PUBLIC HEARING

It was announced by the President that notice had been given that the Acadia Parish Police Jury would hold a public forum on Tuesday, October 19, 2004, at 6:30 P.M., Police Jury Meeting Room, Courthouse Building, Crowley, Louisiana, to receive public comments on the proposed partial abandonment of Thompson Road.

No comments were received on the subject of the partial abandonment of Thompson Road

THERE BEING NO FURTHER COMMENTS TO COME BEFORE THE JURY, THE PRESIDENT ADJOURNED THE PUBLIC HEARING.

THE ACADIA PARISH POLICE JURY met on the above date at 6:30 p.m., in the Police Jury Meeting Room, Courthouse Building, Crowley, Louisiana, in regular session with the President, Cecelia Broussard, presiding. A motion was offered by Mr. Felton Moreau, seconded by Mr. A. J. Credeur, to approve the request to assist with the maintenance on the TRIAD Building. Motion carried.

A motion was offered by Mr. A. J. Credeur, seconded by Mr. Alton Stevenson, to authorize beautification work at the Recycling Center with the assistance from the inmate program. Motion carried.


COMMUNITY/ECONOMIC DEVELOPMENT

Mr. Stephen Broussard, Executive Vice President of the Acadia Economic Development Corporation, reported on recent economic development activities. He indicated that his office has been in conversation with Lowe’s regarding demographics, maps and other information. He noted that the proposed project would create about 150 permanent jobs and 50 part-time jobs. He also reported that the group assisted over 40 new and potential businesses this year which included 5 expansions, 16 ongoing projects from 2003 and twenty-five 2004 projects.

In addition, the group received 27 requests for proposals. Mr. Broussard also expanded in the GIS Mapping Program and efforts to improve the access road to the Mermentau Port.


FINANCE

A motion was offered by Mr. John Humble, Sr., seconded by Mr. Jimmie Pellerin, to approve $500 expenditure to assist with transportation costs associated with the 2005 Career Expo. Motion carried.

A motion was offered by Mr. John Humble, Sr., seconded by Mr. Alton Stevenson, to authorize the President and Chairman of the Finance Committee to approve monthly bills processed for payment. Motion carried.

The following statement was read into the record by Director of Operations Mr. John Quebodeaux:

Madam President, Members of the Jury,

Please bear with me for a few minutes while I review some things that I think may justify my request. I’m sure that we are all familiar with the suit filed against me by three members of this body.

I have been an employee of the Acadia Parish Police Jury for nearly 9 years. In that time you have given me many assignments, all of which I tried to accomplish in a manner that reflected well on the Jury and on myself. I feel that everything that I have touched in this Parish is better off for it. (Homeland Security and Emergency Preparedness, the Federal Off-System Bridge Program, Household Hazardous Waste Day, Animal Control, Mosquito Control, Pre-Disaster Debris Contract, Obnoxious Weeds and Derelict Buildings Enforcement, Building Permits, Mapping and Technology, Grants and Accountability.) I think we have set the standard for many parishes and I am proud to know that I played a role in that. I have worked with all Parish agencies, Law Enforcement, Fire and the Municipalities, in an effort to provide better services and emergency services to the citizens of Acadia Parish. I did all of this because you asked it of me and in nearly every case I did it for a very reasonable price (free). I couldn’t have done it without your support and approval. I have never overstepped the boundaries of may authority, even though on different occasions some of you may have asked me to. I have made many recommendations to you in the past 9 years and you approved nearly all of them. By working together, some great things have happened in this Parish, things that we should all be proud of.

On October 22nd, I received a “Thank You” note like I had never received before. I sincerely believe that the school board issue is a mute issue and if it’s not, then as the elected official, I have to do what’s right. Although if I resign that position, I don’t know what most of you will do since the majority of my calls on school board issues during Police Jury duty hours, come from Police Jurors. I also sincerely believe that the other 2 issues in the suit are a personal attack on me as your employee and I am asking for your assistance by paying for that part of my legal expenses.

I can assure you that this issue is not about me and I didn’t cause it. If I thought that resigning all positions would fix what’s wrong, you’d have my resignation tonight. But I’ll say again, it’s not about me. It hasn’t been about me for nearly 9 years and all of a sudden it’s about me, think about it. I thank you for your time and I respectfully request your help in this matter.

Juror John Humble, Sr., recanted the situation where a previous employee had been sued for negligence and the Police Jury defended the conditions brought forth.

