p.m., in the Police Jury Meeting Room, Courthouse Building, Crowley,
Louisiana, in regular session with the President, A. J. Broussard,
presiding. At the request of the President, a moment of silence was
offered and the Pledge to the Flag was recited in unison. The Roll

ENDORSEMENT RESOLUTION FOR A COMPANY TO
PARTICIPATE IN THE ENTERPRISE ZONE PROGRAM
RESOLUTION STATING THE ACADIA PARISH POLICE JURY'S ENDORSEMENT OF
ARENA GRASS FARMS, LLC TO PARTICIPATE IN THE BENEFITS OF THE
LOUISIANA ENTERPRISE ZONE PROGRAM
WHEREAS, the Louisiana Enterprise Zone act of 1981, Act 901
was enacted by the Louisiana State Legislature, and Act 337 was
enacted by the 1982 Legislature, Act 433 was enacted by the 1987
Legislature and Act 581 was enacted by the 1995 Legislature;
and
WHEREAS, the Louisiana Enterprise Zone Program offers
significant incentives for economic development to some of the most
distressed areas in the Parish of Acadia;
and
WHEREAS, the Louisiana Department of Economic Development
designated Census Tract 9609, Block Group 2 or
Economic Development Zone in Acadia Parish as an "Enterprise
Zone or Economic Development Zone" eligible based on enabling
legislation (R.S.51.21.1787-1791);
and
WHEREAS, the Acadia Parish Police Jury states this
endorsement is in agreement with the Overall Economic Development
Plan for the Parish of Acadia;
and
WHEREAS, the attached Enterprise Zone map has been marked
to show the location of the business being endorsed;
and
WHEREAS, in accordance with the Louisiana Enterprise Zone
Program requirements the Acadia Parish Police Jury agrees:
1. To participate in the enterprise zone program.
2. To assist the Department in evaluating progress made in any
enterprise
zone within its jurisdiction.
BE IT RESOLVED by the Acadia Parish Police Jury in due,
regular and legal session convened this 5th day of June
2007 that and their project, purchase of new equipment and
employment growth in Crowley, LA, State Application # 070894-0 is
endorsed to participate in the Louisiana Enterprise Zone Program.
BE IT FURTHER RESOLVED that if any provision or item of this
resolution or the application thereof is held invalid, such
invalidity shall not affect other provisions, items or applications
of this resolution which can be given effect without the invalid
provisions, items or applications and to this end the provisions of
this resolution are hereby declared severable.
BE IT FURTHER RESOLVED that all resolutions or parts thereof
in conflict herewith are hereby repealed

A motion was offered by Mrs. Cecelia Chambers and seconded by Mr.
Jimmie Pellerin that Acadia Parish Policy Manual, Section 5.4,
Overtime Compensation be followed for compensation for hours worked
in excess of 40 hours per workweek. Motion carried.
PUBLIC FACILITIES, BUILDING AND GROUNDS
A motion was offered by Mrs. Cecelia Chambers and seconded by Mr.
John Humble, Sr. to approve the request of the Registrar of Voter’s
to use the Annex Building for office and storage space. Motion
carried.
A motion was offered by Mrs. Cecelia Chambers and seconded by Mr.
A. J. Credeur to request Warden Eby Henry to inspect the Annex
Building and identify building and repair needs. Motion carried.
A motion was offered by Mr. Alton Stevenson and seconded by Mr.
Felton Moreau to approve the transfer of the Road Manager’s office
to the Triad Building. Motion carried.
A discussion on the required repairs to the Triad building was
discussed. Road Manager, Robert Bergeaux, told the members of the
Jury that two floors needed repair and that standing water under the
building needed to be pumped out. He suggested a sump pump be placed
under the building to prevent future collection of water. Mr.
Bergeaux said he would get cost information for the next meeting.
RESOLUTION 07-07-10

BE IT RESOLVED: by the Acadia
Parish Police Jury in regular session duly convened this 24th day of
July, 2007, does hereby call for a public hearing to hear comments
on a proposed ordinance to require self contractors to abide by the
Louisiana New Home Warranty Act and to include a Hold Harmless and
Indemnity agreement between the Parish and the self contractor.

RESOLUTION 07-07-13
BY MADAM CECELIA CHAMBERS AND MESSR JOHN HUMBLE, SR.
WHEREAS, the
Building Official has notified the Acadia Parish Police Jury of a
violation of Code of Ordinances, Article III. Section 5.64;
and
WHEREAS, notice
has been issued to the property owner, E. J. Stephen, by the
Building Official’s office for repairs and/or demolition to be made
of the improvements on Lots 2 and 3 of Block 10, Midland North
Addition, Acadia Parish, having an address of 106 West Calcasieu
Avenue, Midland, LA,
and
WHEREAS, no action
has been taken and the Building Official has requested a public
hearing on the condemnation of the said property.

the Acadia Parish Police Jury in regular session duly convened this
24th day of July, 2007, in regular session duly convened, that
notice of rule to show cause should be issued to E. J. Stephen for a
public hearing to be held on the 21st day of August, 2007, at 6:00

