CROWLEY, LOUISIANA

MARCH 2, 2004

THE ACADIA PARISH POLICE JURY met on the above date at 6:30 p.m., in the Police Jury Meeting Room, Courthouse Building, Crowley, Louisiana, in regular session with the President, Cecelia Broussard, presiding. At the request of the President, a moment of silence was offered and the Pledge to the Flag was recited in unison. The roll was called and final attendance was recorded as follows:

A motion was offered by Mr. Jimmie Pellerin, seconded by Mr. Alton Stevenson, to amend the agenda and consider final approval of Verlon Davis Subdivision, repairs to the bridge on Vie Terre Beau and an address from Architect Carroll Blewster. Motion carried.

A motion was offered by Mr. Jimmie Pellerin, seconded by Mr. John Humble, Sr., to approve the Minutes of the February 17, 2004, Regular Police Jury Meeting. Motion carried.

Parish Engineer Karl Aucoin commented on Verlon Davis Jr. Subdivision and noted that there were no drainage patterns indicated on the plat that was submitted for property surrounding the development. Juror A. J. Credeur assured members that there were no drainage problems.

WHEREAS, the Acadia Parish Police Jury wishes to amend the Deferred Compensation Trust pursuant to an agreement dated January 1, 2002, providing that then President Claude J. Courville be authorized to execute the plan for and on behalf of the employer, and

WHEREAS, January 12, 2004, election were held and a new President was elected to the Acadia Parish Police Jury.

THEREFORE, BE IT RESOLVED by the Acadia Parish Police Jury in regular session duly convened on this the 2nd day of March, 2004, does hereby empower, authorize and direct the new President of the Acadia Parish Police Jury (employer) Ms. Cecelia S. Broussard to execute this amendment to the plan for and on behalf of the employer and all further action, including the execution & delivery of documents as may be deemed necessary to effectuate fully and carry out the purposes of the forgoing resolution.

WHEREAS, the Acadia Parish Police Jury advertised for an oil, gas and mineral lease as provided by law for all of the oil rights in and to any highways, rights-of-way, streets, roads, lanes and alleys or other lands owned by and not presently under mineral lease from the Acadia Parish Police Jury, Acadia Parish, Louisiana in the following described property:

          All of the rights, titles and interest in lands owned by and
          not under mineral lease from the Acadia Parish Police Jury,
          situated in Sections 2, 3, 4, 9, 10, and 11, Township 10
          South – Range 1 East, Acadia Parish, Louisiana, within the
          following described boundaries:

          Beginning at a point having Coordinates of X = 1,683,500.00
          and Y = 555,900.00; thence West 9,900.00 feet to a point

ROYALTY:         1/4 of all the oil, gas and all other minerals produced and
                       saved. 1/4 of all gas produced and saved or utilized, but
                       not less than 1/8th, and 1/4 of all other liquid or
                       gaseous minerals in solution and produced with oil and
                       gas and saved or utilized but not less than 1/8th.

PRIMARY TERMS: Three (3) years.

WHEREAS, after careful consideration it is the opinion of the Police Jury that the bid is satisfactory.

THEREFORE, BE IT RESOLVED by the Acadia Parish Police Jury in regular session duly convened this 2nd day of March, 2004, that the bid of Hilliard Acquisitions II LLC, for said oil, gas and mineral lease is hereby accepted, and

BE IT FURTHER RESOLVED that the President is hereby authorized to sign the oil, gas and mineral lease as herein approved in behalf of the Acadia Parish Police Jury, and

BE IT FURTHER RESOLVED that a completed copy of said lease be sent to the Louisiana State Mineral Board for its approval.

BE IT RESOLVED: by the Acadia Parish Police Jury that the President and Secretary advertise for bids for the leasing of the oil, gas and mineral rights in and under the following described properties, to-wit:

          All of the rights, titles and interest in any highways,
          right-of-ways, roads, or other lands owned by and not
          under mineral lease from the Acadia Parish Police Jury,
          situated in Sections 10, 11, 14, 15, 22, 23, and 83,
          Township 8 South – Range 2 East, Acadia Parish,
          Louisiana, within the following described area:

          1,719,100.00 and Y = 612,000.00; thence West 7,500.00

          7,500.00 feet to a point having Coordinates of X =
          1,711,600.00 and Y = 605,000.00; thence North
          7,000.00 feet to a point having Coordinates of X =
          1,711,600.00 and Y = 612,000.00; thence East
          7,500.00 feet to the point of beginning, containing
          approximately
8 Acres, as shown on the attached plat.

