CROWLEY, LOUISIANA

JANUARY 29, 2008

THE ACADIA PARISH POLICE JURY met on the above date at 6:30 p.m., in the Police Jury Meeting Room, Courthouse Building, Crowley, Louisiana, in regular session with the President, A. J Creduer, presiding. At the request of the President, a moment of silence was offered and the Pledge to the Flag was recited in unison. The roll was called and final attendance was recorded as follows:

A motion was offered by Mr. John Quebodeaux, seconded by Mr. Cade Benoit and carried unanimously to add three items to the agenda regarding the FY 2007 LCDBG: (1) resolution establishing a separate non-interest bearing checking account for the funds, (2) resolution authorizing Police Jury officers/personnel to sign request for payment forms, and (3) resolution granting the authority to the Police Jury President to sign any and all documents in connection with the grant.

The following resolution was offered by Mr. Alton Stevenson, seconded by Mr. Kermit Richard and unanimously carried:

A RESOLUTION ESTABLISHING A SEPARATE,
NON-INTEREST BEARING CHECKING ACCOUNT FOR THE
LOUISIANA COMMUNITY DEVELOPMENT BLOCK GRANT PROGRAM FOR SEWERAGE IMPROVEMENTS

WHEREAS, the Acadia Parish Police Jury has been awarded a Fiscal Year 2007 Louisiana Community Development Block Grant for sewerage improvements; and

WHEREAS, said funds from the State shall be deposited directly in a financial institution of the Police Jury’s choosing as they are requested, and

WHEREAS, the Police Jury must establish a separate bank account for the Louisiana Community Development Block Grant funds.

THEREFORE, BE IT RESOLVED by the Acadia Parish Police Jury in regular session duly convened on this the 29th day of January, 2008, does hereby authorize the Honorable A. J. Credeur, President, to execute the appropriate Designation of Depository Form as required by the Division of Administration for a separate non-interest bearing checking account at the Bank of Commerce, Crowley, Louisiana.

The following resolution was offered by Mr. Kermit Richard, seconded by Mr. John Quebodeaux, and unanimously carried:

ACADIA PARISH POLICE JURY OFFICIALS/EMPLOYEES TO SIGN THE REQUEST FOR PAYMENT FORMS
FOR THE LOUISIANA COMMUNITY
DEVELOPMENT BLOCK GRANT PROGRAM FOR SEWERAGE IMPROVEMENTS

WHEREAS, the Acadia Parish Police Jury has been awarded a Fiscal Year 2007 Louisiana Community Development Block Grant for sewerage improvements; and

WHEREAS, under the Louisiana Community Development Block Grant Program, a maximum of four (4) Police Jury officials and/or employees are to be authorized to sign the Louisiana CDBG Request for Payment forms to draw down funds from said grant; and

WHEREAS, in order to draw down funds, an authorized signature card must be completed with the signatures of a maximum of four (4) Police Jury officials and/or employees in addition to one (1) person who is to be authorized to witness the signing of the authorized signature card.

THEREFORE, BE IT RESOLVED by the Acadia Parish Police Jury that the following Police Jury officials and employees are the only persons hereby authorized to sign Request for Payment forms under the 2007 Louisiana Community Development Block Grant for Sewerage Improvements:

BE IT FURTHER RESOLVED that A. J. Credeur is hereby authorized to witness and certify that the above mentioned Police Jury officials and employees actually sign the authorized signature card for the Louisiana Community Development Block Grant Program.

WHEREAS, this federal grant program involves a significant amount of documentation and reporting.

THEREFORE, BE IT RESOLVED by the Acadia Parish Police Jury in regular session duly convened on this the 29th day of January, 2008, does hereby authorize the Honorable A. J. Credeur, President, to sign and submit all of the necessary documents in connection with the 2007 Louisiana Community Development Block Grant sewerage improvements.

ORDINANCE #955

AN ORDINANCE MAKING IT UNLAWFUL FOR ANY PERSON TO OPERATE OR DRIVE A MOTOR VEHICLE UPON RIVERSIDE ROAD IN ACADIA PARISH, LOUISIANA, AT A SPEED IN EXCESS OF THIRTY-FIVE MILES PER HOUR, AND, PROVIDING FOR THE PENALTIES FOR THE VIOLATION THEREOF.

SECTION 1. BE IT ORDAINED by the Police Jury of Acadia Parish, Louisiana, that it shall be unlawful for any person to operate or drive a motor vehicle in excess of thirty-five miles per hour on the following described Parish Road:

Riverside Road

from Evangeline Hwy. (LA 97) south approximately 3 miles

SECTION 2. BE IT FURTHER ORDAINED that any person found guilty of operating or driving a motor vehicle in excess of thirty-five miles per hour on the Parish road described above, shall be guilty of a misdemeanor, and upon conviction therefore, shall be fined not more than Fifty Dollars ($50) or be imprisoned not more than ten (10) days or both.

SECTION 3. BE IT FURTHER ORDAINED that any laws or parts of laws in conflict are hereby repealed.

The Ordinance was offered by Mr. Felton Moreau, and seconded by Mr. Cade Benoit, after being read and considered section by section, was adopted as a whole by the following vote:

A motion was offered by Mr. Cade Benoit, seconded by Mr. Alton Stevenson, to introduce an ordinance and provide for a public hearing to amend Chapter 8 of the Code of Ordinances, Solid Waste Management. Motion carried.

A motion was offered by Mr. Alton Stevenson, seconded by Mr. Kermit Richard, to allow an additional 30 day extended sick leave to Versey Allen and to allow a 30 day extension of sick leave for Wallace LeBlanc. Motion carried.

A motion was offered by Mr. John Quebodeaux, seconded by Mr. Cade Benoit, and carried to advertise for Third Party Service Providers in conjunction with the Louisiana Uniform Construction Code.

A motion was offered by Mr. Felton Moreau, seconded by Mr. John Quebodeaux, and carried, to lease a John Deere motorgrader for six months from Scott Truck LLC.

A motion was offered by Mr. John Quebodeaux, seconded by Mr. Felton Moreau, and carried, to hire Bradley Lavergne part-time to perform bridge inspections. Mr. Lavergne is to conduct three bridge inspections per year at an hourly rate of $25.00 with a ceiling of 160 hours per bridge.

A motion was offered by Mr. Cade Benoit, seconded by Mr. Kermit Richard, and carried, to approve the Emergency Work Report for the month of December, 2007, in the amount of $71.33.

A motion was offered by Mr. Cade Benoit, seconded by Mr. Thomas Sonnier, and carried, authorizing the payment of bills.

A motion was offered by Mr. John Quebodeaux, seconded by Mr. Felton Moreau, making the Secretary-Treasurer, Terry L. Lacombe, the principal administrative official of the Police Jury responsible for the overall administration and setting Mr. Lacombe’s annual salary at $50,000.00. The Secretary-Treasurer’s job performance is to be evaluated in one year for salary adjustments. The motion carried with Mr. A. J. Broussard voting no.

A motion was offered by Mr. John Quebodeaux, seconded by Mr. Cade Benoit, setting the Police Jury Regular Meetings for the second Wednesday of each month at 6:30 P.M. in the Police Jury Meeting Room and the Committee Meetings to be scheduled for the Wednesday before the second meeting of each month at 6:30 P.M., in the Police Jury Meeting Room. The motion carried with Mr. A. J. Broussard voting no.

Various speakers addressed the Police Jurors regarding an appointment to the Board of Commissioners of the Acadia-St. Landry Hospital.

A motion was offered by Mr. A. J. Broussard, seconded by Mr. Kermit Richard, to add an item to the agenda regarding an appointment to the Board of Commissioners of the Acadia-St. Landry Hospital. Yeas: A. J. Broussard, Kermit Richard and Thomas Sonnier. Nays: Cade Benoit, Felton Moreau, John Quebodeaux and Alton Stevenson. Motion failed.
