A RESOLUTION OF THE ACADIA PARISH POLICE JURY APPROVING THE CALL
OF A SPECIAL ELECTION BY THE FOURTH WARD DRAINAGE DISTRICT NO. 1
OF THE PARISH OF ACADIA, STATE OF LOUISIANA, (THE "DISTRICT"),
FOR THE RENEWAL OF A TAX MILLAGE; AND PROVIDING FOR ALL MATTERS
RELATIVE THERETO OR IN CONNECTION THEREWITH.
WHEREAS,
the Board of
Commissioners of the Fourth Ward Drainage District No. 1 desire
to submit to the voters of the District a proposition to renew a
six & thirty-two-one-hundredths (6.32) mill tax on all property
situated in the District for the purpose of acquiring,
constructing, maintaining and operating gravity drainage works
within the said District which expires on the 31st
day of December, 2010,
and
WHEREAS,
the concurrence
and approval of this body is necessary to call for the said
Election,
and
WHEREAS,
the ad valorem tax
millage is assessed against all property situated within the
District and is a source of funds to acquire, construct,
maintain and operate gravity drainage works within the District
which is necessary for public drainage within the District,
and
WHEREAS,
the Board of
Commissioners of the Fourth Ward Drainage District No. 1 of the
Parish of Acadia, State of Louisiana, requests the concurrence
and approval of the call of the Special Election be granted by
the Acadia Parish Police Jury,
and
THEREFORE, BE IT RESOLVED
by the Acadia Parish Police Jury in regular session duly
convened that they do hereby concur with and approve the call
for the Special Election as requested by the Board of
Commissioners of the Fourth Ward Drainage District No. 1 of the
Parish of Acadia, State of Louisiana, for the renewal of a six &
thirty-two-one-hundredths (6.32) mill tax on all property
situated in the District for the purpose of acquiring,
constructing, maintaining and operating gravity drainage works
within the said District.
The foregoing resolution having been submitted to
a vote, the vote therein was as follows:

RESOLUTION
A resolution approving the holding of
an election in Acadia-Evangeline Fire Protection
District of the Parishes of Acadia and Evangeline,
State of Louisiana, on Saturday, October 2, 2010, to
authorize the levy of a special tax therein.
WHEREAS, the Board of Commissioners of
Acadia-Evangeline Fire Protection District of the Parishes of
Acadia and Evangeline, State of Louisiana (the "Governing
Authority"), acting as the governing authority of
Acadia-Evangeline Fire Protection District of the Parishes of
Acadia and Evangeline, State of Louisiana (the "District"),
adopted a resolution on June 29, 2010, calling a special
election in the District on Saturday, October 2, 2010, to
authorize the levy of a special tax therein; and
WHEREAS, the governing authority of the District
has requested that this Police Jury, acting as the governing
authority of the Parish of Acadia, State of Louisiana, give its
consent and authority for the District to hold the aforesaid
election, and in the event that the election carries to levy and
collect the special tax provided for therein; and
WHEREAS, as required by Article VI, Section 15 of
the Constitution of the State of Louisiana of 1974, it is now
the desire of this Police Jury to approve the holding of said
election and in the event that the election carries, to levy and
collect the special tax provided for therein;
NOW, THEREFORE, BE IT RESOLVED by the Police Jury
of the Parish of Acadia, State of Louisiana, acting as the
governing authority of said Parish, that:
SECTION 1. In compliance with the provisions of
Article VI, Section 15 of the constitution of the State of
Louisiana of 1974, and in accordance with the request of the
Board of Commissioners of Acadia-Evangeline Fire Protection
District of the Parishes of Acadia and Evangeline, State of
Louisiana, this Police Jury hereby approves the holding of an
election in the District, on Saturday, October 2, 2010, at which
election there will be submitted the following proposition,
to-wit:
PROPOSITION
(MILLAGE RENEWAL)
Summary: 10 year, 1.03 mills tax
renewal for constructing, maintaining and operating
the Acadia-Evangeline Fire Protection District's
fire protection facilities, including the cost of
obtaining water for fire protection purposes.
Shall Acadia-Evangeline Fire
Protection District of the Parishes of Acadia and
Evangeline, State of Louisiana (the "District"), be
authorized to levy a one and three hundredths (1.03)
mills tax on all the property subject to taxation in
the District (an estimated $34,000 reasonably
expected at this time to be collected from the levy
of the tax for an entire year), for a period of ten
(10) years, beginning with the 2012 and ending with
the year 2021, for the purpose of constructing,
maintaining and operating the District's fire
protection facilities, including paying the cost of
obtaining water for fire protection purposes?
SECTION 2. In the event the election carries,
this Police Jury does hereby further consent to and authorize
the District to levy and collect the special tax provided for
therein.

resolution on June 21, 2010, calling a special election in the

a parcel fee therein; and
WHEREAS, the governing authority of the District
has requested that this Police Jury, acting as the governing
authority of the Parish of Acadia, State of Louisiana, give its
consent and authority for the District to hold the aforesaid
election, and in the event that the election carries to levy and
collect the parcel fee provided for therein; and
WHEREAS, as required by Article VI, Section 15 of
the Constitution of the State of Louisiana of 1974, it is now
the desire of this Police Jury to approve the holding of said
election and in the event that the election carries, to levy and

SECTION 1. In compliance with the provisions of

approves the holding of an election in the District, on

PARCEL FEE PROPOSITION
Summary: 12 year, $50.00 parcel fee
for acquiring facilities and equipment, including
paying the cost of obtaining water for fire
protection purposes and all purposes incidental
thereto, subject to funding into bonds.
Shall Fire Protection District No. 7
of the Parish of Acadia, State of Louisiana (the
"District"), levy and collect annually for a period
of twelve (12) years, beginning with the year 2010,
a fee of Fifty Dollars ($50.00) on each lot,
subdivided portion of ground or individual tract
upon which is located, either in whole or in part, a
residential or commercial structure, regardless of
the structure's being occupied or unoccupied (an
estimated $70,000 reasonably expected at this time
to be collected from the levy of the service charge
for an entire year), for the purpose of acquiring
facilities and equipment, including paying the cost
of obtaining water for fire protection purposes and
all purposes incidental thereto, and shall the
District be further authorized to fund the proceeds
of said parcel fee into bonds to pay the costs of
capital improvements, said bonds to be issued from
time to time in the manner provided by law,
including, but not limited to, Section 1505 of Title
40 of the Louisiana Revised Statutes of 1950, as
amended, said fee to replace the District’s $25.00
parcel fee presently authorized to be levied through
the year 2011 pursuant to an election held on July
15, 2000?
SECTION 2. In the event the election carries,
this Police Jury does hereby further consent to and authorize
the District to levy and collect the parcel fee provided for
therein.

The following resolution was offered by Mr. A. J. Broussard and

RESOLUTION
A resolution providing for the
construction of street paving improvements along a
certain street, or such parts thereof as may be
determined upon, within the corporate limits of the
Parish of Acadia, State of Louisiana, and outside of
municipal corporations, in the manner provided by
Sections 3689.1 to 3689.17, inclusive, of Title 33 of
the Louisiana Revised Statutes of 1950 (R.S.
33:3689.1-33:3689.17), and other constitutional and
statutory authority.
WHEREAS, the Police Jury of the Parish of
Acadia, State of Louisiana (the "Police Jury"), acting as the
governing authority of the Parish of Acadia, State of Louisiana
(the "Parish"), adopted a resolution on June 9, 2010, giving
notice of their intention to construct street paving
improvements along a certain street, or such parts thereof as
may be determined upon, within the corporate limits of the
Parish, and outside of municipal corporations (the "Project"),
in compliance with the provisions of Sections 3689.1 through
3689.17 of Title 33 of the Louisiana Revised Statutes of 1950 (R.S.
