PUBLIC HEARING

It was announced by the President that notice had been given that the Acadia Parish Police Jury would hold a public forum on April 20, 2004, at 6:30 P.M., Police Jury Meeting Room, Courthouse Building, Crowley, Louisiana, to receive public comments on the proposed partial abandonment of Castle Cove Road consisting of the final one-third mile of roadway located in District 3 of Acadia Parish approximately 1,750 feet in length.

The President convened the public hearing for the purpose of receiving comments on the aforementioned notice.

No comments were received.

THERE BEING NO FURTHER COMMENTS TO COME BEFORE THE JURY, THE PRESIDENT ADJOURNED THE PUBLIC HEARING.

WHEREAS, the Police Jury published Notice of Intent to sell/transfer approximately eight (8) acres of Industrial Park property to A N.E.W. Rock, Co., Inc., as provided for in Title 33, Section 4717.2 governing the transferring of property by a political subdivision for industrial inducement purposes at an average cost of $8,000.00 per acre including all encumbrances, and

WHEREAS, A N.E.W. Rock, Co., Inc., has agreed to provide five (5) new jobs in exchange for the conditions set forth in the sale, and

THEREFORE, BE IT RESOLVED by the Acadia Parish Police Jury in regular session duly convened on this the 20th day of April, 2004, does hereby authorize the President to execute an Act of Sale with A N.E.W. Rock, Co., Inc., for approximately eight (8) acres at an average cost of $8,000.00 per acre which includes all encumbrances.

The Secretary made reference to issues surrounding the sale of property in the Crowley/Rayne Industrial Park to MJD Construction. A final decision on the tract of land had not been reached.

A motion was offered by Mr. A. J. Credeur, seconded by Mr. John Humble, Sr., to instruct Mader Engineering to temporarily suspend the extension of utilities to the northeast section of the Industrial Park. Motion carried.

A motion was offered by Mr. A. J. Credeur, seconded by Mr. Jimmie Pellerin, to authorize additional research on an unidentified right-of-way along a 4.3 acre tract of land adjacent to the Rice Arena to determine ownership. Motion carried.

A motion was offered by Mr. A. J. Credeur, seconded by Mr. John Humble, Sr., to authorize the hiring of Ms. Willa Spell as a part-time employee at $5.15 per hour to work as Receptionist/Secretary under the Veterans Assistance Officer and further amend the 2004 Budget to provide necessary funds for the remainder of 2004. Motion carried.

A motion was offered by Mr. Jimmie Pellerin, seconded by Mr. John Humble, Sr., to approve a grant in the amount of $11,700.00 to the Crowley Chamber of Commerce to develop and maintain a Parish reference tool for marketing purposes and further authorize the purchase and maintenance of one color copier at an estimated cost of $20,000.00 to be kept by Police Jury Administrative and further authorize an amendment to the 2004 Budget to provide the necessary funding from General Fund surpluses. Motion carried.


PERSONNEL

A motion was offered by Mr. Cade Benoit, seconded by Mr. A. J. Broussard, to approve the hiring of Mr. Alfha Harrell as Maintenance Tech Level D at a starting pay of $7.00 per hour provided all hiring requirements are met. Motion carried.

A motion was offered by Mr. Cade Benoit, seconded by Mr. A. J. Broussard, to approve the recommendation of the Community Clinic Director to discontinue services at the Iota Center due to lack of participation. Motion carried.

A motion was offered by Mr. Cade Benoit, seconded by Mr. A. J. Credeur, to authorize the hiring of Mr. Bert Lyons as Maintenance Tech Level D at a starting pay of $7.00 per hour provided all hiring requirements are met. Motion carried.


PUBLIC FACILITIES/BUILDING & GROUNDS

WHEREAS, bids were received and further negotiated to construct housing facilities for the Acadia Parish Mosquito Control Operation, and

WHEREAS, pursuant to Section III-D, Article 9-B (page 34) of the Contract for Collection and Disposal of Solid Waste between BFI and Acadia Parish Police Jury a comparative statement reflecting an increase in Base Residential Rate effective March 1, 2004 (Rate Modification Date) was presented, and

WHEREAS, calculation was provided to and inspected by Mr. Stephen Lambousy with Broussard, Poché, Lewis & Breaux as outlined in Article 9-B Consumer Price Index for Urban Wage Earners and Clerical Workers for “all items” and “gasoline”.

