PUBLIC HEARING

It was announced by the President that notice had been given that the Acadia Parish Police Jury would hold a public forum on Tuesday, September 6, 2005, at 6:30 P.M., Police Jury Meeting Room, Courthouse Building, Crowley, Louisiana, to receive comments on the proposed changes to Ordinance #809 providing for the cutting of grass and weeds in approved subdivisions in the unincorporated areas of the Parish. The proposed change would allow enforcement of the Ordinance on tracts of land that are bounded on three sides by existing approved rural subdivisions.

The President called for any comments relative to the subject matter.

THERE BEING NO COMMENTS TO COME BEFORE THE JURY, THE PRESIDENT ADJOURNED THE PUBLIC HEARING.

THE ACADIA PARISH POLICE JURY met on the above date at 6:30 p.m., in the Police Jury Meeting Room, Courthouse Building, Crowley, Louisiana, in regular session with the President, Cecelia Broussard, presiding. At the request of the President, a moment of silence was offered and the Pledge to the Flag was recited in unison. The roll was called and final attendance was recorded as follows:

A motion was offered by Mr. John Humble, Sr., seconded by Mr. Felton Moreau, to amend the meeting agenda to include update and action relative to the Office of Emergency Preparedness, to consider a Rural Development Grant Application for the Iota Long-Point Gravity Drainage District, to consider Change Order #1 to the Correctional Center Project and to consider speed limits on Jacob Road and Streets in Chachery Subdivision . Motion carried.

A motion was offered by Mr. Jimmie Pellerin, seconded by Mr. John Humble, Sr., to approve the Minutes of the August 16, 2005, Regular Police Jury Meeting. Motion carried.

          IN RECOGNITION OF MR. NEWTON LEGER’S 53 YEARS OF
          SERVICE AS A MEMBER OF THE BOARD OF COMMISSIONERS
          OF THE FOURTH WARD GRAVITY DRAINAGE DISTRICT #1 OF
          ACADIA PARISH

WHEREAS, in light of recent events, particularly the aftermath of Hurricane Katrina, the need for drainage in this part of the country is ever more evident, and

WHEREAS, Mr. Newton Leger has made significant personal commitments to construct adequate and effective drainage improvements for flood prevention in his community, and

WHEREAS, Mr. Leger’s efforts extended far beyond the boundaries of the Fourth Ward Drainage District and the Parish of Acadia, and

WHEREAS, the Acadia Parish Police Jury recognizes the value of his efforts and the positive impact they have had on the Parish of Acadia.

THEREFORE, BE IT RESOLVED by the Acadia Parish Police Jury in regular session duly convened on this the 6th day of September, 2005, does hereby convey onto Mr. Newton Leger an expression of gratitude and debt of thanks in exchange for his unselfish work and dedicated service as a Fifty-three Year Member of the Board of Commissioners of the Fourth Ward Gravity Drainage District #1 of Acadia Parish.

BE IT FURTHER RESOLVED that a copy of this Resolution be read into the permanent record of the Parish as a reminder of this accomplishment.

FINANCE

A motion was offered by Mr. A. J. Credeur, seconded by Mr. Felton Moreau, to amend the 2005 Parish Transportation Budget by increasing expenditures in the amount of $200,000.00 for Maintenance of Property, Professionals and Materials and Supplies as presented by the Secretary. Motion carried with a descending vote cast by Mr. A. J. Broussard.

A motion was offered by Mr. Jimmie Pellerin, seconded by Mr. Felton Moreau, to re-allocate $250,000.00 of Capital Outlay Funding in the Sales Tax Road Fund for the purpose of culvert and bridge improvements. Motion carried.


PROPERTY ASSESSMENT

WHEREAS, the list of assessments for the Parish of Acadia in the dollar amount of $207,380,230.00 have been exposed for public review, and

WHEREAS, the Acadia Parish Police Jury did sit as a Board of Review as required by law and no protests were received.

THEREFORE, BE IT RESOLVED by the Acadia Parish Police Jury in regular session duly convened on this the 6th day of September, 2005, that valuation for the 2005 Taxes, Parish of Acadia, as set by the Acadia Parish Tax Assessor, be and the same is hereby accepted by the Police Jury of Acadia Parish.

ORDINANCE #897

          AN ORDINANCE AMENDING ORDINANCE NO. 809; PROVIDING
          FOR THE TRIMMING OF WEEDS AND GRASS; NOTICE TO
          CUT; CAUSING TO CUT AND COLLECTING OF COST.

Ordinance No. 809 is hereby amended to read as follows: (to facilitate the interpretation of changes made to Ordinance No. 809, the following indicates words deleted by dashes through such words and indicates words added by underlining such words).

SECTION I. DEFINITIONS.

The following definitions shall apply to the interpretation and enforcement of this article:

(a) Lot: Any lot, portion of lots or other property improved or unimproved, located within a recognized subdivision.

(b) Recognized: A recognized subdivision is defined as:

(1) Any tract of land in the unincorporated areas of the Parish which has been approved as a subdivision by the Parish Planning Commission and accepted as such by the Parish Police Jury or illustrated and/or indexed as a “DETAILED SUBDIVISION” within and as part of the Acadia Parish Road System.

(2) A subdivision having a plat recorded with the Acadia Parish Clerk of Court and the Tax Assessor whereby 50% plus one (1) of the occupied landowners have signed a petition requesting enforcement of this ordinance in their subdivision.

(3) Any lot that is bounded in whole or part on three sides by recognized subdivision.

© Obnoxious weeds: Shall include but is not limited to Chinese tallow trees a/k/a “chicken trees.”

SECTION II. PROHIBITION ON LOTS OR PROPERTY IN THE PARISH.

(a) It shall be unlawful for the owner of any occupied or unoccupied lot located in a recognized subdivision outside of the municipalities in Acadia Parish to permit and allow to remain upon said lot any grass or obnoxious weeds that have reached a height of more than twenty (20) inches.

(b) In the event that unoccupied lots are used for commercial farming and designated as such by virtue of continuous use, they shall be excluded from the provisions of this article, but in no case shall the owner, tenant or occupant of such property allow it to become a haven for rodents or other dangerous animals or reptiles.

SECTION III. NOTICE.

(a) Upon notification to the Parish Police Jury that an owner of a lot or lots is in violation of Section II (a), the Police Jury will notify said owner by registered or certified letter notifying him of the violations and that the grass and obnoxious weeds must be cut within fifteen (15) days after the receipt of registered or certified letter.

SECTION IV. ENFORCEMENT.

(a) If after fifteen (15) days the owner of said lot has not cut and removed the grass and obnoxious weeds, the Police Jury will cause the grass and obnoxious weeds to be cut by a private contractor who will be chosen from rotating order.

(b) The Police Jury shall appoint a designee and is hereby authorized and empowered to carry out and enforce this provision of the article.

© The designee is hereby authorized to enter property found by the Parish to be in violation of this article.

SECTION V. COSTS.

(a) The lot owner found to be in violation of this article will be charged an administrative fee of thirty-five dollars ($35.00) per lot plus the actual cost to the Parish for having the work performed.

SECTION VI. LIENS.

(a) If the charge has not been paid within thirty (30) days after receipt of the bill, the Police Jury shall file a certified copy of said charges with the recorder of mortgages, and the same, when so filed and recorded shall operate as a lien and privilege against the property on which said weeds and grass were cut and removed.

(b) The designee is authorized to accept full payment of the lien herein levied and is empowered and instructed to authorize the Parish Clerk of Court to cancel and erase such lien from his records.

SECTION VII. EXPENSES TO BE COLLECTED AS AD VALOREM TAX.

(a) Whenever the Police Jury has taken action to abate the aforementioned nuisances by the employing of Parish forces or by a private contractor and paying for the cutting, destroying and/or removal of such weeds and grass, as set forth in this article, the actual cost and expenses thereof plus the $35.00 administrative fee shall be charged to the owner of such lot. The aforementioned charges shall be added to the annual ad valorem tax bill of the property involved if the charges remain unpaid and shall be collected in the same manner as fixed by law for the collection of taxes and shall be subject to the same penalties and delinquencies.

SECTION VIII. BE IT FURTHER ORDAINED that any laws or parts of laws in conflict are hereby repealed.

