CROWLEY, LOUISIANA

THE ACADIA PARISH POLICE JURY met on the above date at 6:30 p.m., in the Police Jury Meeting Room, Courthouse Building, Crowley, Louisiana, in regular session with the Vice  President, Cade Benoit, presiding.  At the request of the Vice President, a moment of silence was offered and the Pledge to the Flag was recited in unison.  The roll was called and final attendance was recorded as follows:

A motion was offered by Mr. John Quebodeaux, seconded by Mr. Thomas Sonnier and carried, to dispense with the reading of the Minutes of the regular meeting held  February 9, 2010.

 

Vice President Cade Benoit recognized the following employees for service awards.

 

Karen Andrepont, Tommy Deaville, and Jonathon Simon- 5 years

Raymond Breaux- 25 years

Nelson Sonnier- 30 years

Claude Rochon and Linus Broussard- 33 years

 

Vice President Cade Benoit presented a plaque of congratulations to Head Coach Louis Cook for the Notre Dame High School football team winning the State Class AAA High School Football Championship at the New Orleans Superdome.

 

A motion was offered by Mr. Alton Stevenson, seconded by Mr. Felton Moreau and carried, that the Police Jury adopt the Acadiana Criminalistics Laboratory Budget for the year 2010.

 

RESOLUTION

 

BY MESSRS: JOHN QUEBODEAUX AND FELTON MOREAU

 

WHEREAS, the State of Louisiana is considering the feasibility of closing down or privatizing the Acadiana Region Supports and Services Center in Acadia Parish, and

 

WHEREAS, the facility is a much needed facility and serves the entire Acadia Parish and surrounding area, and

 

WHEREAS, the Acadia Parish Police Jury would like for the Governor of Louisiana to allow the facility to remain open and operational as a Public Supports and Services Center.

 

THEREFORE, BE IT RESOLVED by the Acadia Parish Police Jury in regular session duly convened on this the 9th day of March, 2010, does hereby request that the Governor of Louisiana reconsider the closing down or privatizing of the Acadiana Region Supports and Services Center in Acadia Parish.

RESOLUTION

 

BY MESSRS: ALTON STEVENSON AND THOMAS SONNIER

 

WHEREAS, the conservation movement peaked in the 1930's during the period referred to as the ADust Bowl@ days as the nation witnessed the crisis of soil erosion, and

 

WHEREAS, the public, wanting to know how to protect the land and water and other natural resources were seeking ways to save their land and natural resources, and

 

WHEREAS, the United States Soil Conservation Act of April 27, 1935, created the Soil Conservation Service at USDA, and

 

WHEREAS, through the education efforts of the Soil Conservation Service at the USDA, Louisiana saw the need to establish an agency that was focused on educating and assisting agricultural communities in protecting the state=s valuable natural resources, and

 

WHEREAS, Act 370 created the Louisiana Soil and Water Conservation Commission in 1938 and led to the establishment of 43 Soil and Water Conservation Districts statewide, and

 

WHEREAS, Soil and Water Conservation Districts were created to educate the local public and those in the agricultural community and to lend technical assistance with conservation measures in an effort to save and preserve our valuable natural resources, and

 

WHEREAS, Acadiana Soil and Water Conservation District serves the communities in Acadia Parish through education and technical assistance, and works with the USDA-NRCS agency to bring in revenues through the cost-sharing EQIP program using best management practices in agriculture, and the land and easement rental programs of WRP and CRP, and

 

WHEREAS, these programs have converted more than 264,578 acres of marginal farm land back to essential wetlands, which provides rich animal habitat, helps filter water run-off providing clean water, and helps slow down soil erosion and helps protect our valuable natural resources, and

 

WHEREAS, the 43 soil and water districts assisted the USDA-NRCS and helped bring in much needed revenues of $108,000,000.00 in 2009 to the Great State of Louisiana, and

 

WHEREAS, the budget of the State Soil and Water Conservation Commission has already been cut $600,000.00 in 2008 and another $600,000.00 is being considered to be cut in 2010 and these cuts have severely crippled the Soil and Water Districts and caused people to lose their jobs, and

 

WHEREAS, the multi-millions of dollars that are annually brought into Louisiana could be at risk of being reduced or lost due to loss of assistance to NRCS and this loss will surely be felt by Louisiana State, the parishes and municipalities through the loss of revenues, and

 

WHEREAS, the Acadia Parish Soil and Water Conservation District is a valuable agency and provides services to the public and helps bring in revenues to Acadia Parish, and

 

WHEREAS, Acadia Parish wants to keep their conservation district and see all other state conservation districts operating at full capacity so that Louisiana, the parish governments, the local municipalities and the citizens may continue to reap the benefits that are provided.

