CROWLEY, LOUISIANA

NOVEMBER 16, 2004

THE ACADIA PARISH POLICE JURY met on the above date at 6:30 p.m., in the Police Jury Meeting Room, Courthouse Building, Crowley, Louisiana, in regular session with the President, Cecelia Broussard, presiding. At the request of the President, a moment of silence was offered and the Pledge to the Flag was recited in unison. The roll was called and final attendance was recorded as follows:

A motion was offered by Mr. Alton Stevenson, seconded by Mr. A. J. Credeur, to amend the agenda to consider reimbursement for vehicular damages, authorizing a contract for Title 5 Air Permits, receive comments from Mr. John Daigle and remove Item 12(f) regarding St. Joan Road from the agenda. Motion carried.

A motion was offered by Mr. Jimmie Pellerin, seconded by Mr. Alton Stevenson, to approve the Minutes of the November 2, 2004, Regular Police Jury Meeting. Motion carried.


ELECTION

Mr. Allen Bares and Mr. Mike Howard, Legal Counsel and General Manager of the Evangeline Downs Racetrack and Casino, advocated the calling of an election to establish off-track betting facilities in Acadia Parish. Mr. Bares explained in detail how such facilities operate.

A motion was offered by Mr. Alton Stevenson, seconded by Mr. A. J. Broussard, to table action relative to the calling of a Special Election to provide for permitting of Off-Track Betting Facilities in the Parish. The following roll call vote was cast: Yeas: Alton Stevenson, A. J. Broussard and Jimmie Pellerin. Nays: John Humble, Sr., Cecelia Broussard, A. J. Credeur, Cade Benoit and Felton Moreau. Motion failed.

A motion was offered by Mr. Cade Benoit, seconded by Mr. A. J. Broussard, to request the President to convene a Special Meeting Tuesday, November 23, 2004, at 5:30 P.M., to authorize the calling of a special election to be held in the Parish to authorize the licensing of offtrack wagering facilities. The following roll call vote was cast: Yeas: Alton Stevenson, A. J. Broussard, Cecelia Broussard, Jimmie Pellerin, A. J. Credeur, Cade Benoit and Felton Moreau. Abstained: John Humble, Sr. Motion carried.

Opposing comments relative to the establishment of off-track betting parlors were received from Mr. Roland Boudreaux, Mr. Martin Guillory, Jr. and Mr. L. J. Gielen.

The following resolution was offered by Mr. A. J. Credeur, and seconded by Mr. Felton Moreau:

                                      
RESOLUTION

          A resolution providing for canvassing the returns and
          declaring the result of the special election held in the
          Parish of Acadia, State of Louisiana, on Tuesday,
          November 2, 2004, to authorize the levy of a special
          tax therein.

BE IT RESOLVED by the Police Jury of the Parish of Acadia, State of Louisiana (the “Governing Authority”), acting as the governing authority of the Parish of Acadia, State of Louisiana (the “Parish”), that:

SECTION 1. Canvass. This Governing Authority does now proceed in open and public session to examine the official tabulations of votes cast at the special election held in the Parish of Acadia, State of Louisiana, (the “Parish”), on TUESDAY, NOVEMBER 2, 2004, to authorize the levy of a special tax therein, and said Governing Authority does further proceed to examine and canvass the returns and declare the result of the special election.

SECTION 2. Procés Verbal. A Procés Verbal of the canvass of the returns of said election shall be made and a certified copy thereof shall be forwarded to the Secretary of State, Baton Rouge, Louisiana, who shall record the same in his office; another certified copy thereof shall be forwarded to the Clerk of Court and Ex-Officio Recorder of Mortgages in and for the Parish of Acadia, who shall record the same in the Mortgage Records of said Parish; and another copy thereof shall be retained in the archives of this Governing Authority.

SECTION 3. Promulgation of Election Result. The result of said election shall be promulgated by publication in the manner provided by law.

This resolution having been submitted to a vote, the vote thereon was as follows:

PROCÉS VERBAL AND PROCLAMATION OF THE CANVASS OF THE VOTES CAST AT THE SPECIAL ELECTION HELD IN THE PARISH OF ACADIA, STATE OF LOUISIANA, ON TUESDAY, NOVEMBER 2, 2004.

