JULY 6, 2004

THE ACADIA PARISH POLICE JURY met on the above date at 6:30 p.m., in the Police Jury Meeting Room, Courthouse Building, Crowley, Louisiana, in regular session with the President, Cecelia Broussard, presiding. At the request of the President, a moment of silence was offered and the Pledge to the Flag was recited in unison. The roll was called and final attendance was recorded as follows:

A motion was offered by Mr. A. J. Credeur, seconded by Mr. Felton Moreau, to add the following items to the agenda: Change Order to the Taxiway Project at the LeGros Airport, request to waive permit conditions by Southwest Acadia Water Corporation, Omit Item 14G from the agenda, appointment to Fire Protection District #3, Speed Limit on Carerra Lane, appointment to Homeland Security Counsel, supervision of Animal Control. Motion carried.

A motion was offered by Mr. Jimmie Pellerin, seconded by Mr. A. J. Credeur, to approve the Minutes of the June 15, 2004, Regular Police Jury Meeting. Motion carried.

                                   
RESOLUTION

          BY MESSRS: ALTON STEVENSON AND JOHN HUMBLE SR

WHEREAS, the members of the Acadia Parish Police Jury with great sorrow and a deep sense of loss, take cognizance of the absence of our beloved friend and past President of this organization, Mr. Howard Duncan, who has been taken by an untimely death, and

WHEREAS, he has rendered innumerable public services to his respective Parish and to the State of Louisiana and to the people thereof, and

WHEREAS, the absence of this outstanding citizen and friend to public service is keenly felt as a personal loss to his family, friends and colleagues.

THEREFORE, BE IT RESOLVED by the Acadia Parish Police Jury in regular session duly convened on this the 6th day of July, 2004, does hereby pay tribute to the memory of

and does hereby express for members of this body and citizens of Acadia Parish their sense of gratitude for his achievements and contributions to the public good.

BE IT FURTHER RESOLVED that when this Jury adjourns, it does so out of respect and in memory of our departed friend “Howard Duncan”.

BE IT FURTHER RESOLVED that a similar and specific resolution be offered and adopted by those convened who exemplify and share equal regard for the deceased.

COMMUNITY/ECONOMIC DEVELOPMENT

Executive Vice President of Acadia Economic Development Corporation Stephen Broussard presented an update of activities of the Acadia Economic Development Corporation. His 2004 Quarterly Report expanded on work done to assist 30 new and potential businesses, several expansion and many ongoing projects.

ELECTIONS

The following Resolution was offered by Mr. Cade Benoit and seconded by Mr. A. J. Credeur:

                                   
RESOLUTION

          A resolution approving the holding of an election in
          Second Ward Gravity Drainage District No. 2 of Acadia
          Parish, State of Louisiana, on Saturday, September 18,
          2004, to authorize the levy of a special tax therein.

WHEREAS, the Board of Commissioners of Second Ward Gravity Drainage District No. 2 of Acadia Parish, State of Louisiana (the “Governing Authority”), acting as the governing authority of Second Ward Gravity Drainage District No. 2 of Acadia Parish, State of Louisiana (the “District”), adopted a resolution on July 1, 2004, calling a special election in the District on Saturday, September 18, 2004, to authorize the levy of a special tax therein; and

WHEREAS, the governing authority of the District has requested that this Police Jury, acting as the governing authority of the Parish of Acadia, State of Louisiana, give its consent and authority for the District to hold the aforesaid election, and in the event that the election carries to levy and collect the special tax provided for therein; and

WHEREAS, as required by Article VI, Section 15 of the Constitution of the State of Louisiana of 1974, it is now the desire of this Police Jury to approve the holding of said election and in the event that the election carries, to levy and collect the special tax provided for therein;

NOW, THEREFORE, BE IT RESOLVED by the Police Jury of the Parish of Acadia, State of Louisiana, acting as the governing authority of said Parish, that:

SECTION 1. In compliance with the provisions of Article VI, Section 15 of the constitution of the State of Louisiana of 1974, and in accordance with the request of the Board of Commissioners of Second Ward Gravity Drainage District No. 2 of Acadia Parish, State of Louisiana, this Police Jury hereby approves the holding of an election in the District, on Saturday, September 18, 2004, at which election there will be submitted the following proposition, to-wit:

                     
PROPOSITION (TAX CONTINUATION)

            SUMMARY: 10 YEAR, 8.89 MILLS PROPERTY TAX
            CONTINUATION FOR THE PURPOSE OF ACQUIRING,
            CONSTRUCTING, IMPROVING, MAINTAINING AND
            OPERATING GRAVITY DRAINAGE WORKS WITHIN AND
            FOR THE DISTRICT.

            Shall Second Ward Gravity Drainage District No. 2 of
            Acadia Parish, State of Louisiana, (the “District”), be
            authorized to continue to levy a tax of eight and eighty-
            nine hundredths (8.89) mills on all of the property subject
            to taxation in the District, for a period of ten (10) years,
            beginning with the year 2004 and ending with the year
            2013, for the purpose of acquiring, constructing, improving,
            maintaining and operating gravity drainage works within
            and for the District?

SECTION 2. In the event the election carries, this Police Jury does hereby further consent to and authorize the District to levy and collect the special tax provided for therein.

This resolution having been submitted to a vote, the vote thereon was as follows:

WHEREAS, the Board of Commissioners of Bayou Plaquemine and Wikoff Drainage District of the Parish of Acadia, State of Louisiana (the “Governing Authority”), acting as the governing authority of Bayou Plaquemine and Wikoff Drainage District of the Parish of Acadia, State of Louisiana (the “District”), adopted a resolution on July 2, 2004, calling a special election in the District on Saturday, September 18, 2004, to authorize the levy of a special tax therein; and

WHEREAS, the governing authority of the District has requested that this Police Jury, acting as the governing authority of the Parish of Acadia, State of Louisiana, give its consent and authority for the District to hold the aforesaid election, and in the event that the election carries to levy and collect the special tax provided for therein; and

PERSONNEL

A motion was offered by Mr. A. J. Credeur, seconded by Mr. A. J. Broussard, to accept the resignation of Mr. Michael Boudreaux, a Parish Road Maintenance employee, as presented in correspondence to the Parish President dated July 2, 2004. Motion carried.

A motion was offered by Mr. Alton Stevenson, seconded by Mr. A. J. Credeur, to approve the hourly pay rate of $7.25 for Mr. Donald Leger as Material Handler. Motion carried.

A motion was offered by Mr. John Humble, Sr., seconded by Mr. A. J. Credeur, to authorize in-house applications for the position of Assistant Road Manager for the Branch Division. Motion carried.

A motion was offered by Mr. A. J. Credeur, seconded by Mr. Felton Moreau, to assign the activities of Animal Control under the direction of the Secretary-Treasurer. Motion carried.


PUBLIC FACILITIES/BUILDING & GROUNDS

WHEREAS, it was advertised to construct Midfield Taxiway “E” at the LeGros Memorial Airport, A.I.P. #3-22-0013-004-04, SP #901-02-0011.

WHEREAS, bids received were as follows:

THEREFORE, BE IT RESOLVED by the Acadia Parish Police Jury in regular session duly convened on this the 6th day of July, 2004, does hereby accept the low bid submitted by H & S Construction, Co., in the amount of One Hundred Sixty-five Thousand Four and 00/100 ($165,004.00) Dollars.

BE IT FURTHER RESOLVED that the President of this Police Jury be and she is hereby empowered, authorized and directed to execute a contract with H & S Construction, Co., on behalf of, in the name and under the seal of the Acadia Parish Police Jury relative to said project.

BE IT FURTHER RESOLVED that unfunded cost of said project be made by the Acadia Parish Airport District.

THEREFORE, BE IT RESOLVED by the Acadia Parish Police Jury in regular session duly convened on this the 6th day of July, 2004, does hereby accept the project repairs to Courtroom A in the Acadia Parish Courthouse as complete and further authorizes payment in the amount of $39,700 to E. L. Habetz Builders.