A motion was offered by Mr. Cade Benoit and
seconded by Mr. A. J. Credeur to approve the amended cost of
Drainage Project 2007-14, St. Henry Road from $2464.50 to $2981.30
because of price increases under new contracts. Motion carried.
Mr. Charlie Johnson, 127 Mardi Gras Lane, Eunice,
LA, addressed the members of the Police Jury concerning the self
assessed paving of Mardi Gras Lane and Suzie Drive. Mr. Johnson,
representing some of the residents of the two streets said that the
residents believed they were being assessed for a 2 inch depth
asphaltic concrete surfacing as opposed to the 3 course asphalt
surface treatment. Juror Cade Benoit asked that the jury consider
refunding a portion of the assessment. Mr. Johnson and Mr. Kevin
Richard opposed the refund, saying they wanted the 2 inch asphalt
surfacing.
RESOLUTION 07-07-14

BE IT RESOLVED by
the Acadia Parish Police Jury in regular session duly convened this
24th day of July, 2007, does hereby cap the self assessment of Mardi
Gras Lane and Suzie Drive at $110,000.00 with the Parish paying a
maximum of $25,000.00 to pave the above named roads with 1 ½ inch
depth asphaltic concrete including a five (5) foot driveway apron
contingent upon approval of Bonding Attorney.

RESOLUTION 07-07-15
BY MESSRS A. J. CREDEUR AND FELTON MOREAU
A resolution providing for the construction of
street paving improvements along a certain street or such part
thereof as may be determined upon, within the corporate limits of
the Parish of Acadia, State of Louisiana, and outside of municipal
corporations, in the manner provided by Sections 3689.1 to 3689.17,
inclusive, of Title 33 of the Louisiana Revised Statutes of 1950 (R.S.
33:3689.1-33:3689.17), and other constitutional and statutory
authority.
WHEREAS, the
Police Jury of the Parish of Acadia, State of Louisiana (the "Police
Jury"), acting as the governing authority of the Parish of Acadia,
State of Louisiana (the "Parish"), adopted a resolution on June 5,
2007, giving notice of their intention to construct street paving
improvements along a certain street or such part thereof as may be
determined upon, within the corporate limits of the Parish, and
outside of municipal corporations (the "Project"), in compliance
with the provisions of Sections 3689.1 through 3689.17 of Title 33
of the Louisiana Revised Statutes of 1950 (R. S. 33:3689.1 through
R. S. 33:3689.17), as amended;
and
WHEREAS, in strict
compliance with the aforesaid statutory authority and the aforesaid
resolution of June 5, 2007, there was public hearing held on
Tuesday, July 17, 2007, at six (6:00) o'clock p.m., after
publication of the notice of intention as required by law, to hear
and receive all objections to the proposed paving improvements, to
the manner of payment therefor and to the manner in which such
improvements will be made, and to consider the question of the
benefit of each lot or parcel of real estate to be assessed as a
result of the construction of said improvements;
and
WHEREAS, the
public hearing was held at the date, time and place set forth above,
and no objections to the proposed paving program were received;
and
WHEREAS, after due
consideration, this Police Jury has determined that each lot or
parcel of real estate to be assessed along the street hereinafter
described will be benefited to an amount not less than the estimated
assessment to be levied against each lot or parcel of real estate as
a result of the construction of said improvements; and
WHEREAS, it is now
the desire of this Police Jury to proceed with the construction of
the street paving improvements on the designated street within the
corporate limits of the Parish and outside of municipal
corporations, or such parts thereof as may be determined upon;
NOW, THEREFORE, BE IT RESOLVED
by the Police Jury of the Parish of Acadia, State of Louisiana (the
"Police Jury"), acting as the governing authority of the Parish of
Acadia, State of Louisiana (the "Parish"), that:
Section 1. This Police Jury, having determined
that each lot or parcel of real estate to be assessed along the
street hereinafter set out, as a result of the construction of the
street paving improvements more fully described below, will be
benefited to an amount not less than the amount of the estimated
assessment to be levied against each such lot or parcel of real
estate, the construction of street paving improvements on the
following designated street within the corporate limits of the
Parish, and outside of municipal corporations (the "Project"), is
hereby ordered and directed, in accordance with the resolution of
intention adopted by this Police Jury, acting as the governing
authority of the Parish, on June 5, 2007, viz:
HIDDEN HERITAGE SUBDIVISION
CONSTRUCTION AND HARDSURFACING OF ROADWAY
Construction and hardsurfacing of a proposed
roadway and associated roadway drainage within Hidden Heritage
Subdivision, commencing at its intersection with Heritage Road and
proceeding north 3275' linear feet to its termination with a cul de
sac, consisting of asphaltic concrete surfacing two (2) inches
thick, eighteen (18) feet wide on a nineteen (19) feet wide soil
cement stabilized base course 8-1/2 inches thick.