BE IT KNOWN AND REMEMBERED that on Tuesday, November 16, 2004, at six-thirty o’clock (6:30) p.m., at its regular meeting place, the Police Jury Room of the Courthouse, Crowley, Louisiana, the Police Jury of the Parish of Acadia, State of Louisiana (the “Governing Authority”), acting as the governing authority of the Parish of Acadia, State of Louisiana, (the “Parish”), and being the authority ordering the special election held therein on Tuesday, November 2, 2004, with the following members present:

There being absent: None;

did, in open and public session, examine the official certified tabulations of votes cast at the said election, and did examine and canvass the returns of the said election, there having been submitted at said election the following propositions, to wit:

          SUMMARY: 10 YEAR, 1-1/2 MILLS PROPERTY TAX FOR
          THE PURPOSE OF PROVIDING FUNDS TO MATCH FEDERAL
          AND STATE FUNDS ALLOCATED TO ACADIA PARISH FOR
          SERVICES TO THE ELDERLY, INCLUDING THE ESTABLISHMENT
          AND MAINTENANCE OF CENTERS FOR SENIOR CITIZENS.

          Shall the Parish of Acadia, State of Louisiana (the “Parish”),
          be authorized to levy a one and one-half (1-1/2) mills tax on
          all the property subject to taxation in the Parish for a period
          of ten (10) years, beginning with the year 2005 and ending
          with the year 2014, for the purpose of providing funds to
          match federal and state funds allocated to Acadia Parish for
          services to the elderly, including the establishment and
          maintenance of centers for senior citizens?

There was found by said count and canvass that the following votes had been cast at the said special election

The polling places above specified being the only polling places designated at which to hold the said election, it was therefore shown that there was a total of
11,232 votes cast IN FAVOR OF the Proposition and a total of 10,859 votes cast AGAINST the Proposition, as hereinabove set forth, and that there was a majority of 373 votes cast IN FAVOR OF the Proposition as hereinabove set forth.

Therefore, the Governing Authority did declare and proclaim and does hereby declare and proclaim in open and public session that the Proposition as hereinabove set forth was duly
CARRIED by a majority of the votes cast by the qualified electors voting at the said special election held in the Parish on Tuesday, November 2, 2004.

                                      PROCLAMATION

I, the undersigned President of the Police Jury of the Parish of Acadia, State of Louisiana, the governing authority of the Parish of Acadia, State of Louisiana (the “Parish”), do hereby declare, proclaim and announce that the proposition submitted at the special election held in the Parish on Tuesday, November 2, 2004, was
CARRIED by a majority of the votes cast at the said special election, all as described and set out in the above Procés Verbal.

FINANCE

A motion was offered by Mr. John Humble, Sr., seconded by Mr. Jimmie Pellerin, to approve a 4% cost of living raise and reclassification pay adjustments as presented effective January 1, 2005, for Parish employees and further approve merit pay raises to six Parish employees as presented effective November 16, 2004. Motion carried.

Juror A. J. Credeur requested clarification on the recommendation to table merit pay raises presented at the last Personnel Committee Meeting.

A motion was offered by Mr. Alton Stevenson, seconded by Mr. John Humble, Sr., to authorize the Secretary to adjust the Proposed 2005 General Fund Budget as presented to balance revenues and expenditures. Motion carried.

The Secretary-Treasurer presented budget entries that would be required to bring the 2004 Budget in line with projected revenues and expenditures. He reported the significant changes were indicated in the revenue side of the General Fund where Severance Taxes and Court Fines would not meet projections. He also noted that entries would be made relative to funding activities that were implemented during the 2004 Fiscal Year.

A motion was offered by Mr. Alton Stevenson, seconded by Mr. Jimmie Pellerin, to authorize the Secretary to make the budget entries as presented for the 2004 Fiscal Year. Motion carried.


HEALTH/SAFETY

It was announced that Wellness Express would be holding a Health Day at the Acadia Parish Courthouse November 30th. The Fair will provide health screening for employees, family and friends.