All bids to offer a cash bonus for a lease having a primary term which shall not exceed three (3) years. Minimum royalties shall be one-quarter (¼) of all oil, including condensate or other liquid minerals, produced and saved; one-quarter (¼) of the value of all gas, including casinghead gas, produced and saved or utilized by methods considered as ordinary production methods at the time of production; one-quarter (¼) of any and all other liquid or gaseous minerals in solution and produced with oil or gas and saved or utilized, which are not specifically mentioned herein.

Should lessee fail to begin operations for the drilling of a well on the leased premises within one (1) year from the date of the lease, the lease shall terminate as to both parties to the lease, unless on or before such anniversary date Lessee shall pay a delay rental (which shall in no event be less than one-half (½) of the bonus offered), which shall cover the privilege of deferring drilling operations for a period of one (1) year. Upon like payments annually, drilling operations may be further deferred for successive periods of one (1) year each during the primary term. The primary term of the lease shall be three (3) years.

Certified check, cashier's check or bank money order, payable to the Acadia Parish Police Jury for the full amount of the cash bonus shall accompany and be deposited with each bid, and no bid when deposited may be thereafter withdrawn or canceled and the cash bonus thus deposited shall be forfeited to the Acadia Parish Police Jury by the successful bidder in the event said bidder does not enter into a written contract within twenty (20) days after the written lease is submitted to him for execution. All bids to be submitted on Louisiana State Mineral Board bid form. Any lease awarded on the above lands shall be subject to the approval of the State Mineral Board.

The Acadia Parish Police Jury reserves the right to reject any and all bids and to grant a lease on any portion of the tracts advertised for a price not less than proportionate to the best bid offered for the lease of the entire tract.

BE IT FURTHER RESOLVED that the President of this Police Jury be and he is hereby empowered, authorized and directed to execute a contract with Quality Unlimited, Helena Chemical and Adapco, Inc., respectively, on behalf of, in the name and under the seal of the Acadia Parish Police Jury relative to the purchase of said chemicals.

LITIGATION

Legal Counsel André Doguet reported on the Court of Appeal ruling relative to Video Poker litigation with the Town of Duson. He noted that the Appellant Court ruled in favor of the defendant. Mr. Credeur, Mr. Pellerin and Mr. Martin were instructed to meet with the Mayor of Duson regarding the matter.


MOSQUITO CONTROL

A motion was offered by Mr. John Humble, Sr., seconded by Mr. Jimmie Pellerin, to approve the following recommendations: (1) Authorize mailbox markings for locations greater than 300 feet from roadways to designate mosquito spraying approval of private property, (2) Authorize one time special function on-demand spraying of private property, (3) Authorize non-binding aerial spraying contract for mosquito control subject to legal counsel approval. Motion carried.


PERSONNEL

A motion was offered by Mr. Thomas Benoit, seconded by Mr. Alton Stevenson, to hire Mr. Bert Lyons and Samuel Jordan, Jr., as Parish Road Maintenance employees (Maintenance Technician Level D) at a starting pay of $7.00 per hour provided all hiring requirements are met. Motion carried.

A motion was offered by Mr. Thomas Benoit, seconded by Mr. A. J. Credeur, to authorize advertising for the position of Assistant Solid Waste Supervisor. Motion carried.


PUBLIC FACILITIES/BUILDING & GROUNDS

A motion was offered by Mr. A. J. Credeur, seconded by Mr. John Humble, Sr., to authorize the President to conduct fact finding exercise to obtain information relative to property purchase, acceptability and funding sources to construct jail space. Motion carried.

BE IT RESOLVED: by the Acadia Parish Police Jury in regular session duly convened this 2nd day of March, 2004, does hereby authorize Ron Lawson, Architect, to proceed with repairs to the roof on the Industrial Park manufacturing facility at an estimated cost of $18,350.00.

S. Department of Agriculture.

Mr. Carroll Blewster with Bradley - Blewster & Associates addressed the members on new jail construction noting that with the assistance of the Sheriff he would be able to put preliminary programming information together to determine approximate costs for new construction.