33:3689.1 through R. S. 33:3689.17), as amended; and
WHEREAS, in strict compliance with the aforesaid
statutory authority and the aforesaid resolution of June 9,
2010, there was a public hearing held on Wednesday, July 14,
2010, at six (6:00) o'clock p.m., after publication of the
notice of intention as required by law, to hear and receive all
objections to the proposed paving improvements, to the manner of
payment therefor and to the manner in which such improvements
will be made, and to consider the question of the benefit of
each lot or parcel of real estate to be assessed as a result of
the construction of said improvements; and
WHEREAS, the public hearing was held at the date,
time and place set forth above, and neither objections nor
petitions pertaining to the proposed paving program were
presented; and
WHEREAS, after due consideration, this Police
Jury has determined that each lot or parcel of real estate to be
assessed along the street hereinafter described will be
benefitted to an amount not less than the estimated assessment
to be levied against each lot or parcel of real estate as a
result of the construction of said improvements; and
WHEREAS, it is now the desire of this Police Jury
to proceed with the construction of the street paving
improvements on the designated street within the corporate
limits of the Parish and outside of municipal corporations, or
such parts thereof as may be determined upon;
NOW, THEREFORE, BE IT RESOLVED by the Police Jury
of the Parish of Acadia, State of Louisiana (the "Police Jury"),
acting as the governing authority of the Parish of Acadia, State
of Louisiana (the "Parish"), that:
SECTION 1. This Police Jury, having determined
that each lot or parcel of real estate to be assessed along the
street hereinafter set out, as a result of the construction of
the street paving improvements more fully described below, will
be benefitted to an amount not less than the amount of the
estimated assessment to be levied against each such lot or
parcel of real estate, the construction of street paving
improvements on the following designated street within the
corporate limits of the Parish, and outside of municipal
corporations (the "Project"), is hereby ordered and directed, in
accordance with the resolution of intention adopted by this
Police Jury, acting as the governing authority of the Parish, on
June 9, 2010, viz:
SEVENTH DISTRICT PAVILION SUBDIVISION (SDP)
CONSTRUCTION AND HARDSURFACING OF ROADWAY
Construction and hardsurfacing of the entire
length of the roadway within Seventh District Pavilion
Subdivision commencing at the roadway’s intersection with U.S.
Highway 90 and running northwesterly to the roadway’s
termination in a cul de sac, Acadia Parish, Louisiana,
consisting of eight and one-half inch (8 1/2") thick soil cement
base course twenty-one feet (21') wide, surfaced with two inch
(2") thick asphaltic concrete wearing course twenty feet (20')
wide.
SECTION 2. The said improvements shall
consist of the above-described street paving improvements on the
street hereinabove set forth and, as shown by plans and
specifications prepared by Aucoin & Associates, Inc., Consulting
Engineers (the "Consulting Engineers") to the Parish in
connection with the Project.
SECTION 3. The total cost of the
project shall include the cost of street intersections,
necessary ditching, curbing, guttering, aprons, drains and
headers, and all other costs incidental thereto, including
engineers' and attorneys' fees. The total cost of the Project
shall be charged to each lot or parcel of real estate abutting
the street improvements in proportion that the frontage each lot
or parcel of real estate bears to the total frontage of all of
the said lots or parcels of real estate to be improved by the
construction of such improvements, in accordance with the
provisions of Sections 3689.1 to 3689.17, inclusive, of Title 33
of the Louisiana Revised Statutes of 1950 (R. S.
33:3689.1-33:3689.17), and other constitutional and statutory
authority.
SECTION 4. The Consulting Engineers are hereby
instructed to prepare the necessary plans and specifications for
the above-described street paving improvements along the street
hereinabove set out, and to file a copy thereof with the
President of the Police Jury.
This

The following resolution was offered by Mr. Alton Stevenson and
seconded by Mr. John Quebodeaux:
RESOLUTION
A resolution giving preliminary authority
for the issuance of not exceeding One Million Seven
Hundred Thousand Dollars ($1,700,000) of Certificates of
Indebtedness, Series 2010, of the Parish of Acadia,
State of Louisiana, providing certain terms of said
Certificates, making application to the State Bond
Commission for consent and authority to issue, sell and
deliver said Certificates and providing for other
matters in connection therewith.
