CROWLEY, LOUISIANA

The Acadia Parish Police Jury met on the above date at 6:30 p.m., in the Police Jury Meeting Room, Courthouse Building, Crowley, Louisiana, in regular session with the Vice-President, Cade Benoit, presiding. At the request of the Vice-President, a moment of silence was offered and the Pledge to the Flag was recited in unison. The Roll was called and final attendance was recorded as follows:

A motion was offered by Mr. A.J. Credeur and seconded by Mr. Felton Moreau to revise the agenda to include the following:

1. Request for resolution supporting a Bike Route on Highway 35
2. Resolution in support of Senate Bill # 63
3. Resolution seeking $2,000,000.00 for unfunded state mandates.
Motion carried.

 

A motion was offered by Mr. Jimmy Pellerin and seconded by Madam Cecelia Chambers to approve the minutes of the April 3, 2007 Regular Meeting and the minutes of the April 11, 2007 Special Meeting. Motion carried.

RESOLUTION 04-07-19

BE IT RESOLVED: by the Acadia Parish Police Jury in regular session duly convened this 17th day of April, 2007, does hereby rescind Resolution 04-07-03 adopted on April 3, 2007, granting a $1000.00 donation to the Kiwanis Club.

A motion was offered by Mr. A. J. Credeur and seconded by Mrs. Cecelia Chambers to enter into a Cooperative Agreement with the City of Crowley to promote a citywide boxing club and to grant $1000.00 to the city for the advancement of the program. Motion carried.
 

RESOLUTION 04-07-20

BE IT RESOLVED: by the Acadia Parish Police Jury in regular session duly convened this 17th day of April, 2007, does hereby authorize the Treasurer to transfer invested funds in the Industrial Inducement Fund 111 to the Correctional Facility Construction Fund Account 301.

RESOLUTION 04-07-21

BY MESSR A.J. CREDEUR AND MADAM CECELIA CHAMBERS
 

WHEREAS, pursuant to Section II, General Conditions, Article (B) of the Contract for Collection and Disposal of Solid Waste between Allied Waste Services and Acadia Parish Police Jury a comparative statement reflecting an adjustment in Base Residential Rate effective March 1, 2007 (Rate Modification Date) was presented, and

WHEREAS, approval of Base Residential Rate is contingent upon calculations being inspected and approved by Parish auditing firm, Broussard, Poché, Lewis & Breaux, as outlined in Article 8 (B) Consumer Price Index for Urban Wage Earners and Clerical Workers for “all items” and “gasoline”, and

WHEREAS, the auditing firm of Broussard, Poché, Lewis and Breaux has determined the Base Residential Rate is to be $6.44 per service unit per month as opposed to the original amount outlined in Resolution 04-07-16 and adopted on April 3, 2007.

THEREFORE, BE IT RESOLVED  the Acadia Parish Police Jury in regular session duly convened on this the 17th day of April, 2007, does hereby approve the amended Base Residential Rate of $6.44 per service unit per month as provided, effective March 1, 2007.

A motion was offered by Mrs. Cecelia Chambers and seconded by Mr. John Humble, Sr. to authorize the Secretary to write a letter of support for the Wright Group’s application for access to the Port of Lake Charles Foreign Trade Zone. Motion carried. 

A motion was offered by Mr. Jimmie Pellerin and seconded by Madam Cecelia Chambers to approve payment of bills for the month of March 2007. Motion carried. 

A motion was offered by Mr. Jimmie Pellerin and seconded by Mr. A.J. Credeur to accept the financial report for March 2007. Motion carried. 

A motion was offered by Mr. A. J. Credeur and seconded by Mr. Felton Moreau to authorize the secretary to advertise for bids for the Official Journal. A roll call vote was recorded with the following results:

LEGISLATIVE

RESOLUTION 04-07-22

BE IT RESOLVED: by the Acadia Parish Police Jury in regular session duly convened this 17th day of April, 2007, does hereby authorize, direct and empower the President to enter into an  Interagency Agreement with the Council on Aging in order to deliver services for the elderly in the Acadiana Area.

RESOLUTION 04-07-23

BY MESSRS FELTON MOREAU AND ALTON STEVENSON
 

WHEREAS, the Acadia Parish Convention and Visitor’s Commission, at its regular meeting on April 12, 2007 revised and approved revisions to its By-Laws and Procedures; and

WHEREAS, the Commission has presented said revisions to the Acadia Parish Police Jury for ratification.

THEREFORE BE IT RESOLVED: the Acadia Parish Police Jury in regular session duly convened this 17th day of April, 2007, does hereby ratify and approve the revisions to the Acadia Parish Convention and Visitor’s Commission By-Laws Policies and Procedures

PUBLIC FACILITIES, BUILDING AND GROUNDS


A motion was offered by Mr. Alton Stevenson and seconded by Mr. Felton Moreau to transfer fifty (50) sheets of metal roofing removed from the Rice Arena to the Correctional Facility, to declare the remaining sheets of metal roofing as surplus and to authorize the Secretary to advertise for bids. Motion carried. 