INSURANCE

Mr. Troy Falgout, Health Insurance Agent, along with Ms. Sherri Baker presented a proposal for Police Jury Group Health Insurance. The presentation was associated with United Healthcare Insurance Company.

Four independent offers were made to provide group health coverage. Each proposal reflected benefits comparable to the current benefit plan offered to Parish employees. The primary option provided for office visit co-pays and $750 deductible with 80% co-insurance. Each exhibit included preferred provider groups.

BE IT RESOLVED: by the Acadia Parish Police Jury in regular session duly convened this 16th day of November, 2004, does hereby authorize the purchase of group health insurance from United Healthcare under the proposal presented by Troy Falgout and Sherri Baker with an estimated annual premium of $658,718.00 for a period of twelve months beginning January 1, 2005.

BE IT FURTHER RESOLVED that the health plan include optional dental benefits as well as employee life coverage.

LEGISLATION

     AN ORDINANCE AMENDING ORDINANCE NO. 735. ORDINANCE NO.
     735 IS HEREBY AMENDED TO REDEFINE A RESIDENTIAL DISTRICT

                                      
ORDINANCE #881

                              OFFENSES AGAINST THE PUBLIC

AN ORDINANCE REGULATING LOUD AND UNUSUAL NOISES, PROVIDING DEFINITIONS THEREOF, AND PROVIDING FOR PENALTIES FOR VIOLATION THEREOF.

Ordinance No. 735 is hereby amended to read as follows: (To facilitate the interpretation of changes made to Ordinance No. 735, the following indicates words deleted by dashes through such words and indicates words added by underlining such words.)

BE IT ORDAINED by the Police Jury of Acadia Parish, Louisiana, proceeding under its police power and further pursuant to the laws of the State of Louisiana, that:

SECTION B. is hereby amended:

RESIDENTIAL DISTRICT: An area of single-family or multi-family dwellings and shall include areas where multi-unit dwellings, high-rise apartments and high-density residential districts are located. The term also includes, but it not limited to, hospitals, nursing homes, homes for the aged, schools, courts and similar institutional facilities. Any tract of land in the unincorporated areas of the Parish which has been approved as a subdivision by the Parish Planning Commission and accepted as such by the Parish Police Jury or illustrated and/or indexed as a “DETAILED SUBDIVISION” within and as part of the Acadia Parish Road System, or A subdivision having a plat recorded with the Acadia Parish Clerk of Court and the Tax Assessor whereby 50% plus one (1) of the occupied landowners have signed a petition requesting enforcement of this ordinance in their subdivision.

Should any section, paragraph, clause or phrase of Ordinance No. 735 be declared unconstitutional or invalid for any reason, the remainder of said ordinance shall not be affected thereby.

All ordinances and laws or parts of ordinances and laws not specifically noted above which are in conflict with this ordinance are hereby repealed.

The Ordinance was offered by Mr. A. J. Broussard, and seconded by Mr. Felton Moreau after being read and considered section by section, was adopted as a whole by the following vote::

A motion was offered by Mr. John Humble, Sr., seconded by Mr. A. J. Broussard, to authorize the introduction of an ordinance regulating the discharge of firearms and further authorize the calling of a public hearing to be scheduled at 6:30 P.M., on Tuesday, January 4, 2005, to receive comments on said Ordinance. Motion carried.

The following proposed ordinance is hereby presented for introduction:

                                      
ORDINANCE #

     An Ordinance amending the Acadia Parish Code of Ordinances
     to add a section Regulating the Discharge of Firearms in the
     unincorporated areas of the Parish and prescribing the penalties
     for violation.

BE IT ORDAINED by the Police Jury of Acadia Parish, Louisiana in regular session on the                       day of          , 20      , an Ordinance Regulating the Discharge of Firearms, as follows:

SECTION I. Restrictions.

a. It shall be unlawful for any person to fire, shoot, discharge or cause to
    be fired, shot or discharged any type of firearm on a Parish road or on
    Parish property, unless specifically authorized by the Acadia Parish
    Police Jury.
b. It shall be unlawful for any person to fire, shoot, discharge or cause to
    be fired, shot or discharged any other type of firearm, including but
    not limited to shotguns of any description, gas operated gun or spring
    gun, or any similar mechanism by whatever name known, which is
    designed to expel a projectile through a gun barrel by action of any
    explosive, for any purpose, within 300 feet of a recognized subdivision
    in the Parish.