WHEREAS, pursuant to elections held in the Parish
of Acadia, State of Louisiana (the "Issuer"), on November 17,
2001 and April 4, 2009, the Issuer is authorized to levy a
special tax of two and twelve hundredths (2.12) mills through
the year 2021 for the purpose of improving and paying the
maintenance and operating expenses of the public health units of
the Issuer and other related public health activities (said rate
being subject to adjustment from time due to reassessment) (the
"Tax"); and
WHEREAS, Section 742.2 of Title 39 of the
Louisiana Revised Statutes of 1950, as amended (R.S. 39:742.2)
(the "Act"), authorizes the Issuer to borrow money in
anticipation of revenues to be realized from the Tax to be used
only for the purpose the Tax was voted; and
WHEREAS, pursuant to and in accordance with the
provisions of the Act, this Police Jury now desires to incur
debt and issue not exceeding One Million Seven Hundred Thousand
Dollars ($1,700,000) of Certificates of Indebtedness, Series
2010, of the Issuer (the "Certificates"), in the manner
authorized and provided by the Act to provide funds for the
purposes hereinafter set forth; and
WHEREAS, the Issuer presently has no outstanding
indebtedness payable from a pledge of the revenues of the Tax;
and
WHEREAS, the annual debt service on the amount
proposed to be borrowed pursuant to this resolution will not in
any year exceed seventy-five percent (75%) of the estimated
income to be realized from the levy of the Tax in the year 2010;
and
WHEREAS, this Police Jury now wishes to fix the
parameters for the Certificates and to provide for other matters
in connection with the issuance of the Certificates;
NOW, THEREFORE, BE IT RESOLVED by the Police Jury
of the Parish of Acadia, State of Louisiana, acting as the
governing authority of the Parish of Acadia, State of Louisiana
SECTION 1) Preliminary approval and authority is
hereby given for the Parish of Acadia, State of Louisiana, to
issue, sell and deliver not exceeding One Million Seven Hundred
Thousand Dollars ($1,700,000) of its Certificates of
Indebtedness, Series 2010 (the "Certificates"), all in the
manner provided by the Act, to pay costs of improving public
health units of the Issuer and costs of issuance of the
Certificates (the "Project"). The Certificates will mature no
later than March 1, 2020, will bear interest at a rate or rates
not exceeding five percent (5%) per annum and will be dated the
date of delivery thereof. The Certificates shall be secured by
and payable from a pledge and dedication of the funds to be
derived by the Issuer from the annual levy and collection of the
Tax (the rate thereof being subject to adjustment from time to
time due to reassessment) for the full period of its
authorization. The rate or rates of interest to be borne by the
Certificates, the maturities thereof, the redemption provisions
and other terms and provisions pertaining thereto shall be set
by subsequent resolution of this Police Jury.
SECTION 2) Application is hereby made to the
State Bond Commission, Baton Rouge, Louisiana, for approval of
the issuance and sale of the Certificates as provided above, and
Bond Counsel is directed to make application to the State Bond
Commission on behalf of the Issuer.
SECTION 3) This Governing Authority finds and
determines that a real necessity exists for the employment of
special bond counsel in connection with the issuance of the
Certificates, and, accordingly, the law firm of Foley & Judell,
L.L.P., Bond Counsel, is employed as Bond Counsel to the Issuer
to handle all matters of a legal nature in connection with the
sale, issuance and delivery of the Certificates. The fee of
Foley & Judell, L.L.P., in connection with the program of
finance is established and fixed at a sum not to exceed that
permitted under the Attorney General's approved schedule for
comprehensive bond counsel service for revenue bonds based upon
the principal amount of Certificates actually issued, sold and
delivered, plus "out-of-pocket" expenses. A certified copy of
this resolution shall be forwarded to the Attorney General of
the State of Louisiana for approval of the employment herein
provided.
SECTION 4. Prior to the issuance of the Bonds or
any interim debt obligations, the Issuer intends to expend
moneys from other available funds for the purpose for which the
Certificates are being issued. Any such allocation of the
proceeds of the Certificates or any interim debt obligations for
reimbursement will be with respect to capital expenditures [as
defined in Treasury Regulation 1.150-1(b)] and will be made upon
the delivery of the Certificates and not later than eighteen
(18) months after the date of (i) the date such expenditure was
made or (ii) the date the improvements were placed in service.
This resolution is intended to be a declaration of intent to
reimburse in accordance with the provisions of Treasury
Regulation 1.150-2.
SECTION 5. By virtue of Issuer’s application for,
acceptance and utilization of the benefits of the Louisiana
State Bond Commission’s approval requested herein, this
Governing Authority resolves that it understands, agrees and
binds itself, its successors and assigns to, full and continuing
compliance with the "State Bond Commission Policy on Approval of
Proposed Use of Swaps, or other forms of Derivative Products
Hedges, Etc.", adopted by the Commission on July 20, 2006, as to
the borrowing and other matters subject to the approval,
including subsequent application and approval under said Policy
of the implementation or use of any swap(s) or other product(s)
or enhancement(s) covered thereby.

A motion
was offered by Mr. John Quebodeaux, seconded by Mr.
Kermit Richard and carried, to accept the following
recommendations of the Building and Grounds Committee:
1. To recommend to the Police Jury that the
proposed health unit be constructed on property owned by the
Police Jury on Capital Avenue adjacent to the Acadia Parish
Correctional Facility.
2. To recommend to the Police Jury that Mr.
Terrell Crochet of Architect’s Design Studio be hired as the
architect on this project.
3. To recommend that the Police Jury
authorize Mr. Lee Hebert to obtain proposals for placing
metal detectors at the front door of the Acadia Parish
Courthouse and for the installation of a key swipe system
for the other entrances to the Acadia Parish Courthouse. It
was also recommended to the Police Jury that the Parish
Attorney issue a legal opinion to the Jury as to who is
responsible for providing Courthouse Security.
RESOLUTION
BY MESSRS: JOHN QUEBODEAUX AND FELTON MOREAU
A resolution urging President Obama to reduce
the six-month moratorium on deep-water drilling in the Gulf to
no more than thirty (30) days, and during that time task
Minerals Management Service (MMS) with conducting thorough
inspections of all deep-water drilling facilities in the Gulf as
well as implement strict safety measures and take enforcement
actions to ensure compliance with safety mandates, thus greatly
reducing the job loss and negative economic impact felt by our
region while ensuring a safer industry.
WHEREAS, in the aftermath of the British
Petroleum (BP) Oil Spill, on May 27, 2010, the Obama
Administration ordered a six month moratorium on existing Gulf
of Mexico deep-water drilling, which will result in the
immediate suspension of operations at thirty-three (33) rigs in
the Gulf of Mexico, and
WHEREAS, the moratorium on offshore
deep-water drilling will cause significant harm to Louisiana’s
energy service industry as well as to the many coastal
communities already suffering tremendously from the
environmental and economic impacts of the BP oil spill, and
WHEREAS, an estimated thirty-three per cent
(33%) of the nation’s domestic oil comes from the Gulf of
Mexico, and
WHEREAS, eighty per cent (80%) of the oil and
forty-five per cent (45%) of the natural gas coming out of the
Gulf of Mexico is from deep-water drilling operations in more
than 1,000 feet of water, and
WHEREAS, suspension of deep-water drilling
operations will result in at least 33 deep-water drilling rigs
being idled for six months or longer, and
WHEREAS, Port Fourchon located in Lafourche
Parish services ninety per cent (90%) of deep-water operations
in the Gulf of Mexico, and
WHEREAS, an average if two (2) supply boats
work each rig per day with rates of $15,000-$30,000/boat.
