The Acadia Parish Police Jury met on the above date at 6:30 p.m., in the Police Jury Meeting Room, Courthouse Building, Crowley, Louisiana, in regular session with the President, A. J. Broussard, presiding. At the request of the President, a moment of silence was offered and the Pledge to the Flag was recited in unison. RESOLUTION 04-07-01

WHEREAS, for the past forty years, Louisiana State University at Eunice (LSUE) has maintained a tradition of excellence in offering educational programs and services to the people of Acadia Parish; and

WHEREAS, LSUE has consistently offered additional opportunities for lifelong learning to residents in the Acadiana area; and

WHEREAS, LSUE graduates often return to their home communities as vital members of local medical teams, entrepreneurial business leaders, productive employees and active residents in church, civic and educational activities; and

WHEREAS, LSUE has remained committed to accessibility and affordability for all of its students, as well as to continually maintain a low student-teacher ratio that fosters more effective learning; and

WHEREAS, LSUE has remained committed to its local business community through its flexibility in meeting the challenges of local workforce needs through customized training on campus, distance learning and online opportunities; and

WHEREAS, LSUE has positioned itself as a focal point in the community for the awareness and support of our cultural treasures through collaboration and the offering of public programs; and

WHEREAS, LSUE has continued to work in partnership with area high schools to address the changing needs of graduating secondary students;

BE IT RESOLVED, the Acadia Parish Police Jury in regular session on this the 3rd day of April 2007 recognizes the programs, services and other activities provided by LSUE and its vital contributions to the continued progress of Acadia Parish, Acadiana and the State of Louisiana.

BE IT FURTHER RESOLVED We celebrate with LSUE during its 40th anniversary in the fall of 2007 year and offer our continued support for its future years of service to the area.

RESOLUTION 04-07-04

BY MESSR CADE BENOIT AND MADAM CECELIA CHAMBERS
 

A resolution approving the issuance, sale and delivery of Three Hundred Thousand Dollars ($300,000) of Certificates of Indebtedness, Series 2007, of Fire Protection District No. 10 of the Parish of Acadia, State of Louisiana, and other matters relating thereto.

WHEREAS, the Board of Commissioners of Fire Protection District No. 10 of the Parish of Acadia, State of Louisiana, by resolution adopted on March 19, 2007, has authorized the issuance of Three Hundred Thousand Dollars ($300,000) of Certificates of Indebtedness, Series 2007 (the "Certificates"), for the purpose of acquiring and equipping fire trucks, acquiring other fire protection equipment for the Issuer, and paying the costs of issuance of the Certificates, under the authority conferred by Sections 2921 to 2925, inclusive, of Title 33 of the Louisiana Revised Statutes of 1950, as amended (R.S. 33:2921-2925), and other constitutional and statutory authority.

WHEREAS, it is now the desire of the Police Jury of the Parish of Acadia, State of Louisiana, to approve the issuance of the Certificates;

NOW, THEREFORE, BE IT RESOLVED by the Police Jury of the Parish of Acadia, State of Louisiana (the "Police Jury"), acting as the governing authority of the Parish of Acadia, State of Louisiana, that:

SECTION 1. In compliance with the provisions of Article VI, Section 15 of the Constitution of the State of Louisiana of 1974, and in accordance with the request of the Board of Commissioners of Fire Protection District No. 10 of the Parish of Acadia, State of Louisiana, this Police Jury hereby approves the issuance of Three Hundred Thousand Dollars ($300,000) of Certificates of Indebtedness, Series 2007, of Fire Protection District No. 10 of the Parish of Acadia, State of Louisiana, said Certificates to be issued under the authority and for the purposes stated in the preamble hereto.

SECTION 2. Neither the Parish nor this Police Jury shall be liable in any manner for the payment of said Certificates.

RESOLUTION 04-07-05

A resolution accepting and approving the certified statement or report prepared by Aucoin & Associates, Inc., of Eunice, Louisiana, consulting engineer to the Parish of Acadia, State of Louisiana (the "Parish"), showing in detail the total cost of constructing street paving improvements along certain streets or such parts thereof as may be determined upon, within the corporate limits of the Parish of Acadia, State of Louisiana, and outside of municipal corporations, including street intersections, engineers' and attorneys' fees and all other costs incidental to said work; and the total cost of said project, together with the amounts thereof to be assessed against each lot or parcel of real estate abutting the improvements; finding and determining that each lot or parcel of real estate to be assessed will be benefited to an amount not less than the proposed local or special assessment; and authorizing the giving of notice to each property owner to be assessed of the proposed assessment and the manner and time for payment thereof, all in accordance with the provisions of Sections 3689.1 to 3689.17, inclusive, of Title 33 of the Louisiana Revised Statutes of 1950 (R.S. 33:3689.1 - 33:3689.17), and other constitutional and statutory authority.