SECTION II. Exceptions.

a. The provisions as recited above shall not be construed so as to
    prohibit any person from discharging a firearm in the defense of his
    person, family or property, or any law enforcement officer in the
    performance of his duties.
b. Further, this ordinance shall not apply to the discharge of firearms
    within the confines of approved and licensed shooting ranges, law
    enforcement agency ranges, existing private and commercial shooting
    ranges, gun clubs, and official hunting areas. Further, the discharge of
    blanks or non-lethal shells or cartridges is not prohibited by this
    ordinance.

SECTION III. Penalty.

Any person who violates the provisions of this ordinance shall be fined not more than $100 or imprisoned for not more than 60 days, or both. Additionally, the court may order the forfeiture of the weapon in accordance with the law.

SECTION IV. Miscellaneous

Effective Date: Ten days after being promulgated as provided in R.S. 33:1366.

R. Core, LLC and extend the final contract time until April 20, 2005, and further require that all other work provided for in the contract be completed by the original deadline of January 19, 2005.

RESOLUTION OF TERMINATION

The following resolution was offered by Mr. A. J. Credeur, duly seconded by Mr. Alton Stevenson, and duly resolved and adopted on November 16, 2004.

A resolution authorizing and directing the President to execute for and on behalf of the Acadia Parish Police Jury, a Notice of Termination from Slick Construction Co., Inc., Contractor, pertaining to the completion of the contract for “Installation of Revetment into the Crowley Center Ditch” in accordance with the plans and specifications contained in the contract documents pertaining thereto.

WHEREAS, a final inspection on the above referenced project was performed on November 3, 2004; and

WHEREAS, Slick Construction Co., Inc., as Contractor, has substantially completed the “Installation of Revetment into the Crowley Center Ditch” in accordance with the specifications contained in the contract documents pertaining thereto; and

WHEREAS, the Acadia Parish Police Jury desires to accept the completed work;

NOW, THEREFORE, BE IT RESOLVED by the Acadia Parish Police Jury that the President of said Acadia Parish Police Jury be, and is hereby empowered, authorized and directed to execute a Notice of Termination for and on behalf of the Acadia Parish Police Jury accepting the work as being substantially completed, and that she be authorized and directed to have a copy of said acceptance recorded in the Conveyance Records of the Parish of Acadia, State of Louisiana.

The following resolution was offered by Mr. A. J. Broussard, duly seconded by Mr. Jimmie Pellerin, and duly resolved and adopted on November 16, 2004.

A resolution authorizing and directing the President to execute for and on behalf of the Acadia Parish Police Jury, an Act of Acceptance for Guinn Brothers, LLC, Contractor, pertaining to the completion of the contract, Bridge Replacement Crossing Coulee De Saule on Harmon Road, in accordance with the plans and specifications contained in the contract documents pertaining thereto.

WHEREAS, Guinn Brothers, LLC, as Contractor, has substantially completed the Bridge Replacement Crossing Coulee De Saule on Harmon Road, in accordance with the plans and specifications contained in the contract documents pertaining thereto; and

WHEREAS, the Acadia Parish Police Jury desires to accept the completed work;

NOW, THEREFORE, BE IT RESOLVED by the Acadia Parish Police Jury that the President of said Acadia Parish Police Jury be, and is hereby empowered, authorized and directed to execute an Act of Acceptance for and on behalf of the Acadia Parish Police Jury accepting the work as being substantially completed, and that she be authorized and directed to have a copy of said acceptance recorded in the Conveyance Records of the Parish of Acadia, State of Louisiana.

ORDINANCE #882

     AN ORDINANCE AMENDING ORDINANCE #761 TO PROVIDE FOR
     AGGREGATE TYPE ROADS AS AN ALTERNATIVE RESIDENTIAL
     STREET IN APPROVED SUBDIVISIONS.

SECTION I. The following language is hereby made part of the Acadia Parish Subdivision Regulations. Within Section V Final Plans and Specifications, Part B Street Improvements Subdivision Development Section 1. Residential streets, add:

c. Aggregate roads:
    a. Under the condition where subdivisions are developed requiring the
        construction of new streets and the subdivision development is
        accessed by existing public aggregate roads then the new street
        development to be dedicated for public use within the subdivision is
        exempt from the standards set forth in Part B of this section.
    b. The standard set forth, and the review of the construction of
        streets in this part, shall be approved by the Road & Bridge
        Committee of the Acadia Parish Police Jury.
    c. Streets constructed under this section to be dedicated for public
        use shall, at a minimum, meet the conditions set forth in Ordinance
        #719, Minimum Requirements for Acceptance of Existing Private
        Aggregate Roads or Drives as Public Roads into the Police Jury Road
        System.

SECTION II. All other Sections of Ordinance #761 shall remain in full force and effect. This Ordinance shall have full force & effect from and after the date of this adoption.

SECTION III. All Ordinance or parts of Ordinances contrary to or in conflict herewith are hereby repealed.

The Ordinance was offered by Mr. Felton Moreau, seconded by Mr. Cade Benoit, and after being read and considered section by section, was adopted as a whole by the following vote:

YEAS: John Humble, Sr., A. J. Credeur, Cade Benoit and Felton Moreau.

NAYS: A. J. Broussard, Cecelia Broussard and Jimmie Pellerin.

A motion was offered by Mr. Cade Benoit, seconded by Mr. Felton Moreau, to amend the agenda to consider additional repairs to Ed Thibodeaux Road Bridge. Motion carried.

A motion was offered by Mr. A. J. Credeur, seconded by Mr. Alton Stevenson, to approve the expenditure in the amount of $5,204.00 to purchase additional drainage pipe to complete the improvements to the bridge at Ed Thibodeaux Road. Motion carried.

No action was taken relative to the request for vehicular repairs alleged to have occurred on Ellis Road.

BE IT RESOLVED: by the Acadia Parish Police Jury in regular session duly convened this 16th day of November, 2004, does hereby authorize the President and the Solid Waste Engineer to negotiate a contract for Title 5 Air Permit Applications not to exceed an amount of Seventeen Thousand Seven Hundred Twenty and 00/100 ($17,720.00) Dollars.

Mr. John Daigle, Parish resident, offered comments relative to the Mosquito Control Program and the Parish’s Director of Operations.

President Broussard extended remarks in response to Mr. Daigle’s comments.

Juror Alton Stevenson requested that discussion relative to electing a Parish President be an agenda item for the next regular meeting.

Ms. Marsha Pellerin offered an additional response to Mr. Daigle’s comments.

Mr. Simoneaux, a resident of Pointe Noir Road, expressed the importance of St. Joan Road near Church Point as a vital route for egress.

Mr. Clifford Dias echoed Mr. Simoneaux’s comments.

Additional closing remarks were offered by Mrs. Earline Oliver and Mr. Douglas Savoy.

The Director of Operations noted that four applications had been received for the position of Equipment Operator at the Sanitary Landfill.

Mr. Charles Scanlan, resident of the Church Point area, explained the situation surrounding St. Joan Road. Other comments were received relative to the subject.


LITIGATION

A motion was offered by Mr. A. J. Broussard, seconded by Mr. Felton Moreau, to adjourn into executive to consider matters relative to the lawsuit by Jamie Duplechine et al vs. General Motors, et al, Docket #70,425. The following roll call vote was cast: Yeas: Alton Stevenson, A. J. Broussard, John Humble, Sr., Cecelia Broussard, Jimmie Pellerin, A. J. Credeur, Cade Benoit and Felton Moreau. Motion carried.

The President reconvened the meeting following the executive session.

Parish Attorney Douglas Wimberly requested authorization to respond to the settlement demand made by the plaintiffs.

A motion was offered by Mr. John Humble, Sr., seconded by Mr. Jimmie Pellerin, to authorize Legal Counsel to respond to the settlement demand made relative to the litigation of Jamie Duplechine et al vs. General Motors, et al., Docket #70,425. Motion carried.