Suspension of drilling activity will result in a nearly $1
million loss per day in just supply boat rental income, and
WHEREAS, each drilling rig averages 180-280
employees for each two week shift, and each job supports four
other jobs in our local communities. Thus, the suspension of
drilling activity will result in a loss of up to 6,000 jobs in
two to three weeks, and more than 20,000 Louisiana jobs over the
next 18 months, and
WHEREAS, Louisiana coastal communities such
as Houma, Morgan City and Lafayette are home to businesses, from
welders and divers to caterers and drivers, that support the
offshore oil and gas industry, with 1 in 3 jobs being related to
the industry, and
WHEREAS, it is estimated that each
exploration and production job represents four supporting jobs
in and around the region, thus a six-month moratorium will
result in the loss of thousands of jobs and millions of dollars
in wages, and
WHEREAS, Louisiana coastal communities will
begin experiencing severe and irreversible economic impacts
within thirty (30) days of the moratorium, and
WHEREAS, idle drilling rigs in the Gulf will
likely be contracted overseas for work in other locations such
as Africa and Brazil, and may not return to the Gulf of Mexico
for several years greatly extending the BP Oil Spill induced
economic crisis for our state, and
WHEREAS, it is unlikely that deep-water work
in the Gulf would resume quickly even after the moratorium is
lifted, given the time and expense involved in relocating rigs,
and
WHEREAS, several of the safety
recommendations set forth in the Department of Interior’s May
27, 2010 Increased Safety Measures for Energy Development on the
Outer Continental Shelf can be implemented immediately within
the next thirty (30) days including MMS verification of the
safety of the (1) MMS certification of the safety of the BOP
stacks, (2) MMS verification of BOP equipment compatibility, (3)
development and implementation of new inspection procedures and
reporting requirements, (4) establishment of new fluid
displacement procedures, and (5) verification of compliance with
existing regulations and National Safety Alert requirements, and
WHEREAS, other measures set forth in the
Department of Interior’s May 27, 2010 Increased Safety Measures
for Energy Development on the Outer Continental Shelf such as
those requiring emergency rule making along with the National
Commission on the BP Deep-Water Horizon Spill and Offshore
Drilling investigation can be conducted simultaneously with the
continued operations of offshore deep-water drilling, and
WHEREAS, MMS could, and should, maintain a
full-time presence on all ongoing deep-water drilling locations,
with a 7-10 day rotation schedule and enforce that strict
compliance with API standards be maintained on all equipment
used in well construction, and
WHEREAS, any failure in compliance should
mandate immediate closure of the offending rig, rather a
complete shut down of all deep-water drilling operations which
would unjustly punish those companies that have provided this
country’s energy needs while operating safely and in compliance
with all regulations, as well as those coastal communities
already facing an economic crisis as a result of this being the
most challenging economic periods in decades coupled with the
devastating economic impacts of the BP Oil Spill on the fishing,
tourism, and ancillary industries, and
WHEREAS, the last thing the Gulf Coast area
needs is a public policy that will certainly destroy thousands
of existing jobs while preventing the creation of thousands
more.
THEREFORE, BE IT RESOLVED by the Acadia
Parish Police Jury in regular session duly convened on this the
14th day of July, 2010:
SECTION 1. A resolution urging President
Obama to lift the six-month moratorium on deep-water drilling,
and instead conduct a thorough review of all deep-water drilling
facilities, implement and enforce strict safety measures to
ensure compliance with safety mandates.
SECTION 2. Further, let it be resoled that,
while we support efforts to make the offshore deep-water
drilling industry safer, we urge President Obama to reduce the
six-month moratorium on deep-water drilling in the Gulf to no
more than thirty (30) days, and during that time task Minerals
Management Service (MMS) with conducting thorough inspections of
all deep-water drilling facilities in the Gulf as well as
implement strict safety measures and take enforcement actions to
ensure compliance with safety mandates, thus greatly reducing
the job loss ad negative economic impact felt by our region
while ensuring a safer industry.
SECTION 3. That the Acadia Parish Police Jury
President, A. J. Credeur forward a copy of said resolution to
President Barack Obama, Louisiana Governor Bobby Jindal,
Louisiana Congressional Delegation, The Police Jury Association,
and NACO.
