The Acadia Parish Police Jury met on the above date at 6:30 p.m., in the
Police Jury Meeting Room, Courthouse Building, Crowley, Louisiana, in regular session with the Vice- President, A. J. Broussard presiding. At the request
of the Vice-President, a moment of silence was offered and the Pledge to
the Flag was recited in unison. The Roll was called and final attendance
was recorded as follows:

A motion was offered by Mr. Jimmie Pellerin, seconded by Mr. John Humble,
Sr., to approve the Minutes of the October 17, 2006, Regular Police Jury
Meeting as revised and to approve the Minutes of the October 24, 2006
and the minutes of the November 8, 2006 Police Jury Meetings. Motion
Carried.

A motion was offered by Mr. John Humble, Sr. and duly seconded by Mr.
Jimmie Pellerin to revise the agenda of November 21, 2006 to include 1.
Drainage improvements on Benton and Standard Mill Road 2. Cinema
Property. 3. Speed limit on Old Spanish Trail from Highway 91 to Chester
Lee and speed limit on Gator Road from Highway 97 to Mamou Road.
Motion Carried.

                              RESOLUTION 11-06-07

BE IT RESOLVED:
by the Acadia Parish Police Jury in regular session duly
convened this 21st day of November, 2006, does hereby reappoint Judia
Lacombe and Cynthia Dominick and to the Acadia Parish Library Control
Board for a five year term effective November 2006 and appoints Conrad
Mouton to the Acadia Parish Library Control Board to fill the unexpired
term of Barbara Mayeaux with said term to expire July 2007.

FEDERAL/STATE FINANCIAL ASSISTANCE

The final Long Term Recovery Report was presented by Mr. Stan McGee,
director of AARD. Members of the Police Jury expressed a desire to have
the plan place more emphasis on drainage.

by the Acadia Parish Police Jury in regular session duly

calling of a public hearing for December 5, 2006, at 6:00 P.M., Police
Jury Meeting Room, to receive comments on the proposed 2007 Budget.

A motion was offered by Mr. Jimmie Pellerin and, duly seconded by Mr.
John Humble, Sr. to approve Financial Statements and payment of bills
for the month of October. Motion carried.

Juror A. J. Credeur objected to the payment of the rate increase
granted to Allied Waste for the month of October.

 
                            RESOLUTION 11-06-09

           BY MESSERS:  JOHN HUMBLE, SR. AND JIMMIE PELLERIN


WHEREAS, there is on-going litigation over the assessment and ad
valore taxation of certain pipeline property located in Acadia Parish;
and

WHEREAS, the Assessor of Acadia Parish is in the process of reassessing
the properties for the referenced taxpayers pursuant to Judgment issued
by the 19th Judicial District Court;
and

WHEREAS, the referenced have lodged the following appeals with the
Louisiana Tax Commission challenging the Assessor’s reassessed valuation
for the referenced years:

WHEREAS, as this litigation proceeds it has become necessary for the
Assessor to defend the assessment in legal proceedings;
and

WHEREAS, such defense will necessitate the Assessor contracting
with legal counsel;
and

WHEREAS, in an effort to limit the cost of such legal counsel, which
cost is ordinarily borne proportionately by the ad valorem taxing bodies
in this Parish, the Assessor intends on engaging legal counsel on a
contingency fee basis,with any fees coming only from any additional
taxes collected as a result of the new Assessment of the above
referenced tax payers;
and

WHEREAS, the ACADIA PARISH POLICE JURY will benefit from the
collection of any additional ad valorem taxes collected with the
assistance of legal counsel contracted by the Assessor.

NOW, THEREFORE BE IT RESOLVED by the Acadia Parish Police Jury
in a duly called upon open meeting does hereby authorize the Assessor
to engage legal counsel for its benefit on a contingency fee basis, not to
exceed ten percent of the additional taxes, interest and penalties
collected for its benefit pursuant to the decision of the Louisiana Tax
Commission in the above referenced proceedings or by judgment of a
reviewing Court and does hereby obligate and encumber an
amount not to exceed ten percent of the additional taxes, interest and
penalties collected for its benefit for the payment of said legal fees.

BE IT FURTHER RESOLVED by the ACADIA PARISH POLICE JURY that the
Assessor and/or the Ad Valorem Tax Collector of Acadia Parish be and
are hereby authorized to pay said legal fees to the legal counsel
contracted by the Assessor to provide legal services in the above
referenced matters prior to or contemporaneously with the disbursal of
ant additional taxes, interest and penalties to it.