A motion was offered by Mr. Alton Stevenson and seconded by Mr. John Humble, Sr. to authorize the Rice Arena manager to apply for a state sanitary permit to operate the concession stand. Motion carried.

 
PUBLIC WORKS ROADS AND BRIDGES


A motion was offered by Mr. A.J. Credeur and seconded by Mrs. Cecelia Chambers to request that the Sixth Ward and City of Crowley Drainage District and Parish Engineer review the plat of Richard Subdivision and construct the drainage ditch as outlined in the plat. Motion carried. 

A motion was offered by Mrs. Cecelia Chambers and seconded by Mr. A. J. Credeur to authorize the Secretary to prepare Public Notice for a Public Hearing for an ordinance for the self assessment on Suzie Drive and Mardi gras Drive. Motion carried.

 

RESOLUTION 04-07-24

BE IT RESOLVED: by the Acadia Parish Police Jury in regular session duly convened this 17th day of April, 2007, does hereby authorize, direct and empower the President to enter into a Cooperative Agreement with the LA DOTD for 50 cubic yards of Reclaimed Asphalt Pavement.

A motion was offered by Mrs. Cecelia Chambers and seconded by Mr. Felton Moreau to approve a waiver of fees for SLEMCO for Project Permit to construct and install underground electrical service for Wayne Garber. Motion carried.

 

RESOLUTION 04-07-25 

BY MADAM CECELIA CHAMBERS AND MESSR JOHN HUMBLE, SR.
 

WHEREAS, public notice had been given that a public hearing was scheduled to receive comments relative to the abandonment of Carolina Road; and

WHEREAS, the Acadia Parish Police Jury  conducted a public hearing on Wednesday, January 10, 2007, in the Police Jury Meeting Room, Courthouse Building, Crowley, LA at which none were registered, and

THEREFORE BE IT RESOLVED:  the Acadia Parish Police Jury in regular session duly convened this 17th day of April, 2007, does hereby authorize the abandonment of Carolina Road upon completion of subdivision development, approval and acceptance.

BE IT FURTHER RESOLVED that said abandonment be recorded with the Acadia Parish Clerk of Court.

A motion was offered by Mr. A.J. Credeur and seconded by Mr. Felton Moreau to appoint Mr. Robert Bergeaux as supervisor of the Inmate Program for the Acadia Parish Police Jury. Motion carried with the following roll call vote being recorded:

A motion was offered by Mr. Alton Stevenson and seconded by Mr. A.J. Credeur to authorize and direct the Treasurer to transfer $50,000.00 from Sales Tax Fund 102 to Parish Road Fund 304-420211672. Motion carried.

 

SOLID WASTE/ENVIRONMENTAL CONTROL 

A motion was offered by Mr. Alton Stevenson and seconded by Mr. Jimmie Pellerin to authorize the Parish Solid Waste Engineer to prepare plans and specifications for the proposed solid waste recycling center and to prepare a master plan for land use on Parish property on Capital Avenue. Motion carried.

 

RESOLUTION 04-07-26

BE IT RESOLVED: the Acadia Parish Police Jury in regular session duly convened this 17th day of April, 2007, does hereby support the formation of a Bike Route on Louisiana Highway 35, between the Town of Church Point, LA and the City of Rayne, LA.

RESOLUTION 04-07-27

BY MADAM CECELIA CHAMBERS AND MESSR JOHN HUMBLE, SR.
 

BE IT RESOLVED: the Acadia Parish Police Jury in regular session duly convened this 17th day of April, 2007, does hereby support the enactment of Senate Bill No. 63, which would provide state funds for a full-time director of parish homeland security and emergency preparedness agencies, would set criteria of eligibility for such a director, would provide for an effective date, and provide for all matters related thereto.

RESOLUTION 04-07-28
 

Whereas, fiscal constraints and lack of funding for essential programs is hindering local governments throughout the state of Louisiana; and

WHEREAS, parish governments throughout the state has felt the tremendous effects of mandated programs without the benefit of increased revenues; and

WHEREAS, the Louisiana Legislature have enacted various legislation and regulations on local governing authorities without providing necessary funding for the implementation and enforcement of these mandates; and

WHEREAS, the state of Louisiana has over $827 million in surplus funds; and

WHEREAS, the Acadia Parish Police Jury does respectfully request that the state of Louisiana allocate two million ($2, 000, 000, 00) of said funds to each parish to compensate for unfunded legislative mandates.

NOW, THEREFORE BE IT RESOLVED by the Acadia Parish Police Jury in regular session duly convened this 17th day of April, 2007, does hereby appeal to the Honorable Governor Kathleen Babineaux-Blanco and the Louisiana Legislature to allocate two million dollars of surplus funds to each Parish to assist in maintaining and providing unfunded state mandates. 

BE IT FURTHER RESOLVED, copies of Resolution 04-07-28 are forwarded to the Honorable Gil Pinac, the Honorable Gerald Theunissen, the Honorable Mickey Guillory, the Honorable Nick Gautreaux.

The Parish Attorney advised the Jury that after review, he was withdrawing his request to hire an expert witness for pending litigation.
