                                                                                         OCTOBER 2, 2007

THE ACADIA PARISH POLICE JURY met on the above date at 6:30 p.m., in the Police Jury Meeting Room, Courthouse Building, Crowley, Louisiana, in regular session with the President, A. J. Broussard, presiding. At the request of the President, a moment of silence was offered and the Pledge to the Flag was recited by 4-H members. The roll was called and final attendance was recorded as follows:

Ms. Claire Boudreaux, a Rayne High Student, stated that she has been in 4-H for five years and is a 2007-2008 4-H Embassador. She stated that October 7-13th is National 4-H Week. She thanked the Jury for their support.

Several 4-H members recited their motto for the Jurors.

A motion was offered by Mr. Alton Stevenson, seconded by Mrs. Cecelia Chambers, to revise the agenda to consider a request for local sales tax exemption on propane/butane used in farm grain dryers, authorize advertising for a Receptionist/Technical Office Assistant and an amendment to the Building Code Ordinance. Motion carried.

A motion was offered by Mr. John Humble, Sr., seconded by Mrs. Cecelia Chambers, to amend the agenda to consider designation of an Interim Secretary. Motion carried.

A motion was offered by Mr. John Humble, Sr., seconded by Mrs. Cecelia Chambers, to designate Mr. Joey Webb as Interim Secretary of the Acadia Parish Police Jury retroactive to August 3, 2007. Motion carried.

A motion was offered by Mrs. Cecelia Chambers, seconded by Mr. Alton Stevenson, to approve the Minutes of the September 12, 2007, Special Meeting and the September 18, 2007, Regular Police Jury Meeting. Motion carried.

Mr. Lee Hebert, Building Code Inspector, reviewed proposed amendments to the Building Code Ordinance with Jurors.

RESOLUTION

BY MESSRS: ALTON STEVENSON AND FELTON MOREAU

BE IT RESOLVED: by the Acadia Parish Police Jury in regular session duly convened this 2nd day of October, 2007, does hereby authorize the calling of a public hearing to hear any and all comments on an amendment to the Code of Ordinances as it relates to Building Codes and Permits.

FEDERAL/STATE FINANCIAL ASSISTANCE

The following Resolution was offered by Mrs. Cecelia Chambers, seconded by Mr. Alton Stevenson:

                                             RESOLUTION

A resolution authorizing the President to execute
an Agreement with the Louisiana Department of
Transportation and Development (LA DOTD) for
improvements at the LeGros Memorial Airport.

WHEREAS, Act 451 of the 1989 Regular Session of the Louisiana Legislature authorized the financing of certain airport improvements from funds appropriated from the Transportation Trust Fund, and

WHEREAS, the Acadia Parish Police Jury has requested funding assistance from the LA DOTD for installation of PAPI’s and REIL’s, and

WHEREAS, the stated project has been approved by the Louisiana Legislature and the LA DOTD is agreeable to the implementation of this project and desires to cooperate with the Acadia Parish Police Jury according to the terms and conditions identified in the attached Agreement, and

WHEREAS, the FAA will provide up to 95% of the necessary funding, and the LA DOTD will provide up to 5% of the necessary funding.

THEREFORE, BE IT RESOLVED by the Acadia Parish Police Jury in regular session duly convened on this the 2nd day of October, 2007, does hereby authorize the President to execute an Agreement for the project identified as AIP No. 3-22-0013-006-2007 and SPN 901-02-0013, more fully identified in the Agreement attached hereto.

This resolution shall be in full force and effect from and after its adoption.

The aforesaid resolution, having been submitted to a vote, the vote thereon was as follows:

FINANCE

RESOLUTION

BY MESSRS: JIMMIE PELLERIN AND JOHN HUMBLE SR

BE IT RESOLVED: by the Acadia Parish Police Jury in regular session duly convened this 2nd day of October, 2007, does hereby authorize the President to execute the contract for Nutritionist Services at the Rayne Community Clinic with Tammy Lamartiniere providing for charges in the amount of $50.00 per hour.

PERSONNEL

A motion was offered by Mr. Alton Stevenson, seconded by Mrs. Cecelia Chambers, to authorize 30 days of meritorious sick leave for Mr. Joseph Shreve and Ms. Versey Allen as provided for in the Personnel Policy Manual. Motion carried.

A motion was offered by Mrs. Cecelia Chambers, seconded by Mr. John Humble, Sr., to authorize the Interim Secretary to advertise for a Receptionist/Technical Office Assistant for the Administrative Office with salary DOE. Motion carried.

The Jury referred the salary of the Human Resource Director for the Administrative Office to the Personnel Committee.

PUBLIC FACILITIES/BUILDING & GROUNDS

The Jury referred security for the Courthouse to the Public Facilities/Building & Grounds Committee.

PUBLIC WORKS/ROAD & BRIDGE

RESOLUTION

ANNUAL CERTIFICATION OF COMPLIANCE

WITH STATE OF LOUISIANA

OFF SYSTEM BRIDGE REPLACEMENT PROGRAM

 

WHEREAS, the Code of Federal regulations as enacted by the United States Congress mandates that all structures defined as bridges located on all public roads shall be inspected, rated for safe load capacity and posted in accordance with the National Bridge Inspection Standards and that an inventory of these bridges be maintained by each State; and

WHEREAS, the responsibility to inspect, rate and load post those bridges under the authority of Acadia Parish in accordance with those Standards is delegated by the Louisiana Department of Transportation and Development to Acadia Parish.

THEREFORE, BE IT RESOLVED by the governing authority of Acadia Parish (herein referred to as the Parish) that the Parish in regular meeting assembled does hereby certify to the Louisiana Department of Transportation and Development (herein referred to as the DOTD) that for the period 1 October, 2006 through 30 September, 2007:

1. The Parish has performed all interim inspections on all Parish owned or maintained bridges in accordance with the National Bridge Inspection Standards.

2. All bridges owned or maintained by the Parish have been structurally analyzed and rated by the Parish as to the safe load capacity in accordance with AASHTO Manual for Maintenance Inspection of Bridges. The load posting information that has been determined by the LA DOTD for all bridges where the maximum legal load under Louisiana State Law exceeds the load permitted under the operating rating as determined above has been critically reviewed by the Parish. Load posting information has been updated by the Parish to reflect all structural changes, and obsolete structural ratings or any missing structural ratings.

3. All Parish owned or maintained bridges which require load posting or closing are load posted or closed in accordance with the table in the DOTD Engineering Directives and Standards Manual Directive No. 1.1.1.8. All DOTD supplied load posting information concerning a bridge has been critically reviewed by the Parish Engineer prior to load posting.

4. All bridges owned or maintained by the Parish are shown on the attached list in the format specified by the DOTD. Corrections to data supplied to the Parish by the LA DOTD are noted.

These stipulations are prerequisites to participation by the Parish in the Off-System Replacement Program.

This resolution was considered section by section and as a whole and upon motion of Mrs. Cecelia Chambers, being seconded by Mr. Jimmie Pellerin, was adopted by the following vote on this the 2nd day of October, 2007:

A motion was offered by Mrs. Cecelia Chambers, seconded by Mr. John Humble, Sr., to approve the Emergency Work Report for the month of September, 2007. Said expenditures to be in the amount of $305.33. Motion carried.

SOLID WASTE/ENVIRONMENTAL

Mr. Tim Mader, Mader Engineering, stated that the bid opening for the new Solid Waste Collection Contract will be moved back one week to Tuesday, October 9, 2007.

Mr. Mader reviewed Addendum No. 2 (amendments to the specifications and contract documents) for the new Solid Waste Collection Contract.

A motion was offered by Mrs. Cecelia Chambers, seconded by Mr. Felton Moreau, to authorize additional publications to three other newspapers within the area of Acadia Parish. Motion carried.

REVISIONS

RESOLUTION

BY: MR ALTON STEVENSON AND MRS CECELIA CHAMBERS

WHEREAS, the Acadia Parish School Board, the Acadia Parish Police Jury, and the Acadia Parish Sheriff’s Department recognize the role of agriculture in our community, and

WHEREAS, the farmers in our Parish are facing ever rising costs in the production of crops, and

WHEREAS, the farmers are seeking the same classification for local sales tax purposes for all utilities necessary for the drying of crops in farm based bins.

WHEREAS, existing legislation does not give local sale taxing bodies the authority to exempt butane/propane used in farm grain dryers from Parish sales tax.

THEREFORE, BE IT RESOLVED by the Acadia Parish Police Jury in regular session duly convened on this the 2nd day of October, 2007, does hereby ask the Louisiana Legislature to provide enabling legislation which would allow the sales tax collecting bodies in Acadia Parish the flexibility to consider exempting local sales tax on propane/butane used in farm grain dryers.

A motion was offered by Mrs. Cecelia Chambers, seconded by Mr. John Humble, Sr., to cancel the regular meeting for November 6, 2007, and authorize a Finance Committee Meeting for budget purposes at 5:00 P.M., on that night. Motion carried.

President A. J. Broussard stated that Allied Waste has not been picking up trash on some areas of his district. He asked Legal Counsel what steps could be taken to handle this situation.

Legal Counsel Doug Wimberly stated that Allied Waste would have 24 hours to pick up trash that was missed and that documentation would have to have been done and a follow-up by the Parish in order to collect fees from them.

The President stated that the Region 7 Meeting was being held in Lake Charles on Wednesday, October 3, 2007.

THERE BEING NO FURTHER BUSINESS TO COME BEFORE THE MEETING, THE MOTION WAS OFFERED DULY SECONDED, THAT THE MEETING ADJOURN UNTIL THE NEXT REGULARLY SCHEDULED MEETING OF OCTOBER 16, 2007, AT THE HOUR OF 6:30 P.M.