LEGISLATION


                                      RESOLUTION 11-06-10

A Resolution terminating an Intergovernmental and Joint Cooperative
EndeavorAgreement between the Acadia Parish Police Jury, the
Vermilion Parish Police Jury and the Lafayette City-Parish Consolidated
Government relative to the Fifteenth Judicial District Children and
Youth Planning Board

Whereas, a Resolution duly adopted on January 17, 2006 authorized the
Parish President to enter into an Intergovernmental and Joint Cooperative
Endeavor Agreement between the Acadia Parish Police Jury, the Vermilion
Parish Police Jury and the Lafayette City-Parish Consolidated Government
relative to the creation of the Fifteenth Judicial District Children and
Youth Planning Board in accordance with La. R.S. 46:1941.1, et seq., as
amended by Act No. 555 of 2004, establishing the composition of the
Board, providing for its functions and duties, and providing for related
matters;
and

WHEREAS, it has been expressed by those individuals who were appointed
to the Fifteenth Judicial District Children and Youth Planning Board that it
has been difficult for those residing in Vermilion Parish and Acadia Parish
to coordinate and attend the monthly meetings that take place in Lafayette, Louisiana;
and

WHEREAS, the members of the Fifteenth Judicial District Children and Youth
Planning Board desire to terminate the Intergovernmental and Joint
Cooperative Endeavor Agreement entered into between the Acadia Parish
Police Jury, the Vermilion Parish Police Jury, and the Lafayette City-Parish Consolidated Government relative to the creation of the Fifteenth Judicial
District Children and Youth Planning Board s that each judicial district
can create its own Children and Youth Planning Board.

NOW THEREFORE, in consideration of the covenants set forth herein the
Acadia Parish Police Jury, the Vermilion Parish Police Jury, and the
Lafayette City-Parish Consolidated Government agree and contract
as follows:

      1.  TERMINATION OF AGREEMENT. The Intergovernmental between the
           Acadia Parish Police Jury, the Vermilion Parish Police Jury and the
           Lafayette City-Parish Consolidated Government relative to the creation
           of the Fifteenth Judicial District Children and Youth Planning Board
           is herby terminated in its entirety.

       2.  EFFECTIVE DATE OF TERMINATION. This termination shall become
           effective when the last governing body of the parishes made a party
           to the Intergovernmental executes this Agreement and authorized the
           termination of such Intergovernmental Agreement.

       3.  ENTIRE AGREEMENT. This Agreement shall constitute the entire
           agreement of the parishes. All prior agreement between the parties,
           whether written or oral, shall have no force and effect.

President to execute an amended contract for Nutritionist Services at the
Rayne and Church Point Community Clinics with Tammy Lamartiniere, LDN,
RD providing for charges in the amount of $50.00 per hour.

PUBLIC WORKS ROADS AND BRIDGES

BE IT RESOLVED:
by the Acadia Parish Police Jury in regular session duly
convened this 21st day of November, 2006, does hereby authorize the
calling of a public hearing for January 16, 2007, at 6:00 P.M., Police
Jury Meeting Room, to consider the abandonment of Carolina Road.

A motion was offered by Mr. A.J. Credeur and, duly seconded by
Mr. Cade Benoit to approve the Emergency Work Schedule for the
month of October in the amount of sixty seven dollars and ninety-five
cents ($67.95).  Motion carried.

A motion was offered by Mr. A.J. Credeur and duly seconded by Mr.
Felton Moreau to authorize the granting of a permit to Ray Milner to open-
cut a section of Ray Milner Road for the purpose of installing an
irrigation line.  Motion carried.

A motion was offered by Mr. A.J. Credeur and duly seconded by Mr.
Felton Moreau to authorize the Secretary-Treasurer, Parish Attorney
and Road Manager to further explore the idea of an auto repair
agreement with the Sheriff’s Department. Motion carried.


REVISIONS TO AGENDA

A motion was offered by Mr. A.J. Credeur and duly seconded by Mr.
Felton Moreau to defer until after the 1st day of January 2007, the
request for drainage improvements on Standard Mill Road as outlined in
the bid submitted by Mid-South Erosion Control, LLC. Motion Carried.

A motion was offered by Mr. John Humble, Sr. and, seconded by Mr.
Cade Benoit to approve Drainage Projects 2006-16 Benton Road at
a cost of two thousand six hundred seventy-seven dollars and fifty
cents ($2677.50).  Motion carried.

A motion was offered by Mr. A.J. Credeur and duly seconded by Mr.
Jimmie Pellerin to authorize an architect’s evaluation of the Crowley
Cinema. Motion carried.

               
                                      ORDINANCE No. 921
 

AN ORDINANCE MAKING IT UNLAWFUL FOR ANY PERSON TO OPERATE
OR DRIVE A MOTOR VEHICLE UPON OLD SPANISH DRIVE ACADIA
PARISH, LOUISIANA, AT A SPEED IN EXCESS OF TWENTY-FIVE MILES
PER HOUR
, AND, PROVIDING FOR THE PENALTIES FOR THE VIOLATION
THEREOF.

SECTION 1.  BE IT ORDAINED by the Police Jury of Acadia Parish,
Louisiana, that it shall be unlawful for any person to operate or drive
a motor vehicle in excess of twenty-five miles per hour on the
following described Parish Road:

            OLD SPANISH DRIVE FROM Highway 91 to Chester Lee Drive

SECTION 2.  BE IT FURTHER ORDAINED that any person found guilty
of operating or driving a motor vehicle in excess of twenty-five miles
per hour
on the Parish road described above, shall be guilty of a
misdemeanor, and upon conviction therefore, shall be fined not more
than Fifty Dollars ($50) or be imprisoned not more than ten (10)
days or both.

SECTION 3.  BE IT FURTHER ORDAINED that any laws or parts of
laws in conflict are hereby repealed.

The Ordinance was offered by Mr. John Humble , Sr. and seconded by
Mr. Cade Benoit and after being read and considered section by section,
was adopted as a whole by the following vote:
