CROWLEY, LOUISIANA

MARCH 12, 2008

THE ACADIA PARISH POLICE JURY met on the above date at 6:30 p.m., in the Police Jury Meeting Room, Courthouse Building, Crowley, Louisiana, in regular session with the President, A. J Creduer, presiding. At the request of the President, a moment of silence was offered and the Pledge to the Flag was recited in unison. The roll was called and final attendance was recorded as follows:

A motion was offered by Mr. John Quebodeaux, seconded by Mr. Kermit Richard and carried, to dispense with the reading of the Minutes of February 13, 2008.

A motion was offered by Mr. John Quebodeaux, seconded by Mr. Kermit Richard and carried, to revise the agenda to include authorizing the President to sign DOTD Signage Contract, adopt Resolution concerning South 13th Street Mermentau, discussion regarding meeting dates and Mosquito Control.

Juror A. J. Broussard read a letter of resignation from Mrs. Antoinette DeRouen, Mosquito Control Director.

A motion was offered by Mr. A. J. Broussard, seconded by Mr. John Quebodeaux and carried, to appoint Ms. Joni Kernan as Interim Mosquito Control Director.

Crowley Mayor Greg Jones addressed the Police Jurors and requested that a historical marker be placed on the Courthouse grounds. The marker, provided by the City of Crowley, will denote the approximate location of a Presidential Campaign Speech delivered by Senator John F. Kennedy on October 16, 1959.

A motion was offered by Mr. Alton Stevenson, seconded by Mr. Felton Moreau and carried, to allow the placement of the marker on the Courthouse grounds and that Mr. Nelson Sonnier assist with the project.

RESOLUTION

BY MESSRS: ALTON STEVENSON AND KERMIT RICHARD

WHEREAS, the construction of a frontage road on the North side of Interstate 10 between LA 13 and LA 1111 exits would enhance economic development, and

WHEREAS, steps have been taken by the City of Crowley to secure funding for the construction of a frontage road, and

WHEREAS, the Acadia Parish Police Jury endorses the construction of said frontage road.

THEREFORE, BE IT RESOLVED by the Acadia Parish Police Jury in regular session duly convened on this the 12th day of March, 2008, does hereby offer its unanimous support for the construction of a frontage road from LA 13 to LA 1111 and request that Governor Bobby Jindal and the Acadia Parish Legislative Delegation provide the funding for said project.

WHEREAS, the Acadia Parish Police Jury has been awarded a Fiscal Year 2007 Louisiana Community Development Block Grant for sewerage improvements; and

WHEREAS, on October 1, 1988, new requirements for a Residential Antidisplacement and Relocation Assistance Plan under the Federal Housing and Community Development Act of 1974 became effective; and

WHEREAS, the U. S. Department of Housing and Urban Development will not award any Community Development Block Grant funds after October 1, 1988 unless a community adopts such a plan; and

WHEREAS, the Police Jury requires the services of one person to be the contact person relative to displacements and relocation; and

WHEREAS, it is the desire of the Police Jury to adopt such a plan and appoint such an officer.

NOW, THEREFORE, BE IT RESOLVED by the Acadia Parish Police Jury that President A. J. "Jay" Credeur be appointed as Antidisplacement/Relocation Officer for the Fiscal Year 2007 Louisiana Community Development Block Grant and perform all tasks associated with this position.

BE IT FURTHER RESOLVED that the attached Residential Antidisplacement and Relocation Assistance Plan is hereby adopted in connection with the Fiscal Year 2007 Louisiana Community Development Block Grant Program for sewage improvements.

WHEREAS, the Acadia Parish Police Jury has been awarded a Fiscal Year 2007 Louisiana Community Development Block Grant for sewerage improvements; and

WHEREAS, the Police Jury is committed to eliminating discrimination based on race, color, religion, sex or national origin; and

WHEREAS, the Police Jury is committed to compliance with federal and state guidelines concerning equal employment opportunity in regards to the Louisiana Community Development Block Grant Program.

NOW, THEREFORE, BE IT RESOLVED by the Acadia Parish Police Jury that the Police Jury does hereby approve and adopt the Section 3 Plan attached hereto and made part of this resolution in connection with the Louisiana Community Development Block Grant Program.

WHEREAS, the Acadia Parish Police Jury has been awarded a Fiscal Year 2007 Louisiana Community Development Block Grant for sewerage improvements; and

WHEREAS, the Police Jury is committed to compliance with Section 504 and the Accessibility Standards for Disabled Persons for the Louisiana Community Development Block Grant Program as set forth by the federal government and the Louisiana Division of Administration; and

WHEREAS, the Police Jury requires the services of one person to administer said guidelines and requirements; and

WHEREAS, the Police Jury desires to adopt complaint procedures for the Americans with Disabilities Act.

NOW, THEREFORE, BE IT RESOLVED by the Acadia Parish Police Jury that President A. J. "Jay" Credeur be appointed as the Accessibility Compliance Officer for the Fiscal Year 2007 Louisiana Community Development Block Grant and perform all necessary tasks as associated with this position.

BE IT FURTHER RESOLVED that the attached Citizen Complaint Procedures for Section 504 and the Americans with Disabilities Act are hereby adopted.

WHEREAS, the Police Jury is committed to compliance with the Labor Standard Requirements for the Louisiana Community Development Block Grant Program as set forth by the federal government and the Louisiana Division of Administration; and

WHEREAS, the Police Jury requires the services of one person to administer said guidelines and requirements.

NOW, THEREFORE, BE IT RESOLVED by the Acadia Parish Police Jury that Mr. Terry L. Lacombe be appointed as the Labor Compliance Officer for the Fiscal Year 2007 Louisiana Community Development Block Grant and perform all necessary tasks as associated with this position.

WHEREAS, the Police Jury is committed to compliance with equal opportunity requirements, which include: Title VI of the Civil Rights Act of 1964, Section 109 of the Housing and Community Development Act of 1974, Section 3 of the Housing and Community Development Act of 1968, Attachment O of the OMB Circular A-102, the Age Discrimination Act of 1975, and Section 504 of the Rehabilitation Act of 1973; and

WHEREAS, the Police Jury requires the services of an Equal Opportunity Officer to coordinate all Affirmative Action efforts.

The following resolution was offered by Mr. Thomas Sonnier, seconded by Mr. John Quebodeaux:

RESOLUTION

        A resolution approving the issuance, sale and delivery of Two
        Hundred Twenty Thousand Dollars ($220,000) of Certificates of   
        Indebtedness, Series 2008, of First Ward Drainage District of the
        Parish of Acadia, State of Louisiana, and other matters relating
        thereto.

WHEREAS, the Board of Commissioners of First Ward Drainage District of the Parish of Acadia, State of Louisiana, proposes to sell and issue Two Hundred Twenty Thousand Dollars ($220,000) of Certificates of Indebtedness, Series 2008 (the "Certificates"), for the purpose of acquiring an excavator and other drainage maintenance equipment, and paying the costs of issuance of the Certificates, under the authority conferred by Section 742.2 of Title 39 of the Louisiana Revised Statutes of 1950, as amended, and other constitutional and statutory authority.

WHEREAS, it is now the desire of the Police Jury of the Parish of Acadia, State of Louisiana, to approve the issuance of the Certificates;

NOW, THEREFORE, BE IT RESOLVED by the Police Jury of the Parish of Acadia, State of Louisiana (the "Police Jury"), acting as the governing authority of the Parish of Acadia, State of Louisiana, that:

SECTION 1. In compliance with the provisions of Article VI, Section 15 of the Constitution of the State of Louisiana of 1974, and in accordance with the request of the Board of Commissioners of First Ward Drainage District of the Parish of Acadia, State of Louisiana, this Police Jury hereby approves the issuance of Two Hundred Twenty Thousand Dollars ($220,000) of Certificates of Indebtedness, Series 2008, of First Ward Drainage District of the Parish of Acadia, State of Louisiana, said Certificates to be issued under the authority and for the purposes stated in the preamble hereto.

SECTION 2. Neither the Parish nor this Police Jury shall be liable in any manner for the payment of said Certificates.

Mr. Lee Hebert, Acadia Parish Building Official, advised the Police Jurors that only one response was received after advertising for a Third Party Provider to conduct plan reviews and inspections according to IBC and IRC requirements as per the Louisiana State Building Codes. The sole respondent was Ron Lawson, Architect, AIA, the Parish’s current Third Party Provider.

A motion was offered by Mr. Alton Stevenson, seconded by Mr. Felton Moreau and carried, to authorize the President to sign a three (3) year contract with Ron Lawson, Architect, AIA, to provide Third Party Contract Service.

A motion was offered by Mr. John Quebodeaux, seconded by Mr. Felton Moreau, to table the appointments to Fire Protection District #7. Motion carried.

A motion was offered by Mr. Felton Moreau, seconded by Mr. Alton Stevenson, to table the appointments to the Bayou Mallet Drainage District. Motion carried.

A motion was offered by Mr. Cade Benoit, seconded by Mr. Kermit Richard, and carried, to accept the following recommendations of the Road & Bridge Committee: to accept the extension of Myers Road into the Parish Road System once the road is brought up to Parish standards and approved by the Parish Road Manager, Robert Bergeaux, to authorize the President to sign Change Order No. 3 on Phase III Road Improvement Contract of W. E. McDonald & Sons, LLC., to get an estimate for repairing the Hazelwood Road Bridge and to authorize the Secretary-Treasurer to find funds necessary to repair the bridge on Charlie Arceneaux Road.

A motion was offered by Mr. Cade Benoit, seconded by Mr. John Quebodeaux, to authorize the removal of cattle guards from St. Joan Road. The motion passed with A. J. Broussard voting no.

BE IT RESOLVED by the Acadia Parish Police Jury in regular session duly convened on this the 12th day of March, 2008, does hereby accept the dedication of road right-of-way & drainage servitude for Bearing Drive in Hubert McManus Subdivision, an aggregate road, indicated on the plat dated 2/28/08 into the Parish Road System.

RESOLUTION

BY MESSRS: CADE BENOIT AND KERMIT RICHARD

WHEREAS, construction debris has been placed on the north bank of Bayou Blanc near its intersection with LA 13, and

WHEREAS, efforts have been made by the Sixth Ward & Crowley Drainage District to have the owner remove the obstructions from the waterway, and

WHEREAS, the dumping of materials into Bayou Blanc has obstructed the flow of water and has altered the course of the Bayou, and

WHEREAS, the Sixth Ward & Crowley Drainage District has requested that the Acadia Parish Police Jury adopt a resolution in support of the efforts of the Drainage District to have said obstructions removed.

THEREFORE, BE IT RESOLVED by the Acadia Parish Police Jury in regular session duly convened on this the 12th day of March, 2008, does hereby support the action of the Sixth Ward & Crowley Drainage District to have property owners remove the obstructions on the north bank of Bayou Blanc near its intersection with LA 13.

BE IT FURTHER RESOLVED that copies of this Resolution be sent to DOTD and to the members of the Legislative Delegation representing Acadia Parish.

BE IT RESOLVED by the Acadia Parish Police Jury in regular session duly convened this 12th day of March, 2008, does hereby empower, authorize & direct the President to execute Change Order No. 3 for Phase III B Road Improvements resulting in a reduction in the amount of Two Hundred Seventy-four Thousand Eight Hundred Sixty-two and 46/100 ($274,862.46) Dollars with W. E. McDonald & Sons, Inc for an adjusted contract price of Four Million Six Hundred Ninety-four Thousand Twenty-seven and 62/100 ($4,694,027.62) Dollars.

       A RESOLUTION ENDORSING LEGISLATION TO AMEND R.S.
       33:4574.1A AUTHORIZING THE INCREASE OF TAXES CHARGED FOR
       HOTEL/MOTEL ROOM OCCUPANCY AND OVERNIGHT CAMPING
       FACILITIES WITHIN ACADIA PARISH FROM TWO PERCENT (2%) TO
       FOUR PERCENT (4%) WITH REVENUES TO BE USED FOR THE
       PURPOSE OF ADVERTISING, PROMOTION AND PUBLICATION OF
       INFORMATION PERTAINING TO ACADIA PARISH, LOUISIANA.

WHEREAS, the Louisiana Legislature, at its 1995 Regular Session, adopted legislation (ACT No. 47) authorizing a transfer in the power to levy a tax on the occupancy of hotel/motel rooms and overnight camping facilities from local governing bodies to city/Parish visitors/tourists, and

WHEREAS, the Acadia Parish Tourist Commission wishes to take advantage of this authority and increase the present hotel/motel and overnight camping facilities tax in Acadia Parish by two percent (2%), and

WHEREAS, the Acadia Parish Tourist Commission through its Board of Directors has agreed that in order to advance tourism in Acadia Parish, Louisiana such increase is necessary.

THEREFORE, BE IT RESOLVED by the Acadia Parish Police Jury in regular session duly convened on this the 12th day of March, 2008, does hereby endorse legislation amending R.S. 33:4574.1A authorizing an increase in taxes charged for occupancy of hotel/motel rooms and overnight camping facilities within Acadia Parish, Louisiana from two percent (2%) to four percent (4%) with revenues being used for the advertising, promotion and publication of information pertaining to Acadia Parish, Louisiana.

A motion was offered by Mr. Cade Benoit, seconded by Mr. Thomas Sonnier and carried, to add an item to the agenda requesting support for a new Interstate 10 Interchange East of Rayne.

The following resolution was offered by Mr. Cade Benoit, seconded by Mr. John Quebodeaux and duly resolved and adopted:

RESOLUTION

        A RESOLUTION SUPPORTING THE CONSTRUCTION OF AN  
        INTERCHANGE AT THE INTERSECTION OF I-10 AND LA. HWY. 98
        (GRAND PRAIRIE HIGHWAY) IN THE CITY OF RAYNE, ACADIA
        PARISH, LOUISIANA.

WHEREAS, the City of Rayne and surrounding areas continue to grow annually at an increasingly rapid pace, and

WHEREAS, this area currently has but one entrance/exit facility providing access to I-10, and

WHEREAS, the now inevitable addition of the Frogland U.S.A. Water Park and Roux Acadiana Commercial Development at this location will tremendously bolster the economy for not only the City of Rayne, but also Acadia Parish as a whole, with its expected influx of nearly a million tourists annually, and

WHEREAS, this additional I-10 interchange is necessary to properly accommodate the unprecedented growth of the City of Rayne and surrounding area, and

WHEREAS, this interchange is also essential to the long term success of the Frogland U.S.A. Water Park and Roux Acadiana Commercial Development, and its corresponding massive boost in tourism with the expected consequential dramatic increase in vehicular traffic all bringing about a welcome economic boon for the City of Rayne and Acadia Parish, and

WHEREAS, the City of Rayne has already secured funds for the required initial planning, and such planning has begun for this interchange.

THEREFORE, BE IT FURTHER RESOLVED by the Acadia Parish Police Jury duly convened on this the 12th day of March, 2008, does hereby support and strongly encourage the efforts of the City of Rayne directed toward the construction of an I-10 Interchange at LA-98 (Grand Prairie Highway) for the great benefit it brings to Acadia Parish, her commerce, and her citizens.

BE IT FURTHER RESOLVED that the Acadia Parish Police Jury urges its state and national delegation of legislators to do everything necessary to bring this interchange project to construction and operation in a most expeditious manner.

AN ORDINANCE TO CREATE ARTICLE VIII SOLID WASTE MANAGEMENT

Chapter 8 of the Acadia Parish Code of Ordinances is hereby enacted to read as follows:

Chapter 8
Article VIII. Solid Waste Management

DIVISION 1. GENERALLY

Section 8-150. Territorial applicability.

The provisions of this article shall apply Parish wide.

Section 8-151. Definitions. (Parish)

The following words and phrases, when used in this part, shall have the meanings respectively ascribed to them:

BAGS: Plastic sacks designed to store refuse with sufficient wall strength to maintain physical integrity when lifted by the top. Total weight of a bag and its contents shall not exceed 75 pounds.

BUNDLE: Tree, shrub, or brush trimmings or newspapers and magazines securely tied together forming an easily handled package not exceeding six (6) feet in length or 75 lbs. in weight.

BULKY WASTE: Furniture, appliances, etc., excluding the following: agricultural solid waste, construction debris, dead animals, offal waste, stable matter, or vegetable waste with weights or volumes greater than those allowed for bins or containers, as the case may be.

CART: A durable receptacle or container provided by the Contractor for fully automated collection service. Each such container shall be equipped with wheels and a lid and have a minimum capacity of approximately 96 gallons. The actual Cart intended for use, its color, labels, and Owner’s logo shall be approved by the Owner prior to being ordered and shipped to the Parish under this contract. Contractor’s logo shall be placed on the Carts at a location and of a size approved by the Owner. Carts shall be OTTO Industries, Inc. MSD95M, Rehrig Pacific ROC95U, or approved equal.

COLLECTION: The act of removing solid waste from an approved storage point at the source of generation.

COLLECTION HOURS: The time period during which collection of solid waste is authorized. Contractor shall adhere to any and all applicable U.S.D.O.T. requirements regarding the maximum time period that such vehicles and drivers are allowed to be in operation on a daily basis. On collection days, the collection of solid waste shall not begin before 4:00 a.m. in the rural areas of the Parish, or begin before 5:00 a.m. within the corporate limits of municipalities within the Parish. Collection operations shall end no later than 8:00 p.m. everywhere throughout the Parish on collection days. Exceptions to these hours shall be effected only upon the mutual agreement of the Police Jury and Contractor. Typically, transportation directly to the day’s first collection point or directly from the day’s last collection point to the landfill is allowed to occur outside the hours of operation.

COLLECTION SERVICES: The operation of and engagement in the collection and transportation of solid waste materials.

COLLECTION VEHICLE: Any vehicle approved by the Police Jury to be used for collection of solid waste within the Parish.

COMMERCIAL SOLID WASTE: All bulky waste, construction debris, yard waste, garbage, and rubbish generated at a commercial unit and placed at an approved storage point in accordance with these specifications.

COMMERCIAL UNIT: All premises, locations or entities, public or private, other than a Service Unit, requiring solid waste collection within Acadia Parish.

CONSTRUCTION DEBRIS: Non-putrescible building material waste resulting from construction, remodeling, repair, or demolition operations as defined by the Louisiana Department of Environmental Quality (DEQ). Such material shall not exceed 6 feet in length and shall be bundled or containerized not to exceed 75 lbs. per bundle.

CONTAINER: A receptacle with a capacity of greater than 20 gallons but not more than 32 gallons constructed of plastic, metal or fiberglass, having handles of adequate strength for lifting, and having a tight fitting lid capable of preventing entrance into the container by vectors. The mouth of the container shall have a diameter greater than or equal to that of the base. The weight of a container and its contents shall not exceed 75 lbs.

CONTRACT DOCUMENTS: The Notice to Bidders, Instructions to Bidders, Specifications, Definitions, Contractor’s Proposal Form, Bid Bond, Affidavit, Agreement, Performance Bond, all required documents, and any Exhibits and Addenda compose the Specifications and Contract Documents, which shall also include all properly authorized modifications of said Contract documents.

CONTRACTOR: Person or persons authorized by the Police Jury to perform solid waste collection services on prescribed routes within the Parish. The person, corporation, or partnership performing parish-wide solid waste collection, transportation, and disposal under contract with the Police Jury.

DEQ: The Louisiana Department of Environmental Quality.

DISPOSAL: The orderly process of discarding useless or unwanted material in a beneficial or non-beneficial manner at a properly permitted facility.

DISPOSAL FACILITIES: The physical components of the disposal system, such as transfer conveyances, transfer stations, processing plants and sanitary landfills properly permitted by DEQ.

DISPOSAL SITE: A sanitary landfill facility properly permitted or approved by DEQ.

DROP-OFF CENTER: A site where residents are allowed to deliver recyclable materials.

GARBAGE: All normal and usual household, commercial, and institutional solid waste that is placed in approved containers for collection purposes, and is usually a mixture of putrescible, non-putrescible, combustible and incombustible materials, such as organic wastes from food preparation and consumption, wrapping and packaging materials, metal, glass, and plastic containers, and other items. This definition also applies to similar waste products from establishments such as business offices, restaurants, cafeterias, schools, and hospitals.

GENERATION: The act of producing solid waste.

MULTI-FAMILY: The term multi-family shall refer to all residential dwelling units considered to be condominiums, apartment houses, grouped housing, or mobile home parks.

NON-PUTRESCIBLE SOLID WASTE: Solid waste materials that do not contain organic matter prone to rapid decomposition by fungi and bacteria.

OWNER: Acadia Parish Police Jury.

PARISH: Parish of Acadia, State of Louisiana, United States of America.

PICK-UP STATION: A facility where solid waste is concentrated for shipment by truck to a landfill designated by the Police Jury.

POLICE JURY: Acadia Parish Police Jury. The Owner.

PRODUCER: An occupant of a commercial unit or a residential unit who generates solid waste.

PUTRESCIBLE SOLID WASTE: Solid waste materials containing organic matter prone to rapid decomposition by fungi and bacteria, such as food waste and dead animals.

RESIDENT: Occupant of a residential property.

RESIDENTIAL SOLID WASTE: All bulky waste, construction debris, yard waste, solid waste, garbage, and rubbish generated by an occupant at a residential unit and placed at an approved storage point in accordance with these specifications.

RESIDENTIAL UNIT: A dwelling within the Parish occupied by a person or a group of persons. A residential unit shall be deemed occupied when either water or domestic light and power services are being supplied thereto. Condominium dwellings, whether of single or multi-level construction, consisting of four or less contiguous or separate single-family dwelling units, shall be treated as residential units, except that each single-family dwelling within any such residential unit shall be counted and billed separately as a residential unit. Mobile homes shall also be treated as residential units, as described in Section III.B, Article 1. Those units which are occupied, but do not have utility service shall be eligible for collection service and the Contractor shall be entitled to compensation.

ROADSIDE: Within the State highway, Parish road, or City street right-of-way, including alleyways, on either side of open ditches or curb at the highway, road, or street end of the Service Unit driveway along the frontage of a Service Unit. Synonym: Curbside

RUBBISH: A mixture of small non-putrescible household, institutional and commercial waste products containing a high percentage of combustible materials such as paper, cardboard, plastics, foliage, grass and leaves, and including non-combustibles such as glass, crockery, cans and light scrap metals. Synonym: Trash

SERVICE UNIT: For the purpose of this Contract, a Service Unit shall be a residential unit (single and multi-family) or a commercial unit situated or located inside the boundaries of Acadia Parish, Louisiana. To be defined as a Service Unit, a commercial unit shall require no more than once a week pick-up and shall be limited to five (5) thirty-two (32) gallon containers/pick-up. In the case of Fully Automated Services, in order to be defined as a Service Unit, a commercial unit shall require no more than once a week pickup and shall be limited to one or two 96 gallon capacity carts under the terms and conditions specified elsewhere herein.

SOLID WASTE: Useless, unwanted or discarded garbage materials with insufficient liquid content to be free flowing, that results from domestic, commercial, agricultural, governmental, and community operations, which require proper storage, collection, transportation, and disposal to prevent environmental pollution inimical to public health, safety, and welfare. Solid waste does not include sewage, earth, or material used to fill land in accordance with construction codes, mining residues, slag, dissolved or suspended solids in industrial waste water effluents which are not acceptable for disposal in sanitary sewage treatment system. Synonym: Refuse

SOLID WASTE MANAGEMENT: The purposeful, systematic control of the storage, collection, transport, separation, processing, recovery, and disposal of solid waste.

SOLID WASTE MANAGEMENT SYSTEM: The entire process of storage, collection, transportation, processing, and disposal of solid waste by any person engaging in such process as a business or by any municipality, authority, Parish or any combination thereof.

SOLID WASTE STORAGE: The handling and holding of solid waste, in an approved manner, near the point of generation pending collection.

SOLID WASTE TRANSPORTATION: The conveying of solid waste from one place to another by means of an approved vehicle.

YARD WASTE: Grass, leaves, flowers, stalks, stems, tree trimmings, branches, tree trunks. Grass, leaves, flowers, stalks, stems and tree trimmings shall be placed in a proper container for collection, bag or box the weight of which shall not exceed 75 lbs. Branches up to six (6) inches in diameter shall be cut in lengths not exceeding six (6) feet and shall be stacked at the curb. Tree trunks shall not exceed 75 lbs. for any one piece.

        Should the Parish enter into a contract with a private contractor for the collection and disposal of garbage, trash, bulky waste and litter, the terms and conditions of that contract shall take precedence over the provisions of this section, including but not limited to the definitions of all items of the contract.

Sec. 8 - 152. Fully automated collection of solid waste; excluding bulky waste, yard waste, construction and demolition waste and tree waste. (Parish)

The Parish, through its Contractor, shall provide fully automated roadside collection of any and all residential and/or municipal solid waste placed in the Carts, as defined in the Solid Waste Contract Specifications, to each residential and commercial Service Unit equipped with a Cart or Carts, one (1) time per week. The Contractor will not be required to collect any residential or municipal solid waste that is not placed in a Cart. The Contractor shall not be required to provide any collection of bulky waste, yard waste, construction and demolition waste, and/or tree waste.

Sec. 8 - 153. Collection of bulky waste, yard waste, construction and demolition waste and tree waste. (Parish)

The Parish shall provide for the roadside collection of bulky waste, yard waste and owner generated construction and demolition waste and tree waste, to each residential Service Unit. The owner and/or occupant of the Service Unit must schedule the collection through the Acadia Parish Solid Waste Landfill office.

The Parish will not collect garbage or waste that would fit into the Carts described herein. The Parish will not collect bulky waste, yard waste, construction and demolition waste or tree waste placed in any containers. All yard waste consisting of leaves must be placed in bags.

All putrescible solid waste, waste materials containing organic matter prone to rapid decomposition by fungi and bacteria, such as food waste and dead animals, must be placed in Carts for collection by the parish’s Contractor. The Parish will not collect putrescible solid waste.

The Parish will not collect construction and demolition waste (C&D) and tree waste generated by, or arising out of a contract for services between the owner/occupant of the Service Unit and a person or entity engaged in residential/commercial construction, remodeling, demolition and/or tree removal/trimming.

Sec. 8 - 154. Garbage cans and waste receptacles required. (Parish)

        (a)   It shall be unlawful and a violation of this part, for any person
               or entity to scatter, throw, deposit, drop, allow, or to permit
               or allow to be scattered, spilled, thrown, deposited or
               dropped, any garbage, trash and any other waste material,
               including bulky waste, yard waste, construction and demolition
               waste, tree waste, or any other substances which may be
               unsightly, offensive to smell or injurious to health in any
               private yard, lot, room or building, or on any sidewalk, street,
               alley, wharf, levee, public parkway, public right-of-way, or
               any other public place, or in any gutter or drain within the
               Parish, other than in the type of Cart, or in the manner, and
               at the places specified in Section 8- 156.

      (b)    The provisions of this section shall not apply to use of the
              sidewalks or the sidewalk and a portion of the street adjacent
              to building construction when in compliance with a permit from
              the building inspector covering materials, equipment,
              barricades, etc., necessary in connection with street, alley or
              utility construction and maintenance.

Sec. 8 - 155. Transportation of garbage, trash or debris. (Parish)

Any person or entity transporting, hauling, or permitting to be transported or hauled, any garbage, trash, or other debris as set forth above, to the place of dumping shall take precautions to prevent the scattering or spilling of the garbage, trash or other debris from the conveyance upon the public roads of the Parish, and shall, for this purpose, when using an open conveyance cause the load to be secured with a tarpaulin, canvas or other covering. Vehicles used for this purpose shall be equipped with tail gates to prevent spilling of debris during transit. This section shall not apply to trucks properly loaded with heavy waste or debris too heavy to blow off.

Sec. 8 - 156. Requirements of owners and occupants. (Parish)

Every owner, and occupant, of any building, house, structure, property or grounds within the Parish, where residential solid waste, bulky waste, yard waste, construction and demolition waste, and tree waste, accumulates, may have such waste collected and disposed of by the Parish only if:

A. Residential Solid Waste:

(1) Placed in the Cart or Carts, as provided for in the Parish Solid
     Waste Contract and Sections 8 - 151 and 8 - 152.

B. Bulky waste, yard waste, construction and demolition waste, tree waste:

(1) Placed in an orderly manner, not less than five (5) feet from the
     traveled surface of the street or sidewalk.

(2) Placed in commercial type disposable bags; or

(3) Bound and bundled, securely tied together forming an easily   
     handled package not exceeding six (6) feet in length.

Waste described in this section shall be placed either on the neutral ground or within the premises immediately adjacent to the street or sidewalk, and not less than five (5) feet from the traveled surface of the street or sidewalk.

No container, bag or bundle shall be placed on the street or sidewalk or in any ditch along the street, nor shall any container, bag or bundle be allowed to remain on the neutral ground or other place for collection except between the hours from 4 p.m. the day preceding the scheduled pickup and 6 a.m. the day after the pickup.

The Parish will not collect putrescible solid waste, nor will it collect any waste material that will fit in the Carts.

The placing of such garbage for collection in any container, manner or place other than as specified in the above paragraph is prohibited and such is hereby made a violation of this part.

Should the Parish enter into a contract with a private contractor for the collection and disposal of garbage, trash, bulky waste and litter, the terms and conditions of that contract shall take precedence over the provisions of this section, including but not limited to the definitions of all items of the contract.

Sec. 8 - 157. Unlawful to damage or destroy garbage containers. (Parish)

It shall be unlawful for any person to wilfully damage or destroy any garbage container.

Sec. 8 - 158. Removal of containers from neutral grounds. (Parish)

It shall be unlawful for any person to permit any garbage container, bag or bundle, required by section 8-156, to remain on the neutral ground in front of or on the side of, their premises or place of business, from 6 p.m. Saturday to 6 p.m. Sunday.

Sec. 8 - 159. Removal of building or repair debris. (Parish)

Any person or entity who enters into an agreement or contract for the erection, demolition or repair a house, dwelling, or structure, or the job contractor, shall remove and shall dispose of same in a duly permitted and authorized landfill or other facility. No such debris shall be placed on the neutral ground for collection by the Parish.

Sec. 8 - 160. Removal of trees and related debris. (Parish)

Any person or entity who enters into an agreement or contract for the trimming, cutting or removal of a tree, located on the property of any citizen in the unincorporated areas of the Parish, shall be required to remove all limbs, branches, trunks and other debris generated by his/its operation and shall dispose of same in a duly permitted and authorized landfill or other facility.

Sec. 8 - 161. Violations. (Parish)

(a) All garbage and trash, as defined in section 8-151, as well as all
     litter, refuse, rubbish, appliances, junk vehicles,
     construction/building materials, limbs, tress or other discarded
     materials or debris shall be accumulated, collected and disposed
     of as provided in this part. The accumulation, collection or
     handling of any of the above in any manner or form other than
     is declared to be lawful by this part, shall constitute a violation
     hereof.

(b) Any unauthorized accumulation of garbage or trash, as defined
     herein, or litter, refuse, rubbish, appliances, junk vehicles,
     construction/building materials, limbs, tress or other discarded
     materials or debris on any premises or property, within the
     unincorporated areas of the Parish, is hereby declared to be a
     nuisance and is prohibited. The failure of any person to remove
     an unauthorized accumulation, within forty-eight (48) hours
     after having been given due and proper written notice to do so,
     shall be deemed a violation hereof. The term "unauthorized
     accumulation" shall mean the accumulation, scattering, spilling
     or other handling of garbage or trash, as defined herein, or
     litter, refuse, rubbish, appliances, junk vehicles,
     construction/building materials, limbs, tress or other discarded
     materials on premises or property in a manner and under
     conditions contrary and in violation of the provisions of this
     part.

(c) If a corporation is the owner or occupant, the president of the
     corporation may be prosecuted for the violation.

(d) If a partnership, firm, or association of persons is the owner or
     occupant, any or all members of the partnership, firm, or
     association of persons may be prosecuted for the violation.

(e) Each day that the violation continues after the forty-eight-hour
     notice shall be considered a separate violation.

(f) Should the Parish enter into a contract with a private
    contractor for the collection and disposal of garbage, trash,
    bulky waste and litter, the terms and conditions of that contract
    shall take precedence over the provisions of this section,
    including but not limited to the definitions of all items of the
    contract.

(g) Specifically, the accumulation of trash, debris, and/or
     construction materials at the construction or renovation-site
     shall not be deemed to be a violation of the provisions of this
     part.

Sec. 8 - 162. Persons subject to prosecution designated. (Parish)

(a) Should any garbage, trash or other waste matter, as defined in
     this part, be found in or on any building, house, structure, or
     grounds in any manner or form other than as is specifically
     declared to be lawful by section 8-156, such shall be a violation
     of this part, and either the owner or occupant, or both of them,
     may be prosecuted thereof.

(b) If a corporation is the owner or occupant, the president of the
     corporation may be prosecuted for the violation.

(c) If a partnership, firm, or association of persons is the owner or
     occupant, any or all members of the partnership, firm, or
     association of persons may be prosecuted for the violation.

Sec. 8 - 163. Ownership of garbage, refuse, rubbish; depositing on dumps. (Parish)

The ownership of all garbage, refuse or rubbish material set out for collection shall remain the property of the generator until properly placed at the Parish landfill. No person shall go upon the Parish landfill for the purpose of depositing materials thereon, except in accordance with regulations established by the Solid Waste Supervisor.

Sec. 8 - 164. Salvage. (Parish)

No person shall salvage, collect, remove or dispose of any garbage, refuse, or rubbish material deposited at the Parish landfill, except by the authority of the Solid Waste Supervisor or pursuant to a resolution authorized by the Acadia Parish Police Jury.

Sec. 8 - 165. Penalty for violation of provisions. (Parish)

Any person, owner or occupant or their agents, servants or employees, violating the provisions of this part shall be guilty of a misdemeanor and shall, upon conviction, be fined not more than five hundred dollars ($ 500.00) or imprisoned in the Parish jail for not more than one hundred eighty (180) days, or both, at the discretion of the judge, for each violation hereof.

Sec. 8 - 166. Creation, maintenance of private dumps prohibited without required permits. (Parish)

(a) It shall be unlawful for any private person to establish or permit
     the establishment of a private dump on any public property or
     on any property privately owned or controlled by him within the
     unincorporated areas of the Parish, with the exception of
     industrial areas, without first having obtained a permit from the
     Louisiana Department of Environmental Quality (LDEQ).

(b) Each day such violation is permitted to continue shall constitute
     a separate offense, and shall be punishable as provided by
     section 8-164.

(c) For purposes of this section, a "private dump" shall mean any
     place or landfill which is not maintained and/or controlled by the
     Parish and which is used for disposal or collection of garbage,
     trash and other waste matter, refuse, rubbish or discarded
     materials.

(d) The Acadia Parish employees, investigators, inspectors, or
     employees of the sheriff’s department shall have the authority
     to identify the owners, by any viable means, of any garbage,
     trash, refuse or rubbish material dumped or discarded at any
     site other than the Parish landfill or other duly
     approved/permitted private dump. The owner of the illegal
     dumping shall have twenty-four (24) hours to clean the
     dumping site and haul the material to the Parish landfill, at his
     expense. In areas where "No Dumping" signs are posted, the
     owner of any garbage, trash, refuse or rubbish material shall be
     responsible to clean the entire "No Dumping" site at his expense
     and haul the material to the Parish landfill within twenty-four
     (24) hours of notification, and shall be subject to the penalties
     set forth in section 8-168.

Sec. 8 - 167. Civil penalties. (Parish)

(a) Upon evidence establishing more probably than not the identity
     of the person who has dumped and/or collected or the property
     owner who has allowed the dumping and/or collection of
     garbage or trash, as defined in this part, or
     building/construction materials, appliances, junk vehicles, limbs,
     trees or other discarded materials or debris, which create a
     nuisance as prohibited by section 8-159, the Parish shall send
     notice personally or by certified mail that the person shall begin
     to make efforts to clean up such nuisance within ten (10) days
     of receipt of notice, and steadily and without delay continue
     such cleanup efforts. Ownership of the property shall be
     determined by the last address of record in the most recent
     Parish assessment roll. If no effort is made to begin cleanup
     within the specified time period and the certified letter has been
     received or if the certified letter is refused, suit allowing
     injunctive relief shall be filed requiring cleanup and authorizing
     fines up to five hundred dollars ($500.00) a day in which no
     efforts are made toward cleanup without an excuse acceptable
     to the Acadia Parish Police Jury. If the certified letter is not
     received due to reasons other than refusal, or if notice is not
     achieved after due and diligent efforts have been made, then
     an attorney at law shall be appointed to represent the party as
     curator. Additionally, if the property owner is a minor or an
     interdict, a curator shall be appointed.

(b) Where immediate action is required to avoid a threat to public
     health, the Parish shall have the authority to enter upon the
     property and cause the necessary work to be done to effect
     compliance with the provisions of this part after twenty-four
    (24) hours notice has been served upon the owner of the
    property or his agent , or upon the occupant of the property, if
    any, or upon the curator, if any. The Parish shall have a lien and
    privilege on the property and any improvements thereon for the
    cost of remedying the violation. The privilege and lien shall be
    preserved and enforced only after the owner has failed to
    reimburse the Parish within thirty (30) days after notification by
    the Parish to pay the costs incurred. The thirty (30) days shall
    run from the date of mailing of the notification. In order to
    preserve the lien and privilege it shall be the duty of the Acadia
    Parish Police Jury President to prepare and sign a sworn
    statement of facts, giving the description of the property and an
    approximation of the cost of the remedial measures implemented.
    This statement shall be filed and recorded in the mortgage office
    of the Parish in which the property is located and the Parish
    shall be entitled to recover the amount of this expense, together
    with all costs of court and legal interest from the date of
    recordation of the lien, by ordinary process in the district court
    having jurisdiction over the property. Additionally, where it is
    necessary for the Parish to appoint an attorney as curator, as
    herein above provided, the attorney shall be paid a scheduled
    fee to be taxed as costs.

Any Parish Ordinance containing provisions in conflict with this Ordinance is hereby repealed.

WHEREAS, the Acadia Parish Police Jury wishes to increase its Economic Development efforts, and

WHEREAS, LA 91 is the only evacuation route between Crowley and Jennings, and

WHEREAS, the bridge over Bayou Plaquemine on LA 91 is a bottleneck and hazard for traffic traveling between US 90 and I-10, and

WHEREAS, LA 91 between US 90 and I-10 is needed both for Economic Development and as an Emergency Evacuation Route; and

WHEREAS, LA 91 between US 90 and I-10 is in dire need of reconstruction to facilitate Economic Development and to serve as an Emergency Evacuation Route.

THEREFORE, BE IT RESOLVED by the Acadia Parish Police Jury in regular session duly convened on this the 12th day of March, 2008, does hereby request its Legislative Delegation to take the necessary steps to secure funding for the reconstruction of LA 91 from US 90 to I-10 and also to provide funding for a new bridge crossing Bayou Plaquemine.

A motion was offered by Mr. John Quebodeaux, seconded by Mr. Alton Stevenson and carried, authorizing the President to appoint a committee to develop guidelines for the Secretary-Treasurer position. The four members of the committee are the President, Mr. John Quebodeaux, Mr. Thomas Sonnier and the Secretary-Treasurer.

A motion was offered by Mr. Cade Benoit, seconded by Mr. Alton Stevenson and carried, authorizing the Secretary-Treasurer to transfer two (2) employees from the Road Department, Dale Rayon and Roy Hebert to the Solid Waste Department at an hourly rate of $12.00 per hour and to hire three (3) additional drivers for the Solid Waste Department. The five (5) individuals are to operate the new grappler trucks.

A motion was offered by Mr. John Quebodeaux, seconded by Mr. Cade Benoit, that all bills be approved for payment. Motion carried.

Sales Tax Reports were distributed to all Police Jurors.

WHEREAS, repairs to South 13th Street would promote economic development of that area, and

WHEREAS, funds from the Economic Development Award Program (EDAP) may be available as a possible funding source.

THEREFORE, BE IT RESOLVED by the Acadia Parish Police Jury in regular session duly convened on this the 12th day of March, 2008, does hereby authorize the President to sign and submit an application and any/and all documents with the Louisiana Economic Development Corporation (LEDC) to secure EDAP funding for this project.

The change is subject to the approval of the Secretary of State’s Office, if necessary.

Mr. Hubert Matte, 3034 Monceaux Road, addressed the Police Jurors regarding a subdivision problem. The matter was referred to the Secretary-Treasurer.

A motion was offered by Mr. John Quebodeaux, seconded by Mr. A. J. Broussard, to adjourn into executive session to discuss litigation on Docket #85802. Motion carried.

A motion was offered by Mr. John Quebodeaux, seconded by Mr. Kermit Richard, to reconvene the meeting. Motion carried.