 

THEREFORE, BE IT RESOLVED by the Acadia Parish Police Jury in regular session duly convened on this the 9th day of March, 2010, does hereby ask that no funding be cut from the operating budget of the State Soil and Water Conservation Commission and additionally ask that as soon as it is feasible that the 2008 level of funding be re-established.

RESOLUTION

 

BY MESSRS: THOMAS SONNIER AND JOHN QUEBODEAUX

 

WHEREAS, Canal BioFuels Company has requested that the Police Jury pass and endorsement resolution regarding a proposed facility to be located on 2111 Evangeline Highway in Acadia Parish, and

 

WHEREAS, the proposed project would add a production facility and create jobs in Acadia Parish.

 

THEREFORE, BE IT RESOLVED by the Acadia Parish Police Jury in regular session duly convened on this the 9th day of March, 2010, does hereby adopt a resolution supporting Canal BioFuels Company=s request for assistance under the Enterprise Zone Program/Quality Job Program, provided that the Police Jury does not have to provide local tax exemptions.

A motion was offered by Mr. Felton Moreau, seconded by Mr. Alton Stevenson and carried, to accept the following recommendations of the Road and Bridge Committee:

 

1.  To authorize Aucoin and Associates to prepare plans and specifications and to receive proposals for the repair of the bridge on Charlie Arceneaux Road.

WHEREAS, Acadia Pipeline Partners, LLC will transfer an undivided 50% interest in all rights under the Acadia Parish Police Jury Permit No. 444 - Buckhorn Road Pipeline Crossing (the APermit@)  to Power Block One, LLC who will merge into Cleco Power, LLC, and

 

WHEREAS, After the above transactions are completed, Acadia Pipeline Partners, LLC will transfer the remaining 50% interest in all rights under the permit to Acadia Power Partners, LLC, and

 

WHEREAS, In 2011, Acadia Power Partners, LLC will transfer the remaining rights under the permit to Energy Louisiana, LLC.

 

THEREFORE, BE IT RESOLVED by the Acadia Parish Police Jury in regular session duly convened on this the 9th day of March, 2010, does hereby authorize and consent to the above transfers of Acadia Parish Police Jury Permit No. 444.

3.  To adopt the Three Year Capital Improvement Program submitted by the Parish Road Manager and the Parish Engineer.

BE IT RESOLVED by the Acadia Parish Police Jury in regular session duly convened this 9th day of March, 2010, does hereby authorize the President to enter into an intergovernmental agreement with the City of Eunice for those areas of the City that are in Acadia Parish.

 A motion was offered by Mr. Felton Moreau, seconded by Mr. Alton Stevenson and carried, to accept the recommendation of the Solid Waste Committee:

 

1.   To accept the proposal of Al-Jon Manufacturing, LLC, in the amount of $431,656.00, Option B, to furnish and deliver a new compactor to the Acadia Parish Sanitary Landfill with trade-in. The motion also recommends the purchase of an extended warranty in the amount of $24,500.00.

 

The Finance Committee recommended to table the request of the District Attorney to

increase the salary of the Assistant    District Attorney, Frederick L. Welter, by

$3,000.00 annually effective January 1, 2010.

 

A motion was offered by Mr. Thomas Sonnier, seconded by Mr. Felton Moreau and carried, to approve the request of the District Attorney and increase the salary of said Assistant District Attorney, Frederick L. Welter, by $3,000.00 annually effective January 1, 2010.

WHEREAS, the Consolidated Security Disaster Assistance and Continuing Appropriations Act of 2009 (Public Law 110-329) enacted on September 30, 2008, made available CDBG  funds for Hurricanes Gustav and Ike, and

 

WHEREAS, Acadia Parish=s 1st allocation is for $1,381,167.00 and its 2nd allocation is for  $1,132,592.00 for a total allocation of CDBG funds for Hurricanes Gustav and Ike of $2,513,759.00, and

 

WHEREAS, Acadia Parish has held two (2) separate public hearings to solicit responses from the citizens of Acadia Parish in order to submit the Hurricanes Gustav and Ike Community Development Block Grant (CDBG) Application Recovery Proposal Form, and

 

WHEREAS, officials and representatives from the Acadia Parish Police Jury and the municipalities within the parish participated in these public hearings to compile activities  that meet the failure to function, and

 

WHEREAS, the Acadia Parish Police Jury has compiled a list of proposed projects to be submitted for funding consideration through the Hurricanes Gustav and Ike Community Development Block Grant (CDBG) Disaster Recovery Program, and

 

WHEREAS, the following projects are to be submitted to the Louisiana Office of Community Development, Disaster Recovery Infrastructure Program for approval:

THEREFORE, BE IT RESOLVED, that the Acadia Parish Police Jury does hereby adopt these projects to be submitted for funding through the Hurricanes Gustav and Ike Community Development Block Grant Application Recovery Proposal Form.