BE IT RESOLVED: by the Acadia Parish Police Jury in regular session duly convened this 19th day of October, 2004, does hereby approve the payment of 2/3 of the legal defense relative to a suit filed for Declaratory Judgement involving Mr. John Quebodeaux, Director of Operations through the hearing date scheduled for December 6, 2004.

Juror Cade Benoit objected to payment of fees without a pre-determined limit.

PERSONNEL

A motion was offered by Mr. Cade Benoit, seconded by Mr. A. J. Broussard, to set entry levy and existing employee pay at $7.00 per hour minimum. Motion carried.

A motion was offered by Mr. Cade Benoit, seconded by Mr. Alton Stevenson, to authorize the hiring of Mr. Donald Ray London as a Material Handler for the Recycling Program at a starting pay of $7.00 per hour provided all hiring requirements are met. Motion carried.

A motion was offered by Mr. Cade Benoit, seconded by Mr. A. J. Broussard, to authorize the Personnel Committee, with assistance from the Director of Operations, to establish a graduated scale for employee pay increases. Motion carried.

A motion was offered by Mr. Cade Benoit, seconded by Mr. A. J. Broussard, to approve the Payroll Attendance Record System as presented by the Secretary. Motion carried.

A motion was offered by Mr. Cade Benoit, seconded by Mr. John Humble, Sr., to ratify the use of interim contract labor at an estimated cost of $1,500 during the application process prior to hiring an Assistant Animal Control Officer. Motion carried.


PUBLIC WORKS/ROAD & BRIDGE

A motion was offered by Mr. A. J. Credeur, seconded by Mr. Felton Moreau, to authorize the Director of Operations to train existing road maintenance staff to administer the Federal Off-System Bridge Program. Motion carried.

A motion was offered by Mr. John Humble, Sr., seconded by Mr. Alton Stevenson, to authorize Aucoin & Associates to prepare cost estimates to repair the bridge on Deer Road. Motion carried.

A motion was offered by Mr. A. J. Credeur, seconded by Mr. Felton Moreau, to approve merit and reclassification pay be established for the following employees in the following amounts: Larris Daigle, $8.50; Terry Shuff, $10.00; Barry Cormier, $9.38; Larry Hebert, $9.00. Motion carried.

A motion was offered by Mr. A. J. Credeur, seconded by Mr. Felton Moreau, to approve expenditures in the amount of $3,409 to construct drainage improvements on Madison Road. Motion carried.

A motion was offered by Mr. A. J. Credeur, seconded by Mr. Cade Benoit, to refer request for damages associated with Faulk Road to Acadiana Shell for consideration. Motion carried.

A motion was offered Mr. A. J. Credeur, seconded by Mr. Felton Moreau, to establish Road Manager as a non-exempt salaried employee with an annual pay of $38,800 subject to the Federal Labor Laws governing non-exempt status. Motion carried.

                                                   RESOLUTION

BE IT RESOLVED: by the Acadia Parish Police Jury in regular session duly convened this 19th day of October, 2004, does hereby authorize Aucoin & Associates to prepare plans and solicit bids to repair the bridge on Ohlenforst Road at an estimated cost of $61,800 and further authorize an increase in the 2004 Budget to provide for the necessary funds.

A motion was offered by Mr. A. J. Credeur, seconded by Mr. Jimmie Pellerin, to authorize the Director of Operations and Road and Bridge Chairman to develop a plan in conjunction with the City of Rayne and First Ward Drainage District to repair the bridge on West Jeff Davis Road. Motion carried.

A motion was offered by Mr. A. J. Credeur, seconded by Mr. Felton Moreau, to authorize repairs to the railing on Simon Road Bridge and further authorize Aucoin & Associates to prepare a cost estimate to repair the Petry Road Bridge. Motion carried.

A motion was offered by Mr. A. J. Credeur, seconded by Mr. John Humble, Sr., to approve the Emergency Work Report for the month of September, 2004. Said expenditures to be in the amount of $67.17. Motion carried.

A motion was offered by Mr. A. J. Credeur, seconded by Mr. Jimmie Pellerin, to authorize the Parish Road Manager and Director of Operations to investigate the request to accept J. W. lane into the road maintenance system. Motion carried.

                                        
RESOLUTION

BE IT RESOLVED: by the Acadia Parish Police Jury in regular session duly convened this 19th day of October, 2004, does hereby authorize Legal Counsel to prepare required entry agreement to resolve property access question in the vicinity of Harmon Road Bridge.

BE IT FURTHER RESOLVED that the President be empowered, authorized and directed to execute said agreement to accomplish same.