The Staff gave a presentation on a Parish Internet web site. The Secretary indicated that the web site was a joint venture between the Police Jury Staff and the Acadiana Regional Planning District at an estimated cost of $750. Mrs. Tina Broussard assisted with the presentation.

                                     
RESOLUTION

             BY MESSRS: THOMAS BENOIT AND A J CREDEUR

WHEREAS, on December 8, 2003, President George W. Bush signed into law P.L. 108-173, landmark legislation that will provide prescription drug benefits for approximately 40 million seniors and disabled Americans beginning in 2006 and approximately $25 billion in relief to hospitals over the next 10 years. P.L. 108-173, Section 405, contains important provisions for CAHs that enhance reimbursement, expand bed-size flexibility, and provide continued funding of the Medicare Rural Hospital Flexibility Program grants (Flex Grants), and

WHEREAS, new legislation pays CAHs at 101 percent of reasonable costs for Medicare inpatient, outpatient, and skilled nursing facility services furnished during cost reporting periods beginning on or after January 1, 2004. (Section 405 (a)), and

WHEREAS, new legislation expands cost-based reimbursement of on-call emergency room physicians to include physician assistants, nurse practitioners, and clinical nurse specialists for costs incurred for covered Medicare services furnished on or after January 1, 2005. (Section 405(b)), and

WHEREAS, new legislation allows CAHs to receive periodic interim payments for inpatient services, effective for payments made on or after July 1, 2004. (Section 405(c)), and

WHEREAS, new legislation removes this limitation and permits CAHs to operate up to 25 swing beds or acute care beds, and

WHEREAS, new legislation extends funding of Flex Grants of $35 million each year from FY 2005 through FY 2008, and

WHEREAS, new legislation allows CAHs to operate up to 10 psychiatric or rehabilitation distinct part beds for cost reporting periods beginning on or after October 1, 2004, and

WHEREAS, the Acadia Parish Police Jury has conducted a survey contacting 11 rural Louisiana hospitals that have already achieved CAH designation. The survey presented a set of questions to each. Currently we have received 8 responses and in each response the indication is overwhelmingly favorable as to the positive impact on improved patient services, improved employee benefits, and improved bottom line financial condition, and

WHEREAS, members of the Acadia Parish Police Jury have engaged in dialog and research relative to current circumstances and conditions particular to Acadia-St. Landry Hospital and have closely considered forecasts prepared by different Certified Public Accounting firms which have demonstrated that the CAH designation to be only direction which provides sound fiscal results alone or when combined with other strategic scenarios.

THEREFORE, BE IT RESOLVED that the Acadia Parish Police Jury endorses the Critical Access Hospital election for the Acadia-St. Landry Hospital and strongly urges the Board of Commissioners of the Acadia-St. Landry Hospital to execute all necessary action and resolutions required in order for Acadia-St. Landry Hospital to elect Critical Access Hospital designation at the Special Meeting of the Board of Commissioners scheduled for 6:00 p.m., on Wednesday, April 21, 2004, and to furthermore make it effective immediately so that Critical Access Designation may be successfully achieved at the earliest possible time and that all time sensitive requirements relative to April 30, 2004, deadlines will have been successfully met.

A motion was offered by Mr. Cade Benoit, seconded by Mr. John Humble, Sr., to amend the agenda and add discussion relative to the roadside inmate program. Yeas: A. J. Broussard, John Humble, Sr., Jimmie Pellerin, A. J. Credeur, Cade Benoit and Felton Moreau. Nays: None. Motion carried.

President Broussard was concerned that much of the work done by inmate crews was not on Parish roads or intersections. She felt the program should be limited to road work only.
She requested the inmate supervisor review the check list of assignments.

No formal action was taken.


COMMENTS FROM THE PUBLIC

Juror Jimmie Pellerin announced that a weekend event would be held in Rayne at the Royer Bed and Breakfast.


LITIGATION

A motion was offered by Mr. John Humble, Sr., seconded by Mr. Felton Moreau, to adjourn into executive session to discuss matters related to pending litigation with K.A.S. Construction, Docket #80137-1. The following roll call vote was cast: Yeas: A. J. Broussard, John Humble, Sr., Jimmie Pellerin, Cade Benoit and Felton Moreau. Nays: None. Motion carried.

Construction which was part of a major renovation project to the Rice Arena.