BE IT RESOLVED by the Police Jury of the Parish of Acadia, State of Louisiana (the "Police Jury"), acting as the governing authority of the Parish of Acadia, State of Louisiana, that:

SECTION 1.  Having received and examined the certified statement or report of Aucoin & Associates, Inc., of Eunice, Louisiana, consulting engineer (the "Consulting Engineer") to the Parish of Acadia, State of Louisiana (the "Parish"), attached hereto as Exhibit "A", which report is hereby accepted and approved, showing in detail the total cost of constructing street paving improvements along certain streets or such part thereof as may be determined upon, within the corporate limits of the Parish, and outside of municipal corporations, including street intersections, engineers' and attorneys' fees, and all other costs incidental thereto, together with the amounts thereof chargeable to each lot or parcel of real estate abutting the proposed improvements, the Police Jury does hereby find and determine that each lot or parcel of real estate to be assessed in connection with said proposed street paving improvement program, will be benefited to an amount not less than the proposed local or special assessment.

SECTION 1.  There shall be mailed to each property owner to be assessed a notice advising each property owner of the proposed assessment and the manner and time for payment thereof, which notice shall set forth a general description of the proposed improvements, a description of the property to be assessed and the location thereof, and shall request the property owner to advise the Secretary of the Police Jury in writing within fifteen (15) days from the date of said notice, if any inaccuracies exist in the proposed assessments. Notice shall be given by depositing said written notice in the United States mail, postage paid, and addressed to the property owner at his/her address as it appeared on the last assessment roll on which the property was assessed for parochial taxes. Said notice shall be in substantially the following form, to-wit:

NOTICE TO PROPERTY OWNERS

NOTICE IS HEREBY GIVEN that, acting under the authority of Sections 3689.1 to 3689.17, inclusive, of Title 33 of the Louisiana Revised Statutes of 1950 (R.S. 33:3689.1 - 33:3689.17), and other constitutional and statutory authority, the Police Jury of the Parish of Acadia, State of Louisiana (the "Police Jury"), acting as the governing authority of the Parish of Acadia, State of Louisiana (the "Parish"), has received, examined, accepted and approved the certified statement or report of Aucoin & Associates, Inc., of Eunice, Louisiana, showing in detail the cost of the construction of street paving improvements on Suzie Drive and Mardi Gras Drive, and all other costs incidental thereto, and has found and determined that each lot or parcel of real estate to be assessed in connection with said proposed street paving program will be benefited to an amount not less than the proposed local or special assessments.

NOTICE IS HEREBY FURTHER GIVEN in compliance with Sections 3689.1 to 3689.17, inclusive, of Title 33 of the Louisiana Revised Statutes of 1950 (R.S. 33:3689.1 - 33:3689.17), and other constitutional and statutory authority, that after thirty (30) days have elapsed from the date of this notice, the Police Jury will proceed to adopt an ordinance assessing your property for said street paving improvements. Following the adoption of said ordinance, each property owner will be given at least thirty (30) days from the date of adoption thereof to pay the assessment against his/her property in full without interest, and if not paid within said thirty (30) day period, it will be conclusively presumed that any property owner whose property is affected thereby will exercise the right and option granted by said ordinance to pay the respective amounts due and assessed in ten (10) equal annual installments maturing on the anniversary date of the assessment ordinance in the years 2008 to 2017, inclusive, and bearing interest at a rate not exceeding six (6%) per centum per annum from date of said ordinance until paid.

NOTICE IS HEREBY FURTHER GIVEN to all property owners proposed to be assessed under this program that in the event inaccuracies exist in the proposed assessment as shown hereafter, please notify the Secretary of the Police Jury in writing within fifteen (15) days of the date of this notice. In the event you have sold this property, please return this notice giving the name and address of the new owner on the reverse thereof. Any inaccuracies which may exist in the proposed assessment will be corrected prior to the formal adoption of the ordinance levying the proposed assessments.

