F-250 Ford Recycling Pickup as Surplus and
authorize its exchange with a 2000 F-150 Ford Animal Control Pickup
and $3,100.00 to offset the difference in value. Motion carried.
A motion was offered by Mr. Felton Moreau, seconded by Mr. A. J.
Credeur, to authorize a $300 per month car allowance for the Solid
Waste Supervisor to be paid in the form of salary. Motion carried.

specifications and solicit bids for the modifications to the

Broussard, to adjourn into executive session to consider potential
litigation relative to the liner extension project at the Acadia

RESOLUTION OF TERMINATION
The following resolution was offered by Mr. John Humble, Sr., duly
seconded by Mr. Felton Moreau, and duly resolved and adopted on May
17, 2005.
A resolution authorizing and directing the President to execute for
and on behalf of the Acadia Parish Police Jury, a Notice of
Termination from Pickett Industries, Inc., Contractor, pertaining to
the completion of the contract subject to a punch list attached
hereto and made a part of this Resolution, for “Extension of a
Subtitle D Clay Liner into Phase V” in accordance with the plans and
specifications contained in the contract documents pertaining
thereto.
WHEREAS, a final inspection on
the above referenced project was performed on May 17, 2005,
and
WHEREAS, Pickett Industries,
Inc., as Contractor, has substantially completed the “Extension of a
Subtitle D Clay Liner into Phase V” in accordance with the
specifications contained in the contract documents pertaining
thereto; and
WHEREAS, the Acadia Parish
Police Jury desires to accept the completed work;
NOW, THEREFORE, BE IT RESOLVED
by the Acadia Parish Police Jury that the President of said Acadia
Parish Police Jury be, and is hereby empowered, authorized and
directed to execute a Notice of Termination for and on behalf of the
Acadia Parish Police Jury accepting the work as being substantially
completed, and that she be authorized and directed to have a copy of
said Notice recorded in the Conveyance Records of the Parish of
Acadia, State of Louisiana.