A motion was offered by Mr. A. J. Credeur, seconded by Mr. Alton Stevenson, to authorize the repair and installation of culverts to replace the bridge on Ed Thibodeaux with assistance from the Bayou Plaquemine & Wikoff Drainage District at an estimated cost of $12,408.00. RESOLUTION

WHEREAS, public notice had been given that a public hearing was scheduled to receive comments relative to the partial abandonment of Thompson Road, and

WHEREAS, a public hearing was conducted to receive said comments at which none were registered, and

THEREFORE, BE IT RESOLVED by the Acadia Parish Police Jury in regular session duly convened on this the 19th day of October, 2004, does hereby authorize the partial abandonment of Thompson Road beginning at a point 1,214 ft. from the centerline of La. Hwy. 13 which coincides with the east boundary of Lot 5 recorded on a plat of survey for Ms. Doy Smith Thompson to the dead end.

BE IT FURTHER RESOLVED that said abandonment be recorded with the Acadia Parish Clerk of Court.

Mr. Garrick Manuel, resident of Ellis Road, addressed the members relative to the poor condition of Ellis Road. He indicated that he sustained considerable front-end damage to his personal vehicles from driving on the failing roadway.

Parish Engineer Karl Aucoin reported that money was allocated under the current chip seal contract to provide patching in the areas that have failed.

Mr. Andy Toups presented an invoice in the amount of $461.19 for vehicular damage alleged to have occurred on Ellis Road.

A motion was offered by Mr. Cade Benoit, seconded by Mr. A. J. Broussard, to refer the matter relative to the request for damages by Mr. Andy Toups in the amount of $461.19 to the Finance Committee for consideration.


SOLID WASTE/ENVIRONMENTAL

A motion was offered by Mr. A. J. Broussard, seconded by Mr. Felton Moreau, to authorize advertising to fill a new position as equipment operator at the Acadia Parish Sanitary Landfill at a starting pay of $7.61 per hour. Motion carried.

A motion was offered by Mr. A. J. Broussard, seconded by Mr. John Humble, Sr., to authorize the use of the proceeds from the sale of recyclables to provide direct payment to participating schools who collect such materials and further authorize the distribution be pro-rated based on amounts collected. Motion carried.

A motion was offered by Mr. Jimmie Pellerin, seconded by Mr. Felton Moreau, to authorize maintenance work at the Rice Arena in the form of painting with the use of inmate labor. Motion carried with two no votes cast: A. J. Broussard and Cecelia Broussard.

                                      
RESOLUTION

            BY MESSRS: JOHN HUMBLE SR AND A J BROUSSARD

WHEREAS, equipment purchased under the Homeland Security Grant Program was formally donated to the Acadia Parish Police Jury for inventory purposes, and

WHEREAS, said equipment was conveyed to local fire protection and law enforcement districts for use, and

WHEREAS, said equipment is in possession of other qualified governmental entities.

THEREFORE, BE IT RESOLVED by the Acadia Parish Police Jury in regular session duly convened on this the 19th day of October, 2004, does hereby formally donate items obtained under the Homeland Security Grant Program to recipients of said equipment.

BE IT FURTHER RESOLVED that any purchases made and retained by any department within the Acadia Parish Police Jury System be registered as inventory within their respective departments.

TWENTY-FIVE MILES PER HOUR, AND, PROVIDING FOR THE PENALTIES FOR THE VIOLATION THEREOF.

SECTION 1. BE IT ORDAINED by the Police Jury of Acadia Parish, Louisiana, that it shall be unlawful for any person to operate or drive a motor vehicle in excess of twenty-five miles per hour on the following described Parish Road:

                                    
Ebenezer Road
                            from LA. 3007 to the Parish line

SECTION 2. BE IT FURTHER ORDAINED that any person found guilty of operating or driving a motor vehicle in excess of twenty-five miles per hour on the Parish road described above, shall be guilty of a misdemeanor, and upon conviction therefore, shall be fined not more than Fifty Dollars ($50) or be imprisoned not more than ten (10) days or both.

SECTION 3. BE IT FURTHER ORDAINED that any laws or parts of laws in conflict are hereby repealed.

The Ordinance was offered by Mr. Felton Moreau, and seconded by Mr. A. J. Broussard after being read and considered section by section, was adopted as a whole by the following vote:

COMMENTS FROM THE PUBLIC

It was noted that garbage collection vehicles were losing trash on windy days. It was suggested that those complaints be documented.

It was noted that another dead bird was found in the Church Point area.

The President stated that following the review of bills she would present to the members a brief report.

Thanks were offered to the those who attended the elected official appreciation day in Church Point on Sunday.

The Mosquito Control schedule for reviewed briefly.