PERSONNEL

A motion was offered by Mr. Cade Benoit, seconded by Mr. Alton Stevenson, to approve the hiring of Mr. Aaron Hornsby III and Byron Batiste as Landfill Equipment Operators at a starting pay of $7.61 per hour provided all hiring requirements are met. Motion carried.

A motion was offered by Mr. Cade Benoit, seconded by Mr. Jimmie Pellerin, to authorize the hiring of Ms. Rhonda Thibodeaux as Assistant Animal Control Officer at a starting pay of $7.00 per hour provided all hiring requirements are met. Motion carried.


PUBLIC FACILITIES/BUILDING & GROUNDS

BE IT RESOLVED: by the Acadia Parish Police Jury in regular session duly convened this 6th day of September, 2005, does hereby empower, authorize and direct the President to execute a Crop Land Lease with Mr. Matt Lambousy for the purpose of managing a 15.6 acre tract of farm land on Capitol Avenue in Acadia Parish.

Mr. Wayne Phillips, Ken Bordelon and Glen Edwards with SLEMCO Electric Company expressed an interest in providing electric service to the new Correctional Center Complex. Mr. Phillips and Mr. Bordelon described the impact that SLEMCO has in Acadia Parish as well as defining the SLEMCO rate structure.

Ms. Sabrina Saling and Ms. Lanie Borel representing Cleco Power, LLC., requested an opportunity to serve the new Parish Correctional Center Complex as well. Cleco representatives expanded on their reliability and economic development discount allowed for such agreements.

No action was taken relative to the discussion.


PUBLIC WORKS/ROAD & BRIDGE

WHEREAS, the Acadia Parish Police Jury advertised for bids in the Official Journal for one new Hydraulic Excavator.

WHEREAS, bids received were as follows:

BE IT FURTHER RESOLVED that the President of this Police Jury be and she is hereby empowered, authorized and directed to execute a contract with H & E Equipment, on behalf of, in the name and under the seal of the Acadia Parish Police Jury relative to the purchase of said equipment.

SOLID WASTE/ENVIRONMENTAL

A motion was offered by Mr. A. J. Credeur, seconded by Mr. Jimmie Pellerin, to authorize the Solid Waste/Environmental Committee to determine marketing strategies for the Parish recycling material. Motion carried.

Mr. Lee Hebert, Emergency Management Director, reported on recent damages caused by Hurricane Katrina and the impact it has had on Acadia Parish. He advised that many shelters were open in Acadia Parish for the purpose of housing evacuees from southeast Louisiana.

The Secretary also advised that requests were made to provide Parish resources to assist in the efforts.

A motion was offered by Mr. Alton Stevenson, seconded by Mr. Felton Moreau, to authorize temporary clerical assistance for the Office of Emergency Management. Motion carried.

                                     
RESOLUTION

         BY MESSRS: A J CREDEUR AND FELTON MOREAU

WHEREAS, the President of the Acadia Parish Police Jury signed a declaration of emergency relative to Hurricane Katrina, and

WHEREAS, Hurricane Katrina caused much devastation across the southeast portion of the State of Louisiana, and

WHEREAS, Parish resources have been called on to do with the effects of said hurricane.

THEREFORE, BE IT RESOLVED by the Acadia Parish Police Jury in regular session duly convened on this the 6th day of September, 2005, does hereby empower, authorize and direct the Office of Emergency Preparedness and the President of the Acadia Parish Police Jury to allocate Parish resources in ways that are necessary to address issues affected by Hurricane Katrina in the southeast as it affects Acadia Parish.

SECTION 1. BE IT ORDAINED by the Police Jury of Acadia Parish, Louisiana, that it shall be unlawful for any person to operate or drive a motor vehicle in excess of thirty miles per hour on the following described Parish Road:

SECTION 2. BE IT FURTHER ORDAINED that any person found guilty of operating or driving a motor vehicle in excess of thirty miles per hour on the Parish road described above, shall be guilty of a misdemeanor, and upon conviction therefore, shall be fined not more than Fifty Dollars ($50) or be imprisoned not more than ten (10) days or both.

SECTION 3. BE IT FURTHER ORDAINED that any laws or parts of laws in conflict are hereby repealed.

The Sales Tax Report was presented for the month of August, 2005. The report indicated a gross receipt of $534,098.32 an increase of $114,506.69 from August, 2004.