Juror Alton Stevenson expressed his support for putting the Correctional Center in the Crowley area. Juror A. J. Broussard noted that selling property in the Industrial Park would provide startup money to build a new facility. It was suggested that Mr. Blewster meet with the President and the Sheriff to obtain additional information.


PUBLIC WORKS/ROAD & BRIDGE

A motion was offered by Mr. Felton Moreau, seconded by Mr. A. J. Credeur, to authorize the purchase of rain gear including jackets and boots for Parish Road Maintenance employees at an estimated cost of $1,500.00. Motion carried.

A motion was offered by Mr. Felton Moreau, seconded by Mr. A. J. Credeur, to authorize mobile phone accounts for Parish Road Division Managers and further authorize an amendment to the 2004 budget in the amount of $3,000.00 to pay for same. Motion carried with one descending vote Mr. Jimmie Pellerin.

A motion was offered by Mr. Alton Stevenson, seconded by Mr. Thomas Benoit, to approve a new entry level pay of $7.00 per hour and an adjustment in the hourly pay for four recently hired Parish Road employees and further dispense with automatic probationary pay increases for same. Motion carried.

A motion was offered by Mr. A. J. Credeur, seconded by Mr. Jimmie Pellerin, to refer to Personnel discussion on Technician Level pay scales and other matters related to salary adjustments. Motion carried.

A motion was offered by Mr. Jimmie Pellerin, seconded by Mr. John Humble, Sr., to authorize the installation of air conditioning units in all motor graders at an estimated cost of $26,000.00. Motion carried.

A motion was offered by Mr. John Humble, Sr., seconded by Mr. Alton Stevenson, to authorize the removal of a tree in the Parish right-of-way on Pearl Street at an estimated cost of $640.00 by Bob’s Tree Preservation. Motion carried.

A motion was offered by Mr. Felton Moreau, seconded by Mr. A. J. Broussard, to authorize the purchase and installation of two-way radios in three motor grader units at an estimated cost of $1,400.00. Motion carried.

BE IT RESOLVED: by the Acadia Parish Police Jury in regular session duly convened this 2nd day of March, 2004, does hereby authorize Aucoin & Associates to prepare plans and specifications and solicit bids to replace the bridge located on Harmon Road at an estimated cost of $171,000.00.

RESOLUTION

            BY MESSRS: FELTON MOREAU AND A J BROUSSARD

WHEREAS, a boundary road exists between Thibodeaux Road located in St. Landry Parish then westly for approximately 1 1/2 miles until the road reaches an intersection with Beckmiller Road (St. Landry Parish)/Jacob Road (Acadia), and

WHEREAS, the midline of the above described road is the Parish boundary line between St. Landry and Acadia Parishes, and

WHEREAS, Acadia Parish is willing to undertake the maintenance obligations for both the road and roadside drainage ditches for the entire roadway described above.

THEREFORE, BE IT RESOLVED: by the Acadia Parish Police Jury in regular session duly convened this 2nd day of March, 2004, does hereby empower, authorize and direct the President to execute an Intergovernmental Agreement with the Parish of St. Landry to accept for maintenance Jacob Road a Parish line road into the Road Maintenance System.

RESOLUTION

             BY MESSRS: JIMMIE PELLERIN AND JOHN HUMBLE SR

WHEREAS, pursuant to Section III-D, Article 9-C of the Contract for Collection and Disposal of Solid Waste between Browning-Ferris Industries and the Acadia Parish Police Jury, the result of a joint house count submitted by BFI indicates an increase of 68 homes bringing the total number of the residential house count to 22,536.

THEREFORE, BE IT RESOLVED by the Acadia Parish Police Jury in regular session duly convened this 2nd day of March, 2004, does hereby concur with the results of the joint house count verifying the number of service units.

BE IT FURTHER RESOLVED that the effective date of the revised count submitted be in accordance with the Solid Waste Collection and Disposal Contract by and between Browning-Ferris Industries and the Acadia Parish Police Jury.

COMMENTS FROM THE PUBLIC

Juror Alton Stevenson requested an update on the plans to improve the Center Ditch.

Mr. Tim Mader responded indicating that the rights-of-way were being acquired.