RESOLUTION

           BY MESSRS: ALTON STEVENSON AND A J CREDEUR

WHEREAS, the Acadia Parish Police Jury investigated the purchase of a certain tract of land consisting of approximately 21 acres more or less to provide place to locate a new Parish Jail, Criminal Justice Complex and other future pubic works needs, and

WHEREAS, at least three acres will be developed for the purpose of jail expansion.

THEREFORE, BE IT RESOLVED by the Acadia Parish Police Jury in regular session duly convened on this the 6th day of July, 2004, does hereby empower, authorize and direct the President to execute an Act of Sale with 5-H Farms, Inc., to purchase 21 acres of land, more or less, on Capitol Avenue, Crowley, Louisiana, at $25,000 per acre, at least 3 acres of which will be used for a Parish Jail.

BE IT FURTHER RESOLVED that the 2004 Budget be amended to provide funds from public works and industrial development sources for said purchase.

RESOLUTION

       BY MESSRS: ALTON STEVENSON AND JIMMIE PELLERIN

WHEREAS, the Acadia Parish Police Jury has determined that it is in their best interest to sell to the Acadia Parish Law Enforcement District a 40 man modular expansion built to temporarily house Parish prisoners on Capitol Avenue, and

WHEREAS, it becomes necessary to obtain a current appraisal to determine fair market value of said properties.

THEREFORE, BE IT RESOLVED by the Acadia Parish Police Jury in regular session duly convened on this the 6th day of July, 2004, does hereby authorize a joint appraisal by Fred Gossen Co., to determine the fair market value of the modular buildings located on Capitol Avenue owned by the Police Jury as a temporary jail facility.

BE IT FURTHER RESOLVED that said appraisal be presented upon completion as a basis to complete a sale agreement between the Acadia Parish Police Jury and Acadia Parish Law Enforcement District.

PUBLIC FRANCHISES

A motion was offered by Mr. John Humble, Sr., seconded by Mr. Felton Moreau, to approve the request by Egan Water to waive permit fees for the installation of potable water system in the Egan-Evangeline area. Motion carried.

A motion was offered by Mr. Alton Stevenson, seconded by Mr. John Humble, Sr., to approve a request made by Southwest Acadia Water Corp. to waive permit conditions and allow class 160 piping to be installed under public roadway crossings as per plans by Mader Engineering for potable water expansion in Southwest Acadia. Motion carried.

BE IT FURTHER RESOLVED that the President of this Police Jury be and he is hereby empowered, authorized and directed to execute a contract with W. R. Core, LLC, on behalf of, in the name and under the seal of the Acadia Parish Police Jury relative to said project.

AN ORDINANCE MAKING IT UNLAWFUL FOR ANY PERSON TO OPERATE OR DRIVE A MOTOR VEHICLE UPON DE PORRES ROAD (PARISH ROAD 3-81) IN ACADIA PARISH, LOUISIANA, AT A SPEED IN EXCESS OF
FORTY-FIVE MILES PER HOUR, AND, PROVIDING FOR THE PENALTIES FOR THE VIOLATION THEREOF.

SECTION 1. BE IT ORDAINED by the Police Jury of Acadia Parish, Louisiana, that it shall be unlawful for any person to operate or drive a motor vehicle in excess of forty-five miles per hour on the following described Parish Road:

                      
De Porres Road (Parish Road 3-81)

SECTION 2. BE IT FURTHER ORDAINED that any person found guilty of operating or driving a motor vehicle in excess of forty-five miles per hour on the Parish road described above, shall be guilty of a misdemeanor, and upon conviction therefore, shall be fined not more than Fifty Dollars ($50) or be imprisoned not more than ten (10) days or both.

SECTION 3. BE IT FURTHER ORDAINED that any laws or parts of laws in conflict are hereby repealed.

The Ordinance was offered by Mr. A. J. Credeur, and seconded by Mr. Cade Benoit, after being read and considered section by section, was adopted as a whole by the following vote:
