THE ACADIA PARISH POLICE JURY met on the above date at 6:30 p.m., in the Police Jury Meeting Room, Courthouse Building, Crowley, Louisiana, in regular session with the President, A. J. Broussard, presiding. At the request of the President, a moment of silence was offered and the Pledge to the Flag was recited in unison. The roll was called and final attendance was recorded as follows:

A motion was offered by Mrs. Cecelia Chambers, seconded by Mr. Alton Stevenson, to revise the agenda to consider removal of Item 13a, removal of Item 11b, to add subdividing of property, speed limits on Ralph, Chester Lee, Rosalynn & Dan Drive, Drainage Project 2007-16 Morrow Road, Cooperative Endeavor Agreement between Acadia Parish Police Jury & DOTD, authorize Registrar to seek Architect bids for Restoration Grant, Junk Vehicles Chapter 12, removal of Item 6. Motion carried.

A motion was offered by Mr. Jimmie Pellerin, seconded by Mrs. Cecelia Chambers, to approve the Minutes of the August 7, 2007, Regular Police Jury Meeting. Motion carried.

FEDERAL/STATE FINANCIAL ASSISTANCE

Juror John Humble, Sr., stated that at the last meeting a motion was approved to re-apply for LCDBG funds for sewage collection lines in the Richard Addition in Morse and renovations to community centers in the City of Crowley. He stated that the motion could not go forward because community centers would have to be applied for by the City of Crowley since they are within the city limits.

WHEREAS, the Acadia Parish Police Jury has conducted a public hearing in order to encourage citizen participation with respect to the selection of viable public facilities projects for their FY 2008-2009 Louisiana Community Development Block Grant Program.

THEREFORE, BE IT RESOLVED by the Acadia Parish Police Jury in regular session duly convened on this the 21st day of August, 2007, does hereby empower, authorize and direct the President to submit an application for funding under the FY 2008-2009 Louisiana Community Development Block Grant Program for sewage collection lines in the Richard Addition in Morse, Acadia Parish.

A RESOLUTION ADOPTING A CITIZEN PARTICIPATION PLAN
RELATIVE TO THE
LOUISIANA COMMUNITY DEVELOPMENT BLOCK GRANT PROGRAM
 

WHEREAS, the Acadia Parish Police Jury intends to submit applications for funding under the Louisiana Community Development Block Grant, and

WHEREAS, the Acadia Parish Police Jury is committed toward encouraging citizen participating in the planning, implementation and assessment of the Louisiana Community Development Block Grant Program, and

WHEREAS, the Acadia Parish Police Jury desire to adopt a written procedure in order to be in compliance with Section 508 of the Housing and Community Development Act of 1974, as amended.

THEREFORE, BE IT RESOLVED by the Acadia Parish Police Jury in regular session duly convened on this the 21st day of August, 2007, does hereby empower, authorize and direct to adopt the Citizen Participation Plan in connection with the Louisiana Community Development Block Grant Program.

FINANCE

A motion was offered by Mrs. Cecelia Chambers, seconded by Mr. Jimmie Pellerin, to approve the Financial Report for July. Motion carried.

A motion was offered by Mrs. Cecelia Chambers, seconded by Mr. Jimmie Pellerin, to approve bills for the months of June & July. Motion carried.

A motion was offered by Mr. Alton Stevenson, seconded by Mr. Felton Moreau, to authorize a budget amendment in the amount of $200,000 in One Percent Sales Tax Fund (309), to increase sales tax revenues as well as to increase expenditures in a like amount. Motion carried.

INSURANCE

Mrs. Claire Kelbaugh with Sterling Wellness Solutions gave a follow-up report summarizing the health findings for employees who completed the Personal Wellness Profile health assessment. She reviewed with Jurors some recommended health actions that employees should take.

She suggested implementing a weight competition program with employees who are willing to participate.

Jurors were in favor of the program.

LEGISLATION

RESOLUTION

WHEREAS, the Acadia Parish Police Jury seeks an Attorney General’s Opinion regarding whether the Acadia Parish Police Jury can enact a Public Safety Ordinance prohibiting and/or restricting the location of a privately owned juvenile correction/detention facility within the Parish.

THEREFORE, BE IT RESOLVED by the Acadia Parish Police Jury in regular session duly convened on this the 21st day of August, 2007, does hereby direct Legal Counsel to seek an Attorney General’s Opinion as to whether the Acadia Parish Police Jury can enact a Public Safety Ordinance prohibiting and/or restricting the location of a privately owned juvenile correction/detention facility within the Parish.

Mr. Valjean Richard submitted to the Jury signatures supporting Associated Marine Institute locating a residential program for juvenile correction.

Messrs. Frank Vautrot, George Cormier, Martin Guillory & Ernest Beaver, spoke in favor of Associated Marine Institutes program.

PERSONNEL

A motion was offered by Mr. Alton Stevenson, seconded by Mr. Felton Moreau, to approve the reclassification of pay for the following employees: Francis Reed, $8.50; Leroy Simon, $9.50; Tommy Deaville, $9.50; and Waylon Thibodeaux, $10.45. Motion carried.

A motion was offered by Mr. Alton Stevenson, seconded by Mr. Jimmie Pellerin, to give the staff at the Rayne Clinic off on Friday, September 7, 2007, due to parking problems during the Frog Festival. Motion carried.

A motion was offered by Mr. Alton Stevenson, seconded by Mr. A. J. Credeur, to authorize the hiring of Bryce Cormier, a COE student, at the Recycling Center at a starting pay of $5.85 per hour. Motion carried.


PUBLIC SAFETY

RESOLUTION

BY: MADAM CECELIA CHAMBERS AND MESSR FELTON MOREAU

WHEREAS, an Intergovernmental Agreement was made between the Town of Basile and the Acadia Parish Police Jury for the purpose of Animal Control assistance, and

WHEREAS, the agreement did not specify that the assistance should be in Acadia Parish only.

THEREFORE, BE IT RESOLVED by the Acadia Parish Police Jury in regular session duly convened on this the 21st day of August, 2007, does hereby amend the Intergovernmental Agreement between the Town of Basile and the Acadia Parish Police Jury for the purpose of Animal Control assistance in that portion of the Town of Basile that is in Acadia Parish only.

Mr. Lee Hebert, Emergency Management Director, stated that Mr. E. J. Stephen had received a certified letter regarding the public hearing on the condemnation of property in Midland. Since there were no objections at the public hearing the building will be posted for 30 days regarding said condemnation.

RESOLUTION

BE IT RESOLVED: by the Acadia Parish Police Jury in regular session duly convened this 21st day of August, 2007, does hereby authorize the condemnation of property located at 106 West Calcasieu Avenue, Midland, Louisiana.

BE IT FURTHER RESOLVED that the enforcement authority be authorized to conduct necessary cleanup activities pursuant to the Ordinance regulating the condemnation of property in subdivisions.

Mr. Hebert gave an update on building permits for the past five months since the new building codes were implemented.
 

PUBLIC WORKS/ROAD & BRIDGE

A motion was offered by Mrs. Cecelia Chambers, seconded by Mr. Felton Moreau, to approve drainage project 2007-15 on Verdin Road at an estimated cost of $2,843.40. Motion carried.

A motion was offered by Mrs. Cecelia Chambers, seconded by Mr. John Humble, Sr., to approve pipe replacement on Thompson Road at an estimated cost of $9,748.16. Motion carried.

Mr. Tim Mader, Mader Engineering, discussed additional cost that would be associated with the Avenue D bridge revetment project in Crowley. He stated that the east side had erosion that was exposing a gas line and that the estimated cost of repairs would be $15,000.00.
 

RESOLUTION

BY: MESSR ALTON STEVENSON AND MADAM CECELIA CHAMBERS

WHEREAS, an Intergovernmental Agreement was signed between the Acadia Parish Police Jury, the City of Crowley and Sixth Ward & Crowley Drainage District to construct improvements for erosion control to the Center Ditch on Western Avenue and the North Crowley Ditch near the bridge on Avenue D, and

WHEREAS, the Acadia Parish Police Jury and the City of Crowley agreed to pay costs not to exceed $15,000.00 each for a total of $30,000.00, and

WHEREAS, engineers have identified additional erosion problems on the North Crowley Ditch east of the bridge on Avenue D.

THEREFORE, BE IT RESOLVED by the Acadia Parish Police Jury in regular session duly convened on this the 21st day of August, 2007, does hereby amend the Intergovernmental Agreement between the Acadia Parish Police Jury, the City of Crowley and Sixth Ward & Crowley Drainage District to include an additional $7,500.00 each for repairs to the east side of the bridge on Avenue D for a total project cost of $45,000.00.

A motion was offered by Mr. Felton Moreau, seconded by Mrs. Cecelia Chambers, to authorize a budget amendment to transfer $50,000.00 from Sales Tax Fund (102) to Sales Tax Road Fund 1996 (304) to patch crossovers on the following roads: Emar, Eve, Fournerat, Riverside, Benton, Hawk, Standard Mill, Sundance, Ebenezer & Napp. Motion carried.
 

SOLID WASTE/ENVIRONMENTAL

A motion was offered by Mr. A. J. Credeur, seconded by Mr. Jimmie Pellerin, to select bid process Option 1 for the collection, transportation and disposal of residential/commercial solid waste in Acadia Parish with bids to be received on October 2, 2007. Motion carried.

A motion was offered by Mr. Alton Stevenson, seconded by Mr. A. J. Credeur, to include the following liquidated damages in the contract: contractor operating outside specified hours of operation $250.00, failure to collect missed pickups $250.00, repetition of valid complaints $250.00, failing to provide a 3-man crew under proposal for manual pickup $50.00 and bringing in waste to the Acadia Parish Sanitary Landfill from outside the Parish $5,000.00. Motion carried.

A motion was offered by Mr. Cade Benoit, seconded by Mrs. Cecelia Chambers, to include the following changes to the contract subsequent to the August 15th meeting: cart replacement requirement from a contract term total of 10% of the initial service unit count to yearly total of 5% of the yearly service unit count, price to purchase additional carts was set at $65 per cart for the first year (this cost will be adjusted over the following years based on the Consumer Price Index adjustment factor), cart must have a 96 gallon capacity (pre-approved cart models include the OTTO Industries Inc. model number MSD95M or the Rehrig Pacific Co. model number ROC95U. Other cart models must meet this standard of quality for approval), 365 day allowance for the use of old trucks-contractors agreed that they can get the new trucks (estimated 10 total) and carts (estimated 25,000 total) by March 1, 2008, if the contract can be executed in November, 2007. Motion carried.

REVISIONS

Mr. George Melancon, Sr., wanted a waiver from the Jury to sell an acre and a half of land which is located on a private road.

The Jury suggested Mr. Melancon follow procedures that the Planning Commission had advised.

ORDINANCE #939

AN ORDINANCE MAKING IT UNLAWFUL FOR ANY PERSON TO OPERATE OR DRIVE A MOTOR VEHICLE UPON RALPH STREET IN ACADIA PARISH, LOUISIANA, AT A SPEED IN EXCESS OF FIFTEEN MILES PER HOUR, AND, PROVIDING FOR THE PENALTIES FOR THE VIOLATION THEREOF.

SECTION 1. BE IT ORDAINED by the Police Jury of Acadia Parish, Louisiana, that it shall be unlawful for any person to operate or drive a motor vehicle in excess of fifteen miles per hour on the following described Parish Road:

Ralph Street

SECTION 2. BE IT FURTHER ORDAINED that any person found guilty of operating or driving a motor vehicle in excess of fifteen miles per hour on the Parish road described above, shall be guilty of a misdemeanor, and upon conviction therefore, shall be fined not more than Fifty Dollars ($50) or be imprisoned not more than ten (10) days or both.

SECTION 3. BE IT FURTHER ORDAINED that any laws or parts of laws in conflict are hereby repealed.

The Ordinance was offered by Mrs. Cecelia Chamber, and seconded by Mr. John Humble, Sr., after being read and considered section by section, was adopted as a whole by the following vote:

SECTION 1. BE IT ORDAINED by the Police Jury of Acadia Parish, Louisiana, that it shall be unlawful for any person to operate or drive a motor vehicle in excess of twenty-five miles per hour on the following described Parish Road:

Chester Lee Drive

SECTION 2. BE IT FURTHER ORDAINED that any person found guilty of operating or driving a motor vehicle in excess of twenty-five miles per hour on the Parish road described above, shall be guilty of a misdemeanor, and upon conviction therefore, shall be fined not more than Fifty Dollars ($50) or be imprisoned not more than ten (10) days or both.

A motion was offered by Mr. John Humble, Sr., seconded by A. J. Credeur, to authorize Registrar Billie Meyer to seek Architect bids for a Restoration Grant for the Annex Building next to the Courthouse. Motion carried.

A motion was offered by Mr. A. J. Credeur, seconded by Mr. Cade Benoit, to authorize the Secretary to advertise for a public hearing to receive comments on proposed changes to Chapter 12, Article II, Code of Ordinances as it pertains to Junk Vehicles. Motion carried.

COMMENTS FROM THE PUBLIC

Mrs. Jo Cart suggested the Jury contact the City of Rayne regarding condemnation of buildings.

Mrs. Carolyn Breaux thanked the Jury for hiring Bryce Cormier at the Recycling Center.