HARDSURFACING OF SUZIE DRIVE AND MARDI GRAS DRIVE
GENERAL DESCRIPTION OF IMPROVEMENTS:

The improvements to the designated streets are to consist of 3 course asphalt surface treatment riding surface 18 feet wide on 8 inch depth soil cement base 19 feet wide, including open ditch drainage improvements.

Mardi Gras Drive, from Suzie Drive proceeding southwest approximately 1350' to the cul-de-sac.

Suzie Drive, from Toby Loop proceeding east approximately 850' to its end at Toby Loop.

SECTION 3.  Notice is hereby further given that after thirty (30) days have elapsed from the mailing of said notice of the proposed assessments, the Police Jury shall adopt an ordinance levying a local or special assessment on each lot or parcel of real estate abutting the street or streets to be improved in the project in proportion that its front footage bears to the total front footage or property to be improved or benefited, in accordance with the aforesaid engineering report which is hereby accepted and approved, all in accordance with the provisions of Sections 3689.1 to 3689.17, inclusive, of Title 33 of the Louisiana Revised Statutes of 1950 (R.S. 33:3689.1 - 33:3689.17), and other constitutional and statutory authority.

SECTION 4.  Foley & Judell, L.L.P., Bond Counsel, of New Orleans, Louisiana, are hereby employed as special bond counsel to the Police Jury, as the governing authority of the Parish, to do and perform comprehensive legal and coordinate professional work with respect to the program of finance described in the preamble hereto. Said Bond Counsel shall prepare and submit to the Police Jury for adoption all of the proceedings incidental to the referenced program of finance, including, but not limited to the authorization, issuance, sale and delivery of the proposed paving certificates (the "Certificates"), shall counsel and advise the Police Jury as to the issuance and sale of the Certificates, and shall furnish its opinion covering the legality of the issuance thereof. The fee of Bond Counsel in connection with the aforesaid program of finance shall be fixed at a sum equal to two and one-half per cent (2-1/2%) of the total project cost as certified by the engineer's report to be prepared for this project on the basis of which the assessments are levied, plus out-of-pocket expenses. The fee is to be payable solely out of the funds derived from the local or special assessments or the proceeds of the Certificates to be issued to represent deferred payments of such assessments. A certified copy of this resolution shall be submitted to the Attorney General of the State of Louisiana for his written approval of said employment and of the fees herein designated, and the Governing Authority is hereby empowered and directed to issue vouchers to said Bond Counsel in payment for the work herein provided for upon completion of the work herein specified and under the conditions herein enumerated.

SECTION 5.   Prior to the delivery of the Certificates, the Parish, through the Police Jury, anticipates that it may pay a portion of the costs of the project described in Exhibit "A" hereto, from other available funds. Said project includes specifically the construction of street paving improvements along certain streets, or such parts thereof as may be determined upon, within the corporate limits of the Parish. Upon the issuance of the Certificates, the Parish reasonably expects to reimburse any such expenditure of other available funds from a portion of the proceeds of the Certificates. Any such allocation of proceeds of the Certificates for reimbursement will be with respect to capital expenditures (as defined in Reg. 1.150-1(b)) and will be made upon the delivery of the Certificates and not later than one year after the later of (i) the date such expenditure was paid or (ii) the date on which the project was placed in service. This Section is intended to be a declaration of official intent within the meaning of Reg. 1.150-2.

RESOLUTION 04-07-08

BY MESSR FELTON MOREAU AND MADAM CECELIA B. CHAMBERS
 

WHEREAS, the Acadia Parish Police Jury seeks an Attorney General’s Opinion regarding whether the Acadia Parish Police Jury can utilize public funds, derived from tax revenue for the purpose of road improvements, for the hard surfacing of Parish Road 3-97, also known as Joshua Road; and

WHEREAS, Parish Road 3-97, a gravel/aggregate road, approximately one mile in length may set the boundary between Acadia Parish and St. Landry Parish at the center of said road; and

WHEREAS, the Acadia Parish Police Jury adopted Parish Road 3-97 (Joshua Road) into its Parish Road System in March 1983, under the Transportation Act and has consistently maintained said road for twenty-four years; and

WHEREAS, members of the Acadia Parish Police Jury have agreed that disposition of hard-surfacing of said road is contingent on the Attorney General’s Opinion; and

BE IT RESOLVED that the Acadia Parish Police Jury in regular session on this the 3rd day of April 2007, does hereby direct Legal Counsel to seek an Attorney General’s Opinion as to whether the Acadia Parish Police Jury, by virtue of continuous maintenance for twenty-four years (24), can utilize public funds, derived from tax revenue for the purpose of road improvements on Parish Road 3-97, also known as Joshua Road.

BE IT FURTHER RESOLVED, an Attorney General’s opinion reflecting that Parish Road 3-97 (Joshua Road) has become an Acadia Parish Road by virtue of the maintenance performed by the Acadia Parish Police Jury or under LA RS 33: 3361 (B) and that Acadia Parish may legally expend funds, derived from tax revenue dedicated for road improvements to construct improvement to Joshua Road will by virtue of this resolution direct, authorize and empower the President of the Acadia Parish Police Jury to sign a Change Order authorizing the hard-surfacing of Parish Road 3-97 (Joshua Road).

McDonald & Sons, Inc. contractor, at a cost of five hundred thirty-two thousand nine hundred sixteen dollars and zero cents ($532,916.00) for an adjusted contract price of four million eight hundred one thousand three hundred forty-six dollars and sixty seven cents ($4,801,346.67) and thirty calendar days increase in contract time.

WHEREAS, the Acadia Parish Police Jury, the City of Crowley and the Sixth Ward & Crowley Drainage district have agreed to construct improvements for erosion control to the Center Ditch on Western Avenue and the North Ditch at Avenue D; and

WHEREAS, the Acadia Parish Police Jury and the City of Crowley have agreed to pay engineering and construction cost not to exceed $15,000.00 each for a total of $30,000.00.

NOW THEREFORE BE IT RESOLVED the Acadia Parish Police Jury in regular session duly convened this 3rd day of April, 2007, does hereby authorize, direct and empower the President to execute an Intergovernmental Agreement with the City of Crowley and the Sixth Ward Crowley Drainage District for construction improvements for erosion control at the Center Ditch on Western Avenue and the North Ditch at Avenue D.

An Ordinance Amending
Ordinance 928

AN ORDINANCE MAKING IT UNLAWFUL FOR ANY PERSON TO OPERATE OR DRIVE A MOTOR VEHICLE UPON LOIS ROAD, ACADIA PARISH, LOUISIANA, AT A SPEED IN EXCESS OF FIFTEEN MILES PER HOUR, AND, PROVIDING FOR THE PENALTIES FOR THE VIOLATION THEREOF.

SECTION 1. BE IT ORDAINED by the Police Jury of Acadia Parish, Louisiana, that it shall be unlawful for any person to operate or drive a motor vehicle in excess of fifteen miles per hour on the following described Parish Road:

Lois Road

SECTION 2. BE IT FURTHER ORDAINED that any person found guilty of operating or driving a motor vehicle in excess of fifteen miles per hour on the Parish road described above, shall be guilty of a misdemeanor, and upon conviction therefore, shall be fined not more than Fifty Dollars ($50) or be imprisoned not more than ten (10) days or both.

SECTION 3. BE IT FURTHER ORDAINED that any laws or parts of laws in conflict are hereby repealed.

The Ordinance was offered by Mr. A.J. Credeur and seconded by Mrs. Cecelia Chambers and after being read and considered section by section, was adopted as a whole by the following vote:

THEREFORE, BE IT RESOLVED by the Acadia Parish Police Jury in regular session duly convened on this the 3rd day of April, 2007, does hereby approve the new Residential Rate effective March 1, 2007, to be decreased to $6.46 per service unit per month as provided contingent upon calculations inspected and approved by Parish auditing firm, Broussard, Poché, Lewis & Breaux, as outlined in Article 8 (B) Consumer Price Index for Urban Wage Earners and Clerical Workers for "all items" and "gasoline".

The Secretary was directed to discuss the issues concerning the Inmate Program with the Sheriff. It was the consensus of the jury that the Inmate Program was primarily for the purpose of cutting and weed eating on parish right of ways.

Legal Counsel and the Emergency Preparedness officer were asked to review Parish ordinances dealing with condemnation of property, tall grass and obnoxious weeds, and regulations for non recognized trailer parks and subdivisions and report findings to the Public Buildings, Facilities, and Grounds. Legal Counsel advised the jury that he would not be able to make the report to the Committee at the April 11, 2007 committee meetings.
 

PUBLIC COMMENTS:

Mr. Martin Guillory requested that the Jury consider either increasing or decreasing the number of members on the Police Jury.

Mrs. Jo Cart asked that the Jury consider appointing the Rayne Independent and the Rayne Tribune as the Official Journal for a period of six months each.
