CROWLEY, LOUISIANA

MARCH 20, 2007 

The Acadia Parish Police Jury met on the above date at 6:30 p.m., in the Police Jury Meeting Room, Courthouse Building, Crowley, Louisiana, in regular session with the President, A. J. Broussard, presiding. At the request of the President, a moment of silence was offered and the Pledge to the Flag was recited in unison. The Roll was called and final attendance was recorded as follows:

A motion was offered by Mr. Alton Stevenson and seconded by Madam Cecelia Chambers to revise the agenda to consider funding for members of the Industrial Inducement Board to attend the Governor’s Conference on Economic Development. Motion carried. 

A motion was offered by Mr. Jimmie Pellerin, seconded by Mr. A. J. Credeur to approve the Minutes of the February 6, 2007 Regular Police Jury Meeting and the March 14, 2007 Special Police Jury Meeting. Motion carried. 

Isabella dela Houssaye announced her candidacy for state House of Representative, District 42. 

Mary Kate Colligan from the Church Point 4-H Junior Leadership program presented a review of her experiences as a 4-H member. 

APPOINTMENTS 

A motion was offered by Mr. Cade Benoit and seconded by Mr. John Humble, Sr. to appointment Mr. Ronnie Joseph Richard to Fire Protection District 10 until January 2008 to fill the unexpired term of Todd Bourgeois. Motion carried. 
 

FINANCE 

A motion was offered by Madam Cecelia Chambers and seconded by Mr. A.J. Credeur to approve payment of bills for the months of January and February 2007. Motion carried. 

A motion was offered Madam Cecelia Chambers and seconded by Mr. Jimmie Pellerin to accept the Financial Statement. Motion carried. 

A motion was offered by Mr. A. J. Credeur and seconded by Madam Cecelia Chambers to approve a $3000.0 contribution to the Crowley Fire Department for their school safety programs. Motion carried. 

A motion was offered by Mr. Alton Stevenson and seconded by Madam Cecelia Chambers to approve funding for Mr. Tommy Freeland, Acadia Parish Economic Development Board member to attend the Governor’s Conference on Economic Development. Motion carried.
 

LEGISLATIVE

ORDINANCE No. 926


AN ORDINANCE MAKING IT UNLAWFUL FOR ANY PERSON TO URINATE ON THE STREETS, IN GUTTERS, ON SIDEWALKS, OR IN ALLEYS, DRIVEWAYS OR OTHER PLACES NEAR STREETS, ALLEYS, SIDEWALKS AND OTHER PLACES OF PUBLIC RESORT.

SECTION 1.  BE IT ORDAINED by the Police Jury of Acadia Parish, Louisiana, that it shall be unlawful for any person to urinate on the streets, in gutters, on sidewalks, or in alleys, driveways, or other places near streets, alleys, sidewalks or other places of public resort.

SECTION 2.  BE IT FURTHER ORDAINED that any person found guilty of urinating on the streets, in gutters, on sidewalks, or in alleys, driveways, or other places near streets, alleys, sidewalks or other places of public resort shall be guilty of a misdemeanor, and upon conviction therefore, shall be fined not more than $500.00 or be imprisoned not more than 60 days or both.

SECTION 3.  BE IT FURTHER ORDAINED that any laws or parts of laws in conflict are hereby repealed.

Resolution 03-07-01

American Red Cross Month/Hometown Heroes Day

WHEREAS, for more than a century, the American Red Cross has been at the forefront of helping Americans prevent, prepare for and respond to disasters large and small. Families and communities depend on the Red Cross in times of need, and the Red Cross depends on the support of the American people to help sustain the foundation; and

WHEREAS, during the month of March we formally recognize the American Red Cross and its essential humanitarian role in our community. We honor the Acadiana Area Chapter of the American Red Cross’ contribution to making Acadiana Parish a better place. This year we focus on the spirit of the volunteers, donors, partners and employees who support our mission; and

WHEREAS,  for more than 89 years, the Red Cross in Acadia Parish, the Red Cross has relied on the everyday heroes who donate time, blood or money – heroes who coordinate blood drives, heroes who assist victims of fires and other disasters, and heroes who help military service members and their families with emergency communications; and

WHEREAS, the Red Cross has been the place where compassionate people freely give their time and talent to help prevent and ease human suffering among friends, neighbors and even strangers; and

WHEREAS, in the past year alone, the Acadiana Area Chapter responded to 150 local emergencies, assisted 581 military families and trained 12,000 people in lifesaving skills such as CPR and first aid. Volunteers are the core of the Red Cross, donating their time and energy to selflessly serve those in need and demonstrating the compassion and generosity for which Americans are known; and

WHEREAS, the Red Cross Chapter in Acadiana and its nearly 126 volunteers and donors provide valuable tools and education to individuals, families, workplaces and schools, making us all stronger and more resilient; and

WHEREAS, on Hometown Heroes Day, we celebrate and acknowledge the contributions of the many heroes of Red Cross for building a better quality of life. For the next 125 years and beyond, the Red Cross will meet the needs of the public by fostering volunteers who are professional, prepared and committed to continuing the tradition of providing supreme service delivery to our community:

BE IT RESOLVED: by the Acadia Parish Police Jury in regular session duly convened this 20th day of March, 2007, does hereby proclaim March 2007 as American Red Cross Month and March 21, 2007 as Hometown Heroes Day and further urges all Americans to continue to give their time, blood and money to make a difference in the humanitarian fabric of this community.

            ENDORSEMENT RESOLUTION FOR A COMPANY TO PARTICIPATE
IN THE ENTERPRISE ZONE PROGRAM
 

RESOLUTION STATING THE ACADIA PARISH POLICE JURY'S ENDORSEMENT OF R. S. Property Management, LLC, TO PARTICIPATE IN THE BENEFITS OF THE LOUISIANA ENTERPRISE ZONE PROGRAM
 

WHEREAS, the Louisiana Enterprise Zone act of 1981, Act 901 was enacted by the Louisiana State Legislature, and Act 337 was enacted by the 1982 Legislature, Act 433 was enacted by the 1987 Legislature and Act 581 was enacted by the 1995 Legislature; and

WHEREAS, the Louisiana Enterprise Zone Program offers significant incentives for economic development to some of the most distressed areas in the Parish of Acadia; and

WHEREAS, the Louisiana Department of Economic Development designated Census Tract    9608    , Block Group    004    or Economic Development Zone in Acadia Parish as an "Enterprise Zone or Economic Development Zone" eligible based on enabling legislation (R.S.51.21.1787-1791); and

WHEREAS, the Acadia Parish Police Jury states this endorsement is in agreement with the Overall Economic Development Plan for the Parish of Acadia; and

WHEREAS, the attached Enterprise Zone map has been marked to show the location of the business being endorsed; and

WHEREAS, in accordance with the Louisiana Enterprise Zone Program requirements the Acadia Parish Police Jury agrees:

     1.  To participate in the enterprise zone program.
     2.  To assist the Department in evaluating progress made in any
          enterprise zone within its jurisdiction.

BE IT RESOLVED by the Acadia Parish Police Jury in due, regular and legal session convened this 20th day of March 2007 that R. S. Property Management, LLC and their project, new medical facility in Crowley, LA, State Application # 062051-0 is endorsed to participate in the Louisiana Enterprise Zone Program.

BE IT FURTHER RESOLVED that if any provision or item of this resolution or the application thereof is held invalid, such invalidity shall not affect other provisions, items or applications of this resolution which can be given effect without the invalid provisions, items or applications and to this end the provisions of this resolution are hereby declared severable.

BE IT FURTHER RESOLVED that all resolutions or parts thereof in conflict herewith are hereby repealed.

MOSQUITO CONTROL

A motion was offered by Madam Chambers and seconded by Mr. Alton Stevenson to revise the agenda to consider ratifying an application for a grant from the Emergency Supplemental Appropriations Act for Defense, the Global War on Terror and Hurricane Recovery, 2006 for the Acadia Parish Mosquito Abatement Program Motion carried.

BE IT RESOLVED: by the Acadia Parish Police Jury in regular session duly convened this 20th day of March, 2007, does hereby empower, authorize and direct the President to enter into a Cooperative Endeavor Agreement for a grant of eighty-four thousand five hundred five dollars ($84,505. 00) from the Emergency Supplemental Appropriations Act for Defense, the Global War on Terror and Hurricane Recovery, 2006 for the Acadia Parish Mosquito Abatement Program.

PERSONNEL

A motion was offered by Madam Cecelia Chamber and seconded by Mr. Alton Stevenson to hire Justin Savoy as a landfill employee at $9.00 per hour, effective April 1, 2007 provided all hiring requirements are met. Motion carried.

 

PUBLIC FACILITIES, BUILDING AND GROUNDS

A motion was offered by Madam Cecelia Chamber and seconded by Mr. Alton Stevenson to authorize the secretary to issue a Public Notice of Intention to sell 3 acres of Tract E on Industrial Parkway (Crowley/Rayne Industrial Park) with incentives. Motion carried. 

A motion was offered by Mr. Alton Stevenson and seconded by Mr. Jimmie Pellerin to authorize the secretary to engage engineering services for the development of a new industrial park. Motion carried. 

A motion was offered by Madam Cecelia Chambers and seconded by Mr. John Humble, Sr. to authorize advertisement for the purchase of horse stalls at the Rice Arena. Motion carried.

 

RESOLUTION 03-07-05

WHEREAS, the Acadia Parish Police Jury advertised for an oil, gas and mineral lease as provided by law for all of the oil rights in and to any highways, rights-of-way, streets, roads, lanes and alleys or other lands owned by and not presently under mineral lease from the Acadia Parish Police Jury, Acadia Parish, Louisiana in the following described property: 

That certain tract of land containing 0.024 acres, more or less, situated in Section 43, Township 9 South – Range 1 East, Acadia Parish, Louisiana, being more particularly described as that portion of the Southwest Corner of said Section 43 lying West of Cherokee Road (Street) and being further described as beginning at the Southwest corner of said Section 43; thence from said point of beginning proceed S 80° 50’ E, along South line of said Section 43, approximately 70 feet to the West line of Cherokee Road (Street); thence Northerly along said West line approximately 125 feet to the intersection of the West line of said Section 43 with the West line of Cherokee Road (Street); thence S 90° 01’ 25” W, along the West line of Section 43, approximately 100 feet to point of beginning, being that same parcel describe in that Donation Inter Vivo dated August 10, 1982 and recorded in COB Q-40, Page 681, Entry No. 0490241 of the Official Records of Acadia Parish, Louisiana Clerk of Court. 

WHEREAS, the following bid of Walter Oil and Gas Corporation was the sole bid received:

     For a three (3) year lease. 

            BONUS:                $500.00 (Five Hundred and 00/100 Dollars).

 

            DELAY RENTAL:      $250.00 (Two Hundred Fifty and 00/100 Dollars).

 

            ROYALTY:              25% of all the oil, gas and all other minerals
                                       produced and saved.  25% of all gas produced
                                       and saved or utilized, but not less than 1/8th,
                                       and 25% of all other liquid or gaseous minerals
                                       in solution and produced with oil and gas and
                                       saved or utilized but not less than 1/8th.

 

            PRIMARY TERMS:    Three (3) years.

 
WHEREAS,
after careful consideration it is the opinion of the Police Jury that the bid is satisfactory. 

THEREFORE, BE IT RESOLVED by the Acadia Parish Police Jury in regular session duly convened this 20th day of March, 2007, that the bid of Walter Oil & Gas Corporation, for said oil, gas and mineral lease is hereby accepted, and           

BE IT FURTHER RESOLVED that the President is hereby authorized to sign the oil, gas and mineral lease as herein approved in behalf of the Acadia Parish Police Jury, and

BE IT FURTHER RESOLVED that a completed copy of said lease be sent to the Louisiana State Mineral Board for its approval.

RESOLUTION 03-07-08

BY MADAM CECELIA CHAMBERS AND MESSER ALTON STEVENSON


WHEREAS
, a request was made by Gulf Coast Sound Production, Inc., to locate in the Crowley/Rayne Industrial Park; and

WHEREAS, the Acadia Parish Police jury recognizes the value of creating new jobs for the benefit of Economic Development; and

WHEREAS, it is the intent of the Acadia Parish Police jury to provide incentives to promote economic growth in Acadia Parish; and

WHEREAS, the Acadia Parish Police Jury gave Notice of Intent in its Legal Journal on March 8 and March 15, 2007.

Therefore Be It Resolved by the Acadia Parish Police jury in regular session duly convened on this the 20th day of March, 2007, does hereby authorize the sale of three acres of Industrial Park property to Mr. Larry Habetz and Mr. Randy Pylant in the amount of $8,500.00 per acre provided the necessary twelve (12) permanent fulltime jobs are created within the next five years. 

Be It Further Resolved that this agreement is subject to the approval of Legal Counsel and further subject to the laws governing the sale of property.

RESOLUTION 03-07-09

BE IT RESOLVED by the Acadia Parish Police Jury in regular session duly convened this 20th day of March, 2007, does hereby add Don Drive, Joshua Road, Acorn Hill, Goodrich Road and Uniform Street to the list of roads to be built under the Phase III B Road Project; and

BE IT FURTHER RESOLVED that said roads be constructed at the time that the contractor is working in the district area in order to forego the cost of having to remobilize equipment to complete the project.

BE IT RESOLVED: by the Acadia Parish Police Jury in regular session duly convened this 20th day of March, 2007, does hereby authorize the Road Manager to proceed with the approved 2007 Drainage Projects:2007 -1 Mamou Prairie at a cost of $1225.75, 2007-2 Riverside Road at a cost of $576.00, 2007-3 St Claire at a cost of $1,312.00, 2007-4 Robert Lejeune at a cost of $498.00, 2007-5 Leroy Breaux at a cost of $1495.30, 2007-6 Sundance at an estimated cost of $4,415.00 and the approved Bridge Replacement Projects: Old Spanish Trail (200536) at a cost of $4111.20 and Legros (200564) at a cost of $15,988.00 for a total of $29,621.25 and for $5000.00 to be used from maintenance account to complete said projects.

RESOLUTION 03-07-13

WHEREAS, the State of Louisiana, Department of Transportation plans to signalize the Eleanor Road (Parish Road 6-42) railroad crossing from funds available through the federal railroad safety program; and

WHEREAS, the Parish of Acadia wishes to enhance railroad safety in our parish through proper advance warning signs and pavement markings.

BE IT RESOLVED:
by the Acadia Parish Police Jury in regular session duly convened this 20th day of March, 2007, does hereby agree to install and maintain both advance warnings signs (W10-1) and pavement markings at the Eleanor Road railroad crossing.

                                 ORDINANCE No. 927 

 
AN ORDINANCE MAKING IT UNLAWFUL FOR ANY PERSON TO OPERATE OR DRIVE A MOTOR VEHICLE UPON MUSKRAT ROAD, ACADIA PARISH, LOUISIANA, AT A SPEED IN EXCESS OF FORTY-FIVE MILES PER HOUR, AND, PROVIDING FOR THE PENALTIES FOR THE VIOLATION THEREOF.

SECTION 1.  BE IT ORDAINED
by the Police Jury of Acadia Parish, Louisiana, that it shall be unlawful for any person to operate or drive a motor vehicle in excess of forty-five miles per hour on the following described Parish Road

           muskrat road from airport road to highway 92 

SECTION 2.  BE IT FURTHER ORDAINED that any person found guilty of operating or driving a motor vehicle in excess of forty-five miles per hour on the Parish road described above, shall be guilty of a misdemeanor, and upon conviction therefore, shall be fined not more than Fifty Dollars ($50) or be imprisoned not more than ten (10) days or both.

SECTION 3.  BE IT FURTHER ORDAINED that any laws or parts of laws in conflict are hereby repealed.

The Ordinance was offered by Mr. John Humble, Sr. and seconded by Mrs. Cecelia Chambers and after being read and considered section by section, was adopted as a whole by the following vote:

ORDINANCE No. 928


AN ORDINANCE MAKING IT UNLAWFUL FOR ANY PERSON TO OPERATE OR DRIVE A MOTOR VEHICLE UPON LOIS ROAD, ACADIA PARISH, LOUISIANA, AT A SPEED IN EXCESS OF TWENTY-FIVE MILES PER HOUR, AND, PROVIDING FOR THE PENALTIES FOR THE VIOLATION THEREOF.

SECTION 1.  BE IT ORDAINED by the Police Jury of Acadia Parish, Louisiana, that it shall be unlawful for any person to operate or drive a motor vehicle in excess of twenty-five miles per hour on the following described Parish Road:

SECTION 2.  BE IT FURTHER ORDAINED that any person found guilty of operating or driving a motor vehicle in excess of twenty-five miles per hour on the Parish road described above, shall be guilty of a misdemeanor, and upon conviction therefore, shall be fined not more than Fifty Dollars ($50) or be imprisoned not more than ten (10) days or both.

SECTION 3.  BE IT FURTHER ORDAINED that any laws or parts of laws in conflict are hereby repealed.

The Ordinance was offered by Mr. A.J. Credeur and seconded by Mr. Felton Moreau and after being read and considered section by section, was adopted as a whole by the following vote:

by the Acadia Parish Police Jury in regular session duly convened this 20th day of March, 2007, does hereby authorize the Solid waste Engineer to prepare bid specifications for a solid waste collection contract.
