Meeting Room, Courthouse Building, Crowley, Louisiana, in regular
session with the President, Cecelia B. Chambers, presiding. At the
request of the President, a moment of silence was offered and the
Pledge to the Flag was recited in unison. The roll was called and

A motion was offered by Mr. Cade Benoit, seconded by Mr. Alton

The following resolution was offered by Mr. A. J.
Credeur and seconded by Mr. Cade Benoit:
RESOLUTION
A resolution creating a fire protection district within the
Parish of Acadia, State
of Louisiana, and defining and
describing the boundaries
thereof.
WHEREAS, at a regular meeting of
the Police Jury of the Parish of Acadia, State of Louisiana (the
"Police Jury"), held on January 17, 2006, the Police Jury, acting
under the authority of Part I, Chapter 7, Title 40 of the La.
Revised Statutes of 1950, as amended (the "Act"), and other
constitutional and statutory authority, adopted a resolution giving
notice of intention to create a fire protection district within the
Parish of Acadia, State of Louisiana (the "Parish"), and described
the territory of said proposed fire protection district, the
boundaries thereof and all other matters required by law (which
proposed fire protection district shall include the Town of Church
Point, State of Louisiana), and provided that the Police Jury would
meet in open and public session on Tuesday, February 21, 2006, at
six-thirty (6:30) o'clock p.m., at its regular meeting place, the
Courthouse, Crowley, Louisiana, to hear any and all objections
thereon, and after hearing such objections proceed to create said
fire protection district; and
WHEREAS, as required by the Act,
the Mayor and Board of Aldermen of the Town of Church Point, State
of Louisiana (the "Town"), have by resolutions adopted on February
6, 2006 and April 3, 2006, respectively, consented to the inclusion
of the Town within the boundaries of the proposed fire protection
district and have concurred in the proposed boundaries of said fire
protection district; and
WHEREAS, following publication of
the Notice of Intention, as required by law, this Police Jury did on
February 21, 2006, hold a public hearing on the creation of the
proposed fire protection district, and no objections were made to
the creation thereof, the boundaries thereof or the property to be
included therein; and
WHEREAS, the Police Jury has
determined that the creation of said fire protection district would
benefit and is to the best interests of the Parish and the
inhabitants of the area affected;
NOW, THEREFORE, BE IT RESOLVED, by
the Police Jury of the Parish of Acadia, State of Louisiana (the
"Police Jury"), acting as the governing authority of the Parish of
Acadia, State of Louisiana (the "Parish"), that:
SECTION 1. By virtue of the authority conferred by Part I,
Chapter 7, Title 40 of the Louisiana Revised Statutes of 1950, as
amended (the "Act"), and other constitutional and statutory
authority, a fire protection district is hereby created within the
Parish, which fire protection district shall embrace all of that
territory within the following described boundaries, which includes
the Town of Church Point, State of Louisiana:

95 approximately 0.8 mile to the northernmost corner of

approximately 0.5 mile to the intersection of Parish Road
3-36 and Parish Road 3-38, thence southwesterly,

Section 77 Township 8S R2E, thence southeast along the
centerline of Parish Road 3-29 to its intersection with the
centerline of Bayou Wikoff in Section 47 Township 8S R3E
and/or the westward projection of the north line of Section
17 Township 8S R3E, thence along said westward project of
the north line of Section 17 to its intersection with the
common boundary between Acadia Parish and St. Landry Parish
in Township 8S R3E, thence generally northerly and westerly
along the common boundary between Acadia Parish and St.
Landry Parish to its point of origin.
SECTION 2.
The fire protection district hereby created shall be known and
designated as "Fire Protection District No. 10 of the Parish of
Acadia, State of Louisiana" (the "District"), and as thus
created shall constitute a public corporation and political
subdivision of the State of Louisiana, and shall have all rights,
powers and privileges granted by and conferred by the Constitution
and Statutes of the State of Louisiana to such corporations,
including the authority to incur debt, issue bonds and levy taxes
and parcel fees.
SECTION 3. In accordance with the provisions of the Act,
the Police Jury hereby appoints Todd Bourgeois and Rodney
Daugereaux, as resident property taxpayers of the District, to
serve as the Police Jury appointees to the Board of Commissioners
(the "Board"), which shall be the governing authority of the
District. The Town of Church Point, State of Louisiana (the "Town"),
shall appoint two (2) resident property taxpayers of the Town to
serve as the Town’s appointees to the Board. At the organizational
meeting of the Board, the members appointed to the Board by the
Police Jury and the Town shall designate the fifth member of the
Board who shall serve as the initial Chairman of the Board. Also, at
the organizational meeting, the members of the Board shall by lot
determine their terms of office as follows: Two (2) members of the
Board shall hold office until one (1) year from the January first
immediately succeeding their appointment, and three (3) members
shall hold office until two (2) years from the January 1st
immediately succeeding their appointment. All members subsequently
appointed to the Board shall serve for a period of two (2) years.
SECTION 4. The domicile of the District is hereby
designated as the Church Point Fire Station, 111 South Broadway,
Church Point, Louisiana, and such domicile is within the corporate
limits of the District, and the above named members of the Board
shall meet at said domicile on Thursday, April 20, 2006, at
five-thirty (5:30) o'clock p.m., and shall then and there
proceed to organize and elect their officers, all in the manner and
form provided by law.
SECTION 5. Due notice of the formation and creation of the
District hereby created, attached hereto as Exhibit "A", shall be
published in accordance with law and the President of this Police
Jury is hereby instructed and ordered to issue notice of the
formation and creation of the District and to cause publication
thereof to be made in compliance with the provisions of the Act.
SECTION 6. This resolution shall become effective
immediately.

PUBLIC WORKS/ROAD & BRIDGE
Engineer Fred Trahan, representing Southwest
Acadia Rural Water Corporation, presented details of the upcoming
Phase II expansion and requested the fees be waived for the
construction.
A motion was offered by Mr. John Humble, Sr., seconded by Mr.
Jimmie Pellerin, to waive permit fees for Southwest Water
Corporation Phase II expansion. Motion carried.
A motion was offered by Mr. John Humble, Sr., seconded by Mr.
Cade Benoit, to limit roadside drainage improvements to $50,000.
Motion carried.
RESOLUTION
BY MESSRS: ALTON STEVENSON AND A J CREDEUR
BE IT RESOLVED: by the Acadia Parish Police Jury in regular
session duly convened this 4th day of April, 2006, does hereby
authorize the purchase and installation of embankment improvements
by Mid-South Erosion Control, LLC, as part of Drainage Project

AN ORDINANCE MAKING IT UNLAWFUL FOR ANY PERSON TO OPERATE OR
DRIVE A MOTOR VEHICLE UPON EASTLAND LANE IN ACADIA PARISH,
LOUISIANA, AT A SPEED IN EXCESS OF TWENTY MILES PER HOUR,
AND, PROVIDING FOR THE PENALTIES FOR THE VIOLATION THEREOF.
SECTION 1. BE IT ORDAINED by the Police Jury of Acadia
Parish, Louisiana, that it shall be unlawful for any person to
operate or drive a motor vehicle in excess of twenty miles per
hour on the following described Parish Road
:

SECTION 2.
BE IT FURTHER ORDAINED that any person found guilty of
operating or driving a motor vehicle in excess of twenty miles
per hour on the Parish road described above, shall be guilty of
a misdemeanor, and upon conviction therefore, shall be fined not
more than Fifty Dollars ($50) or be imprisoned not more than ten
(10) days or both.
SECTION 3. BE IT FURTHER ORDAINED that any laws or parts of
laws in conflict are hereby repealed.

RESOLUTION
BY MESSRS: CADE BENOIT AND FELTON MOREAU
WHEREAS, the LA Department of Health and Hospitals (LA DHH)
is charged with regulating waste water treatment and effluent
discharges in Acadia Parish, and
WHEREAS, the LA DHH investigates complaints involving public
health matters in Acadia Parish as well as participates in the
permitting and inspection of treatment systems required to be
installed pursuant to the Acadia Parish Ordinance resulting from
either new construction or changes in ownership for residential and
commercial facilities, and
WHEREAS, the Acadia Parish Ordinance provides that properties
be grandfathered in unless one of the two aforementioned conditions
exist, and
WHEREAS, the LA DHH in Acadia Parish advises that the policy
of investigating community health complaints is not limited only to
the subject of the complaint but to any and all public health
regulations.
THEREFORE, BE IT RESOLVED by the Acadia Parish Police Jury in
regular session duly convened on this the 4th day of April, 2006,
does hereby strongly urge that LA DHH limit public health complaint
investigations in Acadia Parish to issues specifically defined in
each complaint such that enforcement of other public health
regulations related to sewer disposal systems follow the procedures
set forth in the Acadia Parish Ordinance where only new construction
or change of ownership occurs.
BE IT FURTHER RESOLVED that a copy of this resolution be sent
to LA Department of Health and Hospital Officials, the Louisiana
Legislative Delegation and the Police Jury Association for support.
