The Acadia Parish Police Jury met on the above date at 6:30 p.m., in the Police Jury Meeting Room, Courthouse Building, Crowley, Louisiana, in regular session with the President, A. J. Broussard, presiding. At the request of the President, a moment of silence was offered and the Pledge to the Flag was recited in unison. The Roll was called and final attendance was recorded as follows:

A motion was offered by Madam Cecelia Chambers and seconded by Mr. Felton Moreau to revise the agenda to include: amending the speed limit on Morrow Road to 15 MPH; hard surfacing of Roy Leblanc Road; and hard surfacing of undeveloped Road in Hidden Heritage Subdivision. Motion carried.

A motion was offered by Mr. Jimmie Pellerin and seconded by Mr. John Humble, Sr. to approve the Minutes of the May 15, 2007 Regular Police Jury Meeting. Motion carried.

A motion was offered by Mr. Alton Stevenson and seconded by Mr. A. J. Credeur to allow Sterling Life Insurance Company representative to meet with parish employees to discuss Medicare options to employees age 65 and older. Motion carried. 

FINANCE 

A motion was offered by Mr. Jimmie Pellerin and seconded by Mr. A. J Credeur to approve payment of bills for the month of April. Motion carried.

A motion was offered by Mr. Jimmie Pellerin and seconded by Mr. A.J. Credeur to approve the April financial reports. Motion carried. 

A motion was offered by Mr. Jimmie Pellerin and seconded by Mrs. Cecelia Chambers to continue the policy of investing in local financial institutions as opposed to investing all funds in one account. Motion carried. 

A motion was offered by Mrs. Cecelia Chamber and seconded by Mr. Felton Moreau to approve the request of Solid Waste Supervisor to hire two Special Needs individuals to work at the recycling center for the summer months at $5.15 per hour effective June 1, 2007. Motion carried. 

A motion was offered by Mr. Alton Stevenson and seconded by Mrs. Cecelia Chambers to approve the Road Manager’s request for merit raises for Ferrell Reed  $9.00 per hour; Barry Cormier $12.06 per hour; Jonathon Simon $10.45 per hour, and Don Touchet $9.92 per hour effective May 16, 2007. Motion carried

ORDINANCE 931 

LOCAL OR SPECIAL ASSESSMENT ORDINANCE NO. 1OF THE
PARISH OF ACADIA, STATE OF LOUISIANA, FOR THE YEAR 2007


An ordinance providing for the levy of local or special assessments on certain lots or parcels of real estate abutting on certain streets within the corporate limits of the Parish of Acadia, State of Louisiana, and outside of municipal corporations, to cover the total cost of the construction of street paving improvements on said streets, all in accordance with Sections 3689.1 to 3689.17, inclusive, of Title 33 of the Louisiana Revised Statutes of 1950 (R.S. 33:3689.1 - 33:3689.17), and other constitutional and statutory authority; making application to the Louisiana State Bond Commission for consent and authority to construct said improvements and for authority to issue, sell and deliver paving certificates; and providing for other matters in connection therewith.

WHEREAS, the Police Jury of the Parish of Acadia, State of Louisiana, acting as the governing authority (the "Governing Authority") of the Parish of Acadia, State of Louisiana (the "Parish"), by resolution adopted on September 19, 2006, gave notice of its intention to construct street paving improvements along certain streets or such part thereof as may be determined upon, within the corporate limits of the Parish and outside of municipal corporations (hereinafter, the "Project"); and 

WHEREAS, the Parish held a public hearing on October 17, 2006, to hear objections to the proposed improvements and the manner of payment therefore, and there having been no objections, proceeded to order said improvements constructed by resolution adopted on October 17, 2006; and

WHEREAS, based upon the construction contract awarded, Aucoin & Associates, Inc., of Eunice, Louisiana, consulting engineer to the Parish (the “Consulting Engineer”), prepared a report setting forth the total cost of the Project, the total cost to be assessed against the abutting property and the front foot cost to the abutting property owners of the Project, said report having been accepted by resolution adopted by the Governing Authority on April 3, 2007; and

WHEREAS, each lot or parcel of real estate to be assessed in the Project will be benefited to an amount not less than the proposed local or special assessments, and on April 10, 2007, there was mailed to each property owner to be assessed a notice advising said property owner of the proposed assessment and the manner and time of payment thereof, all in accordance with the provisions of Sections 3689.1 to 3689.17, inclusive, of Title 33 of the Louisiana Revised Statutes of 1950 (R.S. 33:3689.1 - 33:3689.17); and 

WHEREAS, in order to cover the cost of the Project to be assessed against the abutting property in accordance with said engineering report, it is the desire of the Parish to levy local or special assessments, as herein provided: 

NOW, THEREFORE, BE IT ORDAINED by the Police Jury of the Parish of Acadia, State of Louisiana, acting as the governing authority (the "Governing Authority") of the Parish of Acadia, State of Louisiana (the "Parish"):

SECTION 1 That in compliance with and under the authority of Sections 3689.1 to 3689.17, inclusive, of Title 33 of the Louisiana Revised Statutes of 1950 (R.S. 33:3689.1 - 33:3689.17), and other constitutional and statutory authority, in accordance with the contract awarded for the Project and, in accordance with the certified statement or report of the Consulting Engineer, and to pay the total cost of constructing the hereinafter described street improvements, including engineers' and attorneys' fees and all other costs incidental to said work, there is hereby levied a local or special assessment of $17.77 per front foot on each and every lot or parcel of real estate abutting on the following streets listed below, all within the corporate limits of the Parish, and outside of municipal corporations:

HARDSURFACING OF SUZIE DRIVE AND MARDI GRAS LANE 

                         GENERAL DESCRIPTION OF IMPROVEMENTS: 

1.   Mardi Gras Lane, from Suzie Drive proceeding southwest approximately
    1350' to the cul-de-sac.
2.    Suzie Drive, from Toby Loop proceeding east approximately 850' to its end
     at Toby Loop. 

The improvements to the designated streets are to consist of 3 course asphalt surface treatment riding surface 18 feet wide on 8 inch depth soil cement base 19 feet wide, including open ditch drainage improvements.

SECTION 4 The amounts herein assessed shall be due and collectible immediately upon the passage of this ordinance at the Police Jury office in Crowley, Louisiana, and if not paid within thirty (30) days from the date hereof, it will be conclusively presumed that any property owner whose property is affected hereby exercises the right or option which is hereby authorized to pay the respective amounts due and herein assessed by this ordinance in ten (10) equal, annual installments, over a period of ten (10) years, bearing interest at a rate not exceeding six per centum (6%) per annum from date hereof until paid, said interest rate to be established by subsequent resolution of the Governing Authority after taking into consideration the average interest cost the Parish will have to pay on any paving certificates sold by the Parish to finance the cost of the proposed improvements, plus collection and administrative costs.  The first installment and the first payment of interest on the unpaid principal amount of the assessments shall become due on May 15, 2008, and the subsequent installments and payments of interest shall become due annually on May 15th of each year thereafter.  The failure to pay any installments or the interest thereon when due shall ipso facto cause the other installments and the interest thereon to become due and payable, and the Parish, shall, through its proper authority and within thirty (30) days from the date of such default, proceed against the property or properties on which defaults may exist by filing suit in a court of competent jurisdiction to have such property or properties immediately seized and sold for the collection of the total amount due thereon, including interest and attorneys' fees, all as provided for by Sections 3689.1 to 3689.17, inclusive, of Title 33 of the Louisiana Revised Statutes of 1950 (R. S. 33:3689.1-33:3689.17), and other constitutional and statutory authority. 

SECTION 5 This ordinance shall be published in full in one (1) issue of the official journal of the Parish, and a certified copy thereof shall be filed with the Clerk of Court and Ex-Officio Recorder of Mortgages in and for the Parish, who shall forthwith record the same in the Mortgage Records of the Parish and this ordinance, when so filed and recorded, shall operate as a lien and privilege against each lot or parcel of real estate herein assessed, which lien and privilege shall prime all claims except taxes.

SECTION 6 After the thirty (30) day period set forth in Section 2 has expired and after the delivery of the paving certificates described in Section 2, the unpaid balance owed on an assessment may be prepaid at any time at a price equal to the outstanding principal balance on the assessment being prepaid and a penalty in the amount of the total annual interest for the then current assessment year on the principal balance being prepaid.

SECTION 7 Any and all payments made in cash in payment of the assessments herein levied shall be expended for no purpose other than the payment of the cost of said improvements herein referred to, and the Treasurer of the Governing Authority, or a representative thereof, is hereby empowered, authorized and directed to issue receipts authorizing the cancellation of the assessments hereby levied upon payment to the Parish of the full amount due on account of the respective installments.

SECTION 8 In case any one or more of the provisions of this ordinance shall for any reason be held to be illegal or invalid, such illegality or invalidity shall not affect any other provisions of this ordinance, but the same shall be construed and enforced as if such illegal or invalid provisions had not been contained herein.  Any constitutional or statutory revision enacted after the date of this ordinance which validates or makes legal any provision hereof shall be deemed to apply hereto.

SECTION 9 Application is hereby formally made to the Louisiana  State Bond Commission for consent and authority for the Parish to proceed with the Project and for further consent and authority to levy local or special assessments against each assessable lot or parcel of real estate abutting said improvements to cover the total cost of said improvements and to issue, sell and deliver certificates in an amount sufficient to cover the unpaid cost of said improvements, all as provided for in the Act, said certificates to mature over a period of ten (10) years and bear interest at a rate or rates not exceeding six per centum (6%) per annum.

By virtue of the Issuer’s application for acceptance and utilization of the benefits of the Louisiana State Bond Commission’s approval resolved and set forth herein, it resolves that it understands and agrees that such approval is  expressly conditioned upon, and it further resolves that it understands, agrees and binds itself, its successors and assigns to, full and continuing compliance with the “State Bond Commission Policy on Approval of Proposed Use of Swaps, or other forms of Derivative Products Hedges, Etc.”, adopted by the Commission on July 20, 2006, as to the borrowing(s) and other matter(s) subject to the approval(s), including subsequent application and approval under said Policy of the implementation or use of any swap(s) or other product(s) or enhancement(s) covered thereby.

SECTION 10 This ordinance shall become effective immediately.
This ordinance having been submitted to a vote, the vote thereon was as follows:

A motion was offered by Mr. Alton Stevenson and seconded by Mr. Cade Benoit to enter into an Intergovernmental Agreement with the City of Crowley for North of I-10 Street and Drainage Improvements. Motion failed.

A motion was offered by Mr. Felton Moreau and Mr., John Humble, Sr. to refer the request of the City of Crowley for an Intergovernmental Agreement for North of I-10 Street and Drainage Improvements to the Public Works Road and Bridge Committee for further review. Motion carried.
 

RESOLUTION 05-07-14 

WHEREAS, the channel bank destabilization is the partial result of large amounts of concrete debris being placed in the channel bank and causing displacement of material into and shifting of the drainage channel to the south thus increasing the potential for erosion of the bridge at Highway 13/Eastern Avenue, destabilization of the bridge and further channel bank instability; and 

WHEREAS, The Acadia Parish Police Jury supports the efforts of the City of Crowley, the Sixth Ward and City of Crowley Drainage District and the Louisiana Department of Transportation (LaDOTD) to stabilize the channel bank of Bayou Blanc; and

THEREFORE BE IT RESOLVED, the Acadia Parish Police Jury in regular session duly convened this 15th day of May, 2007, does hereby authorize, direct and empower the President to execute an Intergovernmental Agreement with the City of Crowley, the Sixth Ward and City of Crowley Drainage District and the Louisiana Department of Transportation to stabilize the channel banks of Bayou Blanc, reduce the potential for erosion and the potential devastating loss of highway bridge approaches.

BE IT FURTHER RESOLVED, Legal Counsel is authorized to engage the services of a second real estate appraiser in the event that said property is appraised in excess of thirty thousand dollars ($30,000).

A motion was offered by Mr. Cade Benoit and seconded by Mr. A. J. Credeur to authorize the Road Manager to repair and widen Berlin Road at an estimated cost of $15,000.00. Motion carried. 

A motion was offered by Mr. Cade Benoit and seconded by Mr. Felton Moreau to approve the application by Reese Guillot to open cut a portion of Airport Road for the purpose of placement of 15” irrigation pipe. Motion carried.

ORDINANCE No. 932
 

AN ORDINANCE MAKING IT UNLAWFUL FOR ANY PERSON TO OPERATE OR DRIVE A MOTOR VEHICLE UPON MORROW ROAD, ACADIA PARISH, LOUISIANA, AT A SPEED IN EXCESS OF FIFTEEN MILES PER HOUR, AND, PROVIDING FOR THE PENALTIES FOR THE VIOLATION THEREOF. 

SECTION 1.  BE IT ORDAINED by the Police Jury of Acadia Parish, Louisiana, that it shall be unlawful for any person to operate or drive a motor vehicle in excess of fifteen miles per hour on the following described Parish Road:

 MORROW road

SECTION 2.  BE IT FURTHER ORDAINED that any person found guilty of operating or driving a motor vehicle in excess of fifteen miles per hour on the Parish road described above, shall be guilty of a misdemeanor, and upon conviction therefore, shall be fined not more than Fifty Dollars ($50) or be imprisoned not more than ten (10) days or both.

SECTION 3.  BE IT FURTHER ORDAINED that any laws or parts of laws in conflict are hereby repealed.

 RESOLUTION 05-07-20

Whereas, Mr. Robert Hanks, et al has propositioned the Acadia Parish Police Jury to enter into a cooperative agreement whereby Mr. Robert Hanks, et al agrees to pay for the hard-surfacing of Roy Leblanc Road beginning at the intersection of Caffey Road east approximately 1330 feet under the Phase III B Road Improvement Program; and 

Whereas, the Acadia Parish Police Jury wishes to enter into a cooperative agreement with Mr. Hanks, et al contingent upon payment of the sum of thirty eight thousand five hundred sixty-eight dollars and 30/100 ($38,568.30) and execution of a cooperative agreement; and 

BE IT RESOLVED, the Acadia Parish Police Jury in regular session duly convened this 15th day of May, 2007, does hereby authorize, empower, and direct the President to enter into a cooperative endeavor with Mr. Robert Hanks, et al for the hard surfacing of a portion of Roy Leblanc Road as stated. 

BE IT FURTHER RESOLVED, the President is hereby authorized, directed and empowered to execute Change Order 2, under the Phase III, B Road Improvement Project, W.E McDonald & Sons, Inc., P.O. Box 787, Glenmora, LA 71433, for the hard surfacing of Roy Leblanc Road and Joshua Road at a net addition to the contract of one hundred sixty- seven thousand five hundred forty-three dollars and 43/100 ($167,543.41) for a revised contract amount of $4,968,890.08.

 RESOLUTION 05-07-21 

BY MADAM CECELIA CHAMBERS AND MESSER A.J. CREDEUR
 

WHEREAS, Ronald Lynn Canino and Pamela C. Canino petitioned the Acadia Parish Police Jury for a local or special assessment to construct street paving in the planned development of Hidden Heritage Subdivision; and

WHEREAS
, Mr. Ronald Lynn Canino and Mrs. Pamela C. Canino, the developers, agree to accept responsibility for payment of reasonable engineering fees should said project be terminated or abandoned by the developers;
and 

NOW, BE IT RESOLVED, the Acadia Parish Police Jury in regular session duly convened this 15th day of May, 2007, does hereby provide the description and type of construction for the said project to be: construction and hard surfacing of a proposed roadway and associated roadway drainage within Hidden Heritage Subdivision, commencing at its intersection with Heritage Road and proceeding north 3275’ linear feet to its termination with a cul de sac, consisting of asphaltic concrete surfacing two (2) inches thick, eighteen (18) feet wide on a nineteen (19) feet wide soil cement stabilized base core 8 ½ inches thick.