SECTION 1. The said improvements shall consist of
the above-described street paving improvements on the street
hereinabove set forth and, as shown by plans and specifications
prepared by Aucoin & Associates, Inc., Consulting Engineers and Land
Surveyors, of Eunice, Louisiana, consulting engineers (the
"Consulting Engineers") to the Parish in connection with the
Project.
SECTION 2. The total cost of the project
shall include the cost of street intersections, necessary ditching,
curbing, guttering, aprons, drains and headers, and all other costs
incidental thereto, including engineers' and attorneys' fees. The
total cost of the Project shall be charged to each lot or parcel of
real estate abutting the street improvements in proportion that the
frontage each lot or parcel of real estate bears to the total
frontage of all of the said lots or parcels of real estate to be
improved by the construction of such improvements, in accordance
with the provisions of Sections 3689.1 to 3689.17, inclusive, of
Title 33 of the Louisiana Revised Statutes of 1950 (R. S.
33:3689.1-33:3689.17), and other constitutional and statutory
authority.
SECTION 3. The Consulting Engineers are
hereby instructed to prepare the necessary plans and specifications
for the above-described street paving improvements along the street
hereinabove set out, and to file a copy thereof with the President
of the Police Jury.
This resolution having been submitted to a vote, the
vote thereon was as follows:

RESOLUTION 07-07-16
BY MESSRS A. J. CREDEUR AND JIMMIE PELLERIN
A resolution requesting the Louisiana Department
of Transportation and Development (LDOTD) to provide double yellow
striping along Hwy 35 just North of the Rayne city limits from
Public Road to a point beyond (north of) Oak Tree Lane.
WHEREAS, the alignment of La. Hwy 35 near
Public Road in the City of Rayne is that of a long, sharp curve;
and
WHEREAS, the north end of the long sharp
curve is only a short distance away from Oak Tree Lane, the entrance
to Oakwoods Subdivision, a residential subdivision;
and
WHEREAS, residents of Oakwoods Subdivision,
when leaving the subdivision and turning right to proceed southbound
on Hwy 35, are faced with a situation whereby northbound vehicles on
Hwy 35 are allowed to pass around other northbound vehicles;
and
WHEREAS, when such northbound vehicles pass
other northbound vehicles, the passing vehicles enter the opposing
southbound lane while accelerating and moving at a high rate of
speed;
and
WHEREAS, these accelerating and fast moving
vehicles are very difficult to judge for southbound traffic coming
out of the Oakwoods Subdivision;
and
WHEREAS, there is a documented history of
near misses and accidents that have been caused by these conditions,
one of which resulted in a fatality;
and
WHEREAS, the LDOTD, having recently studied
this situation apparently based mostly on objective criteria,
concluded that these conditions should not warrant any changes in
striping of the highway in this area;
and
WHEREAS, the Mayor and Council of the City of
Rayne strongly disagree with this conclusion and firmly believe
that:
1. Adding the
necessary striping to prevent northbound vehicle passing
in this area would
greatly reduce the potential for the type of
accidents described
above; and
2. Adding such striping would apparently not
create a more dangerous
situation.
NOW, THEREFORE BE IT RESOLVED by the Acadia
Parish Police Jury in regular session on this the 24th
day of July 2007 and duly convened, that the LDOTD is hereby
requested to revisit and revaluate its recent study of this problem,
and take into account not only the objective criteria, but also the
accident experience and potential in this unique situation, and
especially the close personal knowledge and serious concerns of the
Mayor, Board of Alderman, and Police Chief of the City of Rayne and
the Acadia Parish Sheriff regarding this problem;
and
BE IT FURTHER RESOLVED that the LDOTD is
requested to reach a conclusion to provide and immediately proceed
to add double yellow striping along the centerline of said curve
from Public Road to a point safely beyond (north of) Oak Tree Lane.

ORDINANCE No. 938
AN ORDINANCE MAKING IT UNLAWFUL FOR ANY PERSON TO OPERATE OR
DRIVE A MOTOR VEHICLE UPON NOLARIE ROAD, ACADIA PARISH,
LOUISIANA, AT A SPEED IN EXCESS OF FIFTEEN MILES PER HOUR,
AND, PROVIDING FOR THE PENALTIES FOR THE VIOLATION THEREOF.
SECTION 1. BE IT ORDAINED by the Police Jury of Acadia
Parish, Louisiana, that it shall be unlawful for any person to
operate or drive a motor vehicle in excess of fifteen miles per
hour on the following described Parish Road:
NOLARIE ROAD
SECTION 2. BE IT FURTHER ORDAINED that any person
found guilty of operating or driving a motor vehicle in excess of
fifteen miles per hour on the Parish road described above, shall
be guilty of a misdemeanor, and upon conviction therefore, shall be
fined not more than Fifty Dollars ($50) or be imprisoned not more
than ten (10) days or both.
SECTION 3. BE IT FURTHER ORDAINED that any laws or parts of
laws in conflict are hereby repealed.
The Ordinance was offered by Mr. A.J. Credeur and seconded by Mr.
Felton Moreau and after being read and considered section by
section, was adopted as a whole by the following vote:
